Article 1, Section 8, clause 17 forbids the federal government from holding title to any land not consented to by the State legislature... The Constitution further restricts the Federal Government from holding title to ANY LAND except that used for "...erection of Forts, Magazines, Arsenals, dock-yards, and other useful buildings..".
This Constitutional restriction on the Federal Government's holding land... was specifically targeted by our founders to KEEP THE FEDERAL GOVERNMENT FROM STATE PROPERTY... Our founders had witnessed King George use his powers to seize large sections of land in the colonies for his cronies and English interests. They provided Article 1, Section 8, Clause 17 to KEEP THE FEDERAL GOVERNMENT FROM THE UNCONSTITUTIONAL TAKING of private and state lands.
Article I Section 8 Enumerated Powers

P/S When are the states going to hold the Federal Government to our Constitution? This taking of Idaho lands is illegal... unconstitutional.. Let Idaho seize the wind farms and use them for their benefit... Inform California that the Federal Government gave them land, not theirs, and in violation of the US Constitution.
Until we hold all parties in the US accountable to the US Constitution... look for this sort of abuse to continue... under the color of law.

More proof that the Federal Government is completely out of control! The States must take back the powers and authorities which are Constitutionally theirs and do it with haste. If we forced the Federal Government back into performing ONLY its Constitutional duties, the Federal Budget would balance immediately!
