The Constitution of the United States of America is the only law that Congress and the President cannot change. This legitimizes the Constitution as being the supreme law of the land. Every other law can be repealed or changed by the Congress any time they choose.
There are a number of mandates in the Constitution other than the amendments, and these can be used to combat this governments usurpations of our liberty.
We hear people in the news mentioned that members of Congress have sworn an oath to uphold the Constitution. The oath is actually a mandate. In article 6 the third paragraph it states that members of Congress; and the state legislatures; and all executive and judicial officers; both of the United States and the states; shall be bound by their oath or affirmation to support this Constitution. Let's examine how important this is to us. We all know that Congress swears an oath but perhaps some of you did not know that the state legislatures are also bound by their oath to support the Constitution. And all Executive officers for example the President, the states Governors and the Mayors of our cities and towns are also bound by their oath to support this Constitution. Contrary to the media's claims that the states are the experimental grounds when it comes to the Constitution, the state and city governments must support it too. This means that all the people we elect to represent us have to support this Constitution as a condition of accepting the office. Violating a constitutional mandated oath of office should be an impeachable offense.
When you allow a government to pick and choose who gets a tax loophole and who doesn't, you are asking for a corrupt government. When we allow a government to pick and choose who gets a subsidy and who doesn't, you are asking for a corrupt government. This is exactly the situation we're in today with this unconstitutional tax code. It might surprise you to know that in the enumerated power that gives Congress the power to tax there exist a mandate that states all taxes shall be uniform throughout the United States. This mandate means that Congress cannot pass a tax loophole unless every person can use it. They cannot give anyone or any business a subsidy unless everyone gets it too. Funny isn't it! The Supreme Court said that the health care law was constitutional based on congresses authority to tax. Yet the court ignored the mandate in the same enumerated power that makes all subsidies in that law unconstitutional. This is a violation of their oath of office as a judge to rule against this mandate in the Constitution. And these judges should be impeached.
Another mandate exists in article 4 section 4 of the Constitution. And it states the United States shall guarantee to every state in the union a Republican form of government. The founding fathers in the Federalist papers describe a Republican form of government as being the society itself divided in many different classes of citizens with different interest and religious beliefs where no majority class can be achieved.
Another very important mandate in article 2 section 4 has to do with the power of impeachment. And it states; the President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors. The meaning is clear, that the members of Congress, must remove anyone in government from office that violates the law. This brings us to some troubling situations that are going on in our government today. We have attorneys generals committing perjury before Congress under oath, a crime. Failing to turn over documents subpoenaed by oversight committees is obstruction of justice, a crime. Redacting documents they do turn over, claiming national security or personal information would be disclosed, when this is actually tampering with evidence, a crime. The IRS doing the same failing to turn over documents subpoenaed by oversight committees and using redaction to most likely cover-up their crimes. Violating the law which requires them to keep these documents, another crime. Even though the Constitution mandates that members of Congress and the Senate must impeach anyone involved, they do not. Isn't this breach of fiduciary duty by these Senators and representatives, another crime. WOW!!!
There are many more examples which could be brought up where our government is violating our constitutional rights.
