Last week, a federal judge said the FBI must hand over records about a letter from 2021 called parents "domestic terrorists."
When the National School Boards Association asked for help, the agency said the parents who were protesting things like critical race theory were real threats.
After the memorandum was made public on Oct. 3, 2021, there was backlash against Attorney General Merrick Garland's plan to investigate the parents with a task group made up of the FBI, U.S. attorneys' offices, and local law enforcement.
After a few days, the government watchdog group Protect the Public's Trust used the Freedom of Information Act to ask the Department of Justice for all papers and letters about the task force.
Judge Trevor McFadden of the U.S. District Court for the District of Columbia wrote in a new order the DOJ was taking too long to answer the FOIA request.
McFadden said the FBI didn't show the request was unreasonable and gave "scant evidence for summary judgment." He then denied the agency's two motions to have the case thrown out or decided in its favor.
Even though the NSBA has since apologized for the message and taken it back, Garland has kept defending it. During a hearing in 2021, he told the House Judiciary Committee, "True threats of violence are not protected by the First Amendment."
Garland said, "We are not looking into peaceful protests or parent participation in school board meetings." " has never been done before, and we would never do it. We are only worried about violence and threats of violence against school officials, teachers, and staff."
