If Our Republic's Constitution Still Matters...

Predictably, the Supreme Court refused to take up the Texas lawsuit against four states for illegally changing voting rules. This suit was very different in nature from those filed by Donald Trump’s legal team. The Texas suit stressed that those changes were not authorized by the respective state legislatures and that they clearly influenced the election outcome, which, by extension, clearly affects every state and every citizen.

For the record, refusing to take the case based on “lack of standing,” meaning the Court determined the state of Texas did not have direct legal standing to bring the suit, is very different than declaring the claims for the Texas suit don’t have merit. They most certainly did and do have merit. Apparently, all the leftist claims that Amy Coney Barrett was going to rubber-stamp another term for President Trump were what we knew they were — fake news.

Now that the Electoral College has met to declare  scumbag/liar-Joe Biden the winner of the 2020 election, if he makes it to January 20th, he will be sworn in as the next president — and then the real candidate, lowlife/liar-Kamala Harris, can soon thereafter step in.

Laughably, scumbag/liar-Biden declared, “Faith in our institutions held. The integrity of our elections remains intact.” Even more laughable, scumbag/liar-Biden is now touting the restoration of ethics to the executive branch.

So, what are we to do now when the scumbag/liar-Biden/lowlife/liar-Harris regime becomes an oppressive lowlife/liar-Harris regime — which it will — and then lowlife/liar-Harris adopts the far-left, constitutionally abrogating policies of her cadres of Demo “progressives”?

Responding to SCOTUS’s refusal to take the Texas case, state GOP Chairman Allen West protested: “The Supreme Court, in tossing the Texas lawsuit that was joined by seventeen states and 106 members of Congress, has decreed that a state can take unconstitutional actions and violate its own election law. Resulting in damaging effects on other states that abide by the law, while the guilty state suffers no consequences. This decision establishes a precedent that says states can violate the US Constitution and not be held accountable. This decision will have far-reaching ramifications for the future of our constitutional republic.”

West then posited, “Perhaps law-abiding states should bond together and form a Union of states that will abide by the Constitution.”

Of course, the Leftmedia propagandists pounced on West’s proposal, insisting it was “secessionist” — you know, like a southern Black man is calling for the South to rise again.

West’s remark is obviously not about secession, much less revolution. It’s about the establishment of an alliance of states “bonded together” by a commitment to “abide by the Constitution.”

This involves a reaffirmation of our Constitution in states attempting to give sanctuary to American Liberty and  Rule of Law as opposed to the Democrat Party effort to undermine our Constitution with the rule of men, the terminus of which is, irrevocably, tyranny.

On that note, let me reintroduce a concept I proposed 20 years ago as part of what is outlined in our Patriot’s Primer on American Liberty.

That concept: “A Constitutional Confederation of States.”

My proposal, then as now, would be to pursue a  grassroots-inspired Constitutional Confederation — an alliance of those states that are not urban-leftist mob-ruled, whose delegations could assemble to affirm the authority of our Constitution in order to provide broader sanctuary for the Rule of Law it enshrines — in effect, to re-ratify our Constitution and reaffirm its supremacy as law.

If we’re to fully restore Liberty and the integrity of our Constitution, we must do so from the bottom up — a groundswell from grassroots Americans if it is to be enduring. We must start at our foundation, speaking with one disciplined, determined, and unified voice toward one primary objective: The reestablishment of Rule of Law.

“Constitutional Confederation” is a more complicated sanctuary concept than those alliances being formed to defend the Second Amendment, but a good starting place would be with those organizational alliances because their mission is, ultimately, the same: protection of the Constitution — 2A being what Justice Joseph Story called the “palladium of the Liberties of the Republic.”

An initial objective could be to obtain resolutions from the 27 Republican governors and county resolutions in the remaining 23 states with statist Democrat governors.

The initial purpose would be to educate our fellow citizens on the point that our Constitution established a Republic and is intended to reflect the consent of the governed — a nation governed by Rule of Law. Article IV, Section 4 states unambiguously, “The United States shall guarantee to every state in this union a republican form of government.”

A Confederation of States should rise to demand no less than the standard our Founders’ set forth in our Constitution and affirmed in its Bill of Rights as “Article the Tenth,” the Tenth Amendment: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

Our Founders understood that Rule of Law would be the foundational guarantee to protect and sustain Liberty for their generation and those of their posterity. Consequently, they prescribed that all elected officials be bound by sacred oath “to support and defend” our Constitution.

But many in the U.S. House and Senate wantonly and constantly violate their oaths. They have forsaken those oaths and instead focus on redistributing others’ wealth to their special-interest constituencies in order to perpetuate their own offices. We can be certain that when the number of constituents who vote for their income and provisions outnumber those who work for their income and provisions, our Republic will be lost.

The time has come to inquire with a unified voice: Because there is no explicit constitutional authority for many of the laws and regulations enacted by the legislative and judicial branches, and enforced by the central government, then by what authority do those entities make such laws and collect taxes to fund unconstitutional laws and regulations? Where there is no authority, this certainly constitutes “taxation without representation.” Thus, what should be the consequence for such dereliction?

A Constitutional Confederation (as opposed to a Constitutional Convention, which poses many hazards to Liberty) would have the purpose of re-adopting our authentic Constitution as originally ratified, with amendments attached as prescribed. This confederated alliance would thus reject the so-called “living constitution” that has now undermined our actual  Constitution almost beyond recognition — accelerated by judicial diktats from the “despotic branch” of which Thomas Jefferson so presciently warned.

Although Article V of our Constitution provides the people with an authentic means for amendment, activist jurists and regressive lawmakers have altered that founding convention well beyond any semblance of its original intent. They have used the courts, legislation, and regulation to greatly expand the powers of the central government according to their decrees.

The states re-ratifying as members of the Constitutional Confederation would determine an orderly plan to withdraw from the plethora of unconstitutional diktats, regulations, and targeted taxes (Bills of Attainder) that are in clear violation of Tenth Amendment Federalism as defined in The Federalist Papers and prescribed when each state first ratified our Constitution. This serious movement to restore the authority of our Constitution is a genuine act in support of “We the People” rather than an act of insurrection. This is a proposal for restoration, not revolution, seeded in the Second “Tea Party” Revolt a decade ago.

This proposal could generate national momentum and would most assuredly generate a LOT of heartburn for the socialist Democrats and their legions of useful idiots. The notion of the unalienable Rights of Man are anathema to the Left’s statist worldview and objective of total state authority.

Founder Patrick Henry wrote of seemingly benign encroachments upon Liberty: “It is natural to man to indulge in the illusions of hope. We are apt to shut our eyes against a painful truth — and listen to the song of that syren. … For my part, whatever anguish of spirit it might cost, I am willing to know the whole truth; to know the worst, and to provide for it.”

It is time to fully object to the degraded state of our Constitution and reject any further degradation by way of “illusions of hope” that these depredations will magically repair themselves. It is the responsibility of our generation of Patriots to provide for its revitalization. In the spirit of Thomas Paine’s 1776 assertion, “If there must be trouble, let it be in my day, that my child may have peace,” so, too, it should be in our day.

Why mention this now? First, because the 2A sanctuary movement is endeavoring to do in Virginia and other states precisely what a Constitutional Confederation can do across our entire nation, starting with resolutions in support of such a confederation.

And second, because for the last four years, we’ve witnessed deep-state operatives endeavoring to undermine our Constitution by undermining the duly elected president of the United States. They did so first by attempting a coup d'état to take down Trump without firing a shot. When that failed, they undertook an impeachment charade also originating with one deep-state operative, whose primary handlers were Adam Schiff and Chuck Schumer — the latter of whom then oversaw the prosecution of Trump in the Senate.

We can all agree that our nation is besieged with BIG and systemic problems. And I would submit that nearly every major problem facing our country today can trace its roots to lawless extraconstitutional legislation and policies. This notion of a Constitutional Confederation of States is representative of the BIG ideas that need to be considered in order to ensure future generations of Americans are not beset with the current degraded state of our Constitution. This proposal is entirely consistent with our Patriot Mission to extend Liberty to the next generation.

As Ronald Reagan declared: “There are no easy answers, but there are simple answers. We must have the courage to do what we know is morally right. … You and I have a rendezvous with destiny. We will preserve for our children this, the last best hope of man on earth, or we will sentence them to take the last step into a thousand years of darkness.”

Having known Allen West for almost 20 years, I know for sure that he is, and has always been, dedicated first and foremost to defending Liberty today in order to extend its blessing to the next generation. Since our inception, that has, likewise, been the mission of your Patriot Post team.

What 'Hero' Really Means

For the last two months, I have been, initially at least, amused by the now-ubiquitous adjectives and nouns invoked to describe a large swath of Americans — the “heroic heroes” across our nation. Who knew we had so many?

My initial amusement, though, has devolved into irritation. Why? Because of the grossly cavalier misapplication of this word by mass-media talkingheads, few of whom have ever witnessed, much less performed, anything truly heroic. Thus, they lack context for and understanding of genuine heroism.

Allow me to offer my own definition of “hero” in the proper context: “An ordinary person faced with extraordinary circumstances, summoning the greatest measure of courage in order to place his or her life at immediate mortal risk to save the life of another.” Thus, “hero” is a word that should be reserved exclusively for that level of service and sacrifice, be it by an average citizen, a first responder, or a Patriot in uniform.

Setting the low bar for exploitation of this revered descriptor, scumbag/liar-Nancy Pelosi recently announced her bloated $3 trillion “HEROES Act,” the latest entry in the COVID-19 “everyone is a hero” file. I mean, a vote against that leftist tub of lard must be a vote against our nation’s heroes … right?

A quick search of references to “frontline heroes” for the past week returned thousands of national and local media stories related to those helping people in a variety of circumstances. The purpose of most of these stories was a well-meaning tribute, a “thank you” to people doing their jobs under difficult circumstances.

But, again, as much as we appreciate the efforts of our fellow Americans here, doing one’s job under difficult circumstances is not heroism.

President Donald Trump, in his exaggerated New York rhetorical style, has led the lavish use of the hero label, declaring recently: “They’re running into death just like soldiers run into bullets, in a true sense. I see that with the doctors and the nurses and so many of the people that go into those hospitals. It’s incredible to see. It’s a beautiful thing to see. But I really call them ‘warriors.’” He then inappropriately broadened that analogy to include all Americans: “We’re all warriors; everyone in our country is a warrior. We have to be because of what happened. And it should have never happened. It should have been stopped at the source.”

Well, no.

A day later, in an alliterative Rose Garden ceremony for “Hard Work, Heroism, and Hope,” the president said, “I’d like to thank everybody for being here, especially our great, great heroes. Because that’s what you are — heroines and heroes. That’s exactly what you are.”

Again, no.

Actually, in New York City, the epicenter of CV19 disease and death, healthcare workers and police have a lower  rate of infection than the city’s population in general.

Unfortunately, in many locations outside of major urban centers, a significant sacrifice that healthcare workers have made has been the loss of their jobs in the name of “flattening the infection curve” — more than 1.4 million of them in April and many more yet to be counted thus far in May. Of course, most of these workers have been temporarily furloughed and will return to work during the restoration of our economy — the Great Reopening — because, as we have noted repeatedly, that restoration will inevitably result in more infections. But that is the consequence and heavy cost of a functioning society and economy.

Beware of the politically polar framework that Democrats and their Leftmedia outlets promote: On the Right is unmitigated reopening and on the Left is total lockdown. But those two polar opposites constitute a false dichotomy, and that phony choice enables those on the Left to claim that every death taking place after a state reopens has unnecessarily placed economic interests above life. This is a convenient and despicable lie, but one that will be repeated frequently until the November elections.

Now, before you first responders and healthcare folks flood my inbox, let me say something that should go without saying: I have great respect for you and what you do. In fact, to better understand my respect for you, let me share a little personal history. In the summer between my freshman and sophomore years of college, when I aspired to a career in law enforcement with the FBI or Secret Service, I graduated from a state police academy and for the next three years wore the law-enforcement uniforms of two states while completing my undergraduate degree. Additionally, I was certified as an EMT and firefighter — so I was a dedicated first responder. And though I found myself in more than a few dangerous situations, I never did anything that would or should be described as “heroic.” And certainly, nobody I worked with ever thought that simply putting on a uniform made them a “hero.” Among my colleagues, that notion was simply absurd.

Fact is, I have never met any first responders or healthcare workers who would ever describe themselves or their service to others as “heroic.” They would reject that label outright.

However, in those early career years and since, I’ve known police officers, firefighters, and EMS personnel who actually did do heroic things, placing their lives in immediate mortal peril to assist a citizen or fellow first responder.

Moreover, in my capacity as a board member of the National Medal of Honor Heritage Center, I’ve been privileged to meet many members of our nation’s most exclusive fraternity — those military personnel whose courage under the most extreme of circumstances has earned them our nation’s highest military award for valor.

Not one of those Medal of Honor recipients would describe their actions as “heroic,” but simply being in a place and time that required something extraordinary of them. To a man, they are then quick to say that most others would have done the same if they’d been in the recipient’s boots.

This week, falling as it does between Armed Forces Day and the upcoming observance of Memorial Day, allow me to express my frame of reference for the meaning of “hero” by telling you about one American.

Last Thursday, I received word from a mutual friend that Staff Sgt. Ronald J. Shurer II had died after a three-year battle with cancer.

In 2008, at the age of 29, Ron was a Senior Medical Sergeant in Special Forces Operational Detachment Alpha 3336, Special Operations Task Force-33, in support of Operation Enduring Freedom during the battle of Shok Valley, Afghanistan. He was an ordinary man who faced extraordinary circumstances and summoned the courage to repeatedly run through enemy fire to provide medical care to his brothers in arms. Despite being wounded himself, he tended to four critically wounded soldiers and 10 injured commandos, then helped evacuate many wounded through fields of fire to waiting medevac helicopters.

In recognition of his actions, Ron Shurer was awarded the Medal of Honor by President Donald Trump on 1 October 2018, having exhibited all the fundamental character traits associated with that singular award: Courage, Commitment, Citizenship, Sacrifice, Integrity, and Patriotism. To read and contemplate his citation is to understand what “hero” really means.

Typical of such warriors was Ron’s comment about receiving the recognition for his service: “This award is not mine. This award wouldn’t exist without the team. If they weren’t doing their job, I wouldn’t have been able to do my job.”

Last month, on 6 April, the 12th anniversary of the battle of Shok Valley, Ron wrote, “When we started working our way up that mountain, we didn’t expect the fight we would face … but neither did they.”

Dillon Behr, one of the men Ron saved that brutal day, wrote: “Without Ron Shurer at my side, I would have died that day. No question. His presence gave me the confidence to know I could make it. There’s a good chance if he would have been critically injured or killed on the battlefield … we all might have died out there.”

Ron left military service in 2009, becoming a Secret Service agent and eventually serving on a team defending the president.

He was the son of career Air Force parents Ronald and Fabiola Shurer, and at the tragically young age of 41 he leaves behind his wife, Miranda, two sons, Tyler and Cameron, and his extended family.

Fellow Medal of Honor recipient Flo Groberg said of Ron: “He was an inspiration to me. He never let cancer take away his smile and his mission to support our community. We all know about his military exploits, but it was the husband, the father, and the friend that made Ron unique. He never showed his pain — only his love and strength. … He was the ultimate friend, and the best teammate that you could ever ask for. … God Speed, my friend.”

In a nation of some 330 million people, after Ron’s departure, only 69 Medal of Honor recipients survive today.

Ron was a genuine hero — one who demonstrated the humility that always attends authentic acts of heroism. He was a man of faith, and he lived these Gospel words: “Greater love has no one than this: to lay down one’s life for one’s friends.”   ~The Patriot Post

Each week, I typically have to choose from among 10 or more active and carryover topics to write about. Choosing just one can be a challenge.

I’ve been holding a topic — “Enemies of the People” — for six weeks, waiting on scumbag/liar-Joe Biden to announce lowlife/liar-Kamala Harris as his 2020 running mate.

The “enemies” topic was high on my list this week, and then House Speaker scumbag/liar-Nancy Pelosi opened her pie hole, making it the indisputable frontrunner.

Two years ago, President Donald Trump set Democrat Party heads on fire when he declared, correctly, that their Leftmedia propagandists were the “enemy of the people.” According to Trump: “There is great anger in our country caused in part by inaccurate, and even fraudulent, reporting of the news. The Fake News Media, the true Enemy of the People, must stop the open and obvious hostility and report the news accurately and fairly. That will do much to put out the flames of Anger and Outrage and we will then be able to bring all sides together in Peace and Harmony. Fake News Must End!”

For the record, when Trump says “fake news” is the “enemy of the people,” he clearly means the enemy of American Liberty, the foundation that has sustained our Republic since its inception.

Fast-forward to this week, as Democrats are trying to throw the 2020 presidential election to scumbag/liar-Biden with scumbag/liar-Pelosi’s Postal Service subterfuge: carpet-bombing mailboxes with ballots rather than requiring the prescribed absentee ballot process now used by every state. Preemptively mailing ballots offers no assurance of who is actually casting a ballot — precisely the “election interference” Democrats are seeking.

Demos are desperate to control the outcome of the 2020 election after their 2016 Russia-collusion coup failed, as did their effort earlier this year to impeach Trump for what Biden actually did.

That desperation caused scumbag/liar-Nancy Pelosi to offer up this extraordinary invective: “The Russians were there [in 2016] and they are there now 24/7 trying to interfere in our election, but they’re not the only ones. We take an oath to protect [sic] and defend the Constitution from all enemies, foreign and domestic. And sadly, the domestic enemies to our voting system and our honoring of the Constitution are, uh, ah, uh, right at 1600 Pennsylvania Avenue with their allies in the Congress of the United States.”

scumbag/liar-Pelosi added: “They’re doing everything they can [to] suppress the vote with their actions, scare people, intimidate by saying law enforcement will be there… It’s really actually shameful. Enemies of the state.”

Now, if by “enemies of the state” scumbag/liar-Pelosi only meant those who are the enemies of socialist statism, she would be correct. But of course she also meant “enemies of the people.”

First, anytime Democrats invoke their oath “to support and defend” (not “protect and defend”) our [Constitution][https://patriotpost.us/pages/540-celebrate-constitution-day-sept-17-1789], and by extension the Rule of Law it enshrines, it should evoke herniating laughter from all of us who have sworn the same oath to defend Liberty at great personal risk. The sad truth is that scumbag/liar-Biden, lowlife/liar-Harris, scumbag/liar-Pelosi, and Chuck scumbag/liar-Schumer spend all day every day violating that oath.

Second, the phrase “enemies of the state,” as used by communist governments to label dissidents, is tantamount to the phrase “enemies of the people,” but in scumbag/liar-Pelosi’s context, both indict those who support our Republic’s Constitution and the good order of society.

So, how do you really spot an enemy of the state? Watch for their opportunistic response to a national crisis.

For example, when our nation is in the middle of a pandemic that has claimed an estimated 180,000 lives and 40 million American jobs so far, pay attention to what the enemies of the state do.

First, they start an election-year pandemic inquisition with the sole political objective of blame-shifting to their political opponents. At the same time, they embrace the real enemy responsible for the plague, Red China, our nation’s most perilous adversary and existential threat. As Pelosi noted recently in a moment of accidental honesty, “China would prefer scumbag/liar-Joe Biden.”

Then, when our nation is at its most vulnerable, they conjure up a pandemic of “systemic racism” to explain the unjust death of a deeply troubled Minneapolis man. Then they blame cops in order to further stir division and hatred, for which they then blame Trump.

That’s right: Enemies of the state are those anti-American politicians at all levels, and their Marxist haters and “useful idiots,” who politicize a deadly virus and then foment race riots across the nation in the midst of that national security crisis.

And to enhance their machinations, they have teamed up with the leftist billionaire archenemies of Liberty, particularly socialist George Soros. He recently acknowledged that the China Virus pandemic provided a “revolutionary moment,” and we all know that leftists never let a good crisis go to waste. According to Soros: “I would describe it as a revolutionary moment when the range of possibilities is much greater than in normal times. What is inconceivable in normal times becomes not only possible but actually happens. People are disoriented and scared.”

Seasoned political analyst Charles Hurt likens them to rats in a plague: “This is the perfect time for Washington Democrats to pillage for their own personal political profit. … After all, there is no time like a plague when rats like to party it up.”

Hurt is much too kind.

These Demo-rats are feeding on the fear, anger, and misery of the most vulnerable among us.

scumbag/liar-Biden promises to be “the most progressive [read: ‘regressive’] president in history,” which earned him the endorsement of the Communist Party USA. As Barack scumbag/liar-nObama said this week, “If you look at scumbag/liar-Joe Biden’s goals and [socialist] commie-Bernie Sanders’s goals, they’re not that different.”

As focused as they are on divisive racial issues, you’d think these Democrats would know the difference between light and dark. But this week, they’re collectively claiming that the upbeat messages of hope and opportunity from RNC convention speakers, who uphold American exceptionalism, are categorically “dark.” How dark? Check out this video compilation of Leftmedia talkingheads parroting the Demos’ “dark” memo.

But it is scumbag/liar-Biden, lowlife/liar-Harris, scumbag/liar-Pelosi, and scumbag/liar-Schumer who would like to shutter our nation in the darkness of socialist oppression under their limitless statist power. They are, indeed, the enemies of Liberty, which makes them the enemies of the state and all American people.

Most American citizens are good and decent people, and by “most” I mean the vast majority — however lost some may become in the darkness cast by the Left. Most Americans simply want the opportunity to prosper, to be secure in their person and property, to support their family, to care for others, and to live in peace. Unfortunately, those common desires will progressively elude them under the leadership of Democrat Party enemies.
