The only way I know to describe it is that the better things get in America economically, the more Un-American the dummycrats- Democrats become. Some of the good news: We are seeing a significant improvement in the U.S. GDP growth rate. We need a steady 3% annual GDP growth rate for America to be sound financially. The liar-nObama Administration did not achieve this any year during his eight years in office. Our GDP growth rate has steadily improved since President Trump was sworn in. It is now approaching 4% and some well-known economist are predicting that we may actually see an unheard of 5%! Our unemployment rate is less than 4%, with record levels of employment in our minority populations. And this is without the Trump Administration “cooking the books” like the liar-nObama Administration did. The liar-nObama Administration actually declared that the unemployment rate dropped during a month when there were virtually no new jobs created. In fact the growth in our economy is so strong now that many companies have jobs that they cannot fill. Among them was a Washington state congresswoman, the lawmaker said on Twitter. The protests came as demonstrations occurred around the country over the Trump administration’s policy of separating immigrant families. They offered a glimpse of what might happen on Saturday when rallies are planned coast to coast. Amid unrelenting daily images of distraught immigrant children separated from parents and herded into fenced enclosures, women sat on the floor of the Senate Hart Office building’s 90-foot-high atrium. GOP lawmakers grilled Peter Strzok on Wednesday in a closed-door deposition. According to Chairman Goodlatte, FBI counsel instructed Strzok not to answer many of the questions. Wray and Rosenstein appeared on Capitol Hill Thursday for a Congressional hearing. House Republicans torched Rosenstein over his conflicts of interest in the Mueller probe and demanded he fork over classified documents on Trump-Russia.  Later Thursday afternoon, House Republicans passed a resolution giving DAG Rosenstein 7 days to turn over requested documents or face impeachment and or contempt charges. Out of the eighty senators in total who voted in favor of the secure fence act, twenty-six out of the forty-four dummycrats-Democrats voted in favor of the bill one, Ted Kennedy did not vote. A fundamental difference between wind and solar and traditional energy sources is that wind and solar are intermittent and erratic. The weather affects both wind and cloud cover. The sun sets every night, turning off solar generation, often just when demand peaks. In winter, solar generation drops -- dramatically in areas with heavy winter cloud cover. Wind and solar are dumb electricity. It would be helpful if the erratic electricity flow could be smoothed out by means of electricity storage. But all methods of storing electricity are too limited or too expensive. Batteries are flexible but wildly expensive for anything beyond very short term storage. Pumped storage is the most realistic method of storing electricity. Pumped storage requires reservoirs and reversible hydroelectric plants, rendering it impracticable except where natural reservoirs and abundant water are present. Why Britain's Deradicalization Programs Are Failing

As the Times reported recently, BIT examined 33 deradicalization programs across Britain, in schools, youth centers, sports clubs and English-language classes. Most of these are part of Prevent -- a strategy presented in 2011 to the UK Parliament by the Secretary of State for the Home Department -- designed to keep vulnerable citizens from becoming terrorists or supporting any form of violent extremism inspired by radical Islamist or right-wing ideologies. BIT found that only two of the programs have been successful. The main reason for the failure of the other 31 programs, according to the Times' report on the study, is: "...that facilitators were uncomfortable dealing with sensitive topics and would often refuse to engage if they were brought up. Mexico's Rising Communist Regime

by Michael Swartz:  Because the American media depends on constant coverage of the race between the red and blue horses — turning even primaries and special elections into seminal events — Americans rarely pay attention to balloting that occurs beyond our borders. But this coming weekend will, without a doubt, affect how President Donald Trump deals with our neighbors to the south. Mexico, now one of the most violent nations in the world, is about to be under a communist president backed by the drug cartels.

             Since Mexico limits presidents to one six-year term, its field is more wide open and the leading contender in Sunday’s election is a twice-unsuccessful candidate who once served as the mayor of Mexico City. But the third time may be the charm for Andrés Manuel López Obrador, better known to the Mexican people by his initials, AMLO, and his projected victory would take that nation in a radical direction.
               Obrador is a socialist who proposes income redistribution to students and seniors, government picking winners and losers in the energy sector, and possible amnesty for some drug criminals. He’s backed by the drug cartels, you see. It’s a laundry list of promises that appeal to the “throw the bums out” mentality that Mexican voters have adopted, but it’s not without its critics. “I am going to vote for whoever is in second place, to take a bit of strength away from (AMLO),” said one voter who works for a government energy agency. “The important thing is keeping the economy running, and I am afraid Lopez Obrador will screw it up.”
               AMLO, however, also supports the economic boost (for his country) of offloading Mexico’s poor onto their far wealthier neighbor to the north, according to Tucker Carlson of Fox News. After all, Obrador has called emigration “a human right,” and this may cause a little conflict with the American idea of border security.
               Mark Alexander had it right earlier this week: “The immigrants flooding across our southern border, risking their lives and those of their children to get here, are fleeing statist regimes in their Central American countries, along with the corruption and poverty generated by such regimes.” Voters may ensure Mexico stays on that list of statist regimes.
               Complicating matters in this election cycle is the rampant drug-fueled crime that’s plaguing Mexico. While most Mexican leaders pledge to fight the cartels — and more than 100 politicians have paid for their stance with their lives during the campaign for local and legislative offices also at stake in this weekend’s balloting — AMLO has been comparatively silent. In past campaigns, though, Obrador has openly supported the cartels by promoting a stance of “hugs, not bullets” when it came to their leaders, like the notorious Joaquin “El Chapo” Guzman (who was extradited to the U.S. last year to face trial this fall.) “The Mexican war on drugs will come to an abrupt end” if AMLO wins, warned one observer.
               At a recent rally near Mexico City, AMLO laid his idea out in plain language: “For the good of all, the poor come first.” To Obrador, advancing the poor would not only require spending billions of pesos but perhaps involve scrapping NAFTA rather than embarking on the separate bilateral deals with Mexico and Canada that President Trump wants. According to economic adviser Gerardo Esquivel, “We are not really looking for a bilateral agreement with the U.S. or Canada. The trilateral agreement (already in place with NAFTA) is what we want.” Yet last year, Obrador was singing a different tune, stating, “We should put a national emergency plan in place to face the damage and reverse the protectionist policies of Donald Trump.”
               AMLO’s rhetoric sounds eerily like something we’d hear in Venezuela or Cuba. Calling the country’s electoral prospects “so clear a danger,” political commentator Dick Morris worried that Sunday’s balloting “may be Mexico’s last free election.” Nothing should be put past a “Hugo Chavez wannabe” if he wins as expected on Sunday.   ~The Patriot Post

Many  conservative lawmakers have accused Rosenstein of being a “deep state” swamp creature hack that is purposefully hiding or withholding those documents in order to cover up criminal misdeeds or embarrassing examples of political bias or incompetence at the DOJ and FBI. Of course, Rosenstein has denied that he is hiding or withholding anything without valid reason — such as the need to keep sensitive information relevant to ongoing investigations, sealed indictments, subpoenas and warrants under wraps for the time being — and has vowed to cooperate with all Congressional requests to the best of his ability...

According to court documents, on or about Dec. 19 and 20, 2017, Markara Man, 33, of Norwalk, allegedly sent three emails to Chairman Pai’s email accounts. The first email accused Chairman Pai of being responsible for a child who allegedly had committed suicide because of the repeal of net neutrality regulations. The second email listed three locations in or around Arlington, and threatened to kill the Chairman’s family members. The third email had no message in its body, but included an image depicting Chairman Pai and, in the foreground and slightly out of focus, a framed photograph of Chairman Pai and his family. The FBI traced the emails to Man’s residence in Norwalk, California, and when initially confronted in May 2018, Man admitted to the FBI that he sent the email threatening Chairman Pai’s family because he was “angry” about the repeal of the net neutrality regulations and wanted to “scare” Chairman Pai...

Six Potential Targets of Trump's Supreme Court  

by Jordan Candler:  In a piece devoted to Justice Anthony Kennedy’s departure, National Review’s David French lays out the case for why the “the consequences of Kennedy’s retirement — both legal and political — are immense.” Justice Kennedy is universally regarded as a swing jurist. French observes that “he wrote or joined a number of solid opinions that protected and reaffirmed core constitutional liberties, including liberties protected by the First and Second Amendments.” But Kennedy also “served as the primary judicial guardian of abortion rights and was more responsible than any other justice for the relentless legal march of the sexual revolution.” Therefore, the addition of another originalist will be unquestionably influential.

             The Washington Examiner editorial board highlights six pivotal cases that could be overturned without Justice Kennedy: Roe v. Wade, which “struck down all state abortion restrictions in 1973” (Kennedy himself voted in support of Planned Parenthood v. Casey in 1992 — a case that would have overturned Roe v. Wade); Kelo v. New London, which in 2005 “re-established that private property can be taken from owners through eminent domain for nonpublic uses”; Obergefell v. Hodges, which “established in 2015 that all states are constitutionally mandated to recognize marriages between two people of any sex”; Massachusetts v. EPA (2007), which mandates that “the Environmental Protection Agency must regulate carbon dioxide”; U.S. Term Limits, Inc. v. Thornton (1995), which stipulates that “individual states … may not set rules for would-be members of Congress that are more restrictive than what’s outlined in the U.S. Constitution”; and Kennedy v. Louisiana (2008), which “blocked the expansion of the death penalty for violent crimes where the victim did not die and was not intended to be killed.”
               Kennedy’s departure doesn’t mean all of these will be overturned in the near future. Some (most?) may not be overturned at all. However, another originalist at least denotes that all of these cases face the possibility of being reversed. French ends his op-ed with a cautionary tone: “We’ve been here before. We’ve had opportunities to remake the Court. President Reagan and the first President Bush together appointed a majority of the Supreme Court. Yet Roe endured, and the Court even moved left on key issues.” True enough. However, many of the people on Trump’s Supreme Court list are exceptional, bona fide conservative candidates. It’s certainly not unrealistic to envision an A-team-caliber Supreme Court majority whose decisions will result in a defense of life (literally), Liberty and justice unforeseen in our modern day.

House Gives Rosenstein July 6 Deadline to Hand Over Documents

The measure adopted on a party-line vote of 226-183 calls for full compliance by July 6, but it doesn’t say what would happen if Deputy Attorney General Rod Rosenstein and the department fail to meet that date. Some Republicans have talked of citing Rosenstein, who’s overseeing the continuing Russia probe, for censure or contempt of Congress or even impeaching him. Republican Representative Mark Meadows, a sponsor of the resolution, H. Res 970, said on the House floor that “when we get these documents we believe that it will do away with this whole fiasco of what they call the Russian collusion investigation because there wasn’t any!”...

For his own sake. We know he may not give a damn about his people, but we assume that he cares very deeply about maintaining his power and his dictatorial legacy. And the only path – the ONLY path – left for him to keep the throne is to live up to the promises he made in Singapore this month. We don’t say this as supporters of the president or even as American citizens. We say this as rational observers of the man in the White House: Stab Donald Trump in the back, and you will pay a hefty price. In Kim’s case, that price will almost certainly be the keys to the Hermit Kingdom. Trump took a huge gamble when he agreed to meet Kim Jong Un as an equal on the global stage. This was something that no previous president had been willing to do: Grant North Korea a degree of legitimacy in the hopes that an offer of respect would translate into a denuclearization deal for the good of the globe. And he took no small amount of criticism – some from within the Republican Party – for moving forward with the summit. Critics feared that he was simply giving North Korea a decade’s worth of propaganda in exchange for empty promises that would ultimately mean nothing. Some feared that Kim Jong Un was merely using this as an opportunity to buy time while his engineers continued working on a nuclear weapons program. Trump, willing to take the chance, went forward with the historic meeting. { wnd.com } ~ It’s one thing – albeit a decidedly detestable one – when we have elected officials and deep state operatives subverting the law of the land in order to facilitate the ongoing influx of illegal immigrants into the United States. It’s entirely another when their actions in the pursuit of this agenda descend to the level of criminality.

If I were to publicly incite mob violence against someone I disliked in the city in which I live, I am quite certain that I would be swiftly prosecuted. I’m pretty sure that the same would apply to nearly all readers of this column.

Yet this is precisely what California Democratic Rep. mad-Maxine Waters has done in recent days. This past weekend on MSNBC, mad-Waters called for groups to harass and protest members of the administration of President Donald Trump at public venues.

mad-Waters did this with great relish, claiming that members of Trump’s Cabinet “won’t be able to go to a restaurant, they won’t be able to stop at a gas station, they’re not going to be able to shop at a department store.” Waters actually employed the word “harassment,” and later doubled-down on her endorsement of this behavior after being criticized.

In context, mad-Waters was referring to an incident in which White House Press Secretary Sarah Sanders was forced to leave a restaurant in Virginia last week. The owner of the restaurant, who reportedly chased Sanders and her family into the parking lot as she berated Sanders, is a Trump detractor.

Florida Attorney General Pam Bondi was accosted by hecklers as she attended a movie over the same weekend, and on June 19, Homeland Security Secretary Kirstjen Nielsen was waylaid by an angry mob and forced to flee a Mexican restaurant in Washington.

The ostensible rationale for Waters’ proposal, as well as a great deal of liberal outrage over the last few weeks, has to do with the practice of immigration officials separating the children of illegal immigrants from their parents when they are interdicted at our southern border. The outrage is all ginned-up of course; the procedure has been in place for some time, and was even implemented during the liar-nObama administration’s orchestrated “undocumented minor” tsunami of 2014.

This week, the group Judicial Watch delivered a letter to the House Office of Congressional Ethics calling for an investigation into whether mad-Waters violated House ethics rules by encouraging violence against Trump administration Cabinet members. Personally, I don’t think this goes nearly far enough. Harassment is a criminal offense, as are stalking and inciting mob violence. As such,   mad-Maxine Waters ought to be criminally prosecuted, as you or I would be if we engaged in such behavior.

It may not be entirely germane to the discussion, but I truly believe that Maxine Waters is so mind blowingly stupid that she wasn’t even aware her proposal carried the possibility of criminal prosecution as opposed to being aware of it and reasoning that her august status would shield her from reprisal.

While President Trump did recently sign an executive order temporarily suspending the family separation protocol, his overall strategy has been to force the hand of Congress in providing a more permanent remedy to the problem of illegal immigration. His grounds for doing so are rooted in prudence, security and fairness; Trump has argued that America’s immigration policy is “laughed at all over the world, [and] is very unfair to all of those people who have gone through the system legally.”

Since Donald Trump’s election, the shrill deportment of the left under normal circumstances has developed into apoplectic histrionics on a daily basis. Their fear and desperation concerning the threat to the pre-eminence of the Washington establishment is bleeding over into practically everything they touch. The bias of the press has been evident for a long while, but even the formulaic propaganda proffered by the entertainment media has become unabashed as well as tedious. Apparently, nearly everything produced by a major movie or television studio must now contain references to the president being either intellectually enfeebled, a misogynist, a sexual deviant, or a racist, in addition to the current formula that mandates the inclusion of gratuitous homoerotica, feminist overtones, the “reality” of global warming and other far-left doctrine.

When a really juicy matter such as illegal immigration comes to the fore, with all of the potential for capitalizing on racialism and victimhood, the left descends into abject rhetorical incontinence. It is this reckless abandon that has given rise to calls for the harassment of administration officials.

President Trump can order security measures to protect his Cabinet members in extreme situations, but this is hardly the point. It is the perception on the part of leftists whethermad-Maxine Waters or some unwashed blogger living in his mother’s basement that they can act in this manner with impunity, which is unacceptable as well as manifestly dangerous. My family and I were once put in a potentially life-threatening situation due to the actions of one of these individuals, and the authorities were never able to determine their identity.

With only the barest 51-vote majority — and one of their own, Arizona Sen. rino-John McCain, on extended leave in Arizona as he grapples with what is likely to be terminal brain cancer — Republicans would have difficultly mustering a quorum without at least some dummycrats-Democratic help. “In the month of June, there have been an average of 1.8 Republican absences across 18 roll call votes,” Koger wrote, “so even if rino-McCain returned to the Senate, the majority would struggle to consistently provide a floor majority.” If rino-McCain doesn’t return, and all 49 dummycrats-Democrats refuse to participate, the 50 Republican senators left in Washington would fall one short of a quorum. The Senate precedents on quorums do not mention whether Vice President Mike Pence could contribute a 51st vote. In that case, “the Senate can do nothing,” Koger concluded. “No bill can pass, no amendment can be decided on, no nominations can get approved.” The Senate would screech to a halt for lack of a quorum — and dummycrats-Democrats could conceivably delay a confirmation vote until a new Senate, perhaps with a narrow dummycrats-Democratic majority, is seated next January...

Trump Reportedly 'Green Lights' Israeli Attacks on Iranian Forces

ICE at Bay: Siege at Portland Continues

 as Copycat Insurrections Spread Nationwide

The direct action to shut down operations of the Federal Immigration and Customs Enforcement and investigative agency began with a small group of demonstrators on June 17. Within two days, scores of radicals, including families with children, had set up a sprawling tent city on the sidewalks and streets surrounding the building, effectively shutting it down. By week’s end, hundreds of “comrades” had been lured by social media to join the campaign, as it served to inspire similar provocative illegal actions around the country. According to  Willamette Week, “The Portland  occupation, the first nationwide, is an attempt to disrupt President Donald Trump's ‘zero tolerance’ policy that has treated refugees seeking asylum as criminals and separated small children from their parents.”  National mainstream television and cable news coverage of these developments in Portland has continued to be largely nonexistent. The fact that the movement has gone nationwide has also been ignored. Several Internet political publications, including American Thinker on June 25, have reported on the story, as have a few major newspapers. In contrast, the radical ragtag “Occupy Movement” demonstrations in the fall of 2011 grabbed major media coverage including on TV from the outset of the first one, Occupy Wall Street. It’s plausible that the widespread coverage of obnoxious and potentially criminal actions that have been taken place, and their potential impact to harm dummycrats-Democrat candidates in the fall, have discouraged the MSM from reporting on the equally obnoxious radical encampments in Portland and other cities...Theres a law against this act.

What Prince William Did Not See in Ramallah

Abbas also said that the Palestinians were "committed to combating terrorism." What makes this news interesting is that as Abbas was speaking to Prince William in his Ramallah headquarters, known as the Mukata, the Palestinian government issued a statement praising Palestinian terrorists imprisoned by Israel. Primary Recap: dummtcrats-Democrats Lose Big

             The latest evidence of this seismic shift was Tuesday’s primary defeat of the number four Housedummycrats-Democrat, Joe Crowley. On Monday, the New York dummycrats-Democrat who’d been in Congress since 1999 was the heir-apparent to House Minority Leader Nancy Pulosi. By Tuesday night, he was conceding a 57-42 defeat to a Millennial socialist who he’d out fundraised 10-1. Alexandria Ocasio-Cortez, a 28-year-old political activist, will likely represent part of the Bronx and Queens. After all, how likely is that district to elect a Republican?
               Ocasio-Cortez is a member of the dummycrats-Democratic Socialists of America and is backed by commie-Bernie Sanders’ group Our Revolution. “What we need to do,” she says, “is be bold enough and courageous enough to choose leadership that takes no corporate money and advances health care, education, and housing for all.” Eliminating the federal Immigration and Customs Enforcement agency is also on her agenda. When even the leftist rag Washington Post — owned by socialist billionaire Jeff Bezos — declares her win a big loss for dummycrats-Democrats, that’s saying something.
               Two other notable election tidbits: First, Bradley “Chelsea” Manning lost his bid to defeat Sen. Ben Cardin in the Maryland primary. Manning’s pitiful attempt to keep his 15 minutes of fame alive came not because he’s a traitor against his country but because he’s a poster child for the transgender movement.
               Second, Trump was a big winner. Soon after helping defeat South Carolina Rep. Mark Sanford with an election day tweet on June 12, Trump-backed Henry McMaster, the Palmetto State’s governor, fended off a runoff challenge from John Warren. And in Utah, Mitt Romney — yes, the same Romney who denounced  Trump as a “phony” and “fraud” in 2016 — won the Senate primary with Trump’s backing. Romney will face off against dummycrats- Democrat Jenny Wilson for retiring Sen. Orrin Hatch’s seat in November, and that election will likely be in part about Trump. Media's Constant Attacks on Trump Backfiring

             In the movie classic “The Princess Bride,” the hero, Wesley, is captured and forced into servitude by the Dread Pirate Roberts, only to assume the role of Roberts when the actual Dread Pirate Roberts decides to retire.
               Roberts/Wesley discovers a plot to kill his beloved by the prince who will marry her, and sets out to find and defeat the criminal band hired to do the killing. After defeating the giant brute and the master swordsman, Wesley then engages in a battle of wits with Vizzini, the genius behind the plan. Wesley pours two glasses of wine, poisons one with iocane powder, and leaves the genius to use his deductive reasoning to determine “who is right, and who is dead.”
               After the genius makes his decision and they both drink, Wesley reveals that both glasses were poisoned; Wesley has actually spent years taking small doses of iocane powder in order to build up an immunity.
               Thus it is with Donald Trump. The media, by spending the better part of the last two years in a state of perpetual outrage at Trump, have unwittingly immunized Trump from their hysterical criticism. Their Outrage Meter is eternally pegged at 100, unchanged whether screaming about Trump’s immigration policies or his latest tweet. No matter what he says or does, it is officially The Worst Thing Ever™.
               But sane, normal people can’t sustain that level of interest, much less outrage. It becomes a tsunami of whining and accusations that regular Americans just tune out. So, ironically, in a desperate attempt to destroy Trump, leftists have immunized him from their attacks.
               Of course, their perpetual outrage is not just a result of their hatred of Trump. It’s calculated to increase profits — the greedy capitalist pigs!
               A recent report revealed The New York Times, the bible of the Left, has done quite well as the anointed mouthpiece for anti-Trumpers. Since Election Day 2016, the NYT has seen its stock value skyrocket 141% (netting its largest shareholder, Mexican billionaire Carlos Slim Helu, a cool $423 million in profits).
               Late-night comedian Stephen Colbert struggled in the ratings before he repackaged himself as a vicious (and often vile) anti-Trumper, with a nightly onslaught of criticism and mockery of the president. And without Trump’s tweeting criticism of them, poor CNN, which recently dropped below Nickelodeon and HGTV in cable ratings, may be lost from the American consciousness altogether.
               It seems that CBS Chairman Les Mooves was half right when, in 2016, he said that Donald Trump’s candidacy “may not be good for America, but it’s damn good for CBS.” The greedy One Percenter continued, “The money’s rolling in and this is fun. … It’s a terrible thing to say. But, bring it on, Donald. Keep going.”
               One wonders if the Leftmedia appreciates the irony that the president they now seek to take down was made possible by the estimated $2 billion in free media coverage they gave him during the primaries (calculating that Trump was the weakest Republican candidate).
               However, there is growing evidence that the constant barrage of vitriol directed at Trump by the press is focusing the intensity of his detractors, but it is not expanding the number of critics. In fact, not only is the criticism not hurting Trump, it may actually be helping him.
               According to the Real Clear Politics polling aggregate, in recent months Trump’s approval rating on the economy has risen to 51% (higher than Barack liar-nObama ever achieved), with just 36% disapproving, and his overall approval rating has risen to 41%, with a 10-point drop in his negative ratings. This is even after the non-stop coverage of the border situation of some children being separated from their illegal alien parents, and the press depicting Trump as cruel and heartless. Surprisingly, Trump’s handling of that situation had little effect at all on the polls either way.
               It almost seems the opposite of liar-nObama, whose personal likability was high with the American public while his policies were frowned upon. Many Americans may not like Trump’s tweeting or his street-fighter style, but they sure do like the prosperity his policies are bringing.
               Paradoxically, the more the media attacks Trump, the less credibility it has with the public. In 2016, more Americans believed media bias was a problem than big campaign contributions. That was before the 24/7 Trump-bashing began in earnest, and that percentage is likely higher now as Americans become more and more numb to the “Pollaganda Effect” (agenda-driven polling masquerading as news).
               There are signs that the dummycrats-Democrats are getting worried, and rightfully so. Their endless attacks on President Trump are failing. An astute observer will notice that dummycrats- Democrats no longer talk of impeachment, and the Russia investigation has yielded little of substance other than exposing a coordinate effort by senior FBI officials under liar-nObama to sabotage Trump.
               November is a long way away, and anything can happen between now and then (like Trump’s plan for tariffs undermining his pro-growth policies). But for now, that predicted Blue Wave is looking less like a tsunami and more like a leaky faucet.
               And the biased, anti-Trump media deserve at least some of the credit for that.   ~The Patriot Post

And you tell them that they are not welcome, anymore, anywhere,” it would seem Mad Maxine is in trouble.

Her statement, an incitement to violence could, and should get her expelled from the House, and it could, and should land her ample arse in an official investigation from which jail time could, and should be forthcoming.

That is the most of Mad Maxine’s problems, but it’s the least of the problems for the liberal party.

ICE Protesters Demand To Enter Agency Headquarters, Fail

The protesters also shouted “quit your jobs” at the guards in front of the building. GRILLED: Strzok Questioned by Lawmakers

Strzok, who evaded a subpoena from House Judiciary Committee chairman Bob Goodlatte (R-VA), voluntarily appeared at the hearing. Thousands of Strzok’s anti-Trump text messages, which he exchanged with former FBI lawyer and his paramour, Lisa Page, sparked anger from Republicans and criticism from some dummycrats-Democrats who contend that senior members of the FBI utilized their power and political leanings to target Trump both before and after the 2016 election. SCOTUS Narrowly Upholds Constitution 

by Thomas Gallatin:  On Tuesday, the Supreme Court handed down two significant rulings that both upheld clear, constitutionally and statutorily defined powers and rights. On Wednesday, it issued a ruling on another First Amendment case. However, the disturbing fact was that all three decisions were determined by the narrowest of margins, the 5-4 split. This demonstrates just how fundamentally divided the highest court in the land is when it comes to viewing Rule of Law and the Constitution. And how important election results can be.

             In Trump v. Hawaii, the Court upheld President Donald Trump’s statutory authority under 8 U.S.C. §1182(f) to enforce his “travel ban” on immigrants from certain countries. That this explicitly delineated authority was even in question, and that it rose all the way up to the Supreme Court to enforce, speaks volumes as to the state of the nation’s judiciary. It was obvious that Trump had the statutory authority, irrespective of the merits of his decision. But judicial despots at every level insisted that they could divine Trump’s supposedly racist and anti-Muslim intent, ruling on that basis instead of what the law actually says.
               Likewise, in NIFLA v. Becerra, the Court ruled in favor of free speech protections and against state-compelled speech by striking down California’s Reproductive FACT Act, which mandated that any women’s health clinic — including those dedicated to pro-life services — provide information on abortion services. Clearly, the law targeted pro-life organizations, compelling them to advise in favor of the very issue they exist to oppose. Justice Clarence Thomas noted that the Constitution recognizes no such dubious category of “professional speech” that supposedly “[gives] the States unfettered power to reduce a group’s First Amendment rights by simply imposing a licensing requirement.” And Justice Anthony Kennedy pointedly observed that the FACT Act was inherently discriminatory and “a paradigmatic example of the serious threat presented when government seeks to impose its own message in place of individual speech, thought, and expression.”
               The third case likewise involved compelled speech — that of public employees subject to forced union dues, or “fair share” fees to support collective bargaining and other union activities. “This procedure violates the First Amendment and cannot continue,” Justice Samuel Alito wrote for the majority. “Neither an agency fee nor any other payment to the union may be deducted from a nonmember’s wages, nor may any other attempt be made to collect such a payment, unless the employee affirmatively consents to pay.” The ruling is a big loss for Big Labor.
               Collectively, the most concerning aspect of these rulings is the Court’s 5-4 split. All three decisions would have gone the other way if Merrick Garland rather than Neil Gorsuch had been sitting on the bench. As for Kennedy, still no word on his rumored retirement, but now — with Trump and Senate Majority Leader Mitch McConnell still at the helm — would be a great time.   ~The Patriot Post

I charged the two attorneys who owned the dog with murder for the homicide of Diane Whipple, because the dogs were similar to having a deadly weapon and likely to cause great bodily injury or death since they were trained to kill and attack...

Supreme Court sides with Florida over Georgia in water fight

{ jewishworldreview.com } ~ During Jared Kushner's recent round of Middle East diplomacy, he refrained from spelling out the details of the Trump plan for an Israeli-Palestinian deal. But you don't need details to see where things are heading. Kushner laid that out in a remarkably blunt interview in Al Quds, the leading Palestinian newspaper.

"The world has moved forward while you have been left behind," he told Palestinian readers. "Don't allow your grandfather's conflict to determine your children's future."

In other words: The war against the Jewish state is over. You lost. Now get over it. Kushner dismissed the traditional Palestinian core issues the return of refugees, a fully sovereign state including East Jerusalem and the end of Jewish settlement in the West Bank as "talking points," in an endless quarrel.

He also portrayed the Palestine Authority under Mahmoud Abbas as naysaying time-servers: "We will release our peace plan and the Palestinian people will actually like it because it will lead to new opportunities for them to have a much better life."

This assumes that a new generation of Palestinians will put material self-interest before anti-Zionist dogma and accept a peace with Israel that offers Muslim control of the holy places in Jerusalem, limited communal autonomy in the West Bank, and prosperity through massive public and private-sector investment. Kushner calls it an opportunity for Palestinians left behind decades ago "to leapfrog into the next industrial age" by inclusion in the ecosystem of the "Silicon Valley of the Middle East, Israel."

Kushner seems to think that young, upwardly mobile Palestinians will take a chance and leap. But it won't be easy. For them, it would not be like challenging a distant dictatorship, a la the Egyptian Arab Spring. It would be more personal -- a rejection of elders, relatives in the diaspora, and a widely believed national narrative.

Still, there are some reasons for optimism. One is the failure of the West Bank to explode, as predicted, over the opening of the U.S. Embassy or the Gaza March of Return. Another is the eagerness of Palestinians to work peaceably in Israel.

During the Kushner visit, the Israeli government announced that it is issuing 7,500 work permits to residents of the West Bank, where unemployment hovers around 20 percent. This decision is made possible by the Israel's belief that they will not pose a security threat. This assessment stems from the fact that 100,000 West Bankers already work in Israel, largely without incident.

But the kind of prosperity Kushner is talking about does not rest primarily on blue-collar jobs in Tel Aviv. It depends on the Trump administration's ability to provide major economic benefits, and fast. This generates a degree of skepticism.

After the 1993 Oslo accords, there was grandiose talk about international investments in the Palestinian economy. The second intifada, which began in 2000, put a damper on this. So has the endemic corruption of the Palestinian ruling class and its bureaucracy. And Israeli entrepreneurs were mostly unwelcome; West Bankers didn't want to be accused of collaboration. This could change, but Trump's "peace through prosperity" approach has to produce results.

Still, the Trump plan has a lot going for it, starting with the Trump attitude. Previous U.S. administrations wanted to be seen as honest brokers. To demonstrate this, they gave the Palestinian leadership something approaching a veto over developments in the "peace process."

That's finished.

Trump has made it abundantly clear that he is not neutral. He sees things Israel's way. If current Palestinian leaders reject his plan and no one comes forward to take it up, well, that's their problem. If there is no Palestinian partner, Trump will let Israel go ahead and impose the deal it wants in the West Bank.

This is serious leverage. The Palestinians can't count on Arab governments to counter it: Already the support of Saudi Arabia, Egypt, Jordan and the Gulf States has been reduced to lip service. These governments depend on the U.S. for protection against ISIS and Iran and they understand that Trump is a transactional president. He doesn't believe State Department wisdom about the need to court Arab goodwill. As far as he is concerned, it is the Arab allies who need to court him. That means helping him get the deal of the century in the Middle East.

Nor is Trump likely to accept the excuse that they can't help him because of the hatred in the street for Israel. If they can't deliver, what good are they?

This approach is radically different than anything the U.S. has proposed in the past. It is premised on the idea that most Palestinians want a better life more even than they want revenge or another generation of dysfunction and conflict. Perhaps Trump is naive to think so. Maybe his plan is a coarse appeal to personal gratification. Or maybe he is right.

In any case, it is what's coming next.

Everyone believes that prohibitionism works and never works. The progressive advocating for drug legalization believes just as fervently in the power of gun control as in the futility of banning pot. He doesn’t see the contradiction, because he knows that the drug laws never stopped him from getting high. But he would never want to buy guns, legally or illegally. So banning them should work. 

The first law of prohibitionism is that banning things other people want seems easy. But banning the things that you want appears impossible. Prohibitionism never works for you, but works for him. 

We ban all sorts of things. Many of them, like nuclear bombs or lethal toxins, are things that few would want. So prohibiting possession of them works fairly well. But when there’s significant demand, then no amount of legal and social sanction can stop a black market from continuing to operate in the shadows. 

Prohibitionism won’t entirely wipe out that black market. But that doesn’t mean we should stop trying. 

Nothing is as reviled in our society as the sexual abuse of children. Hardly anyone in the United States, on the left or the right Some of Europe’s Green parties have tried to legalize pedophilia, and the New York Times and Gawker, in its glory days, had pieces defending it will advocate legalization. 

Operation Broken Heart recently made 2,300 arrests for everything from child pornography to child trafficking. The investigation, which ran from March to May, received 25,000 tips. Those are horrifying numbers. And they show that, as the cliché goes, prohibitionism doesn’t work. It hasn’t stamped out traffic in the vilest crime that we can possibly imagine. But that also shows the limits of the cliché. 

No law will ever entirely wipe out certain crimes. But prohibiting them limits their prevalence. And it reduces the number of innocent victims. 2,300 or 25,000 are both horrifying numbers. But imagine how high they would be without prohibitionism. The laws we take for granted today weren’t always there. 19th century moralists campaigned hard for them by exposing the abuse of children in London and Paris. 

Prohibitionism has a strong moral component. That’s why it doesn’t work without social sanction. 

Social sanction and law enforcement can banish a behavior to the shadows. But without social sanction, the behavior reemerges into the daylight. And the calls for legalization swiftly follow. The enforcement of laws that aren’t backed by social sanction turns hollow and becomes a curious historical relic. 

Like Prohibition era cops raiding speakeasies and smashing barrels of moonshine with sledgehammers. 

The left dismantled social sanctions on drug use and gay marriage, but has spent three times as long trying and failing to impose social sanctions on gun ownership. That’s because dismantling social sanctions is easy. All it takes is demonstrating that a significant section of society practices the sanctioned behavior with no consequences. And is perfectly happy to go on doing so indefinitely. 

Social sanctions can’t be imposed on a divided country. And that’s just as true for the left’s sanctions. 

The left has failed to realize that it is much harder to build values in a divided society than to take them apart. If Kansas can’t change Hollywood, why should Hollywood be able to change Kansas? The cultural elites wanted immunity from the community values of the heartland. But having won all those battles, they hypocritically turned around and tried to impose their own values on the heartland. 

Hollywood has replaced the Hays Code that governed what could be shown on the screen with its code that, like the Hays Code, is designed to socially engineer values throughout the entertainment industry. This Hollywood Code, with its codicils about diversity, environmentalism, hostility to the military and endorsement of progressive values, is only faintly codified. But virtually everything you see projects it. 

But it is even more difficult to embed values remotely than it is to govern a country from far away. Making policy for the whole country in the Washington D.C. bubble backfires. Making values for the country in the Hollywood, Harvard and Manhattan bubbles is an even more doomed political project. 

The left’s moral panics, over gun control or global warming, are amplified through the megaphones of popular culture, academia and the media. They are dressed up in the traditional images of victimized children and total catastrophe. Not to mention the lab coats of science. But each time the panic comes up against the existence of the gun owners and truck drivers of the other half of the country. 

Our values reflect how we live. And people in Iowa and Nebraska are not going to live like New York or San Francisco no matter how much they’re scolded and hectored by their bicoastal betters. 

Moral panics are directed at populations, not behaviors. Prohibition targeted liquor at a time when that was the substance of choice for those on the lowest rung of the ladder. These days it’s drugs. But it was the social problems caused by that population living on the lowest rung that was the real issue. 

When a society is united, then its moral panics are aimed at pockets of misbehavior in the lowest and highest social spheres. But when it’s divided, then the moral panics are aimed broadly at the way the other half lives. And these panics serve only to reinforce the sense of superiority of the panickers. Every failed gun control bid ends with blue state lefties sighing in relief at their infinitely better way of life. 

Punitive prohibitionism in a divided society is just tyranny. All it does is deepen the existing social divide. 

Social sanctions don’t work when a society can’t agree on a common set of values. Attempting to impose them anyway leads to a social civil war of the kind that made President Trump a reality. 

"A house divided against itself cannot stand," Lincoln famously observed. Political divisions can be endured, but sustaining moral divisions in a single country requires an even greater compromise. And the left is not about to accept the same moral libertarianism that it had demanded throughout the twentieth century. It is convinced that it won. And winners don’t compromise. They take everything. 

But the left didn’t actually win. It just wrecked the house. It didn’t unite the country under its values. Instead its social catastrophes are destroying the very idea of values around the country and the world. 

Our values originated in religion. And that is declining across the country. They originated in communities that are being fractured by nationalization, globalization and the internet. And the left’s ideology will never replace religion and community for more than a tiny fraction of the population. Its experiments in the Soviet Union, the People’s Republic of China, Cuba and Europe have shown that. 

While the 1% of the leftist cult actually run a society, the other 99% retreat into hollow pursuits. Birth rates fall, suicide rates rise, alcohol and drug abuse run rampant as people lose any sense of purpose. 

We are beginning to see the same situation in the United States of America. 

While the left rants about gun violence, suicides far outnumber homicides. Our suicide rate continues to rise for reasons having nothing to do with the left’s moral panic about gun owners, but everything having to do with a lack of purpose and meaning. The loss of purpose and meaning is killing Americans. 

Prohibitionism represents a failure of values. Sometimes these failures are local. Other times national. 

Even the most morally divided society can still occasionally agree on things so reviled that they must be prohibited. But our society is losing its values and those we have are increasingly not the ones we have in common. The civil war tearing apart this country has its origins not in violence, but in values.

Marten Kudlis was separated from his parents while waiting for his mother to bring him his ice cream. The 3-year-old boy who had just been playing in the park never got his ice cream. 

Instead Francis Hernandez, an illegal alien driving 81 miles an hour, slammed into a pickup truck, killing the two women inside, and smashing it through the glass wall of the Baskin Robbins. 

Blood and broken glass covered the floor. Little Marten, who had just learned to ride a bike, died of a slashed jugular vein and was buried with a teddy bear. 

Francis Hernandez had been arrested 16 times in 5 years without ever being turned over to immigration authorities. That failure to enforce immigration law separated a little boy from his family forever. 

Advocates for illegal migration claim to be outraged by family separation. They want illegal alien invaders like Francis to go on separating American children from their families. What the fake news media falsely calls family separation is just arresting illegal aliens like Francis instead of releasing them. When previous administrations failed to enforce border security, they separated American children like Marten and many others from their parents forever. And the blood of those children is on the hands of the posturing politicians, activists and pundits who want to unite illegal aliens and separate Americans. 

In February 2018, the United States government separated Grace Aguilar from her parents. 

Grace was a bright and cheerful 6-year-old girl. While she was sitting by her favorite tree in the front yard of her family home, Maximino Delgado Lagunas, a Mexican illegal alien who had already been deported twice, ran her down. 

The illegal alien's blood alcohol limit was three times the legal limit. He had been arrested before for a DUI, but was put back on the street by local cops instead of being turned over to immigration authorities. 

Sanctuary city policies separated Grace, whose parents had tried to have children for 8 years, from her parents. The illegal alien who killed her had been deported twice, once under Bush and once under liar-nObama. The combination of lax border security by these two administrations and local sanctuary policies permanently separated the little girl and her parents. Unlike the illegal migrants whose plight is playing out on every cable news channel, the Aguilar family will never get their daughter back. 

16-year-old Kayla Cuevas and 15-year-old Nisa Mickens were separated from their parents when they were battered with baseball bats and butchered with a machete in a suburban cul-de-sac by illegal alien MS-13 members. 

The brutal illegal alien assault left the bodies of the African-American teenage girls, who had been out celebrating Nisa's birthday, barely recognizable. 

“There are days where you feel like you want your world to end, just like your child’s,” Kayla's mother said. “Then you realize you have a new purpose: to fight, so that your child’s death is not in vain.” 

10-year-old Alena Clay was separated from her family while walking down a bike lane with her 16-year-old sister and two other girls. Juan Carlos Ortega-Santos, an illegal alien, had no driver's license, no insurance and his blood alcohol level was far over the limit. 16-year-old Tyeisha Lacy, Alena's sister, pushed an 8-year-old girl out of Juan's way. But Juan slammed into the two Lacy girls killing them both. 

"He will never know the extent of the damage he did," Lakeenya Lacy, Tyeisha's mother, said in court. "You did not just take their lives. You took other people's lives with them." 

4-year-old Ellie Bryant and 22-month-old Grayson Hacking were separated forever from their mother when Margarito Quintero Rosales slammed head on into their car. Ellie, Grayson and Courtney Hacking's husband, Peter, were all killed. 

Rosales had been previously deported and had no license. He was sentenced to two years in prison. 

15-year-old Genesis Cornejo-Alvarado was separated from her parents when two illegal alien MS-13 gang members killed her in a satanic ritual after previously raping her and a 14-year-old girl. 

11-year-old Abigail Robinson and 6-year-old Anna Dieter-Eckerdt were separated from their parents while playing in a pile of leaves. Cinthya Garcia-Cisneros, who ran them over, was an illegal alien and one of Obama's DREAMERs. Despite killing the two girls, she was released from jail and allowed to apply for a Social Security number and a work permit. And that is exactly what illegal alien advocates want. 

When illegal aliens separate a child from her parents, no power on earth can undo that separation. 

The sheriff's department and volunteers searched hundreds of acres for 14-month-old Owen Hidalgo-Calderon. The body of his mother, 18-year-old Selena Hidalgo-Calderon, had already been found. 

Evarardo Donoteo-Reyes, a Mexican illegal alien who had already been deported twice, and convicted once of illegal entry, was charged with moving her body. 

10-year-old Kayla Gomez-Orozco went missing after church. Her body was later found in a well. The accused murderer was Gustavo Zavala-Garcia, her previously deported illegal alien uncle, who allegedly sexually assaulted her, beat her with a blunt object, choked her and then drowned her in the well. 

But sometimes illegal aliens don’t even bother separating parents and children. Marco Tulio Hernandez Ramirez was driving his employer’s van when he slammed into the Cannon family's Toyota Camry. 

His blood alcohol level was three times the legal limit, he didn’t have a license and was driving on the wrong side of the roadway. But the illegal alien survived to become a 40-year burden on taxpayers. 5-year-old Rose Marie Cannon didn't. Neither did Katherine Cannon and Russell Cannon.

Rose Marie had been given a dollar to spend as the family headed out to do their Christmas shopping. 

“And she died with that dollar in her hand," Louise Cannon, Russell's mother, said. "That's the most heartbreaking thing." 

"He gave them the death sentence," she said of Ramirez. 

But it wasn’t only Ramirez who did that. Ramirez had been deported before, but there he was back again. The failure to enforce immigration laws separated Rose Marie forever from her family. 

America is full of angel dad and moms whose children were separated from them by illegal aliens. 

Ray Tranchant was separated forever from his 16-year-old daughter Tessa, when Alfredo Ramos, a drunk illegal alien, slammed into the back of their car. 

"My idea of heaven", Tessa had written in her journal, "is a nonstop vacation on a tropical island … all the people I love would be there with me." 

Ray Tranchant has been fighting to prevent other American families from being separated from their child. 

And he’s not alone. 

The victims are all around us. These are only a handful of their stories. They are members of every race and religion. Some were born in this country and others came here as legal immigrants. 

We have a choice to make. 

Either we can detain illegal migrants crossing the border or we can let them all in. We can take the Merkel way out and hope that the family that pays the price for illegal migration isn’t our own. 

There are no apologies or excuses necessary for detaining illegal aliens who illegally cross the border. Even if we set aside minor matters like national sovereignty and the rule of law, the stories of these murdered children provide ample justification for arresting every single illegal migrant.

Either we separate illegal migrants from this country. Or they will go on brutally tearing families apart. And if we allow them to use children as human shields, then American children will pay the price. 

President Trump has called the media the “enemy of the American people.” It’s not just the enemy. Its manicured hands are covered in the blood of American men, women and children. The media advocates for drug dealers, for Islamic terrorists and for illegal aliens. The more Americans they kill, the more the media cheers them on. Justice Anthony Kennedy to retire from Supreme Court

He said the liberals want criminals to know that if they show up at the border with a minor and claim to be its parent, they get released into the U.S. He added, "The children will be abducted & sold to drug cartels & slave-traders as a free ticket into U.S."

Cotton, a supporter of President Trump on immigration, was absolutely right. So why did President Trump change his position about illegal border crossings?

The answer lies in a message sent by top Republican Rep. Steve Scalise to his supporters. It is headlined "liar-nObama's Third Term" and declares, " liar-nObama is back, and he's trying to take over. He set up permanent shop in Washington, DC. He's behind a Congressional redistricting scheme to erase Conservatives from the map. He's having secret meetings with potential Trump challengers."

This is called "Permanent Revolution," and it's the main title of our forthcoming book about Barack Hussein liar-nObama. Permanent revolution is a Marxist concept and revolutionary strategy that applies to "the modern era." The only way to bring down a modern capitalist state like America is by orchestrating conflict and the disintegration of society. That's accomplished through invasion and/or subversion. 

Rep. Scalise went on to say, "It's an American tradition that when a President steps down, he stops clinging to power. But liar-nObama isn't doing that. His election interference is completely unprecedented – and each new scheme is worse than the last. liar-nObama wants to be the man behind the curtains, hand-selecting the next Liberal President and pulling their strings."

The latest "scheme" is the well-orchestrated defeat of Trump's hardline stance on illegal border crossings. Obama smells blood. His forces on the left and in the media are mobilized and ready to take Congress this November. Then impeachment is on the table.

Of course, Obama never had any intention of going away. Scalise made the common conservative mistake of thinking that liar-nObama was just a liberal who respected American institutions. Analyst and author Trevor Loudon calls the political nature of these changes the "Rainbow conspiracy" and cites the Brown is the New White book by liar-nObama confidant Steve Phillips. They take the concept of Jesse Jackson's Rainbow Coalition and create a new American majority fusing communists, progressive whites, gays, transgenders, minorities, Islamists, and illegal immigrants. To facilitate this coalition, borders must remain open.

In addition to the various political components of the Rainbow Coalition, there are now literally millions of people who have embraced the New Age ideas of mysticism, atheism, and humanism. They follow nOprah and attend "metaphysical" churches and play with Ouija boards. Many smoke dope and go to "New Age" festivals and join cults.

Clearly, many are products of the Marxist Madrassas, also known as colleges and universities. But many in fact are using mind-altering drugs and hallucinogens. This isn't just on the fringe. A recent edition of nOprah's magazine recommended marijuana as the "new Merlot" and advised mothers as to how they can use and distribute the drug without getting caught. But the high potency marijuana being grown in California and Colorado and shipped across the United States can not only cause mental illness, but birth defects, low birth weights for babies, more emergency room visits, violence, and an increasing number of school problems. Cases of "scromiting," or screaming while vomiting, have been linked to marijuana use.

Conservatives can win if they remain resolute and stand firm. In Colombia, the slogan was "Vote so that Colombia does not become another Venezuela." New President Ivan Duque rejects the "peace deal" his predecessor made with the communist narco-traffickers known as the FARC. Brazil is waking up as well after suffering through two Marxist presidents and a mammoth corruption scandal. Meanwhile, conservative political leaders in a dying Europe are trying to save their Christian heritage from radical Islam and George Soros.

In America, that means holding the line on illegal immigration and pushing back against the madness of the drug legalization movement that liar-nObama and his billionaire backer scumbag-George Soros have been promoting. Trump's flip-flop on illegal border crossings is not a good sign.

If we maintain our will to resist, we might just be able to reverse liar-nObama's "permanent revolution," making it not so permanent after all. But at this point in time, based on President Trump's flip-flop on illegal border crossings, it looks like liar-nObama's third term may begin before Trump is finished with his first. Trump's political base is shaken to its core and the liar-nObama revolution is back on track. In fact, some fear that Trump may follow liar-nObama friend Justin Trudeau's lead in Canada and embrace some form of marijuana legalization here in the U.S. That's reportedly what his son-in-law Jared Kushner is pushing.

Legalization would create even more stoners to vote to carry on the liar-nObama revolution. They would then demand more tax dollars for prevention, treatment, and recovery services for those wasted by or addicted to the drug. The liberals would, of course, be more than happy to oblige with another government program.

This is how liar-nObama makes cannon fodder for the revolution, in the form of new "progressive" voters, and expands the power of the state. Heroin injection centers with free needles are the template for liar-nObama's Brave New World. Many will suffer and die. But the revolution will continue.

Syrian Refugees Begin Massing on Israel's Border

They say that being as close as possible to Israeli forces is the safest place to be, presumably because Syrian dictator Bashar Assad and Russia are wary of drawing Israel further into the country's bloody civil war. The Assad regime is feeling confident of late after managing to regain control over most of Damascus and its suburbs, with the help of the Russians. Mueller can continue to prosecute 

Manafort for matters unrelated to the campaign

{ legalinsurrection.com } ~ This morning in court on Manafort’s motion challenging Mueller’s authority to prosecute the bank fraud case... the Judge lashed out at Mueller and made some comments that echo the points I’ve been making all along. We don’t have a transcript, but we do have multiple news reports. From The Washington Post(emphasis added): A federal judge in Virginia on Friday grilled lawyers from the office of special counsel Robert S. Mueller III about the motivations for bringing a bank and tax fraud case against former Trump campaign manager Paul Manafort. “You don’t really care about Mr. Manafort’s bank fraud,” Judge T.S. Ellis III said during a morning hearing. “You really care about getting information Mr. Manafort can give you that would reflect on Mr. Trump and lead to his prosecution  or impeachment.” While this public lashing was correct, I cautioned about reading too much into it based on the news reports of the hearing...

SCOTUS Punts on Florist's Religious Liberty 

by Lewis Morris:  On Monday the U.S. Supreme Court vacated a unanimous Washington State Supreme Court ruling that a florist violated the state’s anti-discrimination laws by refusing on religious grounds to provide a floral arrangement for a same-sex wedding. The High Court ordered Washington’s court to rehear the case in light of its recent decision in favor of a Colorado baker who refused to create a customized wedding cake for a same-sex wedding.

             In Arlene’s Flowers v. Washington, shop owner Barronelle Stutzman was sued by the state of Washington and two homosexual men who solicited her services. One of the men was a longtime customer of Stutzman. When he asked her to create a floral arrangement for his wedding to his male partner, she respectfully refused. Stuztman said that creating the floral arrangement for a same-sex wedding violated her freedom of expression and ran counter to her religious beliefs. She offered to sell the customer a pre-arranged setting or loose flowers. She even gave him the names of other florists who could provide the services he sought. But that wasn’t good enough.
               Washington Attorney General Bob Ferguson sought to make an example of Stutzman, dragging her through an expensive legal battle that could shut down her business. Ferguson was true to form of the typical leftist crusader. He was not content to live and let live; he wanted to force Stutzman to comply, accept and even celebrate something that ran counter to her beliefs.
               This is very similar to what happened to Colorado baker Jack Phillips, who was persecuted for his religious views in refusing to create a special cake for a same-sex wedding. As with Stutzman, providing something off the shelf was not good enough for Phillips’s customers or the Colorado state authorities. They wanted him to play ball or face the threat of having his business destroyed.
               The Supreme Court ruled 7-2 in Masterpiece Cakeshop v. Colorado Civil Rights Commission that the state of Colorado had been particularly hostile to Phillips’s religious views. The justices declined, however, to go deeper and establish a broad definition of what constitutes infringement on religious liberties or freedom of speech and whether that infringement justifies the refusal to provide specially created goods or services. Instead, the majority pointedly noted that the decision applied to Phillips alone.
               That being said, it seems hard to imagine that the Washington state court will rule any differently in rehearing Stutzman’s case. So, it is a distinct possibility that the Supreme Court has not heard the last of her.
               In Stutzman’s favor, though, is the fact that the Supreme Court in Masterpiece and Arlene’s Flowers has made clear that states must neutrally apply antidiscrimination laws. Religious objections to what someone views as compelled speech cannot be viewed differently than other types of compelled speech.
               That is a major distinction that the media deliberately leaves out in reporting these cases. The public is left with the perception that Phillips and Stutzman are deliberately discriminating against homosexuals by refusing them service altogether. That is not the case.
               “I think the worst part is when they say I won’t serve gay people,” Stutzman has said. “That’s just not true. I’ve never discriminated against anyone in my life.”
               These business owners are trying to protect their artistic expression under the First Amendment. For now, the Supreme Court is letting the lower courts search for a solution that will protect these people from running afoul of antidiscrimination laws. That will only work so long as certain states don’t try to use those laws to wedge the public into accepting viewpoints that violate their religious or moral values. It’s one thing to allow same-sex marriage; it’s another entirely to force people who object to provide specific artistic services in celebration of it.
