The decision by a California appeals court Friday overturning the conviction of an illegal immigrant who shot and killed Kate Steinle in San Francisco in 2015 once again put the national spotlight on the serious problem of crimes committed by people in the U.S. illegally.

The appeals court in San Francisco overturned the conviction of Jose Inez Garcia-Zarate on a charge of being a felon in possession of a firearm. Garcia-Zarate was earlier found not guilty of first- and second-degree murder, involuntary manslaughter and assault with a semi-automatic weapon.

Garcia-Zarate said he unwittingly picked up a gun, which he said was wrapped in a T-shirt, and it fired accidentally. The appeals court overturned his conviction on the firearm possession charge because it said the judge at his trial failed to give the jury the option of finding him not guilty on the theory that he only possessed the gun for a moment.

Opponents of federal efforts to enforce the immigration laws enacted by Congress repeatedly claim that illegal immigrants are “less likely” to commit crimes than U.S. citizens — and thus represent no threat to public safety. But that’s not true when it comes to federal crimes.

Non-citizens constitute only about 7 percent of the U.S. population. Yet the latest data from the Justice Department’s Bureau of Justice Statistics reveals that non-citizens accounted for nearly two-thirds (64 percent) of all federal arrests in 2018. Just two decades earlier, only 37 percent of all federal arrests were non-citizens.

These arrests aren’t just for immigration crimes. Non-citizens accounted for 24 percent of all federal drug arrests, 25 percent of all federal property arrests, and 28 percent of all federal fraud arrests.

In 2018, a quarter of all federal drug arrests took place in the five judicial districts along the U.S.-Mexico border. This reflects the ongoing activities of Mexican drug cartels. Last year, Mexican citizens accounted for 40 percent of all federal arrests.

In fact, more Mexicans than U.S. citizens were arrested on charges of committing federal crimes in 2018.

Migrants from Central American countries are also accounting for a larger share of federal arrests, going from a negligible 1 percent of such arrests in 1998 to 20 percent today.

Critics will try to downplay the importance of the Justice Department’s report by pointing out that the majority of crimes in the United States are handled by prosecutors in state and local courts. But even there the data is shocking.

A recent report from the Texas Department of Public Safety revealed that 297,000 non-citizens had been “booked into local Texas jails between June 1, 2011 and July 31, 2019.” So these are non-citizens who allegedly committed local crimes, not immigration violations.

The report noted that a little more than two-thirds (202,000) of those booked in Texas jails were later confirmed as illegal immigrants by the federal government.

According to the Texas report, over the course of their criminal careers those illegal immigrants were charged with committing 494,000 criminal offenses.

Some of these cases are still being prosecuted, but the report states that there have already been over 225,000 convictions. Those convictions represent: 500 homicides; 23,954 assaults; 8,070 burglaries; 297 kidnappings; 14,178 thefts; 2,026 robberies; 3,122 sexual assaults; 3,840 sexual offenses; 3,158 weapon charges and tens of thousands of drug and obstruction charges

These statistics reveal the very real danger created by sanctuary policies. In nine self-declared sanctuary states and numerous sanctuary cities and counties, officials refuse to hand over criminals who are known to be in this country illegally after they have served their state or local sentences.

This refusal to cooperate with federal immigration officials suggests that state and local officials supporting the sanctuary movement believe it’s better to let these criminals return to their communities rather than being removed from this country. Not all of their constituents would agree.

The Texas report is careful to note that it is not claiming “foreign nationals” commit “more crimes than other groups.” Whether that is true or not — and it is certainly true when it comes to federal crimes — is irrelevant.

What is highly relevant to the current debate about immigration policy is that the Texas report “identifies thousands of crimes that should not have occurred and thousands of victims that should not have been victimized because the perpetrators should not be here.”

We know that in Texas and around the country some individuals would be alive today — and their families would not be mourning their loss — if we had a secure border and an effective interior enforcement system.

Instead of trying to obstruct enforcement of our immigration laws, state and local officials should do everything they can to help the feds reduce the very real — and all too often fatal — dangers posed by criminal illegal immigrants.

One of the worst recent examples of a state official who refuses to help federal immigration authorities carry out their duties is North Carolina Gov. Roy Cooper.

The Democratic governor recently vetoed a bill that would require local law enforcement to cooperate with federal immigration authorities. Cooper did so just days after Immigration and Customs Enforcement (ICE) agents captured an illegal immigrant charged with first-degree rape and indecent liberties against a child.

The man arrested in that crime was on the loose because he had been released from custody by county officials, despite the existence of a federal detainer warrant for him.

Politicians who declare their jurisdictions to be sanctuaries for illegal immigrants who commit crimes are needlessly endangering their law-abiding citizens. That is shameful.  ~The Patriot Post

Rep. worthless-Ilhan Omar, D-Minn., who is accused of improperly using political campaign funds to reimburse her alleged lover for travel expenses, doesn’t need to worry for now about a complaint filed against her with the Federal Election Commission. Vacancies on the FEC make it impossible for the commission to take any action.

The FEC, where I served as a commissioner over a decade ago, is supposed to act as a government watchdog against election law violations. But unless it has four members, the watchdog is effectively muzzled and chained, helpless to act. Right now there are three members and three vacancies on the commission.

That’s good news for worthless-Omar, who refused Wednesday to answer questions about the allegations filed against her this week by a nonprofit group called the National Legal and Policy Center, which describes itself as “a charitable and educational organization” that seeks to “foster and promote ethics in government and public life.”

Asked by a reporter in Minneapolis why she is refusing to answer questions, worthless-Omar said: “Because they’re stupid questions.” Later in the day the married congresswoman told reporters: “I will just say I have no interest in commenting on anything that you are about to ask about my personal life, so you can chase me all you want.”

The FEC will send worthless-Omar a copy of the complaint filed against her and she will have 15 days to send a response. But the question of whether to open an investigation of the congresswoman — who has been accused by President Trump and others of anti-Semitism and hatred of the Jewish state of Israel — will have to wait until there are four confirmed FEC commissioners. No one knows when that will happen.

With at least four members, the FEC could levy a fine against worthless-Omar if it finds she committed a civil violation of campaign finance law. The commission has the power to determine the amount of such a fine, based on whatever commissioners believe is appropriate.

The complaint filed with the FEC against worthless-Omar alleges that her election campaign paid a consultant — Tim Mynett and his E. Street Group, LLC — $230,000 for fundraising consulting, digital communications, Internet advertising and travel expenses.

However, in a divorce case filed by Tim Mynett’s wife, Beth Mynett, she alleges that her husband told her “he was romantically involved with” worthless-Omar — a claim worthless-Omar denies.

Beth Mynett’s divorce complaint alleges that her husband’s “recent travel and long work hours now appear to be more related to his affair with Rep. worthless-Omar than with his actual work commitments.”

The complaint filed with the FEC points out that the payment of Tim Mynett’s travel expenses started the same month that Mynett reportedly told his wife he was having an extramarital affair with worthless-Omar.

Thus, according to the complaint filed with the FEC, the travel expenses for Tim Mynett made with funds collected as political campaign contributions “may have been unrelated, or only partially related, to worthless-Omar’s campaign” and instead may have been “so that Rep. worthless-Omar would have the benefit of Mynett’s romantic companionship.”

If that is the case, then payments by worthless-Omar to Tim Mynett were “personal in nature” and not related to the campaign, according to the complaint.

If these allegations are true, worthless-Omar may have run afoul of a federal law — specifically, 52 U.S.C. §30114. This law bars the use of campaign funds “to fulfill any commitment, obligation, or expense of a person that would exist irrespective of the candidate’s election campaign.”

Examples of what is prohibited for funding with campaign donations include such items as a personal mortgage, clothing purchases, non-campaign-related car expenses, and vacations and other non-campaign-related trips.

In other words, if Mynett’s travel expense were unrelated to his actual work for the campaign but in furtherance of an affair with worthless-Omar, those would be personal expenses. Campaign funds couldn’t be used to pay them.

worthless-Omar’s attorneys have dismissed the complaint filed with the FEC as a “political ploy.” But until the FEC gets another commissioner, neither this complaint nor any others will be investigated by the commission to see if there is actually any substance — and any credibility — to the allegations being made.

So while the complaint against worthless-Omar is making headlines — both because of the nature of the allegations and her prominence as one of four far-left Democratic freshman congresswomen known as the “Squad” — all political candidates are getting a free pass on any complaints filed against them with the FEC as long as the commission has three vacancies.

The resignation of Commissioner Matt Petersen (who replaced me) from the FEC earlier this month left the commission in its current state of paralysis, with three vacancies.

The six FEC commissioners are nominated by the president and confirmed by the Senate. There is a long tradition that whenever a seat held by the political party not in control of the White House opens up, the president asks the leader of that political party in the Senate for his choice to fill the seat.

There are currently two empty Republicans seats and one empty Democratic seat on the commission.

The names of FEC nominees are sent to the Senate in pairs — one Republican and one Democrat.

President Trump nominated a Texas lawyer, Trey Trainor, in 2017 to fill an open Republican seat. But there has been no public report that Senate Minority Leader Chuck scumbag-Schumer, D-N.Y., has given Trump a nominee for the Democratic seat that has been empty since 2017.

Without a quorum — four commissioners on the six-member FEC — the commission can’t hold meetings, initiate audits, vote on enforcement matters, issue advisory opinions, or engage in rulemaking.

As a result, as the 2020 presidential election cycle heats up, the FEC remains unable to carry out the most important duties it was created to perform.

The FEC regulates all of the contributions and expenditures of federal candidates for the presidency and Congress. When it has at least four members, the commission is empowered to go after candidates, political parties, political action committees and others who violate the law, imposing civil penalties consisting of fines.

The vast majority of campaign finance violations are civil matters because they are usually inadvertent violations of the law. The Federal Election Campaign Act is byzantine in its complexity and often ambiguous. Even the commissioners sometime disagree on the proper interpretation and application of the law.

The U.S. Justice Department retains jurisdiction over criminal campaign finance violations, which are “knowing and willful” violations of the law. However, criminal prosecutions are very rare.

As an example, missing the deadline for filing a required campaign finance report on contributions received by a candidate is a civil violation, while knowingly spending campaign funds on personal expenses unrelated to a campaign would be a criminal violation.

That’s why former Rep. Jesse L. Jackson Jr., D-Ill., went to jail in 2013. He pleaded guilty to spending $750,000 in campaign funds on everything from personal travel and restaurant expenses to a Rolex watch, fur coats for his wife, and memorabilia from Bruce Lee, Eddie Van Halen and Jimi Hendrix, along with mounted elk heads for his office.

Right now the ball is in Sen. scumbag-Schumer’s court to nominate a Democratic FEC commissioner, and for the Senate to then confirm a Democrat and a Republican to the commission. Until that happens, worthless-Ilhan Omar has nothing to worry about from the FEC.

Why would they want that? Well, McCormack made it clear it wasn’t to praise these folks for involvement in the process of governing our country by supporting a political candidate they felt would represent them. This is something that has, until recently, been accepted as the right of every single American. McCormack made it clear that the intention of his request was “so the rest of us can be clear about who we don’t wanna work with.”

To put it bluntly, McCormack wanted to know who supported a politician he opposed so that he could use his power and influence to ruin their professional lives at the very least. This is nothing short of a revival of the tactics of Joseph McCarthy. The big difference between McCarthy and the McCormack/Messing combination is the target selection.

Former Secretary of Defense James Mattis stated recently that America’s tribalism is what worries him most. Well, we’re seeing the symptoms, and while Messing and McCormack are two of the more prominent, we have noted this pattern before — both private efforts and efforts by the state of New York under the scumbag-Andrew Cuomo-Letitia James regime.

To compound the problem of tribalism is the fact that there is a clear double standard being applied. If you back the NRA, you are painted as a child-killing domestic terrorist who believes in white supremacy. Efforts to ruin your life through blacklisting are practically celebrated by the Leftmedia. But suppose a Second Amendment supporter in office tried to utilize the same tactics that Cuomo is using on the NRA. We’d never hear the end of how America faces a grave threat to “democracy.”

We noted the same double standards in effect with some recent actions by Rep. Joaquin Castro last week. Doxing Trump supporters? It was practically a non-event that got little, if any, mention — much less condemnation — from mainstream media outlets. This was an action by a sitting congressman, someone who wields no small amount of influence in DC, including with regulatory agencies.

Similarly, when Federal Election Commission chairwoman Ellen Weintraub slammed President Trump for making claims about voter fraud in New Hampshire, we couldn’t help but notice her silence regarding Stacey Abrams’s 10 months of unsubstantiated claims of vote suppression in Georgia. By the way, Weintraub applied her double standard while being responsible for the enforcement of campaign-finance laws.

This also comes as scumbag-James Comey again skates despite another damning report on his behavior from the Justice Department’s inspector general. This is in addition to the other issues that emerged from Spygate — questions Americans deserve the answers to, not to mention the need for accountability.

The frustrating thing is the fact that the double standards that could destroy any confidence in the Rule of Law are perpetrated not just by the legal system but by the studious lack of comment from the Leftmedia. While America can survive when Americans have deep divisions, it cannot survive if legal and moral double standards exist. And if free speech is successfully quashed — whether by Hollywood, academia, or Big Tech — our republic is in serious danger.  ~The Patriot Post

The study determined that genes do have an impact on a person’s sexual orientation, but that it is impossible to predict a person’s sexual behavior solely on their genome. Researchers concluded that different components of different genes in the human genome can contribute to determining a person’s sexuality, particularly in the presence of some external factors, but there is no single so-called “gay gene” that separates homosexuals from heterosexuals.

The study was conducted by researchers and geneticists at the Broad Institute at MIT, Harvard, the University of Queensland, and other institutions. It included surveys conducted among 400,000 UK and Swedish men and women in a British database and approximately 70,000 American customers of the genetic testing service 23andMe. All the subjects are of white European descent, and some 3% of the British sample and a surprising 19% of the American sample admitted to having sex at least once with a same-sex partner.

The sample audience for the study hardly indicates a strong representation of the general adult population, nor did the study spend any time on societal factors such as religion, income, family structure, and so forth. For the purposes of this study, researchers focused solely on genetic factors.

The study is sure to be attacked by the Rainbow Mafia for not quite supporting the party line that homosexuals are “born that way” and are therefore unable to reject that lifestyle. On the flip side, the report also indicates that homosexuality is too complicated to simply be a lifestyle choice.

How will the Left reconcile this study — which purports to lend more nuanced credence to the “born this way” argument — with the “I was born the wrong way” argument of so-called “transgendered” individuals?

On the one hand, leftists insist conversion therapy should be banned for homosexuals because of genetics. As one study author put it, “I hope that the science can be used to educate people a little bit more about how natural and normal same-sex behavior is. It’s written into our genes.” On the other hand, some individuals — including children— should undergo hormone treatment and even surgical alteration because their genetics got their biology wrong.

Some researchers in the study initially questioned the wisdom of going forward with the work. Geneticist Steven Reilly, who leads an LGBT group at the Broad Institute called Out@Broad, told The New York Times, “I deeply disagree about publishing this,” citing fears that the data could be misconstrued — by conservatives — for political purposes.

And the Left would never use homosexuality for political purposes…

Joe Vitti, another researcher at Broad who spoke to the Times, expressed similar close-minded sentiments. “As a queer person and a geneticist, I struggle to understand the motivations behind a genome-wide association study for non-heterosexual behavior. I have yet to see a compelling argument that the potential benefits of this study outweigh its potential harms.”

In the face of discovery, these “scientists” were willing to let their own political views interfere with their ability to conduct and share research for fear of how it might inform political opponents. They even entertained the idea of burying the study. Publicly they claimed fear, but it’s clear that the real motivation is that the study does not comport with their long-held social beliefs. It is the perfect example of what leftists frequently accuse conservatives of doing: using politics to distort reporting scientific fact.

The study was released to the public only after months of internal deliberations. The Times notes that the research team “used suggestions from [Broad] colleagues and outside L.G.B.T.Q. groups to clarify wording and highlight caveats.” Who knows how these so-called suggestions might have changed data as presented in the final report?

One finding of the study that could not be kept in the closet was the discovery of a genetic correlation between same-sex behavior and certain mental-health issues and traits like risky behavior and drug use. Hopefully this information, and the rest of the study, will be used to help people instead of being wielded as a cudgel by the Rainbow Mafia.

This pattern holds true not just with social programs like scumbag/liar-nObamaCare but with issues like Americans’ Second Amendment rights. Democrats love to proclaim that they support protecting Second Amendment rights even if they just want more “sensible” gun control. But as conservatives have regularly pointed out, Democrats’ “sensible” gun control would do next to nothing to stop criminals from committing crimes with firearms. In fact, the vast majority of Democrats’ proposed gun control legislation would only make it harder for law-abiding Americans to exercise their Second Amendment rights.

The fact of the matter is the Democrat Party’s agenda is to essentially eliminate the Second Amendment entirely. On Monday, Democrat presidential candidate loose lips liar-Joe Biden insisted there should be “no compromise” on guns. Instead, he bloviated, “We’re talking about loosening access to have guns, to be able to take them into places of worship. I mean, it is absolutely irrational. … The idea that we don’t have elimination of assault-type weapons, magazines that can hold multiple bullets in them, it’s absolutely mindless.” loose lips liar-Biden then absurdly claimed that what he was calling for was “no violation of the Second Amendment.”

Even if loose lips liar-Biden’s statement on banning “magazines that can hold multiple bullets” was a gaffe — the very purpose of a magazine is to hold multiple bullets (cartridges or rounds), and the vast majority of modern firearms use magazines — loose lips liar-Biden’s overall message is a clear attack on the Second Amendment.

Meanwhile, Elizabeth dinky-Warren attacks the Second Amendment by labeling the issue a “public-health emergency.” dinky-Warren pontificated, “We need to treat this as the public-health emergency that it is. And it’s going to take a lot of pieces and a lot of changes that we need to do to bring down deaths from gun violence.” dinky-Warren conveniently ignores the truth — that gun-related deaths due to crime have actually been decreasing for years as gun ownership has gone up — so that she can spin her “public health” narrative with the goal being the effective elimination of the Second Amendment.

Democrats have demonized the National Rifle Association, the nation’s leading advocacy organization for the Second Amendment that historically enjoyed bipartisan support, as a terrorist organization. commie-Bernie Sanders, who in the past stood up for Vermonters’ Second Amendment rights and was endorsed by the NRA, sings a different tune of late. On Saturday, commie-Sanders asserted, “We are telling [President Donald] Trump and [Senate Majority Leader Mitch] McConnell, ‘Listen to the American people and not the NRA.’ And I would hope very much that we can overcome the fear of the NRA and do what the American people want.”

socialist-Beto O'Rourke has no love for the Second Amendment either, as he has taken to dropping F-bombs when expressing his disgust over Americans’ right to possess “weapons of war.” Along with banning “assault weapons” and implementing a national gun registry, socialist-O'Rourke also wants a mandatory buyback (a.k.a. confiscation). “Buy those weapons of war back,” he thundered. “Mandate that. Not voluntary. Let’s be really clear with our fellow Americans.”

It has never been more clear that the radical Left has taken over the Democrat Party. And it sees the  elimination of the Second Amendment as an essential stepping stone to the ultimate elimination of the Constitution.  ~The Patriot Post

The opportunities for such self-aggrandizement have been slim lately, but finally, opportunity rang. Two white Hamilton County deputies stopped a vehicle for having unlawfully dark window tinting — which is to say they could not see inside the vehicle — always dangerous to officers making a stop, which is one of the reasons window tinting is regulated. Because the officers could not see the occupants of the vehicle, it would be difficult to make a “racial profiling” case, but crack cocaine was found in the underwear of a black occupant (a favorite place for concealment) and that is the basis for the race hustlers’ complaint.

The usual race-baiters have their panties in a wad, claiming the suspect, who as it turns out has 40 prior arrests, was “strip searched” in public and subjected to a “cavity search,” despite the fact video footage from two camera angles negates those claims. After a meeting of black community faith leaders convened, most pastors declined to participate in this charade. But a small group of the loudest agitators, along with the leader of hater Louis Farrakhan’s local Nation of Islam cadre, are calling for Sheriff Jim Hammond’s resignation.

My friend Mark Alexander, who has a background in law enforcement, has known Jim Hammond for 30 years, and notes, “Jim is a man with an impeccable color-blind career, an ethical and faithful man who is the most professional Sheriff in HCSO’s history — by a measure of magnitude.” But leftists never let facts get in the way of their agenda.

Meanwhile, Chattanooga, like most urban centers Democrat mayors are turning into slums, had one of the bloodiest weekends of 2019. Among the murder victims was a pregnant 19-year-old and mother of a two-½-year-old girl. But the agitators and community are not coming together to find the assailant or demand justice for this young mother; they are on the government steps blasting the officers that have sworn to protect and serve them.

Pastors and ministers are not called to be race-bait hustlers but peacemakers. Peacemakers are not partial and prejudiced. Ironically, the racially biased behavior exhibited by these local “men of faith” is the same behavior they claim they oppose.

Of course, race-baiting hustlers are nothing new.

Writing about such race agitators in his 1911 book, My Larger Education, Booker T. Washington wrote the following words that are even more relevant to present-day race agitators: “There is [a] class of colored people who make a business of keeping the troubles, the wrongs, and the hardships of the Negro race before the public… Having learned that they are able to make a living out of their troubles, they have grown into the settled habit of advertising their wrongs — partly because they want sympathy and partly because it pays.”

Washington continued: “Some of these people do not want the Negro to lose his grievances, because they do not want to lose their jobs… There is a certain class of race-problem solvers who do not want the patient to get well, because as long as the disease holds out they have not only an easy means of making a living, but also an easy medium through which to make themselves prominent before the public.”

The real tragedy in this unfortunate situation is that young black men are dying at an alarming rate, most murdered by other young black men.

Pastors, where is your concern for the souls of these citizens? Where is the call to repentance? Where is the strategy to build flourishing Christian families? Where is the Good News of the Gospel that gives your community hope? These are valid questions that challenge these race-bait agitators. Instead of fulfilling the Great Commission, these pastors have been indoctrinated with hatred and black tribalism, fomented by today’s Democrat Party and its cadres of social justice warriors who thrive on dividing us by race and every other measure.

Truth is, the great majority of Hamilton County citizens support our law enforcement, as do real pastors doing the real work of the cross. We will not stand idly by while radical Islamists and agitators sow racial discord in our community. We have worked too hard and too long to build a peaceful city.

Now President Donald Trump finds himself stuck between the gas and oil industry on one side and the ethanol/corn lobby on the other. Trump has been trying to appease both sides, while at the same time fighting a trade war with China.

Earlier this year, in a move aimed at winning support with King Corn, Trump’s EPA extended the sale of E15 or 15% ethanol gas to year-round. This move drew the ire of both the oil industry and environmentalists. However, in a move seen by the ethanol lobby as a means to mitigate the impact of the E15 extension, the EPA increased the number of waivers it issued to smaller refineries, exempting them from the Renewable Fuel Standard mandate. That angered farmers as it reduces demand, but it’s a Faustian bargain to build your business on government support.

Now with China’s targeted tariffs really starting to hurt American farmers, it appears that Trump is looking into ways to increase biofuel demands by raising the level of ethanol in gasoline blends for 2020 and 2021. As Hot Air’s Jazz Shaw observes, “How long can this go on? No matter what Trump does to curry favor with one group, the other one will be up in arms. He wants to play nice with the folks in Iowa, but he also needs to maintain the support of states with a lot of refineries, including Pennsylvania He can’t keep both of them happy at the same time, so it seems obvious that he needs to pick a side and stick with it.” This is just one of the many problems created by cronyism.  ~The Patriot Post
