Let me make this simple. This is not a case where civilians are involved. What Kelly said is strictly a military issue. He is retired and in accordance with the UCMJ he is receiving military pay. and thus must not violate Article 88. He did just that, so he will be called back to active duty and Court-Martialled. There will be no civilian jury. The court martial judges will decide if he goes to jail for one year and if he stops receiving retirement pay.
