“Whatever you sow, you shall reap!” That’s a big ‘yikes’ for CBS, as it appears they are going to reap a big whirlwind! The $10 billion lawsuit filed by Donald Trump, which CBS recently attempted to dismiss, highlights a fundamental truth: "Payback Is A Bitch."
In October, Donald Trump initiated legal action under Texas' Deceptive Trade Practices Act (DTPA), claiming CBS manipulated Harris' responses to portray her as "coherent and decisive" in a segment of "60 Minutes." The final broadcast modified the segment that initially hinted at a fragmented and unclear response regarding U.S.-Israel relations, leading to accusations of media manipulation. The legal representatives for Trump contended the alterations deceived countless viewers, including him, as "consumers" of CBS's broadcasting services.
CBS promptly submitted a motion to dismiss the case, citing the First Amendment to uphold its editorial choices. The network's legal team presented a comprehensive 33-page brief asserting that Trump's allegations do not meet the rigorous standards set forth by Rule 9(b), applicable to DTPA claims. They rejected the lawsuit as an effort to expand consumer protection laws into the area of editorial judgment—a perilous precedent, as noted by CBS, for the freedom of the press.
The controversy highlights a recurring ploy among progressive groups to demonize those who won’t obey their agenda. Media outlets and those with opposing views frequently engage in harsh criticisms—whether through sharp remarks or curated stories—against individuals who dare to question their beliefs. However, when these strategies fail or encounter legal obstacles, the common defense typically relies on the principles of free speech or claims of excessive actions by their adversaries. However, it appears that they have gone beyond a First Amendment defense in this case.
In this instance, detractors contend that CBS’s careless editing of Harris’ interview exemplifies the bias they profess to oppose in others. The Trump campaign emphasized how CBS polished Harris' unclear statements regarding Israel, a matter of significant geopolitical relevance, to fabricate a misleading portrayal of capability. CBS’s unwillingness to engage with the core issues at hand, along with its legal approach to dismiss the case entirely, reinforces the belief in a double standard.
The First Amendment protects free speech; it does not shield individuals from criticism or legal examination when media practices spin deception. Regardless of its outcome, the lawsuit underscores the growing skepticism between the public and mainstream media outlets, particularly among individuals who perceive unjust targeting or misrepresentation.
As CBS aims to dismiss the lawsuit, the court's ruling will carry consequences that extend beyond just those directly involved. For those who hold traditional values, this is an opportunity to confront what they see as a sick and hostile media environment. For those on the left, it’s a challenge to see if their claims of supporting press freedom can withstand accusations of dishonesty.
Final Word: If you share my dissatisfaction with the poisonous content of the Lame-Stream media, you will be relieved to know Trump and several others not only strike back but also deliver a severe legal beating in the process!
