It used, it seems, taxpayers' money, intended for the earthquake victims, to pay for "Caligula-style orgies". It also fired the actresses Kristin Davis and Scarlett Johansson, who volunteered as Oxfam "ambassadors," after they appeared in advertisements for Israeli companies. Unconstitutional No-Fly, No-Buy Won't Prevent Mass Murder 

by Louis DeBroux:  Watching the CNN town hall following the Parkland massacre — in which Republican Sen. Marco Rubio and NRA spokeswoman Dana Loesch were accused of being Nazis and complicit in the 17 deaths at Marjory Stoneman Douglas High School for daring defend the Constitution — reminds us of a truth written by 19th-century British journalist Walter Bagehot. He declared, “A democratic despotism is like a theocracy: it assumes its own correctness.”

          During this inquisition, whenever Rubio or Loesch attempted to introduce facts or reason into the gun debate, a howling mob screamed and shouted them down. The mindless outrage, refusing to allow a different opinion to even be spoken, was reminiscent of the “Two Minutes Hate” in George Orwell’s dystopian novel 1984 — every citizen screaming hate and fury for exactly two minutes each day while watching a film depicting the state’s enemies.
          This is what public debate has been reduced to, with one side demanding the constitutional rights of law-abiding citizens be stripped without due process, and accusing any dissenters of the most malevolent motivations and a desire to see children die gruesome deaths. It leads to a sort of security theater where “solutions” are proposed that do nothing to address the actual problem.
          And while this is being mostly driven by Democrats (who, as Justice Clarence Thomas notes in his concurrence in the McDonald v. Chicago case, originally passed gun control laws in order to leave blacks defenseless against KKK mobs), even a few Republicans have joined in, most notably Arizona’s retiring Sen. rino-Jeff Flake.
          rino-Flake introduced a bill that recycles a 2016 bill dubbed “No-Fly, No-Buy,” which would prohibit anyone on the federal government’s no-fly list from exercising his or her Second Amendment right to keep and bear arms.
          As The Federalist’s David Harsanyi notes,“One day Sen. rino-Jeff Flake is warning America about rising Stalinism and the next he's supporting a bill that strips the rights of citizens who’ve been arbitrarily placed on secret government lists without any probable cause or due process.”
          Indeed, rino-Flake’s bill represents an egregious infringement of the citizens’ First, Second, Fourth, Fifth and Sixth Amendment rights, giving often incompetent and/or abusively partisan bureaucrats the power to prohibit both travel and self-defense based on an inaccurate, extrajudicial government list.
          Both the NRA and the ACLU, which agree on very little, nevertheless concur that the “No-Fly, No-Buy” bill is bad legislation, and even leftist rags like The New York Times and Los Angeles Times published editorials in 2014 arguing that such a ban is unconstitutional.
          Why? The no-fly list is arbitrary; hundreds of thousands of Americans placed on the list have not only committed no crime but are not even suspected of committing a crime. By the government’s own admission, 40% of those on the watchlist have “no affiliation with recognized terrorism groups.”
          The Washington Examiner’s Philip Wegmann reports, “According to congressional testimony from 2014, the FBI estimates that those lists ‘currently stands at about 800,000 identities.’ Those names aren’t public though, and neither is the selection criteria. There is only one way to find out if your name is in that database: try boarding a plane.”
          The watchlist is so riddled with errors that Congressmen Tom McClintock (R-CA) and John Lewis (D-GA), as well as the late Sen. Ted Kennedy (D-MA) found themselves on it. Despite their connections, it took months to get them removed. Granted, Kennedy probably should not have been allowed to drive a car, but that was no reason to keep him from flying. Regardless, if it took a U.S. senator and a congressman months to get off the list, what chance does the average citizen have of righting this injustice?
          Though Democrats are pushing the bill, minorities will be hurt most, especially those of Middle Eastern descent with names similar to actual terrorists. That may seem ironic — until we consider the effect of most Democrat policies. Still, one would think Lewis, who gained fame for bravely defying racist Democrats while crossing Selma’s Edmund Pettus Bridge in 1965 and who was beaten with nightsticks by state troopers, would understand the right to defend oneself from violent criminals and tyrannical government alike is not a right to be lightly infringed upon. Alas, he does not.
          While in the aftermath of this horrific tragedy it’s understandable that many feel a desire to do something, anything, to fix the problem immediately, the reality is that the solution will not be found in the law but in the culture; and an angry, screaming mob mentality that sacrifices Liberty for political expediency and a false sense of security is unworthy of the highest traditions of the American founding.
          We wonder how quickly Democrats would change their tune if the proposed law prohibited these “potential terrorists” from voting or having abortions (after all, at least one innocent child is killed in every one of the 900,000 abortions performed annually in the U.S.).
          Strange indeed that Democrats still call for the closing of the terrorist detention center at Guantanamo Bay, declaring it a moral evil to imprison foreign enemy combatants without due process, even demanding constitutional rights for them. Yet these same Democrats (and, evidently, some Republicans) are all too eager to deprive actual American citizens, who have NOT been caught engaging in a violent act and who have NOT been accused (much less convicted) of a crime, of their own right to self-defense and free travel.
          Guns are the tools of these mass shootings, not the cause. The cause is a society that no longer respects the sanctity of human life. The cause is a society that actively erodes the traditional family bonds that create good and decent citizens. The cause is a society that immerses itself in graphic depictions of violence while pretending it has no impact on our collective psyche.

DOJ Sues California Over Immigration Obstruction 

by Nate Jackson:  The Justice Department filed suit Tuesday against the state of California over the Golden State’s obstruction of federal immigration law. Specifically, the DOJ seeks an injunction against three recent California laws that are deliberately interfering with immigration enforcement. One law prevents businesses from cooperating with Immigration and Customs Enforcement (ICE) officials by giving workers extra “protections.” Another grants authority to state officials to inspect and monitor Department of Homeland Security-run detention facilities in California. And the third is the infamous sanctuary state law that took effect Jan. 1 — the law prohibits state or local law enforcement officials from notifying their federal counterparts when an illegal alien ends up in custody, or from transferring those prisoners.

          Laws meant to protect the lawless are ironic, indeed. “The Department of Justice and the Trump Administration are going to fight these unjust, unfair and unconstitutional policies,” said Attorney General Jeff Sessions. Last year, the Justice Department also moved to defund sanctuary cities, which is being challenged in court.
          California is a key battleground because an estimated 2.5 million illegals reside there. That number will no doubt increase. State Attorney General Xavier Becerra, who is named in the DOJ suit, insists California will continue to “keep our communities safe.” In fact, he argues, “We believe we are in full compliance with the federal Constitution and federal law.” Democrats sure have a funny way of defining those terms.
          In some cases, the state is doing even more than claiming supremacy of state law over federal law, in violation of the Constitution’s Supremacy Clause (Article VI, Clause 2). One example is the recent case of Oakland’s Democrat mayor, Libby Schaaf, publicly warning illegals of upcoming ICE raids, saving an estimated 800 illegals from arrest. It’s one thing to leave enforcement of federal law to the feds and another to actively obstruct that enforcement. Such is the way of today’s Democrat Party.   ~The Patriot Post

Department of Justice (No. 1:12-cv-01510)). Typically, a Vaughn index must: (1) identify each record withheld; (2) state the statutory exemption claimed; and (3) explain how disclosure would damage the interests protected by the claimed exemption.  A federal court had ordered the production over the objections of the liar-nObama DOJ. The document details the Attorney General scum-Holder’s personal involvement in managing the Justice Department’s strategy on media and Congressional investigations into the Fast and Furious scandal. Biggest Driver of Inflation Is the Government

by Political Editors:  Much of the recent volatility in the stock market can be attributed to growing fears over the Federal Reserve enacting interest-rate hikes due to concerns over increasing inflation. On the subject of inflation, however, it is the government’s meddling in the market that tends to be the greatest contributor. Economist Mark Perry, who has tracked changing prices for over two decades, has noticed a common trend with the price of various goods and services — costs have increased over the inflation level for those goods and services that have lacked competition. This should be no surprise to conservatives.

          Specifically, those goods and services that have seen the greatest overall price increases are in the fields of medical and education-related services. And those two fields are most directly impacted by the government’s intervention in the marketplace, via subsidy and regulation. As the costs for health care and schooling only continue to increase, they in turn significantly impact the overall rate of inflation.
          As Investor’s Business Daily explains, “All that subsidy money was premised on the goal of making these things [health care and schooling] more affordable. The result is, for many, the exact opposite. By paying most of the tab, the government has insulated consumers from the true cost of these things — a recipe for runaway prices.”
          In short, much of the stock market’s current uneasiness can be laid directly at the feet of government for its work to limit competition, all in the name of making these goods and services more affordable. In the end, the American taxpayer is left footing the bill.

Why Antonin Scalia Still Matters 

by Todd Johnson:  This upcoming Sunday would have been Antonin Scalia’s 82nd birthday. In the two years since his untimely passing, his towering intellect and animated presence has been sorely missed on the Supreme Court — notwithstanding the good work of Neil Gorsuch. A legal titan, Scalia’s strict adherence to the concepts of textualism and originalism made his written opinions “must read” material for the conservative movement. Sadly, his passing silenced a significant voice in the judiciary, but thankfully, he left us with a voluminous amount of public speeches and opinions that should serve as a beacon to all Americans who believe in the conservative cause in 2018.

          Scalia devoted his life to the study of the law, and more importantly, the Constitution. A voracious reader throughout his life, Scalia learned that the creation of the Constitution was the result of compromise and, as he stated in a speech in 1991, “a spirit of humility.” His respect and admiration for its creators led him to view their product as “not living, but dead, or, as I prefer to call it, enduring. It means today not what current society, much less the court, thinks it ought to mean, but what it meant when it was adopted.”
          He was a firm believer that the role of the United States judiciary was to interpret laws, but not in a way that would usurp power from the legislative or executive branches.
          In an era where many people seek to denigrate the contributions of our Founding Fathers, Scalia’s lucid prose serves as a clarion call to truly understanding what makes our nation so unique and special. He challenged all of his fellow citizens to read and study The Federalist Papers because, “The Constitution will endure … only to the extent that it endures in your understanding and affection.”
          That is why Scalia was such a staunch advocate of an informed citizenry. He realized that the fate of the country was dependent upon the civic and moral education of its people. That’s why one of the main themes in many of his speeches was virtue.
          In the critically acclaimed book, Scalia Speaks: Reflections on Law, Faith, and Life Well Lived, the editors illuminate the late justice’s passion for education and advocacy for people to get involved in the political process. Scalia said that the limitations on democracy can only be defined by the people themselves, not a committee of judges. “And it is only the people themselves who can add or subtract from those limitations, through the amendment provision of the Constitution.”
          That is why it is imperative that Republican voters make the effort to campaign, as well as vote, in this fall’s upcoming election. The last mid-term election (2014) saw the lowest turnout rate in 70 years. Couple that with the fact that only twice since World War II has the minority party not picked up seats and you have a scenario where every vote will have a real impact on the future of our country.
          Justice Scalia believed that the future of the United States was only limited by the willingness of its people to get involved and make a difference. Out of the thousands of words that he composed during his lifetime there is one passage that truly captures the essence of his love for America:
          “It is a belief that seems particularly to beset modern society that believing deeply in something, and following that belief, is the most important a person can do. … I am here to tell you that it is much less important how committed you are than what you are committed to.”
          Only time will tell if conservatives will heed this call to action.   ~The Patriot Post

Hollywood's Self-Inflicted Ratings Deflation Continues 

by Thomas Gallatin:  Over the weekend, most of America missed watching the 90th Academy Awards. Put another way, this year the award show set the record for the lowest viewership ratings in Oscars history. In fact, total viewership dropped a whopping 20% from last year alone, continuing a downward trend for Hollywood’s premier awards show. Jimmy Kimmel, the hypocritical late-night talk-show host and leftist demagogue, hosted the award show for a second consecutive year and his polarizing presence certainly didn’t help matters.

          It was a surreal combination of Kimmel’s preaching to the choir and Hollywood stars’ virtue signaling their leftist dogma ad nauseam. They ignored their own blatant hypocrisy, all the while congratulating themselves on being the culturally “woke” arbitrators of morality — a nauseating recipe for unwatchable TV. So many Americans simply tuned out and chose to spend three hours Sunday evening engaged in less vacuous pursuits. Honestly, how many people will tolerate being told, “Do as we say, not as we do?”
          Following the show, James Woods, one of Hollywood’s few conservative actors, tweeted, “Sad. How can Hollywood stop itself from alienating its audience?” President Donald Trump had a more humorous take, tweeting, “Lowest rated Oscars in HISTORY. Problem is, we don’t have Stars anymore — except your President (just kidding, of course)!”
          The fact of the matter is that Hollywood has long been a bastion of the Left, propagating its fantasy so incessantly it has become an ideological and isolated echo-chamber that has completely lost touch with real life in America. These Hollywood elites blame their own glaring sins on the rest of America and supposedly backwards conservatives rather than turning introspectively and seriously examining how — maybe, just maybe — they are their own monster.   ~The Patriot Post

American sports fans have grown accustomed to the use of instant replay to correct the erroneous judgments of officials that cause game-changing inequities. The United States Senate must now pass the House’s legislative version of instant replay to correct a game changing “bad call” that threatens to permanently silence many local radio and television stations across the nation and harm the public thereby. 

On February 22, 2012, Congress signed P.L. 112-96, codified at 47 U.S.C.A. § 1452. That law, with the marvelously transparent and typically utopic Obama-era title of: “The Middle Class Tax Relief and Job Creation Act of 2012,” among other things, contained Title VI, or the “Spectrum Act.” The Spectrum Act ambitiously seeks to resolve a long-festering broadcast frequency/spectrum crisis through reallocation of the existing frequencies assigned in the broadcast spectrum for television, radio, wireless communication, and public safety broadband networks on a nationwide basis.

These broadcast spectrum assignments often dated from the dawn of television network broadcasting. The broadcast frequency assigned to a broadcaster is valuable property and represents the “real estate” owned and occupied by the broadcast station as the place it does business. Washington bureaucrats unequivocally promised that no broadcaster’s signals or business would be negatively affected under the Spectrum Act because all broadcasters would simply receive a new spot on the MHz bandwidth.

The reallocation idea, a very good one in theory, was to establish a process for television broadcasters to release spectrum licensed to them for auction as commercial licenses to be “repacked” by the FCC for greater efficiency and for other more modern like high-speed wireless broadband.

The Spectrum Act’s “incentive auction” concluded on March 30, 2017. In total, the FCC repurposed 84 MHz of spectrum, yielding $19.8 billion in revenue, and more than $7 billion in clear governmental profit – by most measures, an overwhelming success.

However, Congress did make one bad call – an unintended oversight – in the early innings that have made a win, or even sustained survival, nearly impossible for some broadcasters. Structural upgrades on TV towers will necessitate spending on renovations and has forced affected broadcasters to look for new channel assignments – a task that must be completed thirty-nine months from the auction close date, e.g., June 30, 2020.  In 2012, Congress anticipated these costs, or presumed they did, and earmarked “$1,750,000,000 of the proceeds from the incentive auction of broadcast television spectrum …. shall be deposited in the TV Broadcaster Relocation Fund”, see 47 U.S.C. §309(j)(8)(G)(ii)(I).

Unfortunately, many broadcasters – most of them small, rural, and local - are in danger of losing a significant amount of their audience reach because the auction and repacking failed to contemplate the full financial impact of the Spectrum Act on the low-power television stations, as well as the over 600 AM and FM radio stations that co-locate their antennas.

A total of 175 television broadcast stations participated in the auction, but over 950 TV stations did not put their spectrum up for bid and are nonetheless still forced to relocate to new channel frequencies. Therefore, while 85% of these broadcasters did not “sell” their frequencies, the government took them and must be liable to protect their ability to broadcast. As for radio stations, they have received nothing and will not receive a thin dime under the Spectrum Act as written. As a result, the Spectrum Act has the potential to silence many consumers’ local radio broadcasts and blackout or substantially limit 85% of the noted local television broadcasts.

Now, it is up to Congress to use a legislative “instant replay” to correct the missed call that if unchanged will unfairly cause game-changing social, financial and cultural losses. This week, The House of Representatives already approved this legislative remedy under H.R. 4986, RAY BAUM’s Act. Now, the Senate just needs to get on board. If they need any convincing, they should consider the constitutional implications of this decision.

The Takings Clause of the Fifth Amendment of the United States Constitution provides that private property shall not “be taken for public use, without just compensation.” As the Constitution’s text makes clear, the Takings Clause does not prohibit the government’s taking of private property, but instead places a payment condition of “just compensation” on the exercise of that power.  Lawsuits involving the Takings Clause are called eminent domain actions. The overriding principal of eminent domain is the constitutional philosophy that the government shall not force individuals to bear public burdens which should be borne by the public as a whole. That guiding principle fits the disparate impact suffered by radio and television broadcasters via  the Spectrum Act like a glove.

Some argue that the eminent domain causes of action for deprivations of broadband frequencies are not fully assured due to clauses within the Communications Act of 1934. However, the broadcast licenses at issue have the two primary hallmarks of property: transferability and exclusivity. Therefore, a very strong argument can be made that the Spectrum Act, if left uncorrected, constitutes an unconstitutional regulatory taking under the Fifth Amendment to the United States Constitution.

It is manifestly clear that those silenced and bedarkened broadcasters that do not receive sufficient amounts from the reserved relocation funds are being forced to bear the public burdens of reallocation of the broadcast spectrum which, in all fairness and justice, should be borne by the public as a whole.

Additionally, license renewal is admitted by the FCC to be routine and perfunctory. Therefore, the expectation of continued use of the assigned broadcast frequency creates an expectation interest in the frequency assignment that is treated like property. As it is, the broadcasts are pledged as collateral and supported by extensive investment in manpower, advertising, customer goodwill, equipment, programming, and content to create profits, all of which would disappear if the assigned broadcast frequency is taken.

The assigned broadcast frequency is a tangible “thing”; an electromagnetic space that is occupied exclusively by a broadcaster. In that regard, it is no less of a protectible property than land, home, water, farm, factory, or grove. Regardless, the Supreme Court has long recognized that intangibles can be property subject to the Takings Clause.

Finally, an eminent domain action may be preserved based upon the “unconstitutional conditions doctrine” established by the United States Supreme Court in property development cases. The unconstitutional conditions doctrine holds that “the government may not deny a benefit to a person because he exercises a constitutional right”. In this case, the requirement of alleged waiver of property rights by the broadcaster in application of the right to receive a broadcast frequency would arguably be violative of the Nollan/Dolan doctrine, named after two U.S. Supreme Court decisions which hold that the Government cannot pressure a person or business into voluntarily giving up property rights for which the Fifth Amendment would otherwise require just compensation in exchange for a license or permit.

Left without an adequate legislative remedy for this “blown call” in the Spectrum Act, affected broadcasters would be forced to seek judicial remedies. These potential lawsuits would involve not only eminent domain claims arising under the Fifth Amendment Takings Clause but claims for denial of Equal Protection, potential Section 1981 of the Civil Rights Act claims, as well as potential breach of contract, quasi-contract and tortious interference claims.

This is an important scenario to keep in mind because, if successful, these litigants harmed by the Spectrum Act would stand to recover damages for future lost profits, business expectations and other damages that would far exceed the relocation costs denied them by the inadequate reserves. Additionally, attorneys’ fees, interest and potentially other damages may be available that would dwarf the relatively microscopic costs of fixing the myopic bad judgment call of the 2012 Congress.

We, the people, are the home team in this dispute. Thankfully, Congress has very recently shown promising signs of moving forward in unison to correct their error. As the home team, let us not rest until the umpire (Congress) gets the call right and fixes the game changing short-sighted error that may cause the broadcast stadiums to go dark and the microphones to fall silent. 

An explosion of litigation to fix the wrong is not a better “fix”. It will be harmful to the general public if the broadcasters fail in their quest for damages in the stead of Congressional action or if they fail and the broadcast landscape becomes barren, silent, and dark. Neither scenario provides a winner., The only winning scenario is if Congress revisits the one oversight it had in this otherwise commendable, pro-consumer incentive auction and rectifies its currently unfunded government mandate.

Guns and the System SNAFU 

by Robin Smith:  Used in the military during World War II, an acronym emerged to sum up a situation that was error-filled yet accepted as normal. It’s had several iterations, a cleaner one of which we’ll use here: SNAFU — Situation Normal: All Fouled Up. That can be applied to before and after of the Parkland, Florida school shooting. The systems in place were supposedly operational and personnel allegedly trained, yet these folks unquestionably ignored red flags and abandoned protocol to produce the landmark failure surrounding the atrocity.

          The horror that occurred on Valentine’s Day and Ash Wednesday ended in the loss of 17 lives at the hand of a troubled 19-year-old. It has mobilized many to activism (legitimate or exploited) and has stirred public debate on many issues that permitted this horrific crime — some that are nothing more than straw arguments to avoid addressing the root causes. But under all the opportunistic political theater demanding gun bans and dramatic controls of constitutional Liberty lies failure. The failure of systems already in place.
          Patriot Post readers have certainly learned of the abysmal failure of existing systems in place that should’ve prevented this young man from having a gun or from being inside a school. And you know that more laws can’t stop the manifestation of evil in the hearts of those intent on doing harm to others — those whose minds are afflicted with mental illness and a distorted reality.
          After a reported 45 calls to the Broward County Sheriff’s Office, at least two specific interactions with the FBI and the fact that the troubled shooter, previously expelled from school, was also prohibited from carrying a backpack on campus, folks around the perpetrator had seen something and said something. Yet the authorities in place to implement systems of safety and enforcement failed to do anything. They failed to work within existing systems, rules, laws and regulations to stop crimes.
          These system failures, however, are truly a SNAFU — chaos that has happened before and, sadly, will happen again, despite the hashtag herald of #NeverAgain.
          In the Texas church shooting, where the NRA instructor with his own AR-15 and a good Samaritan stopped a man whose domestic violence and troubled record was not adequately captured by the Air Force updating his criminal record, a system failure occurred. Even one of the bombers In the Boston Marathon bombing had been brought to the attention of the FBI at least twice, yet they killed, maimed and terrorized with pressure cooker bombs.
          So the public parade marches on to stop “gun violence.” In the last few weeks, one proposal seems logical and worthy of discussion. Understand, however, that even if a law is passed in various states, it will only be successful to the degree of enforcement and observance.
          Florida Republican Senator Marco Rubio responded to the public flogging he took at the CNN town hall meeting — which included him being equated to the actual shooter and lampooned as a prostituted puppet of the NRA — with several legislative fixes. The 2016 GOP presidential hopeful has announced his support of the “Stop School Violence Act” that creates school assessment and crisis intervention teams to work with law enforcement in identifying troubled students. Rubio also called for the expansion of background checks for gun purchases and incentives for states to fully report relevant information to boost the accuracy and usefulness of the National Instant Criminal Background Check System, which according to a November 2017 article has the NRA complaining of over seven million missing records to the FBI-run database.
          Among the Rubio proposals, Gun Violence Restraining Orders (GVROs) are based on common sense and empower individuals closest to a potential threat to intervene rather than waiting on layers of systems that, based on recent activity, have failed.
          GVROs are temporary court orders to remove guns or prevent purchases for individuals identified through evidence to be a threat, rather than limit the rights of a larger group. GVROs would require the petitioners to produce evidence that an individual was presenting as a potential threat (screen captures of social postings, writings of an individual or sworn testimony). The GVROs would permit due process in that the individual in question would be permitted a response to the evidence with the ability for an emergency hearing, should those circumstances dictate. It’s a high burden of proof before a local judge.
          These temporary orders are already in practice in several states — Connecticut, Washington, Oregon, Indiana and California — and 18 other states are considering them. Similar in nature to restraining orders and orders of protection issued in the cases of domestic violence, the GVROs would be a local, individually applied tool that would involve only parties suspected of being capable of harm to oneself or others, in contrast to sweeping gun bans.
          Caution, as with the other temporary court orders, must be exercised. A court order is effective, whether involving a removal of guns or an enforcement of a distance or other specified relief from an adverse party, if the named respondent follows the rules and observes the terms of the restraining order. While these orders can and have been effective, they can also create a false sense of security from individuals who, by their very nature, do not obey laws nor have the capacity to honor established rules.
          SNAFU will continue until and unless the authentic causes of violence are addressed, whether guns are involved or not. Those on the Left reject individual responsibility and Liberty and demand protections as wards of the state, regardless, that include gun control and the elimination of many facets underpinning the Second Amendment. Those on the Right know that fatherless homes, the casual and regular use of psychoactive substances that cause and mimic mental illness, the devaluing of life along with the glorification of violence in media and the plague of a valueless society that embraces politically correct approaches to law enforcement, mental illness and society writ large are key contributing factors to not only violence but so many of our societal ills.
          Situation Normal: All Fouled Up truly captures the failure of current systems due to the incompetence and timidity of those put in place to employ current law, regulations and standards. Demand leaders who lead versus those who agitate, pontificate and stagnate the necessary debate, legislation and governance to be a functioning, decent society.   ~The Patriot Post

It's the Cronyism, Stupid 

by Nate Jackson:  A funny thing happened on the way to Delta Air Lines showcasing its “woke” political activism — it lost $40 million to the state of Georgia, where its Atlanta hub is. Delta was one of the numerous companies that, in knee-jerk response to the Florida massacre, dumped partnerships with the NRA. The shooting had nothing to do with the NRA, but grandstanding trumped common sense. As we noted at the time, Georgia Republicans responded almost immediately by refusing to restore Delta’s tax break.

          Erick Erickson explains, “Up until a couple of years ago, Delta had a special perk in the Georgia tax code. It was exempt from paying sales tax on aviation fuel. Other airlines had to pay the tax. Delta did not. When the state reassessed how it calculates and collects transportation taxes during the recession, Delta lost its perk. Delta has lobbied for it ever since.” And the air line won’t get it back.
          Now for the even funnier thing — because criteria for the NRA discount was so specific, just 13 Delta passengers ever bought tickets with it. Losing $40 million for 13 people works out to about $3 million per discounted ticket. In other words, these corporate do-gooders just made one really expensive virtue signal.
          Still, as much fun as schadenfreude can be, this leads us to the larger point that cronyist tax breaks are a fundamentally bad idea. Unfortunately, every state and governor, as well as every city and mayor and every elected official of either party anywhere in between, offers sweetheart tax deals to corporations for locating in that city or state. Bipartisanship! And this corrupt income redistribution leads to all kinds of ugly stuff. For one thing, Delta lobbies in Georgia for all sorts of leftist causes and against conservative ones — like the state’s Religious Freedom Restoration Act, which Republican Gov. Nathan Deal vetoed in 2016. In this case, however, Delta probably has a case that Georgia Republicans are violating its “freedom of association” rights by using the tax code as retribution for a political stance. Neither would be an issue if it weren’t for such anti-free-market favoritism in the tax code.
          What Delta did was inexcusable political opportunism, but the greater fault lies with Georgia and every other state that favors big, leftist corporations at the expense of small businesses and American taxpayers.  ~The Patriot Post

{ townhall.com } ~ Behind the front-page indictments issued by Special Counsel Robert Mueller, there have been quiet movements in the courts on another front.

These developments have led supporters of former National Security Adviser Michael Flynn to call on President Donald Trump to pardon Flynn, or on Flynn to withdraw his guilty plea for making "materially false statements and omissions" to the FBI in 2017.

The developments are:

--Rudolph Contreras, the federal judge who accepted Flynn's guilty plea on Dec. 1, took himself off or was taken off the case for undisclosed reasons.

--His replacement is Emmet Sullivan, a crusading federal jurist who in 2009 famously lambasted federal prosecutors who had won a conviction against U.S. Sen. Ted Stevens, R-Alaska, for repeatedly withholding exculpatory evidence from Stevens' legal team.

Later, newly installed Attorney General scum-Eric Holder asked that all charges against Stevens, who was convicted in October 2008, be dismissed. Stevens' conviction was overturned, but only after the scandal-soiled senator narrowly lost his bid for re-election.

Ever since then, Sullivan has made it a practice to order prosecutors to share information favorable to a defendant with the defense team. As Flynn awaits his sentencing, Sullivan issued one such order in December. He did so again on Feb. 16, with the important instruction -- that if prosecutors aren't sure if favorable evidence is material, they should hand it over to the judge so that he can decide.

Another straw in the haystack: Relying on anonymous sources, the Washington Examiner's Byron York recently reported that former FBI Director James Comey told Capitol Hill lawmakers in March that FBI agents who interviewed Flynn did not believe he had lied to them about his December discussions with then-Russian Ambassador Sergey Kislyak. If withheld, that information might have kept Flynn from cutting a deal.

According to York, then-Acting Attorney General Sally Yates "reportedly believed Flynn might have violated the Logan Act," a 218-year-old law that is supposed to keep private citizens from conducting diplomacy on their own. Yates sent two FBI agents to talk to Flynn a second time.

Without a lawyer present, Flynn spoke with the agents on Jan. 24, 2017.

Two days later, Yates warned the White House that Flynn could be in danger of blackmail because he had lied to Vice President Mike Pence about the content of his December conversations with Kislyak, which the intelligence community had tapped.

Trump fired Flynn for lying to Pence.

Trump also fired Yates for refusing to enforce his first travel ban. And he fired Comey in May.

Sullivan's instructions and past history have led sympathizers to wonder if federal prosecutors withheld important evidence from Flynn's legal team.

"Of course, the point is moot now because Flynn has admitted his guilt," former federal prosecutor Andrew McCarthy wrote in National Review in December. "Still, I wonder whether Mueller's team informed Flynn and his counsel, prior to Flynn's guilty plea to lying to the FBI, that the interviewing agents believed he had not lied to the FBI."

Michael Ledeen, a Flynn friend who has written multiple books on national security, said, "I want the whole case thrown out. I do not believe for a minute that he lied to the FBI."

Tom Fitton of the conservative gadfly group Judicial Watch had the same reaction. Mueller's investigation, Fitton charged, is "out of control" -- and as far as Fitton is concerned, Flynn would not lie.

Ledeen thinks Flynn cut the deal with Mueller to protect his family, perhaps to shield his son from prosecution.

Here's the problem, countered Max Bergmann senior fellow at the left-leaning Center for American Progress. In the plea deal, Flynn admitted he's a liar. "I think if you plead guilty to lying," that's a hard admission to walk back.

Bergmann added that in March, Flynn offered to talk to House and Senate investigators if they granted him immunity from prosecution. "That's not the action of someone who feels like they're innocent," he said.

Trump would agree. During the 2016 campaign, when aides to liar-Hillary Clinton invoked the Fifth Amendment, Trump told an Iowa rally, "If you're innocent, why are you taking the Fifth Amendment?"

Then there's the matter of Flynn's failure to register as a foreign agent when he represented repressive Turkey during the 2016 campaign. Bergmann said he believes that Mueller went easy on Flynn by not pressing more serious charges against him. If Flynn takes back his guilty plea, Mueller would be free to throw a heavier book at Flynn.

Will Mueller produce a case that the Trump campaign colluded with Russia, as some Democrats contend? Or will a federal judge produce a case for prosecutorial overreach, as some Republicans suggest? Stay tuned.

ISIS supporter tried to recruit 

55 children for attacks in London

The thwarted plot was conceived by Umar Ahmed Haque, a 25-year-old from east London who worked as an administrator at “an after-school madrasa at Ripple Road Mosque in Barking.” Two other men were also convicted of playing supporting roles in Haque’s scheme, which targeted “up to 30 groups, businesses and establishments in London.”  UK counterterrorism officials first became suspicious of Haque in Apr. 2016, when “police officers stopped him at Heathrow Airport as he attempted to fly to Istanbul, Turkey.” Istanbul has been a common transit point for jihadists seeking to join the Islamic State or other groups in Syria. The officers discovered that Haque’s phone has been used to perform “detailed searches for terrorist attacks and executions.” Although he couldn’t be charged at the time under existing laws, Haque’s “passport was revoked by the Home Office under Royal Prerogative.”...

Facebook's Fake Fact-Checkers Bust The Babylon Bee 

by Thomas Gallatin:  One of our favorite satire sites, The Babylon Bee, recently ran a humorous story entitled “CNN purchases industrial-sized washing machine to spin news before publication.” Hours later, Adam Ford, the Bee’s founder, received a notice from Facebook warning that his story had been flagged as false content by its “independent fact-checker” Snopes. Furthermore, the social media giant threatened, “Repeat offenders will see their distribution reduced and their ability to monetize and advertised removed.”                                             To say the least, Ford was surprised — not over being “fact-checked,” as this was not the first time that Snopes has “fact-checked” The Babylon Bee, but rather by the action taken by Facebook. Ford stated, “This is the first time Facebook has used that to threaten us with reduced reach and demonetization.” He added, “Also it seems that anyone who clicked on the article got a notice that it was ‘disputed.’”
          Hours later, after suffering a fully deserved barrage of blowback and mockery, Facebook later admitted its action was a mistake: “There’s a difference between false news and satire. This was a mistake and should not have been rated false in our system. It’s since been corrected and won’t count against the domain in any way.”
          Like Google’s YouTube, Facebook has sought to censor and limit what it calls “fake news” and has increased its efforts since Donald Trump’s election. As part of its anti-fake news efforts, Facebook has teamed up with several leftist “fact-checking” groups. One of these organizations, PolitiFact, explained its work with Facebook, stating, “Our partnership with Facebook is part of a push by the social media company to clean up its news feed and become a more trustworthy platform.” PolitiFact's Aaron Sharackman added, “Facebook introduced a new tool after the 2016 campaign that allows users to mark a post as a ‘false news story,’ and if enough do, the post is sent to fact-checkers like PolitiFact, Snopes and Factcheck.org.”
          Following his recent experience with Facebook, Ford opined, “There is no question in my mind that Snopes and Facebook are biased against conservative-leaning content. It’s clear that this is the case. { rickwells.us } ~ More than once over the past few months, and as recently as the end of January this year, Rep Trey Gowdy... urged Republicans to leave Robert Mueller “the hell alone.” He’s consistent, now stating in a national television interview that he’s got a lot of confidence in the DOJ Inspector General to hold Andrew McCabe accountable for leaks. Leaks are bad enough, but they are hardly the most egregious offense by Andrew McCabe, who led an attempted coup against President Trump. Is this some attempt to minimize the offenses, setting the table for a future plea deal of some sort and the continued obstruction of justice? Gowdy sounds great sometimes but there are more than a few instances where what he’s saying just doesn’t sound right. And it’s also worth noting that the IG has no prosecutorial powers. Why delay, bring in a special counsel and lets really get to the bottom of the whole liar-nObama/liar-Clinton/scum-Soros Mafia Septic Tank. After stating his confidence in Michael Horowitz, the Inspector General, Bartiromo asks, at the 2:46 mark of the video, if AG Sessions should be looking into the matters. Deputy Attorney General Rod J. Rosenstein said the Justice Department will include more safeguards to prevent the kind of problems that have been documented in the past. { townhall.com } ~ Democrats, in a feat of political exploitation unrivaled in the 21st century, are now using the kids from Marjory Stoneman Douglas High School to sign fundraising emails. Part of me had hoped the party of grave-dancing would find using children in this way would be a bridge too far, but the rest of me knew they didn’t have it in them to be tactful, decent people. After all, every left-wing activist group had, one day after the shooting,  started sweeping into town to organize what they and their fellow travelers in the media all claimed was an “organic, grassroots” response to the tragedy. If they couldn’t wait 24 hours before attaching the marionette strings to those kids, the fact that they waited 2 weeks before attempting to use them to line their own pockets is as close to decency as they’re going to get.

With that in mind, and as liberals line up behind a shield made of children to march on the Second Amendment, it’s important to remember what happens when you attempt to compromise with people whose ultimate goal is your obliteration and why no amount of compromise will ever be enough.

There is an example from our recent past that shows how compromise works when it comes to big government liberals. It may not be perfect, and it isn’t pretty, but it is what happens when you accept the concept of diminishing the rights of innocent people over the actions of the guilty.

You have to dig in your heels and make clear you will never, ever acquiesce to their demands. This has been the tactic of the National Rifle Association when it comes to the Second Amendment, and it is the correct choice. But it hasn’t been the choice made by others in the past. 

One particular group that has seen “compromise” used as a way to strip them of their rights is smokers. Now smokers aren’t exactly a group of people who are going to elicit a lot of sympathy or concern from people (junkies, sure, but people who use a legal product are fair game when it comes to attack, which is weird). But what happened to smokers is a useful tool for illustrating why the American people should not compromise with liberals when it comes to one of our fundamental freedoms. 

Comedian and podcaster Adam Carolla has made this point many times on his show, so I can’t take credit for it. But it certainly exemplifies how a slope quickly becomes slippery and, if your interest is simply compromise, you can compromise your rights away.

To paraphrase Carolla, there was a time when you could smoke in restaurants. They are private property, and if the owner wanted to allow smoking, smoking was allowed. Then the government (liberals) decided smokers should be herded into their own area of a restaurant, the “smoking section.” So they went so smokers in the main dining room and said, “We’re going to need you to sit over here, in this side room You can smoke all you want, we just don’t want other people to smell it while they’re eating. You understand, right?”

Smokers, not wanting to cause a scene and knowing some non-smokers could be annoyed, happily complied. 

Then the government comes back and says, “We’re going to need you to move to the bar area when you smoke. People are drinking there, and eating here, so it’d just be better if you moved over there.”

Smokers picked up their ashtrays, “Sure thing,” they said, and moved to the bar.

The government comes back and says they need smokers to step out front. “If you could just stand out front and smoke, that would be much better for everyone, OK? Don’t worry, there’s an awning and a heater, so you’ll be protected from the weather.”

Smokers picked up and moved outside.

“If you could move 50 feet from the door, that would be very helpful,” the government said next. “People smell smoke as they walk in the door and we don’t want that. Thanks.”

And now smokers are stuck down the block, wet and wondering how this happened. If someone had come up to them at first and said, “Hey, get down the street if you want to smoke,” it never would have happened, they wouldn’t have stood for it. But little by little, inch by inch, they moved because each move was small and seemed like a compromise. 

Now smokers are never getting back inside, even if the owners of a bar or restaurant want them to. Their rights are gone, the private property rights of the owners are gone, and it was all done in the name of compromise.

There is no compromise with someone who doesn’t want you to exist, there is only incrementally losing ground until you no longer exist. A right diminished will never return, government does not cede back power once seized. 

The NRA is right to hold its ground, it’s why the organization exists in the first place. Liberals are not honest brokers when it comes to the issue of guns, and neither is the media. Trying to appease leftists never works because nothing short of everything they want is ever enough for them.

If people who support the Second Amendment start to compromise with liberals whose ultimate goal is to strip everyone of their right to defend themselves, it won’t be too long before they’re out on the street in the rain with the smokers. Never give them an inch.
