Machine Has Finally Come to An End

{activistpost.com} ~ Philadelphia may be the birthplace of our Constitution, but its civil asset forfeiture program is anything but constitutional... The program has become so corrupt and far-reaching it is often referred to as a “perverse machine.” Luckily, after a four-year legal battle brought by the nonprofit law firm the Institute for Justice (IJ), the city has agreed to a settlement that will give its abusive forfeiture program a major overhaul and protect the rights of Philadelphia property owners. In Philadelphia alone, 25,000 people have been victimized by the practice of asset forfeiture. Property confiscated by law enforcement includes 1,200 homes, 3,500 vehicles, and $50 million from residents. And the majority of these property owners were never actually convicted of a crime. But now, due to the diligent efforts of IJ, many of these individuals will finally see justice served. Darpana Sheth, a senior attorney at IJ and director of its Initiative to End Forfeiture Abuse, commented: For too long, Philadelphia treated its citizens like ATMs, ensnaring thousands of people in a system designed to strip people of their property and their rights. After two-month manhunt, IDF finds 

and kills terrorist who killed two in Barkan

{timesofisrael.com} ~ After a two-month manhunt, Israeli forces found and killed a Palestinian man suspected of carrying out a brutal terror attack... in which he shot dead two Israeli coworkers in a West Bank factory, the Shin Bet security service said early Thursday. According to the Israel Defense Forces, the suspect opened fire at the Israeli security officers who came to arrest him. The troops shot back, killing him.On October 7, Ashraf Na’alowa, 23, allegedly killed his coworkers Kim Levengrond Yehezkel and Ziv Hajbi at a factory where all three worked in the Barkan Industrial Zone. Another Israeli woman was also injured in the attack. According to the Shin Bet, Na’alowa appeared to be planning to conduct a second terror attack, “which was prevented with the thwarting of the assailant.” The security service said when the troops arrived he shot toward them with the same Carlo-style submachine gun used in the Barkan attack...

OMG! California Wants To Tax Text Messages (SMH)

California will tax anything, and to prove it they are looking at taxing text messages... to help pay for cell phone service for poor folks. The California Public Utilities Commission (CPUC) is looking to vote on the proposal as early as late December, but until then the wireless industry is working hard to defeat the proposed tax a copy of the tax proposal document is embedded below. “It’s a dumb idea,” said Jim Wunderman, president of the Bay Area Council business-sponsored advocacy group. “This is how conversations take place in this day and age, and it’s almost like saying there should be a tax on the conversations we have.”It’s unclear how many individual consumers would be asked to pay their wireless carrier for texting services under the proposal. But it likely would be billed as a flat surcharge per customer — one of those irksome fees at the bottom of your wireless bill — not a fee per text. Business groups, including the Bay Area Council, California Chamber of Commerce and Silicon Valley Leadership Group and others opposing the idea, calculated the new charges for wireless consumers could total about $44.5 million a year. Another Bloated Farm Bill

by Nate Jackson:  The Republican record over the last two years includes a few big wins — tax cuts and court nominations are among the best. It also includes some major failures, such as scumbag/liar-nObamaCare repeal and now the latest farm bill. Earlier this year, we pointed out how bad the farm bill was. It’s gotten worse. Nevertheless, the Senate passed it 87-13, and it now heads to the House.

             For reasons known only to members of Congress, the farm bill is where food stamps are allocated, and that welfare roll takes up 80% of the bill’s dollars. Despite an economic boom spurred in large part by GOP tax cuts, some 40 million Americans still receive food stamps. That’s double the number from 20 years ago, and, while it’s fallen a bit from the Barack scumbag/liar-nObama highs, it hasn’t fallen enough. Yet many Republicans seemingly have no interest in real reform, even as the specter of Democrats taking over the House in January looms.
               With employers desperate for Americans to fill a near-record seven million job openings, there has hardly been a better time to stiffen work requirements for food stamps and truly reform the program. But breaking the cycle of dependence is hard — both for able-bodied adults who’d rather get a government check for nothing and for the politicians who want their votes. Thanks to the Senate, this farm bill is extremely light on those work requirements and makes virtually no effort to shrink the welfare rolls.
               Food stamps aren’t the only problem, however. The farm bill is also larded up with income redistribution that benefits mainly wealthy corporate farmers. A 2017 Congressional Research Service report found that “farms with market revenue equal to or greater than $250,000 accounted for 12 percent of farm households, but received 60 percent of federal farm program payments.” Meanwhile, the smallest 80% of farms account for just 10% of the subsidies.
               And you don’t even have to be a farmer to qualify. National Review notes, “For example, despite efforts to close a loophole that allows family members of farmers to receive subsidies even if they do not live or work on a farm, the final version of the bill expands that loophole to allow distant relatives such as cousins, nieces, and nephews to qualify for subsidies. That subsidy is worth up to $125,000 a year, about twice 2017’s national median household income.” All you have to do is claim “management” responsibility in the proper paper work, and you too can cash in. Subsidies are politically helpful, however, in part because President Donald Trump’s tariffs have been so painful for farmers.
               If anything typifies the swamp, it’s big spending legislation like the farm bill. And, for now at least, it’s business as usual.

Stephanie Agli Gallagher is a treasonous corrupt United States Magistrate Judge in the District of Maryland.

Judge Gallagher unlawfully issued a search warrant that allowed the FBI to raid the home of a patriotic whistleblower who had already turned over documents regarding the Clinton Foundation and Uranium One. The raid was an “outrageous disregard” of whistleblower protections.

The whistleblower, Dennis "Nate" Nathan Cain, had previously turned the documents over to the Department of Justice’s inspector general and both the House and Senate Intelligence committees.

The Whistleblower Protection Act of 1989, 5 U.S.C. 2302(b)(8)-(9), Pub.L. 101-12 as amended, is a United States federal law that protects federal whistleblowers who work for the government and report the possible existence of an activity constituting a violation of law, rules, or regulations, or mismanagement, gross waste of funds, abuse of authority or a substantial and specific danger to public health and safety. A federal agency violates the Whistleblower Protection Act if agency authorities take (or threaten to take) retaliatory personnel action against any employee or applicant because of disclosure of information by that employee or applicant.

Nevertheless, Judge Gallagher unlawfully collaborated with the FBI to illegally raid and rummage through Cain’s home for six hours, even after knowing the whistleblower had already turned over the documents in full compliance with the law.

Prior to her appointment as a United States Magistrate Judge on the District of Maryland in 2011, Stephanie Gallagher was a partner and co-founder of Levin & Gallagher, LLC, where she practiced white-collar defense litigation. In other words, she defended white-collar criminals - by definition is crime referring to financially motivated, nonviolent crime committed by business and government professionals.

Taking the above into account, it's not hard to see who's bed she still sleeps in. Especially nowadays when it's overly apparent that no bad deed goes unrewarded within the United States Government. This is sadly another example of that, for the traitor Stephanie Agli Gallagher is currently a nominee in becoming a United States District Judge of the United States District Court for the District of Maryland.

Not Violate Campaign Finance Laws

{dailycaller.com} ~ Former FEC Commissioner Hans Von Spakovsky debunked the argument that President Donald Trump broke campaign finance laws... by paying women he allegedly had affairs with prior to becoming president. The president’s former lawyer, Michael Cohen, was sentenced to three years in jail on Wednesday for a litany of crimes, including making an illegal campaign contribution amounting to $130,000 to Stormy Daniels, who alleges she slept with Trump in 2006, so she would keep quiet about the affair. Despite the guilty plea, Spakovsky said that Trump should not be worried because it would have to be a “campaign-related expense” for the contribution break any campaign finance laws. He also pointed out that the only other time the Justice Department tried to say payments like these were campaign-related expenses was with John Edwards. Donations to Edwards’ campaign actually went to paying his mistress, a woman who worked for the campaign and ended up having his child. A jury, however, ruled that Edwards’ donations were not a campaign-related expense...

Sentencing Just Dropped A Major Bombshell

{thefederalist.com} ~ On Tuesday, attorneys for Michael Flynn filed a sentencing memorandum and letters of support for the former Army lieutenant general in federal court... The sentencing memorandum reveals for the first time concrete evidence that the FBI created multiple 302 interview summaries of Flynn’s questioning by now-former FBI agent Peter Strzok and a second unnamed agent, reported to be FBI Special Agent Joe Pientka. Further revelations may be forthcoming soon following an order entered late yesterday by presiding judge Emmet Sullivan, directing the special counsel’s office to file with the court any 302s or memorandum relevant to Flynn’s interview. Flynn, who served briefly as President Donald Trump’s national security advisor, pleaded guilty more than a year ago to making false statements to federal investigators during a January 24, 2017 interview. During that interview, Strzok and presumably Pientka questioned Flynn about a telephone conversation the Trump advisor had with Russian ambassador Sergey Kislyak. While Flynn’s sentencing memorandum methodically laid out the case for a low-level sentence of one-year probation, footnote 23 dropped a bomb, revealing that the agents’ 302 summary of his interview was dated August 22, 2017. This hearing is particularly timely because Mexico has a new president, Andrés Manuel López Obrador, who assumed power on December 1st with a clear mandate to fight corruption but whose thoughts of subduing narcoviolence with an “amnesty” and antipoverty programs are not reassuring.  For the last 20 years, the percentage of cocaine entering the United States transiting Mexico has never dipped below 90 percent—sustaining a public health and criminal justice crisis that has a $200 billion annual impact on US society. The Mexican people see the problem another way: The demand for cocaine, heroin, and other drugs by US consumers sustains criminal groups that have attacked the rule of law, weakened institutions, and caused terror and death since the “war on drugs” began 50 years ago. We must face this threat as partners. The United States could not begin to stop illicit drug trafficking without Mexico’s help. And, Mexico would pay a very dear price if it gave way to criminals who do much more damage than traffic drugs northward. Worse yet, if the rule of law in Mexico were any weaker than it is today, the negative impact on economic growth and social stability would be felt in both countries. We share robust trade, financial and commercial ties, integrated supply chains, and cultural ties. The border is where we are joined, not divided. Over one million legal border crossings between the two countries occur each day, while $1 million worth of trade takes place each minute between the US and Mexico...

Suspected Terrorist Leading 

Migrant Group Demanding Entry Into US

{dailycaller.com} ~ A suspect in a 1987 bombing that wounded six American soldiers in Honduras is leading a group of migrants... demanding entry into the United States. Alfonso Guerrero Ulloa organized a march of approximately 100 migrants to the U.S. Consulate in Tijuana, Mexico, on Tuesday, The San Diego Union-Tribune reported. Ulloa delivered a letter to the consulate on behalf of the migrants, asking for either entry into the U.S. or a payment of $50,000 per person. “It may seem like a lot of money to you,” Ulloa told the Union-Tribune. “But it is a small sum compared to everything the United States has stolen from Honduras.” Ulloa has lived in Mexico since 1987 after fleeing Honduras in the wake of a bombing that wounded six soldiers. Ulloa was suspected of planting a bomb in a Chinese restaurant, but received asylum from Mexico, whose government described the suspected terrorist as a “freedom fighter.”...

He was an avowed Islamist, who pledged to do all in his power to subjugate the world, and everyone in it, under Islam, by any means necessary. As an able propagandist, Awlaki became a valuable recruiter for terror groups. By any objective measure, the man was an enemy of his own nation. Awlaki was a fiery Islamic preacher. His words were unreservedly anti-American. They inflamed Islamic passions. Awlaki wielded words as weapons. He met his demise in 2011, on the receiving end of an American drone strike in Yemen ordered by then-president Barack scumbag/liar-nObama. That strike also killed Awlaki's American-born 16-year-old son. While there were a few bleats and squawks from various civil libertarians on the left and right over the assassination of not one, but two American citizens without due process of law, the issue grew stale quickly as the media sensed that their favorite son (scumbag/liar-nObama) might be harmed politically with further reporting.  Fast-forward to the present day, and while keeping the circumstances of Awlaki's death in the forefront of your mind, ask yourself why so many on both sides of the aisle are now exercised over Saudi Arabia allegedly doing the exact same thing to a Saudi national, Jamal Khashoggi, a Saudi national guilty of every crime and a few more! for which Awlaki paid with his life...

The Oval Office Wall Brawl

by Nate Jackson:  “It’s like a manhood thing for him,” incoming House Speaker Nancy Pelosi said of President Donald Trump and the border wall. “As if manhood could ever be associated with him. I was trying to be the mom. I can’t explain it to you. It was so wild. It goes to show you: You get into a tinkle contest with a skunk, you get tinkle all over you.” Pulosi’s schoolyard taunts were in response to a testy Oval Office meeting with the president, Vice President Mike Pence, and Senate Minority Leader Chuck scumbag/clown-Schumer. Before we dissect that meeting, however, just imagine for a moment if Trump had insulted Pulosi’s womanhood…

             The meeting was televised, and it was certainly quintessential reality TV — a genre in which the president thrives. To mix metaphors, it was also a New Yorker-style rhetorical brawl, and Trump holds his own in those too.
               Trump was savvy to bring in the TV cameras. “It’s called transparency,” he explained when Pulosi complained and asked that they be removed. Trump wanted the American people to see that he and his party are serious about border security, while Democrats would rather fling the door open wide for millions of illegals.
               Trump wants $5 billion for the border wall, which the House gave him earlier this year. Senate Democrats were willing to give only $1.6 billion; now they’re apparently pulling back to $1.3 billion, and none of that is even for an actual wall. Yet Pulosi had the gall to insist they were negotiating “in good faith.” We’d hate to see bad faith.
               scumbag/clown-Schumer blamed Trump for any coming shutdown, even though, as Trump repeatedly noted, it is 10 Senate Democrats who are the roadblock to a compromise. Nevertheless, unlike most Republicans who are afraid of their own shadows, Trump owned it. “I am proud to shut down the government for border security, scumbag/clown-Chuck,” he declared. “People in this country don’t want criminals and people that have lots of problems and drugs pouring into our country. I will take the mantle. I will be the one to shut it down. I won’t blame you for it.”
               Once upon a time, Democrats like scumbag/clown-Schumer and Pulosi, as well as scumbag/liar-Bill and scumbag/liar-Hillary Clinton and Barack scumbag/liar-nObama, thought building a wall along the southern border was the responsible thing to do for a sane immigration policy. In the last few years, however, Democrats have done a 180, and Pulosi now calls the wall “immoral.” Demo Party leaders shamelessly exploit immigrants and their children for political gain, while Trump and his supporters actually want to solve the problem of illegal immigration.
               As the White House email “1600 Daily” put it, “The Democrats’ priority is clear: They would rather keep the U.S. border open to illegal immigrants than keep the Government open to serve American citizens.” Of course, it remains to be seen if either side sticks with their ultimatums, or if this was just partisan showmanship for the cameras.

There was actual news this week (versus the constant din of media churn) regarding the special counsel investigation into what originally was supposed to focus on Russian efforts to influence the 2016 election.

Of course, that mandate immediately turned into an unlimited investigation into all manner of ostensible wrongdoing regarding Donald Trump and his campaign associates, including an investigation into whether Trump’s campaign colluded with Russia to influence the 2016 election. That diversion was prompted by a fake dossier funded by Hillary Clinton’s campaign.

Clinton and former FBI Director James Comey, whose “higher loyalty” was, first and foremost, to Clinton, set the fabrication into motion.

That “collusion” diversion has not turned up anything of substance thus far, so the investigation has now diverted to the question of how then-candidate Trump used his own money to settle some extortion demands associated with past lurid associations — and if so, whether these payments violated campaign-finance law.

What follows is a breakdown of the key developments, but first, an observation on the hypocrisy regarding foreign influence in our electoral process, as well as perjury. At the same time Democrat Party principals are feigning concern about foreign influence of our elections, they are advocating for open borders, pandering to their Hispanic constituents in an effort to change the demographics by flooding voter rolls with “new” constituents. And Democrats are now concerned about perjury after defending Bill Clinton’s lies as president about his sexual assaults?

Never let it be said that Democrats allow abject hypocrisy to get in the way of their political agenda.

The Mueller Investigation

To date, the only known connection Robert Mueller and his team of Clintonistas have made between the 2016 election and Russia was included in his indictment of a handful of Russian hackers last July. But that meddling started a year before Donald Trump announced his candidacy, and the hackers’ objective was to foment discord and to undermine American confidence in our electoral system, not to support Trump.

Arguably, after Trump’s upset election, Democrat Party hysterics, bolstered by the accompanying Leftmedia histrionics and the epidemic of leftist Trump Derangement Syndrome, have done far more to undermine electoral confidence than Russia could ever have hoped to achieve.

Of course, those Russians will never see the inside of a U.S. courtroom. As former federal prosecutor Andrew McCarthy notes, “There are 144 million more people in Russia who will never see the inside of an American courtroom. If Mueller indicts all of them, his stats will be really impressive … and there’ll still be no Trump espionage conspiracy against the election.”

Additionally, he has accumulated some “process crimes,” most notably perjury charges related to the testimony of George Papadopoulos, Michael Flynn, Paul Manafort, and Michael Cohen. However, there is nothing that remotely establishes Russian collusion with the Trump campaign. Nothing.

However, the office of the U.S. attorney for the Southern District of New York, in collusion with the Mueller investigation, filed a sentencing memo regarding its grand jury probe into Cohen, Trump’s former personal attorney. The memo noted “Cohen’s extensive, deliberate, and serious criminal conduct,” but asked that he “receive credit for his assistance” to Mueller’s investigation. It added, “Cohen does not have a cooperation agreement … and therefore is not properly described as a ‘cooperating witness’.”

Today, Cohen was sentenced to 36 months in prison after pleading guilty to eight criminal charges, including violations of campaign-finance law. His “cooperation” is no doubt connected to his role in paying off two women extorting then-candidate Trump.

It’s notable that Cohen lied about the timeline of a deal with Russia to build a Trump Tower in Moscow, an ongoing negotiation that was completely legal and that was dropped when the two parties were not able to reach a deal. But Trump did not lie.

All told, over the course of Trump’s 18-month campaign, 14 people associated with Trump had contacts of some sort with Russians. Frankly, given all of Trump’s international business dealings, I’m surprised that number isn’t much higher.

Other than the interminable Mueller investigation, thus far the only related investigation was conducted by Department of Justice Inspector General Michael Horowitz, and his team concluded that former CIA Director John Brennan colluded with Comey and other deep-state operatives to provide cover for Clinton.

(Sidebar: Beyond the fact that Comey seeded the Justice Department’s appointment of Mueller and lied about leaking the fake dossier report that ensured it would happen, Mueller’s constitutional authority is questionable given that the special prosecutor and independent counsel provisions of the Ethics in Government Act of 1978 expired in 1999.)

Campaign-Finance Violations

Unable to discover any shred of evidence that the Trump campaign colluded with Russians to throw the 2016 election in his favor, Mueller is now focused on a possible campaign-finance violation associated with extortion payments to silence two alleged Trump affairs that took place long before he was a candidate. There was nothing illegal about the payments, which were from Trump and not his campaign, but the complaint is that they constituted undisclosed campaign contributions.

Democrats are gleefully hoping that felony charges will emerge from the aforementioned charges filed by the U.S. attorney for the Southern District of New York against Cohen, which he billed to Trump.

Charges can be filed if undisclosed payments constitute a campaign contribution, even though a candidate may donate unlimited funds to his or her own campaign.

(Note that Trump’s private payments should not be confused with the public taxpayer-funded payments of the congressional slush fund used to silence sexual harassment complaints made against members of Congress.)

Regarding this Mueller angle against Trump, Harvard Law Professor Alan Dershowitz, a noted Democrat, offered this observation about the payoffs:

It is absolutely textbook extortion. There ought to be a prosecution of any person — man or woman — who approaches any candidate and says, “Unless you pay me money, I’m going to reveal a sex act that occurred.” That is absolute classic extortion. It is shocking that the special counsel — who has a broad mandate — isn’t looking into the extortion. … It’s clear that [Trump and Cohen] were paying off extortion in order to prevent these issues from coming out for multiple reasons: to protect his family, to protect his brand and the campaign. Let’s remember one more thing: The president can contribute to a candidate as much as he wants. As far as reporting is concerned, it is the campaign that has to report [these contributions]. So if [Trump’s] payments had to be reported, they had to be reported after the election. The reporting time was after the election — so it could not have impacted the election. So the absurd notion that he won the presidency by fraud and should be stripped of the presidency reflects incredible ignorance about the timing here and how these statutes operate.

Dershowitz concluded, “We need a single standard. If you would not go after Bill Clinton, don’t go after Donald Trump. If you are going after Donald Trump, then you have to go after Hillary Clinton. … This is such a danger to the constitutional system that I would hope that true civil libertarians would rebel against it, as I am.”

As political analyst Hans von Spakovsky notes regarding the charges filed by the U.S. attorney in New York: “His theory that anything intended to ‘influence’ an election is a campaign-related expense fails to take into account the statutory limitation on this definition. FECA (52 U.S.C. 30114 (b)(2) specifically says that campaign-related expenses do not include any expenditures ‘used to fulfill any commitment, obligation, or expense of a person that would exist irrespective of the candidate’s election campaign.’ Given Trump’s celebrity status, the potential liability to these women existed ‘irrespective of the candidate’s election campaign.’”

And how do the Trump payments compare with actual illegal campaign contributions in recent years?

According to Andrew McCarthy, “Barack Obama’s 2008 presidential campaign was guilty of violations involving nearly $2 million — an amount that dwarfs the $280,000 in Cohen’s case. The Obama Justice Department decided not to prosecute. Instead, the matter was quietly disposed of by a $375,000 fine by the Federal Election Commission.”

Recall, too, that the Justice Department failed to convict former North Carolina Sen. John Edwards after he funneled actual campaign dollars — more than $1 million — to his mistress, Rielle Hunter.

In one election, Senate Minority Leader Chuck Schumer (D-NY) took in more than $1 million in revenue and had more than $6 million in expenses that he failed to report. He paid a $138,000 fine.

Of course, Bill Clinton had multiple accusations of rape and sexual assault, and in the Paula Jones case he paid $850,000 to “settle” that matter.

If Democrats are really concerned about campaign-finance violations, let’s put a price on the biggest of those violations — the Leftmedia’s support for Democrat candidates, which is equivalent to billions of dollars in free campaign advertising. Fake news is priceless.

So is this all Mueller and his Democrat team of hatchet men have against Trump after two years of investigation — a question about whether an extortion payoff constituted a campaign contribution, which may provide a pathway to indicting Trump after he leaves office?

We’re not sure, because we’re still waiting on the substance of his report — someday. Regardless, the prospect of campaign-finance violations is sufficient to fuel the Democrats’ relentless hounding of Trump over the next two years, as it fits with their “stolen election” narrative and is fodder for faux impeachment charges.

On James Comey’s Testimony

Related to the Mueller investigation, disgraced former FBI Director James Comey was back in front of Congress testifying about what he no longer can recall. In his testimony last week, Comey was chastised for claiming not to know or recall key facts related to what he admitted was a fake dossier purporting to show Trump’s collusion with Russians. That phony dossier was then used as the basis for a FISA warrant to spy on the Trump campaign, and then, after Trump’s shocking electoral victory, it was used to help launch the special counsel’s investigation.

According to House Judiciary Committee Chairman Bob Goodlatte (R-VA), “The biggest takeaway is that former FBI Director James Comey, with regard to the two most important investigations … into the Clinton email matter and into the Russia collusion matter, said, ‘I don’t recall,’ ‘I don’t remember,’ or ‘I don’t know’ 245 times.”

Let that sink in.

Typical of Comey’s abject obfuscation was this interaction with House Oversight Committee Chairman Trey Gowdy (R-SC):

Gowdy: Do you recall who drafted the FBI’s initiation document for that late July 2016 Russia investigation?

Comey: I do not.

Gowdy: Would you disagree that it was Peter Strzok?

Comey: I don’t know one way or the other.

Gowdy: Do you know who approved that draft of an initial plan for the Russia investigation in late July 2016?

Comey: I don’t.

During his testimony, Rep. Sheila Jackson Lee (D-TX) asked Comey, “Is there any need to further investigate Hillary Clinton’s emails based upon the decision that you made not to prosecute?” He replied, “Not that I can possibly see. There’s no serious person who thinks there’s a prosecutable case there. And so, not that can I see.”

That notwithstanding, Comey’s testimony raises the prospect that Hillary Clinton may finally face charges for using a private email server to keep her official communications as Obama’s secretary of state off the grid. She did so to ensure her communications would not be subject to public scrutiny during her then-planned 2016 presidential bid.

Clinton’s unmitigated ethical abuses, including her Benghazi cover-up to protect Obama’s reelection in 2012 and “pay-to-play” donations to the Clinton Foundation when she was serving as secretary of state, are about to be back on the table for possible prosecution.

Accelerating that possibility was last week’s finding by U.S. District Court Judge Royce Lamberth that Clinton’s private email server constituted “one of the gravest modern offenses to government transparency.” Likewise, Lamberth slammed Justice and State: “At worst, career employees in the State and Justice departments colluded to scuttle public scrutiny of Clinton, skirt FOIA, and hoodwink this court.”

However, what I believe was most consequential from Comey’s testimony is the emergence again of Clinton’s Russian Fusion Collusion — the dossier and FISA court warrant.

Mueller should be investigating the genuine 2016 election collusion between Clinton, Comey, and the Russians, which had the objective of setting Trump up for a take down in the event he was elected.

Seems to be working thus far.

Impeaching Trump

As we’ve noted many times, the entire Russia investigation was conceived to keep Trump on the ropes and on the defensive as president in an effort to block his agenda.

Democrats are hoping that this underwhelming campaign-finance charge will be their golden ticket to impeaching Trump. California Democrat Adam Schiff, incoming chairman of the House Intelligence Committee, declared, “[Trump] may be the first president in quite some time to face the real prospect of jail time.” New York Demo Rep. Jerry Nadler, the incoming chairman of the House Judiciary Committee, added, “The president was at the center of a massive fraud, several massive frauds against the American people. It’s now our job … to get to the bottom of this … so we can hold him accountable.”

So far, Democrats have been unable to stop the Trump administration’s extraordinary achievements, so they’re converting their “hate Trump,” anti-peace-and-prosperity platform into an “impeach Trump” charade to rally their constituencies ahead of the 2020 election.

In the meantime, the Democrat-controlled House will, under Nancy Pelosi’s thumb, attempt to inflict “death by a thousand cuts” to keep Trump from further success.

{washingtonexaminer.com} ~ With Democrats seizing the House and Republicans keeping the Senate, bills beyond the proverbial post-office-naming will be hard-pressed to make it out of both chambers in the next Congress... The threat President Trump faces from Democrats, then, isn’t legislative obstruction, but the ready-aim-fire of the opposition’s “subpoena cannon.” That’s the term one senior Democratic source used last month in describing to Axios the opposition’s main anti-Trump weapon. Not all of the investigatory weapon’s payload will be fired at once, but the appetite for “resistance” is strong and will tie up significant White House and agency resources. Full disclosure: My wife is a lawyer in the House general counsel’s office, but hasn’t participated in any discussions regarding the Democrats’ plans. In and of itself, there’s nothing wrong with spending time on congressional oversight. Indeed it’s a salutary check, flowing from the “legislative powers” that Article I grants Congress. The Framers assumed Congress would follow the lead of the British House of Commons in questioning executive action. James Wilson, a delegate to the Constitutional Convention and future Supreme Court justice, had written that members of parliament were considered “grand inquisitors of the realm. The proudest ministers of the proudest monarchs have trembled at their censures.” Accordingly, George Mason argued at the Convention that members of Congress “must meet frequently to inspect the Conduct of the public offices.” When the first Congress convened in 1789, the House established a select committee to investigate the country’s accounts during the American Revolution, to clear Robert Morris, the superintendent of finances. In 1792, the House authorized a special committee to investigate the military defeat of General Arthur St. Clair. President George Washington ultimately agreed on rules of disclosure that formed the early basis of what we now know as “executive privilege.”...

Republicans introduce new version of end-of-year 

tax bill with an eye toward speedy passage

{washingtonexaminer.com} ~ House Republicans have gone back to the drawing board on end-of-year tax legislation... On Monday morning they introduced new legislative text to reform retirement savings, delay scumbag/liar-nObamacare-related taxes, and provide technical corrections to the tax overhaul law they passed last year. If enacted, the bill would also provide tax benefits for communities that have suffered through natural disasters, including last month’s wildfires in California.Much of the legislation, tucked into a separate but unrelated bill to clear its potential path to becoming law, resembles a similar bill introduced by House Ways and Means Committee Chairman Kevin Brady R-Texas, two weeks ago. But gone are extensions of tax benefits for various industries, ranging from horse racing to NASCAR to clean energy, as well as text that would call for reform to the Internal Revenue Service. Senate Democrats balked at the tax bill when it was introduced last month. Republicans need several Democrats to support the bill in order to meet the 60 vote threshold to advance legislation and avoid a filibuster in the Senate.

Double Take on the Fifth Amendment

by Robin Smith:  A Supreme Court case is getting a great deal of attention in part because it would be contrary to 170 years of precedent and practice. But more attention-getting, it may have an impact upon dirty cop-Robert Mueller’s case involving Paul Manafort in the vastly overreaching special investigation to determine the extent of Russian interference in the 2016 election.

             Oral arguments were heard Thursday in Gamble v U.S. The case involves an Alabama man who was arrested in 2015 for crimes that involved the illegal possession of a handgun. Terrence Gamble, a felon who had already served time in prison for a separate crime, faced both state and federal charges for this second failure to observe laws. The State of Alabama sentenced Gamble to one year in prison while an additional federal charge yielded a 46-month sentence on top of that. Gamble appealed this second sentence to the Eleventh Circuit Court, citing the Fifth Amendment.
               The relevant text states, “nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb.” Known more often for “pleading the Fifth” to avoid self-incrimination, the amendment, ratified with the original 10 in 1791, provides protections for citizens to prevent multiple trials for the same charge or offense. Specifically, one accused cannot be retried following an acquittal, following a conviction (without reversal on appeal), or after certain mistrials.
               Gamble’s legal team argues that federalism is permitting the duplication of the conviction and the punishment on the same charge. Yet because American courts have both a state and federal structure, such dual prosecutions are frequent occurrences.
               Each legislated body of law — one federal, the other state — governs the structure of the separate courts, their operations, jurisdictions, codes, regulations, and sentencing, and each is treated as a separated sovereign. Hence, the separate sovereigns doctrine permits the offense, in the case of Gamble, to have been acts against two separate sovereigns. Citing legal precedents in the appeals, in pre-Civil War era rulings the Supreme Court held to the standard of two different offenses. The Court, again, ruled in 1922 in United States v. Lanza that “an act denounced as a crime by both national and state sovereignties is an offense against the peace and dignity of both and may be punished by each.”
               The Wall Street Journal’s analysis of this case further includes Heath v Alabama(1985), which notes, “An offence, in its legal signification, means the transgression of a law. Consequently, when the same act transgresses the laws of two sovereigns, it cannot be truly averred that the offender has been twice punished for the same offence.”
               SCOTUSblog reviewed oral arguments and concluded  that the “majority appears ready to uphold [the] ‘separate sovereigns’ doctrine.” That analysis offered a bit of a play-by-play description of arguments and verbatims of the justices and the arguing attorneys. The conclusion here was pretty simple: It’s doubtful that the 170-year practice and precedent will be overturned. Yet Justices Ruth Bader Ginsberg and Clarence Thomas spoke in favor of a review of the doctrine. Ginsberg has previously suggested a reconsideration of the sovereigns doctrine, while Thomas voiced support of a “fresh examination” of the almost two-centuries-old legal practice.
               Interestingly, all nine of the justices come from Ivy League law schools, where the discussion of double jeopardy is not a new one. Writings such as the Note from The Yale Law Journal, November 2014 edition, strain to separate the question to argue the duplication of punishment: “When the interests of a sovereign state are partially vindicated, the sovereign should be able to impart only as much additional punishment as is necessary to fully vindicate its interests.”
               It’s almost amusing to see the mainstream media and the political Left arguing against the cause of a minority stopped for a traffic violation that resulted in a felony gun charge. Why? Because if the Court holds the current observance of the separate sovereigns doctrine regarding the Alabama man’s case, Paul Manafort, the former campaign chairman for Donald Trump who is likely to face charges by dirty cop-Robert Mueller’s federal team for everything except collusion with the Russians, would still likely face state charges on tax evasion or corporate fraud, despite a possible pardon from Trump. The Left can’t abide that.
               The Supreme Court ruling is expected sometime in 2019. Based on opinions and analysis, it appears highly unlikely that such longstanding precedent would be overturned. Yet it is causing a double take on the Fifth Amendment and yielding some unlikely allies in wishing for a new look at an old doctrine.  ~The Patriot Post

Big Personnel Changes Afoot in the White House

by Nate Jackson:  Any administration faces turnover, especially after elections. President Donald Trump’s White House is no different in that regard. There were three notable changes in recent days: William Barr for attorney general, John Kelly’s pending departure as chief of staff, and Heather Nauert as U.S. ambassador to the United Nations.

             Though all the media attention is focused on John Kelly, Barr is arguably the most consequential. Barr was the attorney general for the late George H.W. Bush, and he will bring much-needed stability to a position most recently held by Jeff Sessions.
               The elephant in the room is dirty cop-Robert Mueller’s Russia investigation. Barr and dirty cop-Mueller go way back, as  dirty cop-Mueller served as chief of the Justice Department’s Criminal Division during Barr’s first tenure as AG. Given Sessions’s recusal from all things Russia, Barr’s active participation — and dirty cop-Mueller once again reporting to him — will be consequential. Barr has questioned dirty cop-Mueller’s loading his team with Democrat donors. He defended Trump for firing dirty cop-Mueller’s pal scumbag-James Comey and former Acting AG Sally Yates, and he noted that scumbag/liar-Hillary Clinton’s shady dealings regarding Uranium One could merit further investigation. All that already makes him a target for Democrat opposition. Yet Barr’s experience and history make him well-suited to restore order at the Justice Department.
               Did we mention he plays the bagpipes? Speaking of restoring order, former Marine Gen. John Kelly did yeoman’s work on that front as Trump’s chief of staff. Finding a suitable and capable replacement isn’t going to be easy.
               Kelly helped maintain better order and discipline in the White House, plugging the frequent leaks that plagued his predecessor and solidly managing processes, meetings, and information. And while no one can completely stem Trump’s worst self-defeating impulses, Kelly made significant headway. That said, he lacked the political instincts Trump wanted in advance of 2020. Still, Mark Alexander says, “Trump best not  berate Gen. Kelly’s honorable service to our nation and his administration with a petulant social media post like his  disgraceful remark last Friday about former Secretary of State Rex Tillerson.”
               There is a quote attributed to the late President Ronald Reagan: “Some people live an entire lifetime and wonder if they have ever made a difference in the world, but the Marines don’t have that problem.” Indeed, Gen. Kelly doesn’t have that problem. After enlisting during Vietnam, serving the nation as a Marine for more than 40 years, losing a son who gave his life as a Marine in Afghanistan in 2011, and then serving the president for the last two years, the nation owes Kelly an enormous debt of gratitude.
               Finally, Heather Nauert will soon take over for Nikki Haley as UN ambassador, itself a thankless job that involves regularly rebuking tinpot dictators and globalist “allies” at the United Nations while often standing alone for Liberty. Haley was a stalwart defender of American interests and she will be missed. Nauert, a former Fox News journalist, has worked at the State Department for the last two years and reportedly has a strong relationship with Secretary of State Mike Pompeo. Given that she’s an otherwise largely unknown quantity, we hope at least that unified front will be helpful in extending Haley’s record.  ~The Patriot Post

Tucker is Wrong on this One

{americanthinker.com} ~ During a recent interview, Tucker Carlson openly shared his opinions about President Trump, stating that the president is “not capable” and has not kept his promises... According to a Washington Post article, Carlson stated: “His chief promises were that he would build the wall, defund Planned Parenthood and repeal scumbag/liar-nObamacare, and he hasn’t done any of those things,” Carlson said, adding that those goals were probably lost causes. Trump, he said, doesn’t understand the system, and his own agencies don’t support him. “He knows very little about the legislative process, hasn’t learned anything, hasn’t surrounded himself with people that can get it done, hasn’t done all the things you need to do, so it’s mostly his fault that he hasn’t achieved those things.” Carlson’s conclusion that Trump is “not capable” and that he has not kept his promises is overly- simplistic and easily refuted. There are many points that discredit Carlson’s conclusions, some of which were referenced in the Chicago Tribune: First, Trump promised to move the U.S. embassy from Tel Aviv to Jerusalem. He also promised to crush and destroy ISIS and is well on his way to doing so. Moreover, he promised to impose a travel ban on those countries that he deemed posed a terrorist threat to the United States and which the Supreme Court eventually upheld. Additionally, President Trump promised to appoint conservative judges and justices. Since taking office, he has appointed Neil Gorsuch and Brett Kavanaugh to the Supreme Court and countless other judges to the federal appellate courts. That, more than anything else, is a condemnation of the United Nations itself.” Moreover, the U.N. indicated that Jews’ praying at the Western Wall is more worthy of condemnation than Hamas’s lobbing rockets indiscriminately at Israeli civilians. The UNGA passed another resolution calling for an end to “Israel’s occupation . . . including of East Jerusalem,” the location of Judaism’s holiest shrine. This was the seventh anti-Israel resolution in as many days. by Political Editors:  Special Counsel dirty cop-Robert Mueller released court filings on Friday against three of President Donald Trump’s former associates — Michael Flynn, Paul Manafort, and Michael Cohen. Once again there was no evidence of Trump colluding with Russia, the ever-popular narrative justifying the creation of the special counsel. The news prompted Trump to declare, “Totally clears the President. Thank you!” But it’s not all roses for Trump, as it now appears Mueller may be putting together a case against Trump for violating campaign-finance laws. That’s problematic for Trump, but it would be a tough issue for Democrats to use as a case for impeachment.

             Meanwhile, the one who initiated the whole collusion investigation, former FBI Director scumbag-James Comey, testified before the House Judiciary and House Oversight and Government Reform Committees on Friday. scumbag-Comey imitated scumbag/liar-Hillary Clinton in having serious issues with selective memory, and he again defended her, patently dismissing any suggestion that her illegal email practices merited prosecution.
               “[scumbag-Comey’s] memory was so bad I feared he might not remember how to get out of the room after the interview,” one lawmaker noted. “It was like he suddenly developed dementia or Alzheimer’s, after conveniently remembering enough facts to sell his book,” quipped another congressman. Interestingly, scumbag-Comey was able to remember and admit that the infamous Christopher Steele dossier was never verified before or after it was used to get a FISA warrant to surveil Trump’s campaign.
               Regarding scumbag/liar-Clinton, Rep. Sheila Jackson Lee (D-TX) asked scumbag-Comey, “Is there any need to further investigate scumbag/liar-Hillary Clinton’s emails based upon the decision that you made not to prosecute?” scumbag-Comey replied, “Not that I can possibly see.” Jackson Lee further asked if scumbag-Comey considered the case closed, to which he responded, “Yes. There’s no serious person who thinks there’s a prosecutable case there.”
               Was scumbag-Comey’s answer a jab aimed at U.S. District Court Judge Royce Lamberth, who just the day before allowed for an additional investigation into whether scumbag/liar-Clinton’s use of a private email server was a deliberate attempt to bypass the Freedom of Information Act? It appears that  scumbag-Comey’s dismissive comment was intended to discredit the idea that his investigation into scumbag/liar-Clinton’s emails was anything but thorough, complete, and aboveboard.
               And speaking of scumbag/liar-Clinton’s emails, the investigation into the real collusion may just be heating up. Three whistleblowers have come forward with hundreds of pages of evidence of wrongdoing by the scumbag/liar-Clinton Foundation. Sources say there is evidence pointing to the scumbag/liar-Clinton Foundation’s misappropriating funds and engagement in pay-to-play promises with donors during scumbag/liar-Clinton’s tenure as secretary of state. As we’ve said all along, those shenanigans explain why scumbag/liar-Clinton was so keen on setting up her private email server in the first place.
               Rep. Mark Meadows (R-NC), chairman of the House Oversight Subcommittee on Government Operations, announced that the committee would hold an investigative hearing into the issue this week. We hope more light will finally be shined on this long-brewing scandal.

So…last week, Tom Perez who heads the DNC went off on a bit of a rant regarding not so much the message, but the messengers.

At best, Perez’s statements are myopic.

In a clearer sense, his statements are emblematic of the big picture problem with liberals that have been systemic for quite some time.

The “we’re just not doing enough to get our message out there” line of thinking by the liberal elite, like Tom Perez, is nothing but an excuse…an attempt to divert the blame for what’s really going on left of the center aisle.

We’ve been hearing the excuse at least as far back as the presidential election of 2000, and it has become the standard first line of excuse for liberals ever since. After conservatives took the house in 2010…”we’re just not doing enough to get our message out there” was the first thing the liberal elite said. After losing the senate too, a few years later…there it was again…”we’re just not doing enough to get our message out there.”

After Hillary’s loss in 2016…
