I believe Smith is not pressing the issue because he knows he is on "thin ice"; he was NOT "constitutionally" (legally) made "Special Counsel" and if the GOP brings that issue to SCOTUS, Smith will be OUT the door!! All is quiet at the moment.

There is only one problem with the Supreme Court's ruling. Biden is still in the White House and he can do basically whatever he wants to do including torpedo the election as long as he acts in his capacity as president. There won't be a thing we can do about it. This ruling came a few months too early in my opinion.
