      The oath has been allowed to devolve to a percieved ceremonial gesture, like executive authority in the President of the Senate.

      Otherwise, felony convictions would surely be in order. Then again, given the Clinton, Obama, and Biden cartels factual evidence of systematic criminal activity NOT acted upon by the DOJ, or the FBI, should this be a surprise?

    • The CCA is designed to limit its authority to apprehend and prosecute communist agents who cross the line and engage in sedition and treason.  The Act is very specific as to the types of actions that become unlawful and form the basis for arrest, prosecution, and conviction.  The act allows non-subversive peaceful dissident protests ...it doesn't allow communist groups to lawfully partipat in the government or society as they are innately subversive and traitorous.

    • Thanks to both you and RikMik for the historical framework. I now sense why for the Founders terseness regarding universal required alliegance to the sitting government. A patriot's rightful protest is easily potrayed as a government insurrection (Gee, do you think that applies to this web page? LOL). 

      Now mandated alliegance to Constitutional due-process ought to be loudly outlined. IMHO

    • With all due respect, you are mistaken... the Communist Control Act of 1954 made it illegal to be a member of the Communist Party and any of its associated groups... The ACT is still on the books and all it takes is for teh President and DOJ to enforce it... the Supreme Court Has not ruled on its constitutional authority albeit many liberal lawyers consider it unconstitutional. This act has never been repealed and as far as I know never formally adjudicated as unconstitutional... enforce it.

    • Although I do not consider wikipedia to be a trustworthy source of information, it has been confirmed through reliable, official US government sources (other than wikipedia) that the federal district court(s) ruled some provisions of the 1954 law to be unconstitutional shortly after it was enacted. The text of the law had been roundly and extensively criticized and condemned since it was of questional constitutionality when adopted, neither provided for enforcement nor penalties but simply referred to the Internal Security Act of 1950 and stated in pertinent part that "Therefore, the Communist Party should be outlawed." The Internal Security Act of 1950 had subsequently been ruled to be unconstitutional by the SCOTUS and has since been repealed. The Communist Control Act of 1954 is meaningless without the provisions of that act which preceded it and to which it refers. You are correct that it is the "law of the land" but it has been consigned to the dustbin of legal history as an unenforceable, unconstitutional and essentially useless piece of legislation. The devil is ALWAYS in the details.

    • We should be very careful with that since that is precisely what the British Crown did when the colonists declared independence from that government. Many of the early settlers in the colonies felt that government to be "duly-constituted" and the signers of the Declaration of Independence and their supporters had essentially signed their own death warrants for treason against the Crown. And all they wanted was the freedom of life, liberty and the pursuit of happiness in their property and possessions without undue government interference or duress. Sound familiar?

        The above is the official government record on the status of the CCA... it has not been repealed... all of the notes on 50 U.S.C. 781 apply to it not the CCA... the problem with researching acts is that Congress often amends and inculcates language from similar bills into one another and when repealed one must be careful not to mistakenly apply the repeal of an amendment to a sister bill as repealing the fundamental or original bills' language or authority as current law.

        The ACLU and othere agents of the Marxit have done everything they can to muddy the water... but the official underlying CCA remains valid... and it has its enforcement section with fines and imprisonment penalties for failure to comply.

    • As I had previously pointed out, the CCA of 1954 relies upon 50 U.S.C. 781 for its enforcement and penalty provisions and it has been repealed. Here are the citations and notes which reference the Internal Security Act of 1950 and its relationship to the CCA. I'm just trying to be accurate and helpful here since the devil is ALWAYS in researching the details, and no offense intended.

    • I would favor Constitutional language that forbids political enfranchisement of any kind of organization that advocates for the overthrow of duly-constituted government.

      So long as the participation and foundational goals are harmonious with Constitutionality, how could a complaint or rejection be formulated?
