Just when you thought New York Attorney General Letitia James could no longer surprise you with the lengths to which she will go to target political opponents with Lawfare, James goes and does something like this... and totally redeems herself!
What is the "something like this" you ask?
James is laying siege to a Castle. Not a metaphorical Castle. An actual Castle.
She's suing to take a Castle away from a non-profit foundation. That's the basic plot.
But there's a bonkers plot twist: the targeted Castle has nothing whatsoever to do with the Empire State and everything to do with the Mountain State.Berkeley Springs Castle. Gilded Age masterpiece. Back from the dead thanks to visionary leadership.
The Castle is located in Berkeley Springs, West Virginia. The non-profit that owns the Castle was formed in and is based in West Virginia. And, the non-profit's founders, who had the vision to restore and revitalize the formerly neglected and unloved Castle, live in West Virginia.
Overreach would be an understatement.
My friends and clients Peter and Lydia Brimelow, who are not wealthy and don't own or live in the Castle, are peacefully raising their three daughters in a modest home near the Castle. Peter and Lydia happen to be the altruistic visionaries who rescued this historic landmark from ruin. They selflessly founded the Berkeley Castle Foundation to preserve and protect the Castle for posterity and take the Castle's visitors back in time to a place of wonder.
But before they saved a Castle, Peter and Lydia made two unforeseeable mistakes that have now come back to haunt them.
First, long before anyone had ever heard of Letitia James, they had the audacity to form a New York non-profit foundation called VDARE, dedicated to ending illegal immigration and open borders. That turned out to be James's jurisdictional hook.
Second, while leading VDARE, they had the further audacity to dust off their First Amendment rights to speak out against illegal immigration and open borders. That constitutionally protected speech turned out to be the dinner bell that irresistibly attracted James's Lawfare Death Star to Deep Red West Virginia from far across the galaxy in Deep Blue New York.
I'm proud to stand with Peter and Lydia to Defend The Castle. I hope you will also. This is a noble cause worth supporting against a less-than-noble opponent worth opposing.
