  • The President COMMISSIONS ALL FEDERAL JUDGES... all the President needs to do is to withdraw a judge;s Commission and have the US Marshall Service remove them from the Bench...  See article 2, section 3

Judges, like all commissioned officers of the Federal Government, receive their power to govern... by Presidential COMMISSION and are subject to the goodwill of the President. Their continued service is based on good behavior subject to Presidential review at any time.

  • Removal us one thing, but an impeachment conviction in the US Senate requires 67 votes.  It is not there.

  • A  Presidential Order or Warrant is all that is necessary to remove a Federal Judge for BAD CONDUCT...

The power to remove a sitting judge by executive power for BAD CONDUCT... is a LEGAL THEORY not tested to date... it needs to be used until the SCOTUS and Congress take steps to remove such power.

I ALL IT REQUIRES IS FOR THE PRESIDENT TO USE HIS CONSTITUTIONAL POWER AND EXECUTIVE AUTHORITY TO ORDER A BAD JUDGE REMOVED... FOR BAD CONDUCT

Trump needs to REVOKE the appointment of any Federal Judge exercising his office during BAD CONDUCT... The President's authority to unilaterally remove a BAD Judge is based on his Constitutional power under the EXECUTIVE, 'TAKE CARE,  APPOINTMENT, AND BAD BHAVOR' clauses..of the US Constitution.

Impeachment is not the only way to remove a sitting Federal judge... Article 3, Section 1 declares: "The judicial Power of the United States, shall…
  • THIS ISSUE HAS TO BE SETTELED, THE SUPREME COURT CANT DUCK AND DODGE THIS ISSUE.WHERE DOES THE AUTHORITY OF THESE POLITICALLY APPOINTED JUDGES END? WHATS NEXT WILL THEY BE STICKING THEIR NOSE INTO DOMESTIC AND FOREIGN POLICY? IF THEY ARE RUNNING THE COUNTRY THEN ITS POINTLESS TO ELECT A PRESIDENT. TE HIGHER COURTS MUST SETTLE THIS OR THE TRUMP ADMINISTRATION MUST MAKE AN EXAMPLE OUT OF THEM.

    • Doesn't that assume the courts are the highest position in the land? It's like giving the prisoners the keys to the jail. It plays right into their false assumptions of supremacy. THAT is the issue. Constitutionally, as the Col.wrote, they are appointed and thus, can have that appointment removed, ended, annulled. They are subject to their appointments and they are bound under the Constitution and they are limited to 'Good behaviour.' They seem to think they were given the keys to the kingdom and are unbound to anything. They are not. They are out of order.

    • Agree Freddie! Impeachment means nothing as we have seen through decades, they keep their job and continue on as if nothing happened. They have to be disbarred so they can never sit in a courtroom again, unless they are the defendants!

    • Freddie...

Impeachment is only one way to remove a sitting Federal judge... Article 3, Section 1 declares:

"The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. The Judges, both of the supreme and inferior Courts, shall hold their Offices during good Behaviour, and shall, at stated Times, receive for their Services, a Compensation, which shall not be diminished during their Continuance in Office."

Judges whose BEHAVIOUR is bad may be immediately removed via 'Executive Order' or Warrant... The President's power to appoint includes the power to revoke (terminate) his appointments.  See Article 2, Section 2, Clause 2 the APPOINTMENTS CLAUSE:  The power to appoint by inference includes the power to end  His appointments.

Therefore, let the President use his  Executive Order Powers to remove his Article 2, JUDICIAL APPOINTMENTS for BAD BEHAVIOR.  The President has the additional Constitutional authority under Articles 2, Section 3  to TAKE CARE the laws be faithfully executed. Removing Judges for Bad Conduct is part of the President's Constitutional DUTY... to police BAD CONDUCT in the Judiciary...thus, faithfully executing the law.

  • Of course they can be impeached. POTUS is the only one elected by the whole country. Congress elected within a district. Judges appointed, which means they can be removed.

    • ...and removed they must be! Impeachment means NOTHING! They have to be gone!

    • Agreed... Appointments and commissions are unelected offices... subject to the Presidents direct removal... at his will.
