{ townhall.com } ~ The left and Trump-opposing right are predictably annoyed at President Trump's persistent description of the liberal media as "fake news." Like it or not, the term as he uses it has merit.

Trump's opponents hysterically claim he threatens the free press when he uses that term to describe them, just as they accuse him of other alleged abuses of constitutional power. In fact, unlike President liar-nObama, Trump has governed within his constitutional authority. If his rhetoric scares them, then maybe they should find a safe space.

Before you accuse me of your favorite discussion stopper, "whataboutism" -- supposed efforts to excuse Trump's alleged misbehavior by citing equal or worse behavior fromliar-nObama, liar-Hillary Clinton or other Democrats -- let me repeat: I am arguing that Trump has not abused his executive powers, so I'm not seeking to excuse him at all.

As I've said before in response to Trump critics, not every criticism of liar-Clinton and liar-nObama is designed to take the heat off Trump. It is important to hold Democrats accountable, even for their past actions, and to showcase their hypocrisy.

I have often detailed President liar-nObama's misdeeds and the liberal media's deliberate refusal to report on these and therefore won't provide another comprehensive list here. But it is important for us all to understand that Democrats, as a rule, don't much care about abuses of constitutional power -- by the executive branch or by the legislative and judicial branches, not to mention the unaccountable administrative state -- when they advance their leftist agenda.

Before you scoff at this, there's a logical reason for this beyond their hyper-partisanship. They don't care as much as we do about the Constitution -- at least not as originally written. It's undeniable from their history of supporting liberal judicial activism alone, wherein liberal judges bend, amend and upend constitutional provisions and principles when it suits their policy preferences. Liberals speciously accuse conservatives of activism when our constitutionalist judges merely reverse their lawless rulings, just as they accuse President Trump of abusing his executive authority when he dips his executive pen into White House ink to lawfully repeal liar-nObama's unlawful orders.

As just one example, President liar-nObama repeatedly and publicly lamented his lack of executive authority to change immigration laws when he was trying to pressure Congress to pass the DREAM Act. But when his efforts failed, he dipped his executive pen into his executive ink and grossly abused his authority to advance his cause. And he did these types of things routinely -- thwarting the will of the people by usurping the authority of Congress.

The liberal media, who hold themselves out as objective journalists, rarely, if ever, criticized liar-nObama for such lawlessness. They are advocacy commentators disguised as journalists, and reporting on these abuses didn't serve their agenda. Seems pretty fake to many of us. Yes, many commentators on the right are biased, as well, but they usually admit their biases rather than masquerade as objective observers.

Those who insist Trump is abusing his executive authority are the same ones who are hot and bothered about his "fake news" moniker for the liberal press, arguing that it somehow threatens the First Amendment. This is nonsense.

Trump doesn't jeopardize anyone's free speech rights by calling them fake. At the risk -- again -- of whataboutism charges, Presidents liar-nObama and liar-Bill Clinton were often in public fights with Fox News and conservative talk radio. Did they threaten free speech in such instances? Moreover, are critics suggesting that Trump has a constitutional or moral duty to remain silent in the face of endless criticism from the media -- the media that are so preoccupied with discrediting him and undermining his agenda that they spend almost all their time on scandal-mongering and almost none on reporting substantive news?

The critics' incessant and unsubstantiated claim that Trump is a threat to the Constitution is itself irresponsible. Most of the examples they cite have to do with his tough rhetoric rather than his actions. They just can't stand him and have an irrational fear that he's going to end the world, maybe even the universe.

So please, the next time someone casually asserts that Trump is a danger to the Constitution, have the person specify and connect the dots between Trump's action or statement and an actual threat to our democracy.

And when you are considering Trump's claim that he's being attacked by fake news, keep in mind that the leftist media 1) aren't honest about their biases and mask their editorial opinions as news; 2) grossly underreport substantive newsworthy events; 3) make things up about Trump -- such as that first lady Melania Trump may have been in hiding to conceal evidence of physical abuse administered by this most evil of chief executives; and 4) deliberately conceal or deny indisputable evidence of Democratic abuses and corruption, the latest being the liar-nObama administration's clandestine assistance to Iran to facilitate its circumvention of financial sanctions -- and its overt lies to the American people about it.

When it comes to political reporting, the liberal media are often fake news, so don't just assume that Trump's repeated claim to that effect is nothing but counter punching noise. It's about time someone called them on it. It's wholly proper for the press to hold public officials accountable when necessary, but there's nothing whatsoever wrong about a president's holding the media accountable, as well. After all, collectively, their bully pulpit is arguably bigger than his.

It cites the murders of Sarah Halimi and Mireille Knoll, two elderly Jewish women murdered by anti-Semitic Muslim thugs, the fact that "French Jews are 25 times more likely to be attacked than their fellow Muslims", and the ongoing ethnic cleansing of Jews from the encroaching no-go zones. 

"10% of the Jewish citizens of Île-de-France - that is to say about 50,000 people - were recently forced to move because they were no longer safe in some cities and because their children could not attend the schools of the Republic,” it courageously warns. 

“This is a quiet ethnic cleansing being carried out in in the country of Emile Zola and Clemenceau." 

The manifesto was written by former Charlie Hebdo editor Philippe Val, who had republished the original Mohammed cartoons from the Jyllands-Posten despite the threats, both terroristic and legal, and its signatories include former president, Nicolas Sarkozy, the former mayor of Paris, Bertrand Delanoë, famed singer Charles Aznavour, actor Gérard Depardieu, and many other significant figures. 

The moral power and the importance of the manifesto should not be underestimated. 

After 9/11, it was American Jews who brought attention to the plight of French Jews while their community leaders often preferred to remain silent. Now it is French Jews who speak out, who march and whose LDJ even confronts Islamic thugs in the street while American Jews keep quiet or collaborate. 

The despicable alliance between AJC and ISNA, and the ADL’s attack on Canary Mission, carry with them the stench of Vichy on the spring wind. When an Islamic terrorist attacked a Kosher supermarket before the Sabbath, asking his victims if they were Jewish before he shot them, liar-nObama dismissed it as a random attack on a “bunch of folks in a deli.” It’s become virtually impossible in the United States to have a discussion about Islamic anti-Semitism without being denounced as an Islamophobe. 

Why did France and America trade places? France has faced worse terrorist attacks in recent years than we have. But, more significantly, it lacks the politically correct viewpoint consolidation of America. Despite certain views being criminalized, there are all sorts of non-traditional views in public life there that are actively debated, instead of being airbushed or silenced the way they are in the United States. 

Neither the manifesto nor Charlie Hebdo could exist in the United States. The media in this country censored the Mohammed cartoons more vigorously than the Europeans did. Without any legal threat. 

And yet, despite its moral courage and its vital message, the manifesto misses the true nature of Islamic anti-Semitism. 

It’s a lot more than a few verses. 

The verses are part of a larger Islamic narrative. They’re not random outbursts, but a story. And that story is the primal conflict between Mohammed and the Jews. It begins with the massacre of the Jews at Khaybar and concludes with an end of days that can only come when Muslims exterminate the Jews. 

It’s not a few intemperate verses. Anti-Semitism is fundamental to the story of Islam. And that story with its visions of a conquest sweeping across the world has not ended. That’s why the violence goes on. 

Jews and Christians have a paradoxical role in Islam. They are on the one hand, People of the Book, the unacknowledged originators of the ideas and texts that Mohammed looted to found Islam. But their precedence is removed by accusing them of having betrayed Allah and perverted the scriptures. 

Unlike the polytheistic pagans wiped out by Islam, Jews and Christians are in theory monotheists, with a higher status, but they’re also accused of being mushrikeen, polytheists, who take “partners” with Allah. Jews and Christians had “taken Rabbis and monks to be their lords besides Allah”. (Koran 9:31) 

The ambiguity of Jews and Christians gave them a special status and a special peril. Ritual humiliations of Jews and Christians were enacted to demonstrate their inferiority and the supremacy of the Muslim. In an honor-shame culture, Islamic superiority had to be demonstrated by humiliating other religions. 

When Jews and Christians gained independence or won battles, it called the truth of Islam into question. 

That, rather than a few verses, is what we are dealing with. The verses remain relevant to those Muslims who believe that they are in a zero-sum struggle with every other religion on a battlefield whose scope is as large as the planet and as small as a neighborhood or a building. And that’s the vast majority. 

You can try to make an idea obsolete when it’s no longer relevant. But the anti-Semitic hatred in almost every country where Jews and Muslims both live shows that anti-Semitism remains quite relevant. 

Hating Jews, attacking them and even killing them, remains a meaningful part of Islamic identity. 

The Jews were a primal Islamic enemy. That enmity is written into Islamic scriptures, traditions and prayers. All of that can’t be made obsolete because the Islamic conquest is an ongoing project. 

It’s not a few verses. It’s the context of the conquest. That’s the mission at the heart of Islam. 

The Lebensraum and Drang Nach Osten of Islam might pause for periods, but it never actually stops. Iraqis, Pakistanis and Somali migrants pour into Europe seeking Lebensraum. They move into poorer areas associated with immigrants bringing them into contact with earlier Jewish communities. 

When the second generation, usually more prone to supremacist violence and expansionism than its immigrant forebears, comes of age, the Jewish communities are violently driven out of their homes. 

The verses that justify it won’t become obsolete until the modes of behavior behind them lapse. 

Calls for the persecution of Jews and Christians won’t be outmoded relics of another time until Muslims make them so, not by changing words, but by changing deeds. The trouble is that the verses remain entirely relevant because Muslim populations around the world continue to fight religious wars. 

Muslim hatred of Jews has unique elements. As anti-Semitism usually does. But it’s still a subset of an Islamic supremacism and xenophobia that is endemic and whose consequences can be seen in clashes between Muslims and Christians in Nigeria, Muslims and Hindus in Kashmir, Muslims and Buddhists (and Hindus) in Myanmar, Muslims and Yazidis in Iraq, Muslims and Zoroastrians in Iran, Muslims and Atheists in Bangladesh, and those are just a few of the many examples around the world. 

Islam is not on good terms with any other religion. Including its own spinoffs, like the Bahai, or its own subdivisions, like the Sunnis and the Shiites. 

It’s not about the Jews. It’s about Islam. 

The truth of Islam is validated by violence. Its theological disputes are settled by force. 

The verses about Jews and Christians are not the problem. They’re a symptom of the problem. As are the terrorist attacks, stabbings, shootings, bombings, no-go zones, sharia police and sex grooming gangs. 

The response from Muslim clerics in France to the manifesto has been to claim that the verses are meant to be seen in the context of their time and that Islamic wars are only defensive. Historically, that’s nonsense. But everyone would be perfectly happy if they believed that and really lived it. 

Instead Islamic violence is always deemed to be defensive. Peace can only come from victory, not co-existence. War with non-Muslims who don’t submit to Sharia law is seen as inevitable and necessary. 

The verses libeling Christians and Jews, and justifying violence against them, are just rationalizing this fundamental Islamic worldview and applying it to specific targets. Islamic anti-Semitism is born of Islamic supremacism and imperialism. Muslims aren’t persecuting Jews just because of anti-Semitic verses in the Koran. They’re persecuting Jews because the Koran is supremacist and imperialistic. 

That’s why Muslim violence against Jews is not just a problem for Jews. It’s a problem for everyone. 

Like the Yazidis, Jews are a tiny minority and more vulnerable. That’s what makes them the canaries in the coal mine of Islamic migration. Muslim attacks on Jews in Europe date back over a generation. Long before Paris, Brussels and London were being regularly terrorized; European Jews had already retreated into fortified synagogues, stopped wearing Jewish clothing in public and maximized their security. 

That was the canary in the coal mine. If Europe had woken up then, it wouldn’t be choking now. 

American synagogues and Jewish institutions are starting to resemble their European counterparts. A decade ago, armed guards were a rarity outside synagogues. I walk past them all the time now. 

The French manifesto is an imperfect effort to call attention to a burning problem. It’s an attempt to start an urgent and necessary conversation in France that can’t even be had in the United States. 

And it’s a conversation that we must have before civilization chokes in the coal mine.

{ heritage.org } ~ Alabama has filed an unprecedented but little-noticed lawsuit against the U.S. Census Bureau. If the state wins, it could have major political ramifications and restore fundamental fairness in political representation in Congress.

Alabama is arguing that by including illegal immigrants in its count of the population, the Census Bureau deprives the state — and other states with low numbers of illegal immigrants — of representation in the U.S. House of Representatives, as well as votes in the Electoral College that determine who is elected president.

Conversely, the lawsuit argues, the practice of counting illegal immigrants in the census gives states that protect them California, for example seats and votes they are not entitled to have.

The 14th Amendment to the Constitution provides that representatives in the House “shall be apportioned among the several States … according to their respective Numbers,” with the “Numbers” determined by “counting the whole number of persons in each State.”

After every census, House seats are reapportioned according to the population of each state. Electoral College votes are reapportioned according to the number of each state’s congressional representatives.

Alabama is right about the unfairness of the current system. Illegal immigrants, by definition, have no right to be in this country. It is unjust to allow states to gain a political advantage over other states by flouting federal immigration law.

The number of representatives in the House — 435 — has been fixed by law since 1910. So as Alabama says in its complaint, apportionment is “a zero sum proposition: Each state’s gain is another state’s loss.”

Alabama argues that by including illegal immigrants in apportionment, congressional seats and Electoral College votes are unfairly distributed.

Based on the 2010 Census, Louisiana, Missouri, and Ohio each lost a seat in the House and a vote in the Electoral College, while Montana failed to gain a seat and an electoral vote. By contrast, California gained two House seats and two Electoral College votes. And Florida and Texas each gained one seat and one vote.

As a result, says Alabama in its lawsuit: “Four House seats and four Electoral College votes were redistributed by the inclusion of illegal aliens in the apportionment base in the 2000 Census.”

Alabama claims that including illegal immigrants in the 2020 Census will likely cause it to lose a congressional seat and an Electoral College vote. It says this “will rob the State of Alabama and its legal residents of their rightful share of representation.”

This also violates the “one person, one vote” equal representation standard of the 14th Amendment. According to Alabama, “The gains from including illegal aliens in the apportionment base flow to citizens who live in state with large numbers of illegal aliens.”

Why? Because it means that “in a state in which a large share of the population cannot vote, those who do vote count more than those who live in states where a larger share of the population is made up of American citizens.”

This results in “representational inequality” by devaluing the vote of Alabama’s legal residents. This redistribution of political power “disincentivizes states with large illegal alien populations from cooperating with federal immigration authorities lest they lose political power that comes with additional representatives and votes in the Electoral College,” Alabama argues.

Moreover, including illegal immigrants in the census “punishes states who [sic] do cooperate with federal immigration authorities in the identification and removal” of illegal aliens, Alabama’s lawsuit states.

Alabama’s final complaint is monetary. Including illegal immigrants in the census, it says, will likely cause it to lose its fair share of the almost $700 billion distributed annually by the federal government in grants and other funds.

The key to Alabama’s case is the definition of “persons” who should be counted and thus used in apportionment. Alabama argues that the term “persons” was understood at the “time of the founding and when the 14th Amendment was ratified” to mean the “inhabitants” of a state.

Furthermore, “In the public law of the founding era, the term ‘inhabitant’ did not encompass unlawful residents because inhabitance was a legal status that depended upon permission to settle granted by the sovereign nation in which an alien wished to reside,” Alabama argues.

In other words, “persons” does not include individuals who are in the U.S. illegally, without the permission of the federal government.

The “Residence” rule adopted by the Census Bureau for the 2020 census stipulates that foreign nationals will be counted and allocated to the state where their “usual residence” is located, regardless of whether they are legally present.

Alabama argues that the rule is unconstitutional. Moreover, it claims, the rule violates the Administrative Procedure Act because it is “arbitrary and capricious” and exceeds the Census Bureau’s statutory authority.

The last time the Supreme Court had a significant case involving the census was in 1999 in Department of Commerce v. U.S. House of Representatives. The justices concluded that the Census Bureau had to do an actual count of the population — it could not use statistical sampling.

In 2015 the Supreme Court held that states could use total population numbers — which includes illegal immigrants — in drawing the boundaries of legislative districts. But that case was about redistricting, not apportionment.

Does Alabama have a case? That will largely depend on whether it can convince the Supreme Court that its understanding of the historical definition of “persons” in the apportionment clause of the Constitution is correct. This is not an issue the Court has addressed before.

But regardless of the ultimate resolution of this novel legal argument, Alabama is right about the unfairness of the current system. Illegal immigrants, by definition, have no right to be in this country. It is unjust to allow states to gain a political advantage over other states by flouting federal immigration law, as California has done with its sanctuary policies and obstruction of federal enforcement.

A Conspiracy Theory About a Conspiracy

But that could just as easily apply to the New York Times. 

The Times is unaware of the sublime hypocrisy of accusing the President of the United States of "sowing widespread suspicions about the government" even as it is doing just that. 

The paper of broken record specializes in spreading conspiracy theories claiming that President Trump didn’t actually win the 2016 election but that “nefarious, hidden forces” made it happen. Its promotion of conspiracy theories about the 2016 election is obviously informed by its “political opportunism.” 

But so are most conspiracy theories. 

A conspiracy theory is usually the conspiracy. Democrats spread claims that the JFK assassination was a right-wing conspiracy. That conveniently redirected blame from the Socialist who pulled the trigger and from the Democrats who benefited from it. 9/11 conspiracy theories likewise shift blame away from Muslim terrorists and the Democrats who champion open migration from terror states like theirs. 

Before the Democrats used conspiracy theories to delegitimize Trump’s electoral victory, they used them to delegitimize Bush’s victory. You don’t need to be a deep thinker to spot the opportunism. 

Or the classic nature of the conspiracy theory: an infinitely expanding plot whose gnostic pleasures come from studying the endless roster of conspirators, the promise of a final takedown never to be delivered, and the seductive appeal of overturning an unwelcome reality with an appealing lie. 

Why don’t conspiracy theories ever prosper? Because if they appear in the New York Times, they aren’t conspiracies. What is the Timesian definition of a conspiracy theory? Anything favorable to Trump. 

Really. 

“The Conspiracy Theory That Says Trump Is a Genius,” is the actual title of a Times op-ed. 

Suggesting that the nation’s first billionaire president is a genius is an opinion. Not a conspiracy theory. On the other hand, proposing that the New York Times is biased against Trump is an indisputable fact. 

Conspiracy theories, fake news, lies, scandals, corruption and abuses of power are not defined objectively, but along party lines. Timesians are convinced that conspiracies are something that lower class and wrong party people irrationally believe in. Instead truly rational people believe that the 2016 election must be overturned and the winner locked up because of some inchoate string of sentences that begin with Moscow, end with Facebook and take scenic detours through more exotic international locations and random businesses than Anthony Bourdain and a year’s worth of Forbes issues combined. 

Successive New York Times stories have spun a web of Trump conspiracies from the Ukraine to Russia, from the United Arab Emirates to Israel. Either Trump is the world’s greatest genius or the New York Times is using crazy conspiracy theories to help sell skin care products to wealthy Manhattanites. 

The Times bemoans “baseless stories of secret plots” right before it scoops them up and sells them. The day before that accusation, it ran a story headlined, “Ivanka Trump Wins China Trademarks, Then Her Father Vows to Save ZTE.” The evidence for that secret plot is a string of conjectures and innuendo. 

Or baseless. 

But it’s not just the Russians, it’s also the Chinese. And the Germans. "Big German Bank, Key to Trump's Finances, Faces New Scrutiny," is another Times hit piece. As is, “Trump's Business Ties in the Gulf Raise Questions" which brings in the Saudis. More Timesian conspiracism includes India, Israel and Uruguay. 

The New York Times accuses President Trump of eroding trust in our institutions with conspiracy theories. But that’s exactly what the conspiracy theories it’s spreading are meant to do to elections. Spreading paranoia? That’s another conspiracy media special. The Russians are in your Facebook. Your friends are all fake. If your news isn’t certified by our fact checkers, you shouldn’t trust it. 

After an election, the old battles are set aside and everyone agrees to work together. Instead we have an endless election because the media spread conspiracy theories to erode trust in those results. 

And those conspiracy theories were based on opposition research from the losing campaign. 

President Trump didn’t erode trust in institutions, institutions eroded trust in themselves by enlisting in a partisan campaign. The partisan agenda has always been plainly obvious because these investigations inevitably lead back to the liar-Clinton campaign and its political allies. Unlike the media’s conspiracy theories about Trump conspiring with the Russians to win the election by posting ads on Facebook, the collusion between government agencies and the Democrats is an open book. Many of the media’s conspiracy theories about Trump, such as the liar-Clinton-Steele dossier, the conspiracy’s founding text, originated from that collusion between political operatives and government officials. 

Conspiracy theorists in the media left are accusing Trump of being a conspiracy theorist for questioning their conspiracy theory. But is a conspiracy theory about a conspiracy theory really a conspiracy theory? 

Is accusing your opponents of spreading conspiracy theories about you really a conspiracy theory? Especially when they’re doing it on the front pages of every major newspaper in America? The media spreads conspiracy theories. Then it accuses anyone who questions its actions of conspiracy theorizing. 

The dubious part of a conspiracy theory is not the ‘conspiracy’ part, but the ‘theory’ segment. 

An actual conspiracy can be proven. A conspiracy theory however is just that. A theory. It never gains factual proofs. Instead it diverts attention from its failure to prove its central claim by expanding its sphere and scope, by personalizing, speculating and persecuting anyone it decides is a useful target. 

And then, before you know it, you’ve spent a year blowing through millions of dollars, harassing people, breaking into their homes and accusing them of unrelated matters without ever proving collusion. 

But don’t worry. The Mueller investigation is on track. That’s why it has to be classified. Like most conspiracy theories, the juiciest parts have to be kept secret because, well, don’t ask questions. 

All will be revealed in time. 

While Republican congressional investigations sought to declassify information, Mueller, the DOJ and the FBI have built a wall of secrecy. Every detail of the investigation, especially its origins, have had to be pried out from behind that wall. And those details, especially those involving the Steele dossier and how it made its rounds through the government, are damning, proven and germane to the conspiracy. 

Unlike the media’s endless world tour of allegations, international conspiracies and vague insinuations, Spygate remains both specific and focused. And, unlike Russiagate, which has yet to even explain its central conspiracy theory of how the Russians actually rigged the election, the accusation is quite clear. 

A conspiracy theory evolves into a conspiracy not through elite influencers, sheer volume of allegations or the creativity of their inventors… but through plausible means, motive and supporting facts. 

Russiagate was always a toxic cocktail of pre-election dirty tricks and post-election sour grapes. Its central theory has never been adequately explained or justified because even its proponents are unable to explain just how the election was rigged or why Trump would turn to the Russians, instead of his own wildly successful messaging team, to run Facebook ads. If there’s one thing that everyone ought to be able to agree on, it’s that Trump has never lacked for marketing savvy. Meanwhile the most popular brand of Russian vodka is owned by the Brits and made in Illinois. 

But the conspiracy to spread the conspiracy theory is real. And its roots have been tracked back through the media, the government and back to the liar-Clinton campaign. While the liar-Clinton-Steele dossier is a series of bizarre unfounded allegations, alternately described as non-credible or as so secret that the Russians would kill for it by its proponents, the conspiracy to seed it into an investigation and the media is not a theory. We know how it happened. We know how it was done. We know who paid for it, who the central players were and why they did it. 

That’s not a theory. It’s a conspiracy.

A disproportionate share of the funds paying for his ever-expanding progressive agenda derive from Silicon Valley’s capital-gains tax revenues and inflation of the state’s coastal real-estate prices. Any slowdown in the tech money machine or drop-off in property values could prove disastrous for Sacramento’s budget—California gets half its revenue from its top 1 percent of earners. According to Pew, this makes it the major American state with the most volatile finances. Both U.S. News & World Report and the Mercatus Center ranked California 43rd among the states in fiscal health. And that was during an economic boom. by Jordan Candler:  It isn’t necessarily news to say the liar-nObama administration used the Environmental Protection Agency treacherously, employing deceitful methods to enact a burdensome environmental agenda. But a recent report sheds some light on one way this was accomplished — “by gaming cost-benefit analysis to downplay the consequences of its major environmental rules,” The Wall Street Journal reveals.

             The liar-nObama EPA produced an annualized average of 565 directives, “imposing the highest regulatory costs of any agency,” according to the Journal. Legally, the EPA is generally required to submit these proposals to a cost-benefit analysis. The caveat is that the agency is also afforded considerable leeway in the process. The liar-nObama administration considered this an opportunity and proceeded to exploit the system by estimating a cost for not enacting regulations.
               The Journal explains, “By introducing ‘social costs’ and ‘social benefits,’ the EPA began factoring in speculation about how regulatory inaction would affect everything from rising sea levels to pediatric asthma. EPA optimists even included their guesses about how domestic regulations could have a global impact. Meanwhile, the agency ignored best practices from the Office of Management and Budget, juking the numbers to raise the cost of carbon emissions.”
               To illustrate, in the run-up to the superfluous and extremely costly Clean Power Plan, the Journal says “the EPA suddenly raised the social cost of a ton of carbon emissions to an average of $36 from $21. Before it embarked on new oil and gas regulations, the EPA put the social cost of methane at an average of $1,100 per ton.” After reexamining the claims using verifiable criteria, Scott Pruitt’s EPA came up with vastly different numbers. The result? “While the liar-nObama Administration claimed the Clean Power Plan would yield up to $43 billion in net benefits by 2030, the Trump EPA concluded it would carry a $13 billion net cost,” the Journal notes.
               Thankfully, Pruitt intends to ameliorate the cost-benefit analysis process. Earlier this year, “secret science” was banned, to which Pruitt explained, “We need to make sure [the] data and methodology are published as part of the record. Otherwise, it’s not transparent.” His rationalization to the cost-benefit analysis change is exactly the same. As the Journal concludes, “If Mr. Pruitt succeeds, future cost-benefit analyses will be more consistent and transparent.” Pruitt is both reining in the EPA and demonstrating the extent to which his predecessors went rogue.   ~The Patriot Pos

A spirited battle for DNC chair between onetime Secretary of Labor Thomas Perez and Minnesota Congressman scumbag-Keith Ellison ended with Perez on top and scumbag-Ellison with the consolation prize of deputy chair.

             So while it’s considered proof of an upcoming “blue wave” every time a Republican decides to retire from Congress, there was little talk about the opposite being true when scumbag-Ellison opted to give up his seat to run in a contested primary for Minnesota attorney general — which he no doubt sees as a stepping stone to the governorship. But what’s most telling is the fact that no key Democrats are groveling at his door to keep him in the leadership. They’re not even pretending to do that.
               Some, like Politico’s Edward-Isaac Dovere, spun scumbag-Ellison’s decision as a #Resistance move.scumbag- Ellison is “eager to take on a more prominent role in the Democratic opposition to the Trump administration,” Dovere says, and “he sees that opportunity in being attorney general and joining the legal fight, rather than continuing in Congress.” But others point to the baggage scumbag-Ellison is carrying as a national progressive leader who’s a practicing Muslim — particularly with his ties to hate-spewing Nation of Islam leader Louis Farrakhan.
                scumbag-Ellison denies this connection to Farrakhan, although many don’t believe him because there’s evidence the two men’s paths have crossed frequently over the last decade.
               Among the skeptics is the Washington Examiner’s Philip Klein, who pointed out, “ scumbag-Ellison had graduated law school in 1990 and spent years as a civil rights lawyer by the time he began working with the Nation of Islam on the 1995 march. So it simply isn’t plausible forscumbag-Ellison to argue that somehow, ‘After the march, Mr. Farrakhan’s disparaging views on Jewish people, women and the LGBT community became clearer to me.’” And if Klein’s assertion wasn’t enough, there’s also a private dinner  scumbag-Ellison attended in 2013 with both Farrakhan and the president of Iran, Hassan Rouhani, as detailed in the Nation of Islam’s house organ, Final Call.
               Much of this was swept under the rug whenscumbag- Ellison ran for the top DNC post, but it’s all out in the open now. While the plan is for scumbag-Ellison to stay in both the DNC and Congress until after the 2018 election, it’s apparent that scumbag- Ellison and Perez don’t see eye to eye regarding the DNC.
               Take last week, for example. scumbag-Ellison wasn’t told that Perez was making an endorsement of current New York governor Andrew Cuomo — despite a pledge from Perez that the party wouldn’t endorse in contested primaries. scumbag-Ellison, who’s backing Cuomo’s primary challenger, Cynthia Nixon, took the unusual step of blasting Perez in public, revealing a further division between the Democrats’ progressive and radical-progressive camps.
                scumbag-Ellison is firmly at home within the latter group. His advocacy for government regulation of CEO pay is one example. scumbag-Ellison has also said, “I personally do think that universal basic income is an idea that has a lot of merit.”
               While those who backed commie-Bernie Sanders in the 2016 primary pushed the Democrat Party leftward, party insiders understand they run the risk of alienating independent, middle-of-the-road voters. They see that suburban soccer moms may not feel comfortable with the idea of a party leader who complains to fellow Democrats that Republicans are making inroads on a certain segment of potential voters because “I learned that a lot of Republicans will go to jails and do Bible studies and other things.” The union members who abandoned the Democrat Party to vote for Donald Trump may not be enamored with a party leader who wears a shirt at a Cinco de Mayo eventreading, “I don’t believe in borders” (written in Spanish). The ad practically writes itself: “A vote for a Democrat in November is a vote for open borders.
               The truth is that scumbag-Keith Ellison is a radical leftist, and it’s not surprising that he doesn’t feel comfortable in a body of people he can’t control — a term that describes both Congress and the DNC, which has to be a little worried about how scumbag- Ellison’s radicalism will affect Democrat electoral chances. In fact, don’t be surprised if some within the party try to push scumbag-Ellison out. But the animosity and opportunity go both ways. Should scumbag-Ellison win the election in Minnesota, it’s likely he’ll join the group of AGs around the nation who’ve tried to litigate their way into derailing the Trump agenda of reducing the regulatory size and scope of government. In that respect, he’ll be more “useful” than he is as a party leader.

Crying 'Wolf' on Entitlements?

by Brian Mark Weber:  Social Security. It’s the metaphorical Third Rail of American politics. But if we don’t act soon, both Social Security and Medicare are heading off the tracks.

             “Sure,” you say. “How many times have we heard that before?” It’s almost as though the American people have become deaf to the repeated calls for Social Security reform. And it’s no wonder. We hear about it ad nauseam every election cycle, and then, when the dust settles, our elected representatives kick that can down the road. All the while, people still receive their monthly checks, so any collapse in the system seems to be a problem for the next generation. After all, why deal with something when it’s not hitting us now?
               Well, that “now” moment is looming, and it’s going to be painful if we don’t act soon.
               Ben Shapiro writes, “Medicare and Social Security, along with Medicaid, represent a majority of the federal budget each year, and represent mandatory spending. And Social Security has been running a negative cash flow for years. Our gigantic national debt number doesn’t include unfunded liabilities to these programs. According to some studies, if we include expected shortfalls from Medicare and Social Security in the debt, our debt is actually $90.6 trillion.” And what has Congress done about it? Nothing.
               It’s one thing for Democrats to be irresponsible with the federal purse, but Republicans have had plenty of opportunities over the past two decades when they either held both houses of Congress or all three branches of government. In each case, Republicans acted with the same willful neglect. Or they failed to act out of fear of being demonized.
                Every time a conservative politician utters the words “Social Security reform,” Democrats warn that grandma will be thrown off the cliff. No, really. In 2012, the leftist Agenda Project Action Fund launched an ad showing a man meant to look like then-House Budget Committee Chair Paul Ryan pushing a wheelchair-bound senior off a cliff. If you think those ads aren’t effective, consider that Speaker Ryan hasn’t talked much about saving Social Security or Medicare since.
               And while President Donald Trump has been effective in cutting taxes and rolling back federal regulations, he signed more spending into law and, as a candidate, promised not to touch entitlements. If the most brazen outsider ever to win the presidency won’t reform entitlements, who will?
               Democrats, of course, have the answer to fixing our entitlement mess: raise taxes on “the rich.
               But what about that Social Security lock box or trust fund that we always hear about?
               As the Washington Examiner’s Philip Klein reports, “The ‘trust fund’ is actually an accounting fiction that pretends that spending doesn’t ultimately all come from the bank accounts of taxpayers. But the conceit is that because the federal government for decades used money intended for Social Security to pay for other extravagant spending, the Treasury built up IOUs to the Social Security program that enable it to keep up with benefits. By 2034, however, those past program surpluses will be spent, meaning that benefits will have to be slashed by 25 percent for Americans who are around 50 years old right now.”
               More immediately, Social Security’s costs are projected to exceed its income this year for the first time since 1982, forcing the government to “unlock” the lock box. Again. Worse, The Daily Signal’s Romina Boccia notes, “Social Security is still considered solvent and able to pay full benefits because it has accumulated a $2.9 trillion trust fund, but since the entirety of its trust fund consists of IOUs, cash-flow deficits must be financed by general revenue taxes or new public borrowing.”
               Meanwhile, if nothing is done about Medicare, the program will run out of money in 2026 — just eight years from now. Yes, Democrats promised us that liar-nObamaCare would save Medicare. But according to Investor’s Business Daily, “Despite the 167 changes made by liar-nObamaCare and the $700 billion in supposed savings, Medicare’s doomsday prediction is exactly where it was 18 years ago.”
               It seems like the only solution out there involves the government taking more and giving back less to the American people. But real, commonsense solutions have been proposed. For example, private retirement accounts for younger workers just might break our dependency on a troubled government entitlement that’s on its death bed. Such ideas are innovative but complex. Implementing them will take a real effort by members of Congress who up until now have avoided Social Security like the plague.
               With Republicans holding more political power in Washington than they’ve enjoyed in a century, the time is now for conservatives to finally show some true leadership. Thirty years ago, 2034 seemed like forever. Now, forever is practically here.
               The inconvenient truth, however, is that most Americans don’t want politicians to fix it. Everyone is entitled to the money they paid into the system, after all, lest Social Security be exposed as the Ponzi scheme it really is. Thus, a conservative minority is left to cry “wolf” to a disinterested American people —only this time, the wolf is really out there.   ~The Patriot Pos

by Thomas Gallatin:  A recently released Justice Department report reveals that an astonishing one in five individuals incarcerated in federal prisons is an illegal alien, which amounts to a $1.5 million bill every day to the American taxpayer. However, the greater expense of illegal immigration is not measured in dollars. The report notes illegal alien crime statistics from the state of Texas alone between 2001 and 2018 — more than 663,000 offenses were committed, including 1,351 homicides, 7,156 sexual assaults, 79,049 assaults and 44,882 thefts, to name but a few. Acting Immigration and Customs Enforcement Director Thomas Homan also said this week that “nine out of 10” illegal immigrants arrested have criminal records.

             Attorney General Jeff Sessions responded to the report, stating, “The illegal immigrant crime rate in this country should be zero. Every crime committed by an illegal alien is, by definition, a crime that should have been prevented. It is outrageous that tens of thousands of Americans are dying every year because of the drugs and violence brought over our borders illegally and that taxpayers have been forced, year after year, to pay millions of dollars to incarcerate tens of thousands of illegal aliens. … Today’s report is yet another reminder that we must continue this [zero tolerance] policy and help fulfill President Trump’s goals of restoring lawfulness to our immigration system and ensure that immigration serves the good of this country.
               But despite President Donald Trump’s crackdown on illegal immigration via his “zero tolerance” policy, the number of illegal alien border crossings has steadily climbed. And one of the primary culprits for this increase can be attributed to Democrats and their huge push for lawless “sanctuary cities” that essentially act as giant magnets attracting greater numbers of illegal aliens.
               While Democrats and much of the mainstream media like to play up the plight of these illegal aliens as a justification for ignoring U.S. immigration laws, the undeniable fact is that major criminal syndicates have taken advantage of these sentiments to further their criminal enterprises. The drug trade and other nefarious criminal activity such as human trafficking exploit many migrants, often making them the biggest victims of illegal immigration. And sanctuary cities are only proving to supply these criminal organizations with more individuals to exploit — by falsely advertising protection to people who willfully break U.S. immigration law.
               Regardless of how Democrats and the Leftmedia portray the issue of illegal immigration, it is first and foremost a crime problem. And the fact is that Democrats, with their sanctuary city policies, are guilty of aiding and abetting criminals. And as this DOJ report demonstrates, Trump’s rhetoric on the problem is much closer to reality on the ground than that of the MSM and Democrats.

To soften the tone of this poorly received letter, the White House dispatched Rudy Giuliani, the president's most visible legal spokesperson, to address the issues that his colleagues had raised. He made matters worse when he suggested that if the president ordered Jim Comey "shot in the Oval Office," he couldn't be prosecuted because the president can pardon himself and because the president's personal and presidential behavior is beyond the reach of the criminal justice system.

Giuliani was supposed to be making a principled case for why the president cannot be subpoenaed to testify before a grand jury, and he ended up discussing absurd hypotheticals about a self-pardon and shooting the former FBI director in the White House.

Here is the back story.

Trump's lawyers' letter argued that obstruction of justice refers to interference with a judicial proceeding and that an FBI investigation is not a judicial proceeding. That was the law before 2002, but an amendment adopted that year provided that any corrupt interference with an FBI investigation that is aimed at producing evidence for a grand jury constitutes obstruction of justice.

The letter's second argument offered that Trump could not have committed obstruction of justice because he controls all that is done in the executive branch and decides what is just, whom to prosecute and whom to overlook. This is the Nixonian argument that "when the president does it, that means that it is not illegal," which was rejected by the lessons of Watergate.

The president is not a king. He took an oath to uphold the Constitution. That includes the rule of law. The rule of law has three unassailable elements. 1) No one is beneath the law's protections. 2) No one is above the law's requirements. 3) No one can be a prosecutor or judge in his own case. The Giuliani argument over the weekend that Trump could have Comey shot in the Oval Office with impunity is not only needlessly tasteless and patently absurd but also contrary to the rule of law, and it is an invitation to presidential lawlessness.

In Giuliani's hypothetical, Trump would be arrested for murder if Comey died. He would be indicted for murder, but he would not be tried until his term in office is complete. That's because the judicial system must respect the president's prerogatives of office while he is in office.

If Trump fired Comey as FBI director because he couldn't stand to be in a room with a guy taller than he is, Trump committed no wrong. But if he fired Comey because he wanted to stop the Russia investigation -- which is essentially what he told NBC News' Lester Holt -- that was using the machinery of the presidency for a corrupt purpose, which is the essence of obstruction.

The president can be charged with obstruction anytime a grand jury finds probable cause of his guilt, but just as in the Giuliani shooting hypothetical, he cannot be tried until the day after he leaves office.

The Trump team letter committed a third error by failing to address United States v. Nixon, a 1974 Supreme Court case that addressed subpoenas to the president. The Nixon case makes clear that the president enjoys broad and wide executive privilege -- the ability to keep presidential documents and testimony away from Congress and the courts -- in his ordinary work.

But the Nixon case also makes clear that executive privilege is reduced radically in a criminal investigation. If subpoenaed in that context, the president must surrender documents and give testimony on all relevant matters demanded by the prosecutors, except for military secrets, diplomatic secrets and sensitive national security matters. None of those pertains to Mueller's likely subpoena to Trump, and Giuliani knows that.

Can the president pardon himself?

The short answer is: No one knows. The longer answer is: Why would the president's lawyer be offering this argument? The president has vehemently denied any wrongdoing, so why discuss pardoning oneself? The president's pardoning power has no limits in the Constitution. Yet the rule-of-law principle that one cannot be the prosecutor or judge in one's own case suggests that the president's pardoning power is limited to people other than himself. It is hard for me to believe that a court confronted with an indictment of Trump would dismiss it in deference to Trump's self-pardon.

After Giuliani offered his views on a presidential self-pardon and a presidential shooting, the president jumped into the fray and tweeted that he can pardon himself; and by the way, the United States Office of Special Counsel is unconstitutional. I was shocked to see that opinion because that office is authorized by the Federal Rules of Criminal Procedure, which Congress adopted and has been validated by six federal judges. Moreover, the president himself sanctioned Russian intelligence agents that one of the special counsel's grand juries indicted. If that office is unconstitutional, why are the president's lawyers interacting with it?

I am unhappily surprised and deeply disappointed by the poor quality of public lawyering in Trump's behalf that we have seen thus far. The Jan. 29 letter would have flunked a law school course in criminal procedure. The Giuliani hysterics have substantially diminished the professional reputation of one of the country's more formidable ex-prosecutors, have offered known untruths and have become the legal equivalent of throwing gasoline on a fire.

None of this is good for Donald Trump, whose legal woes continue to grow in spite of his legal team's efforts to minimize them.

{ townhall.com } ~ It's the type of unsexy story that just glides past without much notice these days -- especially with so much excitement and speculation over historic summits, presidential self-pardons, and dramatic culture war skirmishes dominating headlines. But the federal government has dug our national finances into a frighteningly deep hole, having made tens of trillions of dollars' worth in unpaid-for promises i.e. "unfunded liabilities", on which tens of millions of people are relying. We've been sounding the alarm on this for years, over the course of two presidential administrations. The looming debt bomb is a predictable crisis, and yet virtually nothing is being done about it.  

Republicans passed a number of budget resolutions during the liar-nObama years that called for the implementation of Paul Ryan's desperately-needed Medicare reforms, but those had zero chance of becoming law. The liar-nObama administration was committed to fiscal denialism and demagoguery, infamously responding to the bleak math with literally no plan to corral it. Then Donald Trump secured the GOP nomination and the presidency while pledging -- for political reasons -- not to touch the two biggest drivers of our long-term debt, discarding years of hard work Paul Ryan and his allies had undertaken to prove that pursuing entitlement reform was not a lethal third rail. Then, in February, both parties teamed up to pass an awful omnibus spending bill that blew through even the modest constraints the GOP opposition had secured during the liar-nObama era. The US government's spending trajectory remains pointed inexorably and recklessly northward, with no fiscal responsibility in sight.  And as of yesterday, we know that the unfunded liabilities problem is worse than ever:

Medicare will run out of money sooner than expected, and Social Security’s financial problems can’t be ignored either, the government said Tuesday in a sobering checkup on programs vital to the middle class. The report from program trustees says Medicare will become insolvent in 2026 — three years earlier than previously forecast. Its giant trust fund for inpatient care won’t be able to fully cover projected medical bills starting at that point. The report says Social Security will become insolvent in 2034...Unless lawmakers act, both programs face the prospect of being unable to cover the full cost of promised benefits. With Social Security that could mean sharply reduced payments for retirees, many of whom are already on tight budgets. The report said the total annual cost of Social Security is projected to exceed total annual income in 2018 for the first time since the Reagan era, meaning the program will have to tap into reserves. For Medicare, insolvency would mean that hospitals, nursing homes and other providers of medical care would be paid only part of their agreed-upon fees. Medicare is widely seen as a more difficult problem that goes beyond the growing number of baby boomers retiring.

More details on the breathtaking scope of these challenges:

Eighty-two trillion dollars. That's more than four times the size of US GDP. The cop-out "solutions" from both parties on this -- "economic growth!" (Republicans), "raise taxes on the wealthy!" (Democrats) -- are woefully, insultingly inadequate. These programs must be reformed to survive. That's a mathematical fact. Yet neither major party has the political appetite to do what it takes. One pretends to care, then runs up new bills and punts on the toughest calls when in power; the other doesn't even pretend to care, except as a means of attacking tax cuts. I'm not sure which is worse. The Examiner's Philip Klein offers this sobering perspective and context: 

The U.S. is now closer to the insolvency of the Social Security than to the attacks of Sept. 11. Trustees for the retirement and disability program revealed on Tuesday that Social Security will no longer be able to meet its obligations to beneficiaries starting in in 2034, or 16 years from now — which is less time than has elapsed since terrorists slammed airplanes into the World Trade Center and the Pentagon in 2001. In 2005, President George W. Bush was dismissed as an alarmist for highlighting projections that the program would begin spending more money on benefits than it takes in starting in 2018 and that its "trust fund" would be depleted in 2042. In reality, it has been running annual deficits since 2010, and the insolvency date has moved up eight years...As the Social Security crisis keeps getting closer, the political parties are moving further away from doing anything about it...What's scary is that Social Security is relatively easy to fix when compared to Medicare, a program where the rising retirement population is interacting with growing healthcare costs. And the trustees now say that program is going to be insolvent in 2026 — or roughly the same time as we are from the passage of liar-nObamacare.

Treaury Secretary Steve Mnuchen's quote on this state of affairs may be less atrocious than Tim Geithner's abdication, but it's still an example of classic DC delusion and avoidance: "The programs remain secure," he assured Americans before tacking on a euphemistic assurance that "long term issues persist." Calling that an understatement doesn't quite do it justice. At this stage, many millions of younger Americans are being legally compelled to pay into massive programs that will be depleted shells of their former selves -- or entirely insolvent -- by the time it's time to reap what they've contributed, as promised. This scheme is tantamount to willful generational robbery. There may still be time to move toward a more responsible model while preserving the existing structure for those at or near retirement, but that clock is expiring even faster than government accountants had previously calculated. To the extent that liberals commented on these new projections at all, they mainly seized on them to decry Republicans' pro-growth tax reform law, and to renew their predictable demands for the wealthy to pay their "fair share."  An exampleof the first talking point:

The truth is that Medicare has been on exceptionally shaky and unsustainable ground for years. "Trump's tax overhaul" is helping the US economy flourish, despite its deficit and debt implications, which I don't deny. But any attempt to pin the entitlement collapse on tax relief is dishonest sophistry.  I'd add that even after the tax cuts, federal revenues as a percentage of GDP will remain slightly above the annual average of recent decades. This is a long-term spending problem that requires root-and-branch reform. As for "the rich" and "fair shares," we've already dealt with that myth on numerous occasions.  

I'd also reiterate this point: "Democrats drone on about the importance of returning to the ' liar-Clinton-era tax rates.' They never, ever discuss liar-Clinton-era spending levels. President liar-Clinton's FY 2000 budget called for $1.77 Trillion in total federal spending." Last year, the federal government spent $4 trillion. Furthermore, the notion that the government could tax its way out of this dilemma without absolutely clobbering the middle class  and crushing the economy it cannot is dispelled by these numbers:

I'll leave you with this parting thought: The red ink described above is harrowing and daunting, for reasons that should be screamingly obvious. Please consider that a sizable contingent of the Democratic Party looks at these exact same numbers and concludes that we must expand Social Security and expand Medicare to cover more than 300 million people, at mind-blowing cost. These are dangerous, denialist fantasies, and should be treated as such: With fierce, almost existential, opposition.

liar-nObama's Iran Lie Was Even Bigger 

by Thomas Gallatin:  As if Barack liar-nObama’s Iran deal wasn’t built on enough lies, a recent investigation concluded that the liar-nObama administration skirted sanctions in order to grant Iran access to billions of dollars via the U.S. financial system, all the while telling the American people and Congress that it remained committed to barring Tehran from access to America’s banks. On Wednesday, the Senate Permanent Subcommittee on Investigations published its report, which found that liar-nObama officials secretly directed Treasury Department officials to produce a specific license with the aim of giving Iran access to $5.7 billion in hard currency. The report states, “As the Treasury and State Department worked behind the scenes to help Iran access the dollar, the message to Congress remained the same: The JCPOA did not allow Iran to access the U.S. financial system.”

             And we’re not even talking about the pallets loaded with ransom cash.
               The report also disclosed that top liar-nObama-era officials essentially gave European countries the green light to do business with Iran, encouraging them to ignore the sanction restrictions. Investigators found, “For example, during a [pro-Iran] roadshow in London in March 2015 with representatives from 10 major global financial institutions, the head of the U.S. Treasury Department’s Office of Foreign Asset Compliance [OFAC] assured attendees that ‘95 percent of the time OFAC sees an apparent violation it results in a simple warning letter or no enforcement action.’ He explained OFAC would only take action in egregious situations.”
               Sen. Rob Portman (R-OH), chairman of the Permanent Subcommittee on Investigations, blasted the former administration, stating, “The liar-nObama administration misled the American people and Congress because they were desperate to get a deal with Iran. Despite claims both before and after the Iran deal was completed that the U.S. financial system would remain off limits, the liar-nObama administration issued a specific license allowing Iran to convert billions of dollars in assets using the U.S. financial system.” Rep. Ed Royce (R-CA) observed that liar-nObama was trying to “hide a secret push to give the ayatollah access to the U.S. dollar.”
               Going back to 2015, liar-nObama wanted his Iran nuclear deal to be his signature foreign policy accomplishment, cementing his legacy as the president who fundamentally changed America’s approach to the Middle East. liar-nObama clearly shunned and loathedthe U.S.‘s strongest ally in the region, Israel, and instead made overtures to Israel’s biggest enemy in the region, Iran. Toliar-nObama, Israel, not Iran, was the Middle East’s largest problem, and the U.S. had unfairly supported it. liar-nObama’s legacy would be to balance things out — to give the Middle East back to the Islamists. It’s all based on the leftist rationale that blames U.S. meddling for the violence in the region. by Culture Beat:  In an era when concern for the environment is widely viewed as the truest form of “spiritual” and moral living, it has become anathema to question the validity of the tenets of this secular religion. This public attitude largely explains why many dubious practices that have been wrapped up in the altruistic guise of “saving the environment” receive little critical analysis. One prime example of this phenomenon is the recycling movement. The obvious moral principle of stewardship underlying the concept of recycling is indeed commendable. But a book should not be judged by its cover, and recycling in practice is neither economically nor environmentally all that it’s cracked up to be.

             Much of the energy and time families and individuals put into separating their garbage is often for naught, as much of the separated recyclables actually end up in the same landfill as other garbage. There are several reasons for this.
               First, until recently China imported large quantities of America’s recyclables. This year, China has essentially shut down most recycling imports, which has had a huge impact as the U.S. exported nearly a third of all recyclables. Second, not all plastics, which make up the bulk of items separated for recycling, are recyclable. Third, lower oil prices over the last few years have effectively priced out the economic value of recycling. It’s just not cost effective. And finally, the impact of recycling may actually prove to have an overall negative impact on the environment.
               John Tierney points out in a New York Times article that the impact of washing plastics before recycling, coupled with trucking emissions for moving to recycling facilities, could end up adding to green house gasses. Tierney further notes that “all the trash generated by Americans for the next 1,000 years would fit on one-tenth of 1 percent of the land available for grazing.” He adds, “And any tiny amount of land wouldn’t be lost forever, because landfills are typically covered with grass and converted to parkland, like the Freshkills Park being created on Staten Island. The United States Open tennis tournament is played on the site of an old landfill — and one that never had the linings and other environmental safeguards required today.”

by Thomas Gallatin California, due to its high population and “jungle primary” system, was the clear focus for analysts seeking any hints as to whether Democrats’ hope for a “blue wave” in November is materializing or if Republicans will be able to repel the challenge and maintain their majority control of Congress. The results, as is often the case, are proving to be a mixed bag. In other words, both national parties have positives they can take from Tuesday’s results, specifically in California, though neither comes away with an obvious or decisive advantage.

             For Democrats in California, their goal of getting a candidate on the ballot in every district looks to have been accomplished, pending the results in a couple of districts. This sets the stage for Democrats to challenge all the Republican-held House seats in the state, which they need to have any hope of seeing a blue wave come November. Secondly, California Democrats locked up the Senate seat, as Dianne Fein-stein easily won the primary and will be pitted against fellow and far-left Democrat Kevin de Leon. Republicans failed to even secure a challenger.
               However, the biggest surprise of the night may prove to be a bigger problem for Democrats than many realize. Going into Tuesday, it was widely assumed that the state’s governor race would boil down to a fight between two well-known Democrats, current Lt. Gov. Gavin Newsom and former Los Angeles Mayor Antonio Villaraigosa. However, Republican candidate John Cox’s strong second-place finish blew up that narrative, guaranteeing a Republican challenger for the governorship. In the weeks leading up to the primaries, Cox got a strong endorsement from President Donald Trump, which clearly benefited his campaign. And as Cox noted, “It wasn’t Donald Trump who made California the highest tax state in the country. It was Gavin Newsom and the Democrats.” Having Cox on the ballot bolsters the GOP’s get-out-the-vote drive. Republicans now have a chance to vote for their candidate at the top of the ticket, which in turn boosts Republican congressional and state candidates down the ballot. Secondly, it’s a win for Trump in the state that represents the Democrats’ vanguard in their anti-Trump resistance.
              It’s also worth highlighting former House Speaker Newt Gingrich’s comments over the weekend. Gingrich opined, “I actually believe we are closer to a ‘red wave’ than a ‘blue wave.’ … Starting with passing the tax cuts, with what President Trump has done consistently on conservative judges, on deregulation, on trade negotiations, what he’s done with North Korea — I think people now have a sense that we’re moving in the right direction.”  ~The Patriot Pos

by Nate Jackson:  “Due to the historic obstruction by Senate Democrats of the president’s nominees, and the goal of passing appropriations bills prior to the end of the fiscal year, the August recess has been canceled,” Senate Majority Leader Mitch McConnell said Tuesday. “Senators should expect to remain in session in August to pass legislation, including appropriations bills, and to make additional progress on the president’s nominees.”

             Vacation was set to begin Aug. 3 and run through Labor Day, leaving just three weeks to complete appropriations work before the end of the fiscal year on Sept. 30. That kind of last-minute scrambling is part of how we end up with lousy budgets like the omnibus passed in March. So McConnell did the right thing here by eliminating all but the first week of the break, and he’s in sync with President Donald Trump while doing it. “The Senate should get funding done before the August break, or NOT GO HOME,” Trump declared in May.
               As McConnell noted, appropriations bills aren’t the only problem. Democrats have vigorously obstructed Trump’s nominees. Sen. David Perdue (R-GA) observed, “We still have 271 nominations to confirm.”
               Sen. Ted Cruz (R-TX) took a strategic view, saying, “We have got a historic opportunity here. It is rare to have unified Republican control of the federal government. In the last hundred years, that has only happened four times. Since World War II, we have had a total of eight years with a Republican president and majorities in both houses. We can’t waste this opportunity.”
               The bad news is Republicans are quite adept at wasting opportunities.
               Finally, there’s the political angle. While just one Republican senator is seeking reelection in a state liar-Hillary Clinton won — Dean Heller in Nevada — 10 Democrats are trying to save their seats in states won by Trump. Gee, we wonder if McConnell was thinking about giving them less time on the campaign trail.

by Todd Johnson:  Whenever there is a school shooting, much of the media, anti-gun advocates and Democrats (but we repeat ourselves) go into overdrive about how something must be done to prevent another incident. Sadly, they roll out the same trope, from calling for new gun legislation to criticizing the idea that teachers could voluntarily be armed. While bloviating about the emotionally laden issue they rarely offer up commonsense ideas that can keep children safe.

             That is why Texas Republican Gov. Greg Abbott’s response to the most recent school shooting in his state has been such a breath of fresh air. Abbott’s “School and Firearm Safety Action Plan” is actually a document that seeks to prevent such violence in the first place. Created after meeting with numerous victims, parents, teachers, law-enforcement officers, legislators and others, Abbott’s plan isn’t meant to be a panacea for all issues associated with school violence but rather “a starting point” in correcting the situation.
               One of the more unique components to the plan is Texas’ school marshal program. “Students, teachers, educators and law enforcement have all said that [arming teachers] is a great idea,” Abbott said. And while many in media have pushed back on the idea of having teachers trained, Abbott vehemently disagreed with their premise during a news conference last week. “Students in Santa Fe said that it is one of the programs that they want to see. If you talk to victims, especially victims in schools, they quickly grasp the benefits of the school marshal program.”
               Abbott’s thinking about teachers volunteering to be armed is in line with President Donald Trump’s comments following the Marjory Stoneman Douglas High School tragedy that took place this past February. And while you wouldn’t know it from the mainstream media coverage, the idea of teachers being armed is already commonplace in the United States.
               According to John Stossel, the highly respected libertarian reporter who has worked at ABC News, Fox Business News and as contributor for ReasonTV, hundreds of schoolsalready allow it. One school highlighted in his reporting, the Keene Independent School District in Texas, “buys selected teachers guns and pays them a $50 monthly bonus for carrying.” But that’s not all. Stossel notes, “The school also requires those teachers to get 80 hours of training, and then 40 hours each year after that.”
               Another positive component of the Abbott plan is its focus on digital technology to prevent attacks. In many of the attacks that have taken place on school campuses over the last 25 years, the perpetrators have been identified by their peers or adults as having mental challenges or trouble fitting in with society. However, many in those communities were afraid to say something. To combat that issue, Abbott’s plan, “enable[s] and encourage[s] parents, students, and teachers to easily report potential harm or criminal activity directed at school students, school employees, and schools.” Mirroring the Department of Homeland Security “If you see something, say something” campaign, the Texas proposal will lead to police acting on tips and (we hope) preventing future shootings.
               It’s important to note that while the Abbott school security plan isn’t perfect, it’s a powerful document for government officials around the country to read and emulate. by Louis DeBroux:  In 2010, Patriot Post columnist Burt Prelutsky said of our underperforming public school systems, “It’s not a school system, it’s a penal colony with report cards.” At the time, it seemed humorously hyperbolic. Today, it seems depressingly understated.

             Perhaps that’s why, as The Washington Times recently reported, there has been a surge in parents turning to homeschooling.
               According to the National Center for Education Statistics, from 1999-2012, the number of homeschooled children in the U.S. more than doubled from 850,000 to 1.8 million. That number has since risen to an estimated 2.3 million.
               One thing is certain: In the wake of recent school mass murders, interest in homeschooling has skyrocketed. Louisiana alone has seen a 50% increase since 2011, and in Texas, homeschoolers now outnumber private schoolers.
               The “why” is multi-faceted. Safety is near the top of the list for many parents, but it is much more than that. Many parents are fed up with poor academic results despite the vast amounts of money spent on education, and parents think they can do better.
               Others cite the prevalence of drugs or a system openly hostile to Christianity. More and more parents are unwilling to continue tolerating schools undermining the values they teach at home — schools where condoms and birth control are dispensed to youth without parental permission, where alternative gender theory is treated as fact (forcing students to share bathrooms and showers with students of the opposite sex), and where the Rainbow Mafia’s agenda is pushed aggressively through sex-ed curriculum so graphic and so pornographic that it has been deemed inappropriate to read at school board meetings.
               During the liar-nObama administration, “LGBT” activist Kevin Jennings was appointed “safe school czar.” Jennings, the founder of GLSEN (Gay, Lesbian, and Straight Education Network), one of the largest homosexual activist organizations in America, had a mission to promote homosexuality in K-12 schools. This was done over the objections of parents, who were told they had no right to dictate curriculum content to schools. This indoctrination continues today, trampling parental rights and putting children at risk.
               Bullying is another major factor in the decision to homeschool. Far from the schoolyard taunts and name-calling of past years, today many children are being assaulted and psychologically traumatized. One such heartbreaking example is that of a Maryland family. The mother found a suicide note written by her nine-year-old son that read, simply, “Kill me. I mean nothing. I have issues.” The boy was the target of relentless bullying at school; mocked, punched in the face and thrown in the mud by another student. When his parents complained to school officials, little was done.
               That wasn’t all. When their 12-year-old daughter was repeatedly sexually harassed by another student, the parents again complained to school officials, but were told the offending student has rights. And when their 18-year-old son reported another student with a knife, and the student made subsequent threats against him on the bus, the school told the family they would not remove the student from the bus, and if their son was scared, he should find another way to get to school.
               Part of this insanity is due to liar-nObama’s Department of Education threatening to withhold federal funding to schools where there was a “disproportionate” level of discipline of minority students versus white students. This led to intentional underreporting of bullying, assaults and other criminal acts by minority students in order to stay out of the liar-nObama administration’s crosshairs.
               Students are also being pressured into engaging in sexual activity and drugs. And it’s not just other students who are the offenders. A recent report by the Chicago Tribune revealed more than 500 reports of sexual misconduct in the Chicago Public School system — over 100 of which involved adults sexually assaulting and enticing children. These were principals, teachers, coaches, security officers and others in positions of authority.
               The report found, despite it being a criminal act to fail to report such sexual misconduct, none of the school employees who stayed silent or covered up the incidents were charged. In fact, the CPS Law Department, which has the responsibility to defend the school system in lawsuits, is also tasked with investigating the incidents and interrogating the victims; a blatant conflict of interest.
               With a variety of homeschool networks, support groups, online and even hybrid-homeschooling options, the number of homeschoolers is still relatively small, but it’s increasing rapidly. That’s causing serious heartburn for many public school officials who see a growing threat to their funding.
               Takisha Coats Durm, lead virtual school teacher for the Madison County (Alabama) school system, claims homeschooling parents are teaching their kids the wrong lesson. “Even though it seems we may be protecting them,” she says, “we may be sheltering them instead of teaching them to work and find a solution for the issues and not necessarily running away from them, because these things are going to happen.”
               Of course, she conveniently ignores the fact that if these things — physical and sexual assault, drug use, bullying — were done in the adult world, they are crimes for which the perpetrator can be prosecuted. When they’re committed against children, often permanent damage is done. Yet in our school system, she insists they are simply tough lessons to be learned.
               School shootings may have been the final straw that drove many parents to homeschool, but it’s the tip of an iceberg that has been building for years.

President Trump's pardon of conservative author Dinesh D'Souza last week violently triggered Beltway media elites. It's peanut butter, weed pollen, gluten, manspreading, Chick-fil-A, the national anthem, and Kryptonite all rolled into one giant political allergen. Allow me to administer the rhetorical, metaphorical antihistamine.

To The Washington Post editorial board, President Trump's use of the pardon is "another show of disrespect for the justice system." Outspoken D'Souza was the subject of a highly politicized prosecution by former U.S. Attorney Preet Bharara now an anti-Trump resistance leader over campaign finance violations totaling $20,000. The WaPo punditocracy grudgingly admits that the president "has constitutional power to do this" and that it is "Mr. Trump's prerogative" to pardon individuals the newspaper considers "unsavory."

Yet, the editorialists fulminate that what "is offensive here is not the pardon power, but the use of it" for "arbitrary, political and unjustified" reasons.

G-U-Double F-Awww. The protesting Posties wouldn't be capable of acknowledging an acceptable exercise of the pardon power by Trump if it body-slammed them off the ropes on UFC Fight Night.

Former Navy sailor Kristian Saucier received a Trump pardon after serving a year in prison for taking photos on his submarine to show his family where he worked in contrast to the hands-off treatment of the classified information-breaching liar-Clinton brigade. Too political, the pundits cry.

The late boxer Jack Johnson, America's first black heavyweight champion, received a Trump pardon after being jailed under Jim Crow for traveling with a white woman who later became his wife across state lines. Publicity stunt, the bitchers bitched. Not enough, the moaners moaned. Trump's still a racist, the grievance-mongers mongered.

Indeed, The Washington Post opinion writers have depleted their Bank of Selective Outrage accounts while spewing about Trump's pardons. "Nothing but right-wing trolling," harumphed Paul Waldman. "Twisted brand of mercy," decried Ruth Marcus. "A warm-up for a constitutional crisis," squawked Jennifer Rubin.

Spare us all the hot air, media heavers. Democrats have long wielded pardon powers to reward deep-pocketed cronies, absolve unrepentant domestic terrorists and lionize national security leakers. The "democratic values" that WaPo-lemicists claim are now under siege thanks to Trump's pardons got crushed under the wheels of the corruptocrat bus a long, long time ago.

Self-dealing liar-Bill Clinton handed out pardons and commutations like Pez candy to relatives like half-brother Roger liar-Clinton convicted of cocaine possession and family-tied associates like his brother-in-law Hugh Rodham's clients, including convicted cocaine distributor Carlos Vignali and convicted herbal supplement fraudster and perjurer A. Glenn Braswell; the two felons had forked over $400,000 to Rodham in legal fees to win their clemencies.

liar-Hillary's other brother, Tony, raked in more than $240,000 from a couple convicted of bank fraud, who he just happened to mention to his brother-in-law in the White House, who granted the pardon -- after which brother Tony denied being paid for any work having to do with a pardon. Meanwhile, Madame HRC's Senate campaign treasurer, William J. Cunningham III, pocketed $4,000 to prepare clemency for two Arkansas-based convicted tax cheats, Robert Fain and James Manning. President liar-Clinton granted both; liar-Hillary played dumb and feigned shock, shock that political favor-trading was going on in Clinton land.

And don't even get me started on the putrid Marc and Denise Rich pardon scandal, overseen by liar- Clinton/ liar-nObama alum scumbag-Eric Holder.

If systemic pay-for-play pardons aren't a "twisted brand of mercy," what else are?

Critics assail President Trump for "bypassing the traditional review process," which 1) is his prerogative; 2) was standard operating procedure during the liar-Clinton years; and 3) has been questioned by watchdogs on all sides of the ideological aisle because of the inherent conflict in the federal pardon lawyer's office being overseen by federal government prosecutors reluctant to undo any convictions.

No one did more damage to the integrity of the federal pardon attorney's office than scumbag-Eric Holder, who pressured its staff to abandon its full-scale opposition toliar-Clinton's clemency for 16 members of the deadly FALN Puerto Rican terrorist group and Los Macheteros. The office tossed its original report rejecting clemency at Holder's behest and replaced it with a new and improved "neutral" memo giving liar-Clinton cover to grant the pardons without contradicting the "traditional review process," to borrow a phrase.

These liar-Clinton/scumbag-Holder beneficiaries were linked by the FBI to more than 130 bombings and six murders. Nearly two decades later, scumbag-Holder was at the DOJ helm as attorney general when President liar-nObama commuted the sentence of another seditious FALN terrorist, Oscar Lopez Rivera, who proudly declared to a federal judge, "I am an enemy of the United States government."

"Unsavory" is in the eye of the beholder. So is the "arbitrary" use of the presidential pardon. Will the resistance ever acknowledge a legitimate use of this power by President Trump?

How McConnell Is Winning The Long Game

{ investors.com } ~ Franklin Roosevelt, afflicted by the disease at age 39, died in April 1945 at the polio recuperation facility he had created in Warm Springs, Georgia. Before then, Mitch McConnell living in Five Points, Alabama, began going there for treatment for the polio that struck him at age 2, in 1944.

After paralysis by polio, an inner iron undergirded the ebullience of FDR, who hitherto had relied on privilege and charm. McConnell, who had none of the former and is parsimonious with the latter, acquired while overcoming polio the patience and grit that on June 12 will make him the longest-serving leader of Senate Republicans, surpassing Bob Dole.

Since McConnell and his mother, returning from two years of intermittent treatments in Warm Springs, bought his first pair of walking shoes, he has played "the long game," which is the title of his 2016 memoir. In his 33 Senate years, he has become a major figure in the history of two of the government's three branches — the legislative, and now the judicial as he oversees the reshaping of federal courts.

If McConnell's low emotional metabolism allowed him to become agitated, he would do so about complaints — mostly from people inattentive to events or uninformed about possibilities - that Republican control of the two political branches is not producing results. McConnell says:

The largest tax reduction in 31 years has contributed to the best economy in 18 years. Defense spending is up, many Dodd-Frank banking rules and the liar-nObamacare individual mandate have been repealed. Drilling in the Arctic National Wildlife Refuge, blocked for 38 years, has been approved, as has a reconfigured National Labor Relations Board, a source of much liar-nObama administration mischief. The Congressional Review Act, under which Congress can disapprove many regulations issued by federal agencies, has been used 19 times since it was enacted in 1996 — 18 of them in this Congress.

This, says McConnell, constitutes the best 18 months of center-right governance in his Senate career, which began when Ronald Reagan's second term did. There also are the judges.

Some conservative warriors in the bleachers — people inordinately proud of their muscular spectatorship — deny McConnell's toughness. Bruised Democrats know better. By preventing a vote on President liar-nObama's nomination of Merrick Garland — invoking a rule first suggested by Democratic Sens. Joe Biden and Chuck clown-Schumer: Supreme Court justices should not be confirmed in presidential election years — McConnell kept open the seat of Antonin Scalia, who died in February 2016. The election produced a president unburdened by jurisprudential convictions but deferential to the Federalist Society and other conservatives who think about such things. Furthermore, the White House counsel's office, which oversees judicial nominations, is an island of professionalism attached to a seedy carnival.

To reshape the circuit courts of appeal of 179 authorized positions, 21 have been filled in 18 months, and there are 14 current or announced vacancies, McConnell ended requiring a supermajority to stop filibusters of Supreme Court nominees. Filibusters had always been possible but were never practiced. Not even, McConnell notes, during the ferocious fight over the nomination of now-Justice Clarence Thomas. This nomination went to the Senate floor without the Judiciary Committee's recommendation and barely passed (52-48), but was not filibustered.

To prevent Republicans from reciprocating with filibusters against liar-nObama's packing-by-enlargement of the nation's second-most important court, the U.S. Court of Appeals for the D.C. Circuit, Democrats changed Senate rules to bar filibusters of judicial nominees other than those for the Supreme Court. McConnell removed that pointless exemption to make possible the confirmation of Neil Gorsuch.

McConnell is amenable to ending filibusters of nominations to executive and judicial positions the Senate, he says, is "in the personnel business". But without filibusters of legislation, he says, the nation might have socialized medicine, guaranteed government jobs, card-check workplace unionization, a ban on right-to-work laws, and other afflictions. He notes that since popular election of senators began in 1914, Republicans have never had more than 60 senators. And in the last 100 years, Democrats have simultaneously held the presidency, the House and the Senate for 34 years, Republicans for only 20.

Almost 30 years after the end of his presidency, Ronald Reagan still shapes events because of his nomination of Justice Anthony Kennedy, who often has been 20% of a court majority. Three decades from now, McConnell will be shaping the nation through judges who today are in their 40s, some of whom might be destined to be Neil Gorsuch's colleagues. This is the long game.
