      ARTICLE 3 Section 3. clause 2,

      •  Punishment
      • "The Congress shall have Power to declare the Punishment of Treason, but no Attainder of Treason shall work Corruption of Blood, or Forfeiture except during the Life of the Person attainted."

         

        So yup, Congress may choose to define treason as meriting the death penalty, or select a less harsh punishment (not that I personally would).

    • Note that the Constitution affirmatively designates the Congress with the authority, and not include the Soveriegn States.

      I suggest the founders determined that the federal servant ought to concern itself with treason, being an offense that effected the Union as a whole.

      But being the servant of the Union it better BY GOD deal with it, and forget the "options" attitude of "Fast and Furious"  ATT. GEN. Eric Holder concerning our National Border security!!

    My opinion based on my knowledge of Federal law and Constitional Law;


    This man has committed High Treason.
    He needs to be stripped of his tab, stripped of his rank, demoted to private and dishonerably discharged - then hung by the neck until dead.
    The Constitutuion of the United States of America is very clear on the topic of treason.
    He was OIC when he did this,  a threat to the entire Nation.
