Under Local Law 10-181, commonly known as the “Diaphragm Law” or “Chokehold Bill,” a resisting perpetrator has every incentive to incite a physical struggle with a police officer and then attempt to make it appear as though an NYPD officer placed an arm around their neck while they are attempting to effect a lawful arrest.
Screaming “I can’t Breathe” and “He is Choking me” while causing a crowd to form, while violently resisting arrest, so you can get a viral social media video is encouraged.
Rubbing your face against the concrete or anything that may cause injury is also encouraged so your booking photos will show injury is highly recommended.
Don’t go too hard though and actually injure yourself, remember the NYPD will try everything to not hurt you or your feelings.
Once arrested, now you play the victim.
You tell everyone you were “choked out” by an NYPD officer. You call IAB, CCRB, the Public Advocate, Al Sharpton (If you’re black), and get local elected democrats, candidates and grifters to hold a presser.
Make sure to tell them you lost consciousness and you are suffering from the trauma of being arrested.
Now the easy part, you convince an IAB “investigator” and a District Attorney that you are actually the victim.
The criminal case against you disappears.
You go from being a perpetrator into being a “victim”. You can now pursue a multimillion dollar lawsuit against NYC and the NYPD.
Don’t worry about a long drawn out court battle, shoot for the moon and NYC’s corporation counsel will settle with you somewhere amongst the stars. If you missed any of the above steps your settlement will still be in the clouds.
