The Economist has been fairly consistent in its stand that carbon dioxide emissions from man-made sources are the chief cause of global warming. But in an editorial this week, it sounds less certain.

Global warming predictions haven’t panned out as predicted in the past decade, but the why is a bit fuzzy, the magazine admits.

Greenhouse gas emissions have soared during the past 15 years, the magazine notes, with 100 billion tons of carbon having been added to the atmosphere between 2000 and 2010. Still, both air and ground temperatures during that time have remained virtually unchanged.

In fact, the editorial notes, surface temperatures have been at the bottom of the projected range of various models since 2005. If they remain flat, they will actually begin to fall below projections shortly.

Any day now Britain's Supreme Court will issue a ruling on whether or not the European Arrest Warrant (EAW) issued for WikiLeaks founder Julian Assange is valid, a decision that will determine if Assange is extradited to Sweden to face allegations of sexual assault.

The EAW system increases the speed and ease of extradition throughout EU countries.

Assange, 40, had consensual sex with two women in Sweden in August 2010. He is accused of refusing to use a condom in one instance and having intercourse with the other women while she was not fully awake

U.S. courts will soon decide whether Americans can have the expectation of privacy over their DNA, reports Kate Moser at the Recorder.

Michael Risher of the ACLU of Northern California is challenging a California law that requires all felony arrestees to give a DNA sample.

He argues that Americans "don't want the government to have all that information about us." The government doesn't have the right to demand our genetic material – including the wealth of personal information it holds – even if it promises to use it only for law enforcement, Risher claims.

Hanni Fakhoury, a lawyer at the Electronic Frontier Foundation who filed a friend of the court brief in the case, says he's concerned about "some of the problems of large-scale data gathering not based on any individualized suspicion that someone is engaged in criminal activities."

That concern is already playing out in terms of the other ways the government collects data on innocent Americans without a warrant.

But there is no indication how mandatory DNA collection will play out as technology brings unprecedented challenges to interpreting the Fourth Amendment's right against unreasonable searches.

As Moser puts it in the Recorder:

In the age of smartphones, GPS and the prospect of ever cheaper ways to sequence an entire human genome, it's no small task to interpret the constitutional guarantee against unreasonable searches and seizures.

On one hand, as Supreme Court Chief Justice John Robertspoints out, collecting DNA from individuals arrested for violent felonies "provides a valuable tool for investigating unsolved crimes and thereby helping to remove violent offenders from the general population."

On the other hand, as First District Court of Appeal panel Justice J. Anthony Kline stated when rejecting the notion that DNA collection is like fingerprinting, "there is no doubt that an extraordinary amount of private personal information can be extracted from the DNA samples and specimens seized by the police without a warrant, collected and indefinitely retained by the DOJ."

Last month Roberts said that the nation's highest court would likely hear Maryland v. King, which would establish the controlling law in the land on DNA collection.

Risher said it's unknown how it will play out because DNA is "one of those issues where judges vote in surprising ways" as they value both "importance of robust prosecutorial and police powers" and privacy protections of Americans.

The new tax, which Congress passed in 2010, affects the net investment income of most joint filers with adjusted gross income of more than $250,000 ($200,000 for single filers). Starting on Jan. 1, 2013, the tax rates on long-term capital gains and dividends for these earners will jump from their current historic low of 15% to18.8%, assuming Congress extends the current law....

The new rules present big challenges for taxpayers. But if you start thinking about them now, at least you can minimize the damage.

Peter Orszag, former head of the Obama Office of Management and Budget, is desperate. With even Roll Call recognizing that President Obama is fighting an uphill battle for re-election, Orszag is floating a trial balloon: mandatory voting. His call for forced voting comes in an op/ed for Bloomberg News:

The U.S. prides itself as the beacon of democracy, but it’s very likely no U.S. president has ever been elected by a majority of American adults.

It’s our own fault -- because voter participation rates are running below 60 percent, a candidate would have to win 85 percent or more of the vote to be elected by a majority.

The irony, of course, is that the Democrats seem fine with forcing people to the polls, but object strenuously to people showing ID at the polls when they show up voluntarily.

All his legislative records from the Illinois State Senate are missing and he claims his scheduling records during those State Senate years are lost as well. In addition, no one can find his school records for the elite K-12 college prep school, Punahou School, he attended in Hawaii.

This is not about health care; it is about seizing power and limiting rights.

Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.

To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.

The Bill will also eventually force private insurance companies out of business and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled.

However, as scary as all of that it, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated. If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.

The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people and the businesses they own. The irony is that the Congress doesn’t have any authority to legislate in most of those areas to begin with. I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.

This legislation also provides for access by the appointees of the Obama administration of all of your personal healthcare information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a direct violation of the specific provisions of the 4th Amendment to the Constitution protecting against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.

If you decide not to have healthcare insurance or if you have private insurance that is not deemed “acceptable” to the “Health Choices Administrator” appointed by Obama there will be a tax imposed on you. It is called a “tax” instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However, that doesn’t work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the “due process of law.

So, there are three of those pesky amendments that the far left hate so much out the original ten in the Bill of Rights that are effectively nullified by this law. It doesn’t stop there though. The 9th Amendment that provides: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;” The 10th Amendment states: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people.” Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.

I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights. Article 6 of the Constitution requires the members of both houses of Congress to “be bound by oath or affirmation” to support the Constitution. If I was a member of Congress I would not be able to vote for this legislation or anything like it without feeling I was violating that sacred oath or affirmation. If I voted for it anyway I would hope the American people would hold me accountable.

The worst may be yet to come in the global financial crisis as the central bank spending that kept defaults low runs out, according to Deutsche Bank AG.

Credit-default swap prices imply that four or more European nations may suffer so-called credit events such as having to restructure their debt, strategists led by Jim Reid and Nick Burns said in a note. The Markit iTraxx SovX Western Europe Index of contracts on 15 governments including Spain and Italy jumped 26 percent in the past month as the region’s crisis flared up.

“If these implied defaults come vaguely close to being realized then the next five years of corporate and financial defaults could easily be worse than the last five relatively calm years,” the analysts in London said.

Default rates stayed in line with historical norms between 2007 and 2011 because of the “unprecedented intervention” of European and U.S. policy makers, the analysts wrote in the report.
Now, credit markets are giving up the gains that followed the European Central Bank’s 1 trillion-euro ($1.3 trillion) longer-term refinancing operations and the U.S.’s Operation Twist that buoyed government bonds.

Although defaults have been low, recoveries are falling because the public spending that kept non-payments down has failed to spur economic growth, according to the analysts.

Credit-default swaps pay the buyer face value in exchange for the underlying securities or the cash equivalent should a borrower fail to adhere to its debt agreements.

“The LTROs gave us some respite but they don’t appear to have taken the problem away,” Burns said in a phone interview. “At the moment there are no more LTROs on the table.”

I stand here in abject stupefaction. The so-called "right" or "Tea Party" in this republic is being so thoroughly rolled and defeated that I am struggling to come up with an adequate violent submission metaphor that does not involve prison rape . . . and they honesty think that they're "winning." Really? You call this winning?

- There are no real spending cuts

- There is a massive tax increase effective January 1, 2013

Obama is going to be handed something in excess of $2 Trillion -- and he has made it perfectly clear that he will spend every penny of it before the November 2012 election. That's why he kept saying, " . . . so we don't have to do this again", meaning raise the debt ceiling again. The debt ceiling would only need to be raised if all of the money had been spent. Therefore, he has stated very clearly that he will spend every penny of any debt ceiling increase. He is going to burn through $2 Trillion-plus in the next sixteen months. This was the Obama regime's plan from day one. Geithner appeared before Congress in early May and told them this in no uncertain terms. This outcome has been a known quantity all along.
