“Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.”
And how do these words in the Constitution’s Bill of Rights relate to presidential candidate Donald J. Trump…simply it means that Trump’s right to free speech was in no way violated by the shutting down of his recent rally in Chicago even though Trump immediately spewed out words that, “thugs shut down our First Amendment rights.”
No they did not for while thugs did behave ever so badly it was not thugs per se who shut down Trump’s rally…Trump himself shut down his own rally with his year-long barge of disparaging remarks against minorities, his vile words against his fellow candidates, and with his mocking comments regarding the ‘intelligence’ of some of his own supporters. And these words of his said time and again are words not protected by the First Amendment, as they are ‘instigating’ words deliberately said to fuel anger…to fuel hate…and are what’s legally known as ‘fighting words’…’fighting words’ that could make the person to whom they are addressed…in this case minorities…commit an act of violence. And since Trump instigated the Chicago violence by his ‘fighting words’…as per Chaplinsky v New Hampshire, 315 U.S. 568 (1942)…Trump himself must take at least some responsibility for the violence that ensued because his entire campaign was a powder keg of thuggery waiting to explode.
