This is spot on, and the Secretary of State’s adversarial relationship with the State Election Board absolutely does look like a clear violation of O.C.G.A. § 21-2-33.1(h).

GEORGIA ELECTION UPDATE — THIS IS A BIG REQUEST FOR ACCESS AND ACCOUNTABILITY!!!
The next BIG ?: How will Secretary of State Raffensperger respond to the State Election Board’s request, and will they ultimately assist them to do their job?
On September 18, 2026, the Georgia State Election Board sent Secretary of State Brad Raffensperger a formal request seeking voter-registration data and direct system access for official SEB investigations.
This isn’t simply a request for the public voter file.
The letter seeks a current electronic copy of Georgia’s statewide list of electors — active, inactive, and cancelled — with information maintained in the official system, including registration history, addresses, status changes, citizenship/eligibility flags or codes, voter history, challenge and cancellation history, and identifiers used to match voter records against DDS, SSA, SAVE, vital-records and felony data.
The Board is also requesting read-only access to GARViS for designated SEB investigators and the Executive Director, or an equivalent secure method allowing official queries, extracts and case-level review without public redaction.
And it goes further.
The request calls for recurring statewide and county voter-list extracts; certified elector lists before elections; the dates and times those lists were frozen or certified; precinct-level certified lists; numbered lists of voters after elections; absentee, rejected-absentee and provisional-voter lists; and the checked lists reflecting who voted.
The legal authority cited matters. Georgia law gives the SEB the duty to investigate the administration of election laws and alleged frauds and irregularities. O.C.G.A. § 21-2-33.1(h) further states that, upon the Board’s request, the Secretary of State shall provide the support and assistance the Board determines necessary to carry out its duties.
The letter also addresses the obvious question about confidential voter information. O.C.G.A. § 21-2-225(b) generally keeps information such as Social Security numbers and driver’s-license numbers confidential from public inspection, while providing circumstances in which DOB, SSN and driver’s-license information may be made available to government agencies for elector identification, subject to confidentiality and non-dissemination requirements.
The SEB states that this is an official inter-agency request — not an Open Records Request and not a request to release unredacted confidential voter information to the public.
Finally, the letter asks the Secretary of State to confirm receipt within three business days and provide the initial extract and access plan within ten business days. If any portion is delayed or limited, the SEB asks the SOS to identify the specific legal basis and when the remainder will be produced.
The authority, the requested information, the confidentiality restrictions, and the deadlines are all laid out in black and white.
I am so glad to see this Board stepping it up and doing their job to protect GA voters! Now we watch what happens next.
