By Michael Swartz: Our federal government has spent nearly a half-century fighting a "War on Drugs" with varying levels of success. One tactic introduced early on was the seizing of assets of those who were demonstrated to have acquired them through illegal means. Over the years, government at all levels has managed to make it even easier to secure billions of dollars of alleged profits from an illegal industry — the drug trade.
Yet while the fight against drugs has shifted over the years, from the marijuana and hallucinogens of the late 1960s, to the crack and cocaine of the 1980s, to a more recent surge in methamphetamines, the current opioid epidemic is different. It doesn't necessarily affect the same younger, lower-class peer group as the previous drugs of choice did, nor does it have the same sort of distribution system as other narcotics. But the federal government continues to utilize asset forfeiture as a tactic, despite long-standing abuse of the process and past attempts to both document it and rein it in.
Loopholes in the current system allow for local law enforcement to partner with the federal government to assure that both get a nice piece of the action. This money has, in turn, allowed local investment in assets like drug-sniffing dogs, new police cars and equipment, and other paramilitary gear that police departments claim assists them in getting drugs off the streets. And seizure is politically popular, since people assume that only criminals are having their assets seized and therefore deserve it.
It's no surprise, then, that yet another government review — the latest was put out this week by the Inspector General's Office at the Department of Justice — delivers a scathing look at a practice that, by this estimate, raked in $28 billion of assets over the last 10 years. That's a big revenue stream, and thus the real answer for why the practice continues to expand.
The IG's 74-page review notes that the vast majority of these funds come from the efforts of the Drug Enforcement Administration (DEA). Yet, according to the report, out of 100 asset forfeiture cases selected for further review by the Inspector General's office, "the DEA could verify that only 44 of the 100 seizures, and only 29 of the 85 interdiction seizures, had (1) advanced or been related to ongoing investigations, (2) resulted in the initiation of new investigations, (3) led to arrests, or (4) led to prosecutions. When seizure and administrative forfeitures do not ultimately advance an investigation or prosecution, law enforcement creates the appearance, and risks the reality, that it is more interested in seizing and forfeiting cash than advancing an investigation or prosecution." In other words, the majority of those who had their assets seized were, essentially, found guilty without due process.
And it's the perception of "policing for profit" that civil libertarians have seized on in trumpeting the report.
"This report only further confirms what we have been saying all along," added Institute for Justice attorney Darpana Sheth. "Forfeiture laws create perverse financial incentives to seize property without judicial oversight and violate due process." Sheth added that the "only solution" to the issue would be to end the use of asset forfeiture entirely. The Institute has long been an advocate against the practice, with their second (and most recent) report on "Policing for Profit" released in 2015.
Ending civil asset forfeiture, however, would leave law enforcement with a fiscal hole to fill — in some jurisdictions, a massive one. No one wants to call for a tax increase, and seizures act as easy money: once assets are seized, there is about an 80% chance that no recovery will be sought by the owner, and even the majority of those efforts are unsuccessful. Others might simply consider it the price of doing business or may be embarrassed by how those assets obtained.
But the Constitution's Fourth Amendment prohibits illegal search and seizure for a reason, and it stands just as clearly now as it did when the Bill of Rights was first adopted 226 years ago. Carrying a large sum of cash is not illegal, and there are many who do so for legitimate reasons. (The same goes for certain cash transactions, although the IRS has begged to differ on that subject.)
Shaking down innocent people for cash would be called extortion if a criminal did it, so why should it be legitimate for governments to do the same? It's indeed time to end this plunder once and for all. ~The Patriot Post

We will repeal and replace liar-nObamacare and give the American people the world class health care they deserve.” Just in case the meaning of the word repeal has gotten lost in all of the retreating and calls to compromise with the establishment status quo representatives like Reince Priebus and Paul Ryan, repeal is defined as: “the action of revoking or annulling a law or congressional act.” It doesn’t say anything about converting it to a lite or watered down version of its former self. Rep Louie Gohmert, a Freedom Caucus member, joins the host for a discussion of the situation. This glorification of Palestinian prisoners, many of whom are behind bars for murdering Jews, was issued last week by Fayez Abu Aitah, a senior representative of President Mahmoud Abbas's ruling Fatah faction. Abu Aitah's words of appreciation for murderers of Jews came during a visit he paid to Hatem al-Maghari, a Palestinian Authority (PA) policeman who was released last week after serving 17 years in prison for his role in the lynching of two Israeli reserve soldiers who mistakenly entered Ramallah. Upon his arrival at his home in the town of Rafah in the southern Gaza Strip, Al-Maghari received a hero's welcome. Hundreds of Palestinians have since converged on his home to congratulate him on his release from prison and heap praise him on for his "contribution" to the Palestinian cause. Yesterday there was a report by Bill Still that it was Muslim black supremacist and former DHS Secretary Jeh Johnson. Today comes a report by Mike Cernovich that it is Susan Rice. Both of them cannot be right, meaning the sources of one were more accurate than the other. Whether or not Still and his unnamed source were correct on this particular aspect of the Johnson crimes against the United States, he laid out a great case for locking him up and throwing away the key in general in addition to the potential unmasking and espionage crimes. The Cernovich story was not published by Bloomberg, or the New York Times, who had first access to it, he says, in the interest of protecting liar-nObama. He names his source, who identified Rice as the perpetrator, as the White House Counsel’s office. He says that the White House counsel’s office determined it was Rice after examining her document log requests. Each person must sign for every document that is viewed, leaving a paper trail that led back to Rice. The has not been reported by any of the mainstream propaganda outlets, but was also reported by the Gateway Pundit. Cernovich revealed that, upon learning of what Rice had done, NSA H. R. In a typical political non-answer answer, McConnell says, “Well, look, Judge Gorsuch deserves to be confirmed. When the truth comes out and it explodes in the Democrats’ soft, girlish hands, we’ll all be laughing and toasting their humiliation with Stoli shots.
How do I know this with utter certainty? Because it's all so glaringly obvious, and it’s the only scenario that fits the facts. As Hugh Hewitt says, this scandal has three silos. The first silo is the question of whether the Russians somehow “hacked our election.” The second silo is whether any Trump people “colluded” with the Russians. The third silo, the one patriots care most about since it’s the one that isn’t a ridiculous fantasy, is whether anyone in liar-nObama's administration used our intelligence apparatus to spy on his and liar-Hillary’s political opponents. The answers are “No,” “No,” and “Yes.” The end results are going to be a stronger Trump, weaker Democrats, and various liar-nObama minions exploring new career opportunities in the exciting fields of license plate-making, large-to-small rock transformation, and artisanal pruno distilling.
Russians didn’t hack the election. Liberals use the word “hacked” because they can claim they only mean “influenced” while implying to stupid people inclined to believe their conspiracy theories that the Russians broke into computers and changed votes from liar-Hillary to Donald. Of course, they forgot to also change the Senate votes to the Dems, but whatev.
Even James Comey agrees that never happened, so now the Democrats are claiming that Russian social media bots used fake news to trick the previously liar-Hillary-inclined electorate into voting against her. Basically, they’re saying liar-Hillary’s supporters were easily duped idiots. Now, dummies have always been a key Democrat demographic. She clearly has a unique appeal to the stupid, the gullible, and the readily confused, making the voters she was counting on especially vulnerable to those cunning Russian clickbaiters operating from secret Macedonian villages.

Remember that when the media gets angry about the emails, the reason is that you got accurate information about the media’s partisan pals that the media wanted hidden from you. Every single one. And the NSA has algorithms they can use to search it. You don’t go plant a bug in Trump Tower. You wiretap the opposition party’s nominee for president by running a search through the communications that the government “incidentally” collected. And if you find something juicy, then you call up your buddy at the Post and hand it over.
If. Does anyone here think for a millisecond that the liar-nObama-appointed leadership in the intelligence community, whose loyalty is to their own political class and not to the country, would hesitate for a microsecond before leaking something they thought would hurt Trump? We know they wouldn’t hesitate because they didn't hesitate – they feloniously released a classified transcript involving Mike Flynn just to shaft him and the Administration. Flynn did not do anything illegal in that illegally released transcript; he misled the Veep about the topics he (legally and properly) discussed, and for that he got canned. So why is his lawyer demanding immunity? Because his lawyer isn’t a drooling moron working rear-ender soft tissue cases out of a van down by the river; no quarter-competent lawyer is going to let his client walk into a Democrat witch hunt without either ironclad immunity or the words “I take the Fifth” on his lips – you know, just like all of liar-Hillary’s people did.
The only crime we know about for sure – the only one – is that some senior member of liar-nObama’s intelligence community committed a felony by leaking classified information regarding Mike Flynn's intercepted communications. That's it. And that’s why the Democrats would rather talk about anything else. Understand that everything the Democrats say is a lie. Every single word, plus the punctuation. They’re dumb, but they're not so stupid as not to realize that this Putin nonsense, manufactured as a pathetic excuse for their utter humiliation in November, is falling apart. With the help of their media minions, they hope if they keep shouting “Look, Russians!” we’ll grow so bored we’ll just tune out. It’s their only hope for keeping liar-nObama’s buddies off the chopping block. And maybe Lena Dunham will get put on the cover of the next Sports Illustrated swimsuit edition.

They’re dumb, but they're not so stupid as not to realize that this Putin nonsense, manufactured as a pathetic excuse for their utter humiliation in November, is falling apart. With the help of their media minions, they hope if they keep shouting “Look, Russians!” we’ll grow so bored we’ll just tune out. It’s their only hope for keeping liar-nObama’s buddies off the chopping block. They all thought liar-Hillary was going to win and that there would be no accountability, so they were safe using the government systems they had been entrusted to manage to spy on their incoming boss’s political opponents. Oops.
Look, I have friends who think differently, and I’ve carefully considered their views because some are serious people. They really believe that there is something out there. Maybe I'm wrong. Maybe it was Russian-inspired clickbait stories on Facebook that magically converted hundreds of thousands of dedicated “I’m with her” liar-Hillary fans in the Rust Belt into #MAGA hat-wearing Trumpmaniacs. Maybe liberal Washington D.C. establishment types had the honor and patriotism required to keep a juicy tidbit like Trump playing footsie with the Russians under wraps for better than half a year. And maybe Lena Dunham will get put on the cover of the next Sports Illustrated swimsuit edition.
