In American legal theory... There was once a maxim in our law that provided a jury with both the power to judge the law and the facts in criminal cases.  This idea was central in our founding fathers' concept of justice, where memories of royal justice testified to the corruption of law.  That traditional check on our courts and the law has been steadily eroded by corrupt justices and lawyers.  It is time to reinstate that vital check on justice in our courts.

Our Founding Fathers saw Jury nullification as one of the “rights retained by the people” in the Ninth Amendment. Further, Jury Nullification is one of the “powers reserved to the people” in the Tenth Amendment.  The power of a jury to decide the facts and the law gave a Jury the final consent to be governed by the law. Corrupt laws could be overturned (nullified) by a jury (of the people) in such a system.  The Law becomes a true servant of the people, a SUBJECT of their consent.

Jury nullification is the decentralization of political power...  It is the people’s most important veto in our constitutional system of justice.  A jury verdict is the only time the people vote on the application and administration of the law. It is the power of jury nullification that gives a voice to people on the law. It is the people's final check in a corrupt legal system.  Jury nullification has been eroded by a corrupt judiciary, which has usurped the right of a jury to nullify unjust laws and the administration of a corrupt judiciary.
