However, the States could preempt federal martial law... by declaring a state emergency and state martial law... with a full mobilization of their National Guard, under State Orders. It then becomes a matter for the courts, the Federal Government, and the soverign states ... too, settle.
However, during the process of settling the constitutional issues, the states should insist they have the right to defend their borders UNTIL properly relieved by the Federal government... The term 'Properly Relieved' defined as DEMONSTRATING THE WILL AND POWER TO ENFORCE THE BORDERS AND IMMIGRATION LAWS by the Federal Government... not. Executive orders or bureaucratic Policy NOR Regulatory authority... bu statutory law... and the full intent of Congress.
The Federal Government must demonstrate the will and power to enforce the border and US immigration law... Before the state militia stands down. Only then, should the states consider the border properly defended by federal force. thus recalling its militia from its mission to secure the state's border from INVASION.
P/S the doctrine of Federal Supremecy... applies only to the 18 powers given to it by the People and the States in Article 1, Section 8... Even then the Federal Government is to defer to the sovereignty of the State and People when the Constitution is silent or open to challenges under the 9th and 10 Amendments.
The several States and the People need to exercise their authority and if the federal courts ignore the clear meaning of the Constitution the States need to hold an immediate Article 5 convention to amend the Constitution to clarify their supremecy as the creators of the US Constitution and the Republic it defines.
