The precedent set by Biden DOJ and Judges Howell and Boasberg now looms large in the Omar matter. Howell and Boasberg—kicked back to him as new chief judge following a remand by DC circuit—determined that a large swath of phone records were not covered under Speech or Debate Clause related to his deliberations ahead of Jan 6 vote. Hard to see how any evidence collected off Omar’s phone in an immigration investigation would fall into the categories covered by DC courts 🤷♀️
