Since biteme has not been charged with anything, as of now and he probably will not be charged with anything before he leaves office, there is nothing for him to pardon. It is my understanding that a pardon must be issued listing the specific crime, or crimes that are being pardoned in order for said pardon to be legal.
You are correct, however, if Joe gives a blanket pardon to individual(s) then that throws the issue into the hands of the SCOTUS. Then they will decide the limitations to the 'Blanket Pardon' which could affect the 23-939 Trump v. United States. Also that SCOTUS decision could take months, meanwhile the Pardoned individuals relying on their 'pardon' can slip out of the country to parts unknown. This could be a constitutional disaster in the making.
Trump needs to IGNORE the unconstitutional pardon(s) ... detain those indicted, as FLIGHT RISKS, and proceed with legal due process while the Courts decide the issue on Biden's Pardon(s).
If upwards of 600 ordinary citizens can be held without 'BAIL OR DUE PROCESS'... for alleged insurrection and misdemeanors... There should be no legal argument that justifies government agents being free while on trial for capital crimes and serious felonies.
Indeed yes, court action (reaction) does take time,; usually too much time. So, if said "pardoned subjects" DO anticipate losing in court and make a run for "parts unknown" - - they would probably pick a foreign country with no extradition agreement with US, making the escapee "ubtouchable". If that becomes reality, then I would hope the Trump Administrations' DOJ would have the escapees' US citizenship rescinded and exile the offenders "for life" - - NEVER allowing them to return to US soil.
