We got high school aged students from public school on the way to lockup or coming from lockup back to public school...Some were bigger than me. If I could carry out a lesson plan with them, I could do it anywhere. The first thing I learned was that no matter how good my lesson plan was, it wouldn’t work unless I had control of the classroom. If I couldn’t wield authority effectively, there were students ready to take over. When I felt control slipping, I had to be conscious of one important dynamic and ask myself: “Who is responding to whom?” It was my job to enforce the rules consistently. Never bluff, never yell. Warn once in an even tone, then lower the boom. If the hooligans I taught sensed weakness, they exploited it. I could lighten up only after earning their respect.  Rural hospitals, beset by financial problems, struggle to survive  
(Guy Gugliotta) - Despite residents’ concerns and a continuing need for services, the 25-bed hospital that served this small East Texas town for more than 25 years closed its doors at the end of 2014...joining the ranks of dozens of other small rural hospitals that have been unable to weather the punishment of a changing national health-care environment. The Kansas-based National Rural Health Association, which represents about 2,000 small hospitals across the country and other rural care providers, says that 48 rural hospitals have closed since 2010, the majority in Southern states, and 283 others are in trouble.      (peggynoonan.com) - On Friday at the winter meeting of the Club for Growth, in Palm Beach, Fla., Wisconsin Gov. Scott Walker, a possible contender for the GOP presidential nomination, was pressed for specifics of his foreign-policy views. Walker referred to policy professionals with whom he’d recently met, and then suggested that what is most important in foreign policy is not experience but leadership. The “most consequential foreign-policy decision” of his lifetime, he said, was President Reagan’s handling of the air traffic controller’s strike. “It sent a message not only across America, it sent a message around the world.” The message: “We wouldn’t be messed with.”

     That caused a lot of raised eyebrows. I here attempt to return them to a more relaxed state. In the 1990s, when I was researching and interviewing for my biography of Reagan, “When Character Was King,” I became more deeply aware of the facts and meaning of Reagan and the flight controllers, and I discovered an element of the story that I think had not previously come fully to light:

     It was the spring of 1981. Reagan was still a new president, and recovering from John Hinckley’s attempt to assassinate him in late March. Transportation Secretary Drew Lewis met with Reagan at Camp David to give him bad news. The Professional Air Traffic Controllers Organization, or Patco, wanted to go on strike. The union’s 17,000 workers manned radar centers and air traffic control towers across the country. These were tough, high-stakes, highly demanding federal jobs. The union’s contact was up, they had been working under increasingly difficult conditions, and they wanted a big pay increase.

     Lewis told me Reagan was sympathetic: The increased pressures of the job justified a pay increase, and he offered an 11% jump—this within a context of his budget cutting. But Patco demanded a 100% increase. This would cost taxpayers an estimated $700 million. Reagan rejected it outright. He told Lewis to tell the union that he would not accept an illegal strike, nor would he negotiate a contract while a strike was on. He instructed Lewis to tell the head of the union, Robert Poli, something else: As a former union president he was the best friend they’ve ever had in the White House.

     Reagan’s tough line was not completely comfortable for him, personally or politically. He’d had little union support in the 1980 election, but Patco was one of the few that had backed him. Not many union leaders had been friendly to him, but Patco’s had. And he was a union man. he didn’t want to be seen as a Republican union buster.

     Still, Reagan believed no president could or should tolerate an illegal strike by federal employees, especially those providing a vital government service. Not only was there a law against such strikes, each member of Patco had signed a sworn affidavit agreeing not to strike.

     Talks resumed, fell apart, and by the summer 70% of the air controllers walked out.

     They had thought Reagan was bluffing. He wouldn’t fire them, they thought, because it would endanger the economy and inconvenience hundreds of thousands of passengers—and for another reason, which we’ll get to in a moment.

The walkout became a crisis.

     Reagan did what he said he would do: He refused to accept the strike and refused to resume negotiations. He called reporters to the Rose Garden and read from a handwritten statement he’d composed the night before. If the strikers did not return to work within 48 hours, they would be fired—and not rehired. The 48 hours was meant as a cooling-off period. In the meantime, Reagan made clear, nonstriking controllers and supervisory personnel would keep the skies open

     What Reagan did not speak about was an aspect of the story that had big foreign-policy implications.

     Air traffic controllers in effect controlled the skies, and American AWACS planes were patrolling those skies every day. Drew Lewis: “The issue was not only that it was an illegal strike. . . . It was also that a strike had real national-security implications—the AWACS couldn’t have gone up.” It is likely that even though the public and the press didn’t fully know of this aspect of the strike’s effects, the heads of the union did. That’s why they thought Reagan would back down. “This hasn’t come up,” said Lewis, “but the Soviets and others in the world understood the implications of the strike.”

     The administration quickly put together a flight control system composed of FAA and Defense Department personnel, and private controllers, to keep commercial traffic—and US military aircraft—in the air.

     It was an international story. The French government pressed the administration to make a deal. Britain backed Reagan. Canada’s flight controllers shut down the airport in Gander, Newfoundland, in solidarity with Patco. Lewis, with the president’s backing, told them that if they didn’t reopen within two hours the U.S. would never land there again. They reopened.

     The administration could have arrested the strike leaders but didn’t. Congressional Democrats could have used the strike for partisan advantage and didn’t, or didn’t much.

     Sen. Edward Kennedy and Lane Kirkland of the AFL CIO played helpful and constructive roles. Persuaded the administration had a case—a 100% increase was asking too much, a strike against the public safety was illegal—both kept a lot of Democrats on the Hill and in the labor movement from coming out strong against the administration.

     Lewis said there were unhelpful moments from a few of the president’s longtime supporters. Some were wealthy men who owned their own jets and didn’t want to be inconvenienced. One called Lewis and told him he was going to get him fired. Lewis called the Oval Office. “I said, ‘Mr. President, you’re going out to California soon and Justin Dart and all these guys have private planes and they’re all raising Cain with me.’ I said, ‘I hope you don’t cut my legs out from under me.’”

     Reagan, said Lewis, responded: “I‘ve never cut the legs out from anybody in my life. You let me worry about my friends, you worry about the strike.”

     When the two-day cool-off period ended, 70% of the air controllers were still out. They all lost their jobs. “We fired 11,400 traffic controllers,” said Lewis. “That’s a lot of families. . . . And the union had supported us, and it was a good union. It was very sad. We were both upset about the firing. Reagan was almost in tears that he was going to hurt those families.”

     So why was, and is, the story of Reagan and the flight controllers an important one?

     What was at issue was crucial and high-stakes. What Reagan did worked: The administration promised to keep the skies open and did. The Patco decision set the pattern for wage negotiations over the next eight years, not only for the federal government but for local and state governments. The U.S. Postal Service’s half million workers were readying to go on strike shortly after Patco walked out. They didn’t. Mayors soon observed that a new climate seemed to have taken hold in their municipal negotiations.

     Foreign governments, from friends and allies to adversaries and competitors, saw that the new president could make tough decisions, pay the price, and win the battle. The Soviets watched like everybody else. They observed how the new president handled a national-security challenge. They saw that his rhetorical toughness would be echoed in tough actions. They hadn’t known that until this point. They knew it now.

     This is why Reagan’s secretary of state George Shultz said that the Patco decision was the most important foreign-policy decision Reagan ever made.

     Everyone knew at the time that it was a domestic crisis. It wasn’t until years later that they came to appreciate that it was foreign-affairs victory.

So was Scott Walker right about the importance of Reagan and Patco?

Yes.

     But two caveats. One is that Ronald Reagan himself would never suggest, on the way to the presidency, that all you need to understand foreign policy is a good gut and leadership abilities. You need knowledge, sophistication, grasp. He’d been studying foreign affairs all his adult life. He walked into the Oval Office with a policy: We win, the Soviets lose. A talent for leadership doesn’t tell you where to go, it helps you get there. Wisdom tells you where to go.

     Second, in January Walker said that documents released by the Soviet Union proved the Soviets treated the U.S. differently after the strike. I have never heard of such documents. No one I spoke to for the book referred to them. The Washington Post has quoted former Reagan ambassador to the Soviet Union, Jack Matlock, saying “There is no evidence of that whatsoever.” I suspect that is correct.

     If Walker got it wrong, he should say so. Though I’m not sure it matters in any deep way. Of course the Soviets saw and understood what had happened with Reagan and the union. Of course they would factor it in. They had eyes. They didn’t have to write it down.

He was, of course, speaking of Trayvon Martin…the punk who attacked George Zimmerman and wound up dead for his efforts.

Trayvon Martin…a thug, gang wannabe who was into drugs, had a violent attitude and an apparent history of stealing things from other people’s homes. That is who Obama pictured as HIS son…not some upstanding member of society…not some straight A student…not somebody with potential…Trayvon Martin…punk…thug…drug user and thief.

I think Obama set the bar far too high.

Fast forward…nearly three years to the early morning hours of March 12th, 2015…Ferguson Missouri…that’s when and where two police officers were shot…standing in front of the courthouse while watching over yet another inane protest on the street.

Two shots rang out…two officers fell…one shot in the face…the other shot in the shoulder. Both will survive but the shooting set off a manhunt and after several days…an arrest was made.

Those who adhere to political correctness will call him a suspect or the alleged shooter, but…

 'I Did Not Exchange Classified Information With That Woman'  
As news continues to unfold about Hilly Clinton's secret email servers, which she vowed resulted in "no security breaches" (evoking memories of her finger-wagging husband denying sex allegations with "that woman"), a lesser-reported story broke. The FBI continues to investigate what officials are calling the "worst ever" cyberattack against several federal agencies -- including the State Department. On Tuesday, CNN reported that "suspected Russian hackers have bedeviled State Department's email system for much of the past year and continue to pose problems for technicians trying to eradicate the intrusion." Additionally, the same hackers who compromised the State Department's email system are suspected of being same hackers who penetrated the systems of the White House and other federal agencies. While the State Department may not be as secure as it should have been, and the hack appears to have occurred after Clinton departed State, the convenient timing of the story suggests a subtle attempt to soften the blow against the former secretary. Perhaps we're supposed to believe her violation of federal regulations and consequent placing of our national security at risk were somehow less terrible since the State Department's email system was hacked, too.  -The Patriot Post

 NO ONE READ HILLY EMAILS BEFORE DESTRUCTION 
How did Hilly Clinton know that the tens of thousands of emails from her time in office she ordered destroyed were personal? Did she or even her staff scroll through her sent items scanning emails about “yoga routines” or “family vacations” before deleting them? Nope. No one looked at them. The Clinton campaign said those emails that did not crop up in a keyword search performed by her team were automatically deleted. No eyes. No one to be subpoenaed. Just highlight all and press delete. That method seems better for missing emails than to finding them. And it would sound reckless and haphazard coming from another politician. In this case, though it sounds like a woman covering her tracks in preparation for a long and bloody legal fight over subpoenas to come.

 WH Confirms UN Role in Iran Deal  
(Daniel Halper) - White House Chief of Staff Denis McDonough sent a letter last night to Senate Foreign Relations Committee Chair Bob Corker (TN-R) stating that any Iranian nuclear deal will include the UN Security Council...The letter states that only the Security Council can lift the sanctions put on Iran by the Council. McDonough goes on to explain that the nObama WH expects the five permanent members to support the deal once it is struck, since they are all participating in the negotiations. Some fear that the nObama WH will use the U.N. as a means to bypass the Senate and force U.S. compliance with an Iran nuke deal. A Real Downside to Any Deal With Iran

     (city-journal.org) - Israeli Prime Minister Benjamin Netanyahu caused a stir last week when he blasted President Barack nObama’s attempt to negotiate a nuclear deal with Iran. American television media covered little else for 24 hours. The prime minister and the president are still bickering about it this week on Twitter. Both have ignored a disturbing reality: any deal with Iran, good or bad, is likely to benefit ISIS.

     President nObama is pursuing an agreement for understandable reasons. Far better to resolve the West’s differences with Iran diplomatically rather than violently. Prime Minister Netanyahu, likewise, is wary of the president’s plan for understandable reasons. A bad deal may be worse for Israel than no deal at all. Yet neither nObama nor Netanyahu seem to notice how an agreement, regardless of its content and efficacy, will be viewed by the Middle East’s Sunni Arabs, who are as alarmed as the Israelis are by Iranian ambitions.

     The war against ISIS is being fought on two fronts in two countries, and the Middle East’s Sunni-Shia conflict rips right through the center of both. ISIS is the bloodthirsty wing of the Sunni jihadist movement, while Iran and its Syrian, Iraqi, and Lebanese allies make up the Shia resistance. In no way do average Sunni Arabs view ISIS as their standard bearer. Tens of thousands have lit out from its territory for squalid refugee camps abroad. But at the same time, most Sunni Arabs tremble at the rise of Iranian power and are reluctant to stand against the maniacs on their own side, especially when the U.S. and Europe appear to side with the Persians and Shia against them.

     That’s not how it is, but that’s how it looks. Consider this: Iranian Revolutionary Guard general Qasem Soleimani is personally leading the Iraqi operation to wrest control of the city of Tikrit, Saddam Hussein’s hometown, from ISIS. When Iraq’s Sunnis see Shia militias and Iranian Revolutionary Guard troops gunning for their territory, they feel a looming threat to their very existence. And at the same time, the West is bombing ISIS positions in both Syria and Iraq, while Washington is at least nominally allied to Baghdad and trying to cut a deal with Tehran. The Sunnis see the world’s only superpower teaming up with their enemies and gearing up to smash them to pieces.

     It looks little better from a Sunni’s perspective in Syria. The U.S. hardly supports the malignant Assad, but all of Washington’s air strikes have landed on Sunni jihadist targets even after President nObama accused Damascus of deploying chemical weapons in civilian population centers. Like the government in Baghdad, the House of Assad is firmly in the Iranian camp. The state, along with the ruling family, is heavily packed with members of the Alawite minority, adherents of a heterodox religion that fuses Shia Islam, Christianity, and Gnosticism.

     The Assads have had their boots on the necks of Syria’s Sunni majority since 1971, when the late Hafez al-Assad seized power, and they’ve been the Arab world’s staunchest Iranian allies ever since. Assad is also, along with Iran’s clerical regime, a patron and armorer of Lebanon’s Hezbollah, by far the deadliest Shia terrorist organization in the world and one which is actively and effectively fighting against Syria’s armed Sunni opposition on behalf of its masters. In light of all that, ISIS has an easier time presenting itself as the defender of the region’s Sunni Arab majority against an axis of Persian-Shia-Alawite perfidy.

     Meanwhile, Iraq’s Sunni Arab minority has been out of the saddle since the United States removed Saddam Hussein in 2003 and the Shia majority naturally came to power in elections. Baghdad’s government is less oppressive than the Assad regime, to be sure, but it’s backed by a demographic majority that makes the Sunnis—only a rough 20 percent of the country—feel acutely and permanently endangered.

     These people are hardly ISIS’s natural constituency. They fought and died to evict ISIS from their lands in the late 2000s when it still went by the name al Qaeda in Iraq. The only reason ISIS managed to conquer huge swaths of the country last summer is because the previous prime minister, Nouri al-Maliki, governed like an Iranian-backed Shia warlord. The Sunni tribes fear and loathe ISIS, but they fear and loathe the Iranian regime and Iraq’s Shia-dominated government, too—maybe more. Perhaps better, they think, to be lorded over by “their own” than face pitiless persecution at the hands of “the other.”

     Both sides behave viciously—though the ISIS side wins in the atrocity comptetion. Abu Musab al-Zarqawi, the organization’s founding father under its previous name, described the Shia as “the insurmountable obstacle, the lurking snake, the crafty and malicious scorpion, the spying enemy, and the penetrating venom.” A huge percentage of Iraq’s Sunnis have viewed the Shia this way for more than a thousand years.

     ISIS’s rhetoric is exterminationist. Its serial massacres of Shias, Christians, Yezidis, and Alawites stink of genocide. The West shouldn’t kid itself into believing that what happens in Syria and Iraq will stay in Syria and Iraq. ISIS truly believes it’s on a God-sanctioned mission to challenge and defeat European powers and bring about the apocalypse. “We will conquer your Rome,” it boasts in its glossy online magazine, Dabiq, “break your crosses, and enslave your women, by the Permission of Allah, the Exalted. This is His promise to us.”

     It’s never going to happen, but ISIS and its supporters have already proved they’re willing and able to carry out deadly strikes in Europe. The recent killings at the Charlie Hebdo office in Paris and the attack on a Jewish museum in Belgium last year are likely but prologues. And the odds that ISIS will be undermined internally by Syrian and Iraqi Sunnis while they’re facing what appears to be a Western-backed enemy alliance in Damascus, Tehran, and Baghdad are virtually zilch.

     Does this mean the West shouldn’t cut even a theoretically good deal with Iran to prevent the regime from building nuclear weapons? I have no idea. But I’d like to know if anyone in Washington or Jerusalem is at least asking the question.

            Thank you for contacting me about your support for H.R. 140, the Birthright Citizenship Act of 2015.  I appreciate hearing from you on this important issue.

           Introduced by Rep. Steve King (R-IA), H.R. 140 seeks to prevent children born in the United States from receiving citizenship unless one or both parents is a legal U.S. resident. I do not support this legislation for several reasons. First, abolishing birthright citizenship would require the creation of a massive new federal bureaucracy to accept and adjudicate applications for newborns. Second, because immigrants come to this country primarily for economic reasons, the preponderance of evidence indicates that repealing the 14thAmendment would do little to discourage people from crossing our borders illegally.  Third, an end to birthright citizenship would produce a new population of undocumented children who would grow up without access to basic services and have limited employment prospects later in life.

            In order to fix our broken immigration system, we need comprehensive immigration reform that keeps families together, secures our border, and grows our economy. While I believe protecting our borders and enforcing our laws are indispensable elements of any meaningful effort to reform our immigration system, so is a pathway to earned citizenship that allows the 11 million undocumented individuals to come out of the shadows and have an opportunity to fully contribute to American life. Please be assured that I am committed to working on a bipartisan basis to create a modern, 21st-century immigration system.

 Ferguson Police Chief Resigns, Two Cops Shot  
The Department of Justice made its accusation: The Ferguson Police Department practiced systematic racism. The DOJ named names and so the city's town manager and municipal judge resigned. Then Ferguson Police Chief Tom Jackson announced his resignation. In his resignation letter, Jackson wrote, "My resignation will be effective March 19, 2015 to provide for an orderly transition of command. ... I will continue to assist the city in any way I can in my capacity as private citizen." But Wednesday night, the streets around the police department were anything but orderly. As protesters gathered into the early morning, four shots rang out and two officers fell, seriously injured. The nObama administration was going to come after Ferguson officials if they didn't resign, but did they take into account an emboldened hostility to the peacekeeping force in the city?  Sen. Cotton's Letter to Iran Is Firmly Constitutional  
After the Senate sent its letter to Iran explaining whatever deal Hanoi John Kerry is currently negotiating would not be a lawful treaty, the Left and its "constitutional scholars" think the 47 senators should be tried for treason. In a White House petition, over 200,000 people said, "United States Senators committed a treasonous offense when they decided to violate the Logan Act, a 1799 law which forbids unauthorized citizens from negotiating with foreign governments." And they actually think this petition will get legal legs. Let's start with the Constitution, which says in Article II Section 2 that the president "shall have Power by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur [emphasis added]." John Yoo writes at National Review that nObama could make some kind of agreement with Iran, namely a sole executive agreement, which would only be binding with the nObama administration itself. He continues, "But as a matter of constitutional law, the Cotton letter should be no more controversial than a letter that simply enclosed a copy of the U.S. Constitution (without President nObama's editing)." No, it is the nObama administration that is circumventing the Constitution, as even Hanoi Kerry admitted that "we're not negotiating a legally binding plan." More...  -The Patriot Post  

 Hanoi Kerry's Hypocritical Indignation  
Secretary of State Hanoi John Kerry really wasn't happy with the 47 Senate Republicans who wrote a letter to Iran warning of the temporary nature of any deal with the nObama administration. Testifying before Congress Wednesday, Hanoi Kerry said his reaction to the letter was "utter disbelief" because it "ignores more than two centuries of precedent in the conduct of American foreign policy." He added, "During my 29 years here in the Senate, I never heard of -- nor even heard of it being proposed -- anything comparable to this. ... This risks undermining the confidence that foreign governments, in thousands of important agreements, commit to between the United States and other countries." Funny that he's "never even heard of it" because an open letter to Iran restating the obvious hardly compares to Hanoi Kerry's own record of going it alone on foreign policy. While he was in the Senate, he traveled to Nicaragua to meet with the communist Sandinistas and then returned home to shill on their behalf. And let's not forget his most infamous moment: meeting with the North Vietnamese in 1970 and 1971 while still a Navy reserve officer. Few are now willing to bring up this treasonous behavior, but it's unbelievable hypocrisy for Hanoi Kerry to attack this letter now.  -The Patriot Post  

 Here We Go Again: Online Sales Tax Resurrected  
An online sales tax bill passed the Senate (with 27 mostly Republicans voting "no") in 2013 but flamed out in the House. Its sponsors, however, are undeterred. The Hill reports, "Senate Minority Whip Dick Durbin (D-Ill.) and Sens. Lamar Alexander (R-Tenn.), Mike Enzi (R-Wyo.) and Heidi Heitkamp (D-N.D.) rolled out the Marketplace Fairness Act on Tuesday, which would give states more power to collect sales taxes from businesses that don't have a physical location within their borders." As Mark Alexander explained two years ago, the MFA is designed to force states to collect taxes for the states in which a purchaser resides, and this amounts to taxation without representation. Clearly, politicians want this bill passed to raise new tax revenue for broken state governments facing budget shortfalls. Mitch McCon-nell opposed the bill as Senate minority leader. Now that he's majority leader, we'll see if he holds true. -The Patriot Post  

 Leftists Hail Flawed Gun Ownership Survey  
Anti-gun advocates hailed the findings of a new study released this week that claims firearm ownership in America is fading. NBC News writes, "According to the latest General Social Survey, 32 percent of Americans either own a firearm themselves or live with someone who does, which ties a record low set in 2010. That's a significant decline since the late 1970s and early 1980s, when about half of Americans told researchers there was a gun in their household." If that sounds strikingly odd considering gun purchases remain near historic highs, that's because it is. Steve Sanetti, president of the National Shooting Sports Foundation, says, "GSS isn't actually counting the number of firearms in each household. Rather it is counting the number of individuals willing to disclose to a stranger at their front door how many firearms they own." That's important because "it is far more likely that the political climate is driving down self-reporting." By comparison, Gallup, which relies on anonymous phone surveys, puts gun ownership at 42%, a percentage that's more or less remained constant over the last decade. Truth Catching Up To Secretive,
Subversive State Department – Emails Were Not Auto-Saved, As Earlier Lies Indicated

     (rickwells.us) - Hilly Clinton said that her communications with other State Department employees were automatically preserved on their emails accounts, supposedly freeing her of the inconvenience of complying with the law herself.

     Apparently Clinton is not the only one who sought the freedom of non-compliance when it came to the preservation of government emails. The State Department during her tenure and since was a virtual aviary of free birds who also felt unfairly shackled and  inconvenienced by the laws and policies of the United States. Nobody bothered with keeping their emails and, contrarily to popular belief, they now claim that there was no system for automatically archiving  them.

     According to State Department Spokesperson Jen Psaki, until last month when things really started heating up  and public attention shifted their way, no auto-archiving was done. That’s all behind them now, they’ve seen the light. From now on, they’ll be changing their lawless ways forever. February was a big month for them, the month they “got right with the law.”

     Are we to believe that Psaki is now telling the truth when she lied to everyone straight faced for so long? How do we know that there truly was no archive system and that these claims aren’t just a different angle on the Lois Lerner “lost email” defense, asserting that they were never recorded due to a lack of a system rather than that they were lost. That tactic has been proven to be flawed with the recent acquisition of 32,000 of the “irretrievable” emails. Is this just plan “B?”

     In spite of the fact that for six years they’ve been lying to us all, now that they’ve been caught, and the magical date of March first has passed, we can trust them. We have the word of nObama’s paid liar, everything will be archived from now on. She certainly looks trustworthy.

     Some people might be stupid enough to believe her. They’re the same idiots with a “D” for dishonest or dips**t after their names who got us into this mess by voting this outlaw Marxist regime into power in the first and second place. The rest of us aren’t quite so easily fooled.

     We’ve heard that the nObama regime is supposedly sifting through all of the reams of paper from the Clinton years in search of evidence through which to target her, as an inside political move against her. What if they are just double checking to make certain nothing incriminating slipped by them?

     They were and still are covering up for their criminality and God only knows what other kinds of activities have been conducted inside the State Department and in the other myriad branches of the nObama crime syndicate. They have destroyed all of the evidence, at least they’ve attempted to. That was why they were so emboldened, why they acted with such impunity. They knew most of their anti-American activities could be denied and there was no evidence to prove otherwise.

     We can hear it already, Hussein nObama just found out about it when the rest of us did, from news reports and as he was watching Jen Psaki’s press briefing. While he’s at it he’ll once again reaffirm that his is the most transparent regime in American history.

     He’s partially correct. It’s the most transparently lawless, unconstitutional and anti-American regime to ever plague the United States of America. And he’s still got almost two years left to build on his treacherous “legacy.”

Ferguson Man Busted for Shooting Two Cops

When he was arrested Saturday and charged with one count of discharging a weapon inside a vehicle, two counts of first degree assault and three counts of armed criminal action, Jeffrey Williams admitted to shooting two police officers outside the Ferguson Police Department headquarters March 12. But his story doesn’t add up. Williams said he had a dispute with someone and the cops were collateral damage; he never meant to shoot officers. But the physical evidence suggests something else. Williams fired his .40-caliber handgun about 120 yards away from inside a vehicle and managed to hit two police officers standing next to each other. Aim small, miss small. Furthermore, there’s disagreement as to who Williams is in the drama unfolding in Ferguson. On Sunday, Ferguson police said they saw Williams amid the protesters. But protesters deny Williams' participation in their movement. Of course they’d deny him; he’s messing up the Left’s narrative.

DHS Arrests Four in ‘Pay to Stay’ Student Visa Scam

Give the government credit for actually trying to enforce immigration law. The Department of Homeland Security arrested the operators of four Los Angeles Schools for running a scam that allowed immigrants to stay in the U.S. on a student visa without actually going to school. When the DHS stopped in unannounced at one school, they discovered only three foreign students attending an English class – even though the school said 900 foreign students attended regularly. In a statement, Acting U.S. Attorney Stephanie Yonekura said, “Officials at several schools allegedly abused their responsibility to ensure that only legitimate foreign students were allowed to stay in the country. This type of fraud against the United States will be thoroughly examined to bring those responsible to justice and to protect the integrity of our immigration system.” Such examples of abuse upend the Obama administration’s rhetoric that immigrants only want to come here for better lives and we shouldn’t fault them if they cheat the system. Carville: Hillary Just Didn’t Want Congressional Oversight

Clintonista James Carville is one of the few rushing to defend Hillary Clinton over her secret email servers. But after his most recent comments she may not want his “help” any more. “At the end of the day,” Carville said, “the Republicans can’t pass a budget, alright, [so] we got another investigation, just like we had the Whitewater, just like you go through the file-gate, you go through travel-gate, you go through seven or eight different congressional committees. And you wonder why the public is not following this? Because they know what it is.” In other words, Carville says it’s a political distraction contrived by Republicans – a standard talking point. But he wasn’t finished, adding, “I suspect she didn’t want Louie Gohmert rifling through her emails, which seems to me to be a kind of reasonable position for someone to take. It amounts to … nothing but a bunch of people flapping their jaws about nothing.” Oops. Hillary Clinton just wanted to avoid congressional oversight. How inconvenient to have Congress “rifling through her emails.” Who’d want that? Of course, that oversight is precisely the point, but the Clintons have always played by their own rules.

Kerry: The Climate Debate Is Settled … Because Gravity!

In remarks to the Atlantic Council, which bills itself as “an essential forum for navigating the dramatic economic and political changes defining the twenty-first century,” State Secretary John Kerry presented skeptics of man-made global warming a lesson on science. “When an apple falls from a tree,” he explained, “it will drop toward the ground. We know that because of the basic laws of physics. Science tells us that gravity exists, and no one disputes that.” He continued, “Science also tells us that when the water temperature drops below 32 degrees Fahrenheit, it turns to ice. No one disputes that. So when science tells us that our climate is changing and human beings are largely causing that change, by what right do people stand up and just say, ‘Well, I dispute that, or I deny that elementary truth’?” For starters, science once pontificated earth was flat. And earth was the center of the universe. And high-cholesterol diets ensured heart disease. And socio-economic collapse resulting from global warming should already have happened. And… You get the picture. What Kerry won’t admit is that there is no “scientific consensus” on the issue, and even if there was it wouldn’t make one iota of difference. Climate change is well documented through the ages. So while Kerry disses “climate deniers,” as they like to call us, he’s only illuminating his complete ignorance of history.

‘A Radical Change in Climate Conditions’

Now that meteorological winter 2014-2015 is in the books (though the season isn’t formally recognized as ended until the Spring Equinox on March 20), anti-fossil fuel gurus are warning that, despite frigid cold spells over the Eastern United States, overall it was the 19th warmest on record. “Averaged together,” weather.com reported, “temperatures across the country this winter were 2.1 Fahrenheit degrees above the 20th-century mean, according to NOAA’s National Climatic Data Center.” Moreover, based on measurements from the National Snow & Ice Data Center, seasonal ice buildup in the Arctic is on pace to set a new record low. So it’s officially time to freak out, right? Well, no. Before you start preparing for The Great Climate Apocalypse, consider this:

“The Arctic Ocean is warming up, icebergs are growing scarcer and in some places the seals are finding the water too hot, according to a report to the Commerce Department yesterday from Consul Ifft, at Bergen, Norway.

"Reports from fishermen, seal hunters and explorers, he declared, all point to a radical change in climate conditions and hitherto unheard-of temperatures in the Arctic zone. Exploration expeditions report that scarcely any ice has been met with as far north as 81 degrees 29 minutes. Soundings to a depth of 3,100 meters showed the gulf stream still very warm.

"Great masses of ice have been replaced by moraines of earth and stones, the report continued, while at many points well known glaciers have entirely disappeared. Very few seals and no white fish are found in the eastern Arctic, while vast shoals of herring and smelts, which have never before ventured so far north, are being encountered in the old seal fishing grounds.”

That sounds awfully familiar because that’s exactly what alarmists are clamoring about today. Only the excerpt is from an article published by the Associated Press on Nov. 2 … 1922. Nearly a century later, it still appears the climate is, well, repetitious. As are propagandists on a mission.

How One Man Turned Americans Against Government

Gallup conducted a poll of 1,025 Americans March 5-8 that captured the nation’s growing disgust with the federal government. But the Leftmedia stopped one question short of finding the real reason for this discontent.

“Dissatisfaction with government” now beats out concerns of the economy, terrorism, illegal immigration and unemployment, despite the direct influence of these pocketbook and kitchen-table issues. Don’t underappreciate these rankings. Survey participants most frequently respond to questions through the prism of, “I’m concerned because this issue impacts me directly.”

So why, Mr. or Mrs. American, do you have this increasing dissatisfaction with government?

It boils down to one word, and, no, it’s not racism. It’s “Obama.”

When Barack Obama declared with glee that we are “days away from fundamentally transforming the United States of America,” most voters failed to fully realize the magnitude of his plans. Few understood that a community organizer raised on the milk of anger, hate and socialist indoctrination would so quickly shred the Constitution. But our Founders warned of such tyranny.

How many Democrats or even Republicans back in 2008 imagined Obama would so egregiously overstep the jurisdiction of the executive branch through ObamaCare’s implementation and effective amnesty? Or that today he would be on the verge of a nuclear agreement with Iran, giving the world’s leading terrorist sponsor much of what it wants?

Have you ever dined at a restaurant described as some delightful experience or marketed to fulfill your culinary dreams only to leave with an excessive tab, disastrous service and a meal you could’ve cooked better at home?

Obama marketed himself with promises of transparency, a government that serves all Americans, and all-around, feel-good “Hope ‘n’ Change™.

Yet after six years, the American people have endured lie after lie. To name but a few:

  • "If you like your plan, you can keep your plan.”
  • “I didn’t set a red line on Syria.”
  • “I didn’t call the Islamic State a ‘JV team.’”
  • “Republicans have filibustered 500 pieces of legislation.”
  • “The sequester is not something I’ve proposed.”
  • “Here’s what happened [at Benghazi]. … You had a video that was released by somebody who lives here, sort of a shadowy character who – who made an extremely offensive video directed at – at Muhammad and Islam.”

And then there was, for example, the political targeting by the IRS and the politicization of the Department of Justice by his criminal co-conspirator, Attorney General Eric Holder.

The distrust that has been sown, watered, fertilized and is now at full harvest is a testament to Obama’s successful “transformation” of America. He has left Americans with buyer’s remorse of monumental proportions. Voters didn’t bargain for this mess – even if some of us tried to warn them.

Democrats were walloped in two straight midterm elections, which served notice to everyone but a petulant Obama that his policies, his tactics and his results were rejected. Those Democrats who remain in elected office either have to distance themselves from the radical in the White House, or they represent districts where voters embrace Obama’s radical policies.

The Obama approach to elections has been to place each voter in some interest group – black, homosexual, pro-abortion, illegal immigrant, etc. – and win by mobilizing those groups nationally. Identity politics worked for Obama but failed most Americans.

If there’s a silver lining, it’s that Chief Radical Obama’s failed policies have resulted in a weak bench of leftist extremists down the ballot. The Republican wave was so thoroughly successful that it wiped out vast numbers of state and local Democrats around the nation, from whom the next generation of the party’s leaders will come. It is by no means a permanent defeat, but it’s most certainly a real setback.

Americans are fed up by government because Obama overpromised and under-delivered. His solution to everything is a government program, and, increasingly, Americans are seeing that as the wrong approach.

Oklahoma’s Campus Totalitarians

A video showing Oklahoma University Sigma Alpha Epsilon (SAE) fraternity members chanting racial slurs and singing about lynching has put the spotlight on the inherent conflict between First Amendment-protected speech and college speech codes begetting “zero tolerance” policies. These policies have mistakenly enshrined the “right” not to be offended.

There is little question the chant was offensive. “There will never be a n—– at SAE. There will never be a n—– at SAE. You can hang him from a tree, but he can never sign with me. There will never be a n—– at SAE,” belted out students on one of five buses chartered to take them to a Founder’s Day party at a country club in Oklahoma City two Saturdays ago.

The fraternity’s national organization conducted its own investigation and announced it was shutting down the OU chapter. “We apologize for the unacceptable and racist behavior of the individuals in the video, and we are disgusted that any member would act in such a way,” their statement reads. “Furthermore, we are embarrassed by this video and offer our empathy not only to anyone outside the organization who is offended but also to our brothers who come from a wide range of backgrounds, cultures and ethnicities.”

All well and good, but then University President David Boren crossed the line. He expelled two students identified as leaders of the chant, using the dubious rationale that has usurped the Constitution on far too many college campuses. It is the idea that offensive speech creates a hostile learning environment, and, as night follows day, such an environment engenders a “zero tolerance” policy. “I have emphasized that there is zero tolerance for this kind of threatening racist behavior at the University of Oklahoma,” said Boren. “I hope that the entire nation will join us in having zero tolerance of such racism when it raises its ugly head in other situations across our country.”

Barbara Arnwine, president and executive director of the Lawyers' Committee for Civil Rights Under Law, claims Bowen and OU “would’ve been compelled to do something” or the Justice Department’s Civil Rights Division would have gotten involved via Title VI of the Civil Rights Act. Title VI “prohibits discrimination on the basis of race, color, and national origin in programs and activities receiving federal financial assistance.”

Several legal scholars weighed in on the issue, and most believe the university trampled the Constitution.

“The courts are very clear that hateful, racist speech is protected by the First Amendment,” saidErwin Chemerinsky, a constitutional scholar and dean of the law school at the University of California, Irvine. UCLA constitutional expert Eugene Volokh agrees, explaining there is no constitutional exception for speech that creates the aforementioned hostile environment, nor speech that simply refers to violence absent a direct threat to an individual.

Geoffrey Stone, a professor of law at the University of Chicago, addressed the Title VI argument, noting that it is intended to combat literal discrimination, and statements by students in a private environment aren’t close to violating it. “The statements were made in the innocuous setting of a bus,” he explained, “and any disruption came from the showing of the video, not from the students' speech.”

Volokh also tackled the burden of proof issue, explaining the university might be able to discipline students involved in the frat’s admissions decisions if they can be shown to “have denied membership to people based on race, or intentionally tried to communicate to potential members that they would deny them membership that way.” And while SAE may insist that those who depart from its principles no longer use its name, and students who have engaged in the chant may pay a social and economic price for their actions in the court of public opinion, Volokh insists the government or University of Oklahoma “generally cannot add to this price, whether the offensive speech is racist, religiously bigoted, pro-revolutionary, or expressive of any other viewpoint, however repugnant it might be.”

On the other hand, the university might pay a price for expelling those students based solely on what they said. A board representing OU’s disbanded SAE chapter hired lawyer Stephen Jones, who served as Timothy McVeigh’s lead defense attorney during the Oklahoma City bombing trial, “to assist them in evaluating” their legal position, Jones revealed. He further explained he was retained “to protect the due process rights, the First Amendment rights, and the Fourteenth Amendment rights” of the fraternity’s members. The board is primarily concerned about their “physical safety,” Jones said, adding that some of them “have frankly been afraid to go to class.”

Jones outlined the parameters of a possible lawsuit, insisting the university’s response to the video was a “premature rush to judgment” that implicitly painted all fraternity members “with a tar brush” identifying them as bigots or racists.

For far too long, university campuses have been strangled by political correctness that actively promotes a stultifying conformity at best, and outright totalitarianism at worst. In his book “Unlearning Liberty,” Foundation for Individual Rights in Education (FIRE) president Greg Lukianoff chronicles hundreds of examples of campuses where the need for “intellectual comfort,” an obsession to punish those who “offend,” the emergence of “free speech zones,” and student demands for “trigger warnings” for “sensitive” course materials have rendered the free and open exchange of ideas completely obsolete. Even worse, students who fail to abide by such restrictions face mandatory sensitivity training, kangaroo student courts where they are presumed guilty until proven otherwise – or, as this case and many others like it indicate, expulsion for constitutionally protected speech.

America has long abided the immortal words attributed to Voltaire: “I do not agree with what you have to say, but I’ll defend to the death your right to say it.” That is the essence of the First Amendment, and it doesn’t evaporate once one steps onto a college campus – no matter who gets offended by something as “uncomfortable” as Freedom of Speech.

nObamacare’s 1095-A Nightmare

     (freedomsback.com) - Tax season is stressful enough. But if you are like countless miserable Americans trapped in the nObamacare 1095-A abyss, it’s hell on stilts on a Segway teetering over the South Rim of the Grand Canyon.

     The screw-ups, incompetence and bureaucratic blame avoidance over the health insurance exchange tax forms make the healthcare.gov website fiasco look like a flawless product launch. How do I know? My family inexplicably got ensnared in the 1095-A paperwork pit. It’s a government roach motel: Taxpayers check in, but they can never check out.

     In 2013, our private high-deductible PPO from Anthem Blue Cross got canceled because of “changes from health care reform (also called the Affordable Care Act or ACA).” Millions of others like us in the individual market for health insurance — including self-employed people, small-business owners, writers, artists and home-based entrepreneurs — suffered the same fate.

     My husband reluctantly contacted Colorado’s state health insurance exchange, “Connect for Health Colorado,” just to see what our options were. Months later, we settled on purchasing a new non-nObamacare plan directly from a different private insurer, Rocky Mountain Health. The provider network is much narrower than the Anthem plan we had before the feds intervened. Our two kids’ dental care is no longer covered, and we’ve had our insurance turned down at an urgent care clinic — something that had never happened before.

Better off? Bullcrap. But wait, it gets worse.

     Somewhere along the way, the worker bees at Connect for Health Colorado dragooned us into an nObamacare exchange plan offered by Rocky Mountain Health without our knowledge or consent. (How else has the White House inflated nObamacare enrollment figures? Things that make you go “hmm.”) Last month, we received an IRS 1095-A form, which, much to our shock and chagrin, indicated that we had paid nObamacare premiums every month during 2014.

     It took hours of time on the phone and Internet to receive an explanation from Connect for Health Colorado on how exactly this happened. Here was     the government’s response, word for incomprehensible word:

     “We apologize for the delay in responding to your email. After checking your account we are showing you might have had coverage from October 2014 to June 2014. Please call the number below to speak with a Customer Service Representative if this information is incorrect.”

“Might” have had coverage? From “October 2014 to June 2014″?

     The saga continues. We were finally able to un-enroll after being auto-enrolled in the nObamacare plan. Then, after being bounced around by the state government health exchange to various voicemail dead ends and back, with hours of migraine-inducing, on-hold music in between, we were told there’s absolutely nothing wrong with the 1095-A form — which shows payment of premiums we didn’t pay to an nObamacare plan we never enrolled in and didn’t want in the first place!

     This is just one little horror story. In Minnesota, thousands are still waiting for 1095-A forms that were supposed to arrive on Jan. 31. In California, at least 800,000 taxpayers received screwed-up 1095-As. As a result, some 50,000 people filed the wrong form. Another 750,000 are being told they’ll get corrected forms this month. Hah. Good luck with that.

     The costs in time, money and anxiety to hardworking families dealing with this paperwork perdition are enormous. Unknown numbers of people are still waiting for their forms as the April 15 tax-filing deadline looms. More face the added expense and aggravation of filing amended returns through no fault of their own.

     Where’s the rest of the media — most of whom have been insulated from these problems because they get their health insurance through their employers?

     At least one other journalist smacked head first into reality. Laura Krantz, a former NPR staffer, is now a Scripps Fellow in environmental journalism at the University of Colorado, Boulder. Earlier this month, she found out that Connect for Health Colorado had mysteriously canceled her health and dental insurance. After four days and eight hours in nObamacare Phone Hell (OPH), she learned she had lost her insurance coverage and her tax credit — and had to redo all of her paperwork.

     Poor Krantz still believes the ultimate solution is “single payer.” But another liberal who encountered 1095-A hell has seen the light. San Francisco resident and former nObama supporter Melissa Klein exposed her ordeal with Covered California last week. The state exchange botched her 1095-A and then insisted she had never enrolled despite invoices she showed them documenting her premium payments. After hours in OPH, her case remains unresolved, and she can’t file her taxes. How is it, she wondered, that “Amazon can ship something to NYC in an hour,” but the White House and Covered California “can’t create a health care system that functions”?

     Klein concluded, better late than never: “I no longer believe that the government should mandate health care. … A great idea is just an idea if you can’t execute. And the government has proved time and time again, it can’t execute.

Hilly Clinton finally addressed the brouhaha over her majesty's secret servers at a press conference Tuesday, but beginning with the first seemingly planted question it amounted to partying like it was 1999. Last week, Clinton handed over 55,000 pages of emails from her private clintonemails.com email accounts. It's a fair guess that hardly covers her entire tenure as secretary of state. So where's the rest? What's she hiding? Since the account is hers, she has sole access and control over it (well, besides potential hackers), and she's refusing to turn over everything. She reiterated Tuesday that she would not turn over the actual emails or the servers, which "will remain private." She claims 30,000 emails were personal -- including messages with husband Bill, who claims to have sent all of two emails, ever -- and she admitted to deleting many of them because she "didn't see any reason to keep them."  Iran Letter Went to the Wrong Recipient  
Forty-seven Senate Republicans sent a letter to Iran's leadership earlier this week making clear that the nuclear deal currently being negotiated does not meet the standards of a binding treaty, and that a future U.S. president could nullify it at any time. In other words, stating the obvious. The reaction was swift and furious -- from the Democrats, that is. Every leftist from presumptive presidential candidate Hilly Clinton to Smiling loose lips Joe Biden piled on, calling the letter "dangerous" and "out of step with the best traditions of American leadership" (rimshot!), while claiming it was motivated by a "rush to war" by Republican "traitors." If anyone is a traitor, it's the guy negotiating the deal -- Hanoi John Kerry. All that said, it would have been better if the Republican senators had not sent this letter to Iran. In addition to being a poor method of conducting diplomacy, it's bad politics. It will be spun by the Democrats and their sycophants in the media as just another example of personal animus and racism toward Barack nObama.  Personal hygiene -   The press conference would have been an unmitigated disaster if it were solely about making a defense to the general voting public or making the candidate more appealing. But that’s not why everyone was gathered there on the brown carpet that looked like it had been lifted right out of a motel conference room. Clinton succeeded in the most important area.  Rasmieh Odeh Sentenced to 18 Months In Prison, Then Deported   (investigativeproject.org) - Rasmieh Odeh, a Palestinian woman who conceived of and led a deadly 1969 Jerusalem bombing plot that killed two civilians, has had her citizenship revoked and will serve 18 months in an American prison for naturalization fraud...Prosecutors had asked for her to serve five to seven years.  Preparing for the Next Debt Fight

     I suppose each of us must determine for himself if the crime taking place is suicide by means of a slow-acting poison or murder that can be laid at the feet of homicidal liberals, but I don’t think there can be any question that America is not long for this world.

     America’s most precious possession, the Constitution, has been dragged through the mud by those whose egotism is so great that they seem to believe that their whims -- whether motivated by honest conviction or for strictly partisan reasons -- trumps what a bunch of divinely-inspired, long dead white guys, came up with a couple of hundred years ago.

     And unlike what passes for leadership these days -- a bunch of braying donkeys and preening peacocks -- who never give a thought to anything beyond their next election, these were men who pledged their sacred honor and meant it, and, moreover, had sacred honor to pledge.

     One can easily imagine America gazing into her mirror, tears running down her cheeks, thinking that even Alzheimer’s might be a blessing. That way the reflection looking back would remind her how grotesque she has become, but she would at least be spared remembering the beauty that she once possessed.

     • In the meantime, I think it is criminal that the Supreme Court justices get to take off for so many months. I realize that several of them are getting on in years, but they’re not doing manual labor. In fact, they barely do any mental labor. All the grunt work is done by their staff. Those are the eager beavers whose job it is to hunt down precedence and write up briefs, and then get to brag for the next 50 years that they worked for a judge who owed his judicial career to some political hack.

     It seems to me that when the President or members of Congress question the constitutionality of an executive edict or a piece of legislation, it should be fast-tracked to the Supreme Court. Why should it have to go through lower courts when everyone knows the final decision is inevitably going to rest with the Supremes? It’s obviously far more important to decide whether nObama had the authority to change the Affordable Care Act a dozen times or grant executive amnesty to five million illegal aliens than whether the justices give their blessing to same-sex marriages.

     And just maybe if the justices didn’t take four month vacations, they’d have time to do both.

     • I used to think that there should be a way to prevent everyone named Kennedy from seeking political office. I have now come to add the names of Bush and Clinton to that short list. With over 300 million people in the country, I’m sure we can do better.

     • Speaking of people named Clinton, in spite of having signed a pledge not to accept bribes -- I mean, contributions -- from foreign nations while Hilly was serving as Secretary of State, it now appears that the Clinton Foundation was raking in all they could grab from Algeria, Norway, Kuwait, Qatar, Australia and Oman, between 2009 and 2013.

     What is it about that particular job that it keeps getting filled by people from the bottom of the barrel? As bad as Mrs. Clinton was, we now have Hanoi John Kerry, who is in the process of giving the store away to Iran, the country that has done more to support Islamic terrorism than even Saudi Arabia, just so nObama can brag that he got a nuclear deal signed with the mullahs. The big question about Hanoi Kerry is how anyone who slandered American soldiers in the 1970s, and lied about his own military service, can wind up running the State Department in 2015.

     The ugly truth is that Hanoi Kerry has said far viler things about his fellow Americans than he ever has about those currently beheading and frying Christians.

     Someone once suggested that people get the government they deserve. If true, imagine what that says about us.

     • In other news, when Stephen Hawking recently decided to boycott an Israeli conference as a way to display his sympathies with the so-called Palestinians, some people wondered how such a brilliant fellow can also be a Jew-hater. How, they muse, can such a brainy chap align himself not only with those who elected Hamas to govern them, but to spit on those who invented the miraculous microchip that allows him to speak?

     The answer is that brilliance in one area -- outer space in this case -- doesn’t mean that one can’t be a nincompoop in every other area. Brilliance is a nice gift, but it’s really no substitute for wisdom and commonsense.

     Hawking’s decision also highlights the fact that the two places where you can’t swing a cat without hitting an anti-Semite are the Middle East and among the English intelligentsia.

     What I find most startling about this state of affairs isn’t that the likes of Hawking, Vanessa Redgrave, Emma Thompson and Alan Rickman, to name but a few, hate Jews. In England, as in most of the European nations, hating Jews is what passes for tradition. Sometimes, I even suspect it’s the only exercise they get. The real mystery is that in doing so, they feel the need to identify themselves with the backward savages who subjugate women and homosexuals, do everything in their power to stifle free speech and religious freedom, and, with rather delicious irony, happen to openly despise science, arts and entertainment, and those who are so engaged.

     • Finally, I am passing along something that has gone viral, but you may have missed it. It is rumored that Pete Carroll, the coach of the Seattle Seahawks, is apparently ready to sign on as a special consultant to Pope Francis.

     It seems the Pope wishes to recruit Carroll to be an envoy for the Vatican because he is the first man in history who, on Sunday, February 1st, 2015, caused 100 million people to jump up and yell “Jesus Christ!” in unison.

In 2010, and after much research, I wrote two posts regarding birthright citizenship, a subject which has again taken on considerable importance in the Senate. GIven Sen. Vitter's introduction of the "Birthright Citizenship Act" which would end the practice, I honestly believe this post would be especially useful to clear-eyed readers among us. (Caution: If you're an open-border and birthright citizenship advocate, you'd best keep your blinders on. The facts may be too painful for you to bear.) Here is the post:

We’ve all heard the stats: currently, only the United States grants birthright citizenship to illegal aliens and 8% of babies born in the US are so-called “anchor babies” born of illegal aliens. In and of itself, this doesn’t constitute a crisis, but, for many of us, it does illustrate how far we’ve strayed from the Constitution. 

Like all babies, “anchor babies” too are sweet and cuddly, and deserving of mother’s love and society’s protection. But automatically conferring citizenship on babies of illegal aliens is an ideologically-motivated perversion not only of internationally accepted legal norms, but, much more importantly, of both the Constitution and the 14th Amendment as well. 

By nimbly mischaracterizing the motives of birthright citizenship opponents, many in the media and blogosphere—to include attorneys who should know better-- have irresponsibly misrepresented the framers’ intent and have reduced the level of discourse on this legitimate constitutional issue to that of ad hominem, race-baiting, specious legal citations, contrived legal justifications, and mindless pandering. Shamelessly seeking ideological and political supremacy, to these people the Constitution and the rule of law mean absolutely nothing. And for a nation which once prided itself as being a “nation of laws”, that is inexcusable.

That said, for my own edification I decided to take the time to review the actual words of the 14th’s framers, pertinent case law and the opinions of jurists and legal scholars on both sides of the question to determine the truth in this matter. 

Here, in choppy-brief form, are my findings and conclusions:

First, while researching pertinent materials, I soon discovered that understanding the clear intent and meaning of the 14th Amendment was much simpler than anticipated. In fact, the meaning of the 14th was surprisingly straightforward. Lesson learned: if one simply abandons one’s ideological blinders for a moment and commit to an honest effort to objectively review a constitutional issue, clarity is nearly always one’s reward.

It also became apparent that from a strictly Constitutional standpoint, and despite Lindsey Graham’s initial assertion that a constitutional amendment is needed to outlaw anchor babies, aka birthright (jus soli) citizenship, I was unable to find convincing constitutional evidence that so-called anchor babies can legitimately and automatically acquire U.S citizenship. Thus, a simple act of congress--and most certainly NOT an amendment to the Constitution—in order to clarify the original intent and meaning of the 14th Amendment is all that is really needed. 

To wit, introduced on April 2nd, 2009, and co-sponsored by 93 congressmen, inclusive of one lonely Democratic supporter, Mississippi’s Gene Taylor, HR 1868 (Birthright Citizenship Act of 2009) amends section 301 of the Immigration & Nationality Act to provide that a person born in the US is “subject to the jurisdiction” of the US for citizenship purposes if the person is born in the US of parents, one of whom is: 1) a US citizen or national; 2) a lawful permanent resident alien who resides in the US; or 3) an alien performing military service in the US Armed Forces.” And if one simply reviews the original meaning of the 14th Amendment one can easily see that there is absolutely nothing at all earth-shattering, divergent or revolutionary in that language. 

Intended to protect the rights of emancipated Negroes, the 14th Amendment specifically provided that “all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and the State wherein they reside.”

And as I very quickly learned, of central importance in this statement is the phrase “subject to the jurisdiction thereof”, something birthright citizenship proponents have consistently and very conveniently ignored. 

To begin, Sen. Jacob Howard of Michigan, a co-author of the 14th Amendment, expressly asserted that “this will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers.” And it is this rough grammatical construction which, to birthright proponents, provides convenient ambiguity and cover. Did Howard mean foreigners/aliens who belong to the families of ambassadors or foreign ministers, or did he mean foreigners AND aliens who belong to the families of ambassadors or foreign ministers? A fair question which was soon clarified by him and other co-framers.

Under Section 1992 of the US Revised Statutes, the same Congress which adopted the 14th Amendment confirmed that “all persons born in the United States who are not aliens, excluding Indians not taxed, are declared to be citizens of the United States.”

In 1873, the US Atty Gen ruled the word “jurisdiction” under the Fourteenth Amendment to mean “the absolute and complete jurisdiction. Aliens, among whom are persons born here and naturalized abroad, dwelling or being in this country, are subject to the jurisdiction of the US but only to a limited extent. Political and military rights do not pertain to them.” 

Sen. Trumbell noted during the drafting of the 14th Amendment that it was the Amendment’s goal to “make citizens of everybody born in the US who owe allegiance to the US,” and if “the negro or white man belonged to a foreign government he would not be a citizen.”


On March 1, 1866, Rep. James Wilson of Iowa, House Judiciary Committee, added that “we must depend on the general law relating to subjects and citizens recognized by all nations for a definition, and that must lead us to conclude that every person born in the US is a natural-born citizen of such States, except that of children born on our soil (jus soli) to temporary sojourners or representatives of foreign governments.” This seems to have nicely clarified Sen. Howard’s somewhat ambiguous construction above.

John Bingham, framer of the 14th Amendment’s first section, stated that Sec. 1992 of the Revised Statutes meant “every human being born within the jurisdiction of the US of parents not owing allegiance to any foreign sovereignty is, in the language of the Constitution itself, a natural born citizen.”

And if we reach way back to our founders in search of a definition of citizens of a foreign power, Thomas Jefferson said “Aliens are the subjects of a foreign power.” 

To a man, among the framers the premise behind “within the jurisdiction thereof” was that all children born to parents who owed no foreign allegiance were to be citizens of the US; thus, not only must a child be born on US soil (jus soli) but born within the complete allegiance of the US politically and not merely under its laws.

Subsequently, Sen. Howard further explained that “only thru expatriation, which could be accomplished thru law alone, and not thru any immigrant acting on his own outside the law—and certainly not by any act of birth alone—could an alien become a citizen.” This, of course, would mean that the alien/sojourner would need to affirmatively renounce his allegiance to his/her country of origin before s/he could be considered completely within the jurisdiction of the US. 

Sen. Howard also stated the following: “…the word 'jurisdiction', as here employed, ought to be construed so as to imply a full and complete jurisdiction on the part of the US, coextensive in all respects with the constitutional power of the US, whether exercised by Congress, the executive, or the judiciary; that is to say, the same jurisdiction in extent and quality as applies to every citizen of the US now.” In effect, he was saying that an alien may, by treaty arrangements with his country of origin, avail himself of the protection of the US, much as sojourning US citizens in the alien’s country of origin would avail themselves of that country’s protection.

The rationale behind not granting automatic citizenship is based upon the fact that Indians could not be subject to the jurisdiction of the US because the US dealt with them through treaties. By logical extension, aliens sojourning in the US are extended privileges and protections by virtue of treaties in force with their countries of origin, much as American citizens are granted similar rights and privileges—but not citizenship--when sojourning in those countries. Logically, therefore, only if an alien voluntarily and affirmatively renounces his citizenship and expresses an intent to swear allegiance to the US may the alien, through operation of law (a formal naturalization process) be granted US citizenship. Thus, in a nutshell, since neither children of tourists/sojourners nor of diplomats born in the US can be US citizens, by what stretch can children of illegals be automatically granted that privilege? 

In 1867, George Yeaman, American Minister to Denmark, in his highly respected treatise on allegiance and citizenship and for whom the framers seemed to have great respect, asserted that “the idea of a double allegiance and citizenship united in the same person, and having reference to two separate, independent, and sovereign nations or governments, is simply an impossibility.” Thus, dual citizenship was also a no-no. (Take note, BHO.)

To wit, P. A. Madison, a modern day master of constitutional analysis, points out that “since illegal aliens are unlawfully in the US, their native country has a proper and primary claim of allegiance on the child. Thus, the completeness of their allegiance to the US is impaired, which therefore precludes automatic citizenship.” Slam dunk obvious, I’d say. 

Also, Rep. Aaron Sargent, a representative from California during the Naturalization Act of 1870 debates, said the 14th Amendment’s citizenship clause was not a de-facto right for aliens to obtain citizenship. Significantly, none of his contemporaries raised any objection, or otherwise disputed that assertion. 

Adding to this mix, here is a little case law since the 14th’s ratification.

In the Slaughterhouse Cases(1873), the Supreme Court observed that the 14th Amendment overturned the Dred Scott decision by making all persons born within the United States and subject to its jurisdiction, citizens of the US; the ruling went on to point out “that [the 14th Amendment’s] main purpose was to establish the citizenship of the Negro” and that “the phrase ‘subject to its jurisdiction’ was intended to exclude from its operation children of ministers, consuls, AND citizens or subjects of foreign states born within the United States.” Thus, another clarification of Sen. Howard’s somewhat ambiguous construction above. So, since they cannot be subject to US jurisdiction, children of citizens of foreign sovereignties and children of foreign ministers/consuls/ambassadors cannot be considered US Citizens. Makes perfect sense.

Then, in Elk v Wilkins (1884), the Supreme Court ruled that the 14th Amendment did not even confer citizenship on Indians—because they were subject to tribal jurisdiction, not U.S. jurisdiction. In effect, the court essentially stated that the status of the parents determines the citizenship of the child, and not merely the fortuitous birth of that child on American soil. (Note: not until the Citizens Act of 1924 was U S citizenship granted to Indians. As with many whimsical court rulings over the years, I was unable to understand the legal grounding for this reversal. Thus, it would seem that arbitrariness is not an affliction peculiar to modern day American courts alone.

In US v Wong Kim Ark (1889), the courts held that children born in the US of parents of foreign descent who, at the time of the child’s birth are subjects of a foreign power but who have a permanent domicile and residence in the US and are carrying on business in the US, and are not employed in any diplomatic or official capacity under a foreign power, and are not members of foreign forces in hostile occupation of US territory, become a citizen of the US at the time of birth. As expressed in the minority opinion, the decision violated the 14th Amendment. But, in any case, how many new illegal aliens have permanent domiciles in the US and how many of them are carrying on business in the US? (A lawful business, that is.) I suspect precious few. But note that in this case the parents were, unlike illegal entrants, legally present.

In Steel v Citizens for a Better Environment (1998), the court stated that “jurisdiction is a word of many, too many, meanings.” However, Sen. Trumbell and, yes, Sen. Howard, 14th Amendment authors, had long before provided a definition by declaring that “the provision is, that all persons born in the United States, and ‘subject to the jurisdiction thereof’’, are citizens. That means ‘subject to the complete jurisdiction thereof. What do we mean by ‘complete jurisdiction thereof? Not owing allegiance to anybody else. That is what it means.” From the horses’ mouths. Clearly, jurists in the Steel v Citizens court didn’t bother to research the framers’ intent and meaning.

But, despite the foregoing, we fast forward to the somewhat enigmatic ruling in US ex rel. Hintopoulis v Shaughnessy (1982), which some bloggers have used to justify birthright citizenship. In that case, and out of whole cloth, somewhere in the ruling it asserted, almost in passing, that although a child born in the US to two illegal aliens was a US Citizen (????) that, nonetheless, “suspending the alien parents’ deportation based upon “the accident of birth in the US of their son would be to deprive others, who are patiently awaiting visas…” Thus, since the passing allusion to the legality of birthright citizenship, though gratuitous—and erroneous—was woven into this suspension of deportation decision, birthright proponents often blithely cite this case to substantiate the incontestable legality of birthright citizenship. Don’t ask.

Then, true to activist form, in Plyler v Doe (1982) the court, somehow without ready access to the framers’ erudition and written words, mysteriously ruled 5-4 that there is “no plausible distinction” with respect to “jurisdiction” between resident aliens who entered the country lawfully and those resident aliens who entered unlawfully. Wow. Again, don’t ask. Clearly a yawning divergence from the framers’ clear meaning and intent. Seems judicial activism was as alive and well in 1982 as it is today.

To me, these two rulings which capriciously and arrogantly turned Thomas Jefferson and the framers of the 14th on their heads are clearly unlawful at worst, convenient contrivances at best. 

When I explained all this on-line to an attorney who is also a strong proponent of birth right citizenship, this was her reply: “I disagree with your interpretation of the phrase ‘subject to the jurisdiction thereof'. The first rule of statutory construction is that we don’t look to the drafters’ intent if the words are plain and unambiguous…If the drafters meant to include some allegiance test, they would have. They didn’t.” That sort of revisionism, willful ignorance and dishonesty is, folks, what this country is up against. My rejoinder was civil, but to the point: “It wasn’t MY lowly interpretation. It was the framers’ interpretation. But, ignore original intent and meaning? A living constitution is like having no constitution at all. We can merely make it up as we go along and continue to hand-off an increasingly irrelevant document to the next generation. While I sincerely hope this isn’t what you have in mind, at this juncture I can see there’s really nothing more to discuss with you on this or any other constitutional issues. How very sad.”

Finally, in my humble opinion, and based upon what I understand to have been the 14th framers’ clear intent and meaning, passage of Louisiana Senator Vitter's "Birthright Citizenship Act" which would virtually eliminate this unlawful practice, would finally restore clear intent and meaning of the 14th Amendment—surely a tall order with so many activists and social engineers infesting our courts these days.

 Is the Threat of an Ammo Ban Past  
A bit of good news out of The Swamp for a change. The ATF says it's scrapping plans to ban a popular round of ammunition after loads of negative public feedback. The Associated Press reports, "The Bureau of Alcohol, Tobacco, Firearms and Explosives says the agency received more than 80,000 public comments on the proposal to outlaw some types of 5.56 mm rounds, or .223 caliber. The agency says the comments were overwhelmingly critical of the proposal." The ban was (supposedly) motivated by the "discovery" that "pistols" can now shoot armor-piercing ammo, but perhaps the ATF feared a successful court challenge to the National Firearms Act's definition of "pistol." Certainly, Second Amendment defenders think the NFA is in many ways incompatible with the Supreme Court's Heller ruling. But is this really good news, or just a tactical retreat? According to the ATF, "Although ATF endeavored to create a proposal that reflected a good faith interpretation of the law and balanced the interests of law enforcement, industry, and sportsmen, the vast majority of the comments received to date are critical of the framework, and include issues that deserve further study. Accordingly, ATF will not at this time seek to issue a final framework [emphasis added]. After the close of the comment period, ATF will process the comments received, further evaluate the issues raised therein, and provide additional open and transparent process (for example, through additional proposals and opportunities for comment) before proceeding with any framework."  Social Security Records Show Existence of 6.5M Zombies  
It's strike two against the Social Security Administration. First, the agency wrote to Sen. Ron Johnson, telling him it was still implementing Barack nObama's executive actions granting legal status to millions of illegal immigrants. Now, an investigation showed the agency did not prosecute illegal immigrants it found committing fraud with Social Security numbers belonging to citizens who died. According to a report by the agency's Inspector General, "In three cases, [the Office of Investigators] confirmed that illegal aliens were using deceased numberholders' names and SSNs to work, but U.S. Attorneys in Arizona, Florida, and South Carolina declined prosecution." The report goes on to say there are 6.5 million Social-Security-card-carrying citizens who are over the age 112. Right. But then there's this example: In 2008, a man whose Social Security number indicated he was 122 applied for a job in Arizona, even though the SSA's payment records show it stopped paying him benefits in 1965. Either there was a zombie collecting a salary in Arizona, or the SSA's shoddy record keeping has allowed fraud to fester. More...

 Walker and nObama Tussle Over Right-to-Work  
After Wisconsin Gov. Scott Walker signed right-to-work legislation Monday, Barack nObama bashed the Republican presidential hopeful. "Wisconsin is a state built by labor, with a proud pro-worker past," nObama said. "So even as its governor claims victory over working Americans, I'd encourage him to try and score a victory for working Americans -- by taking meaningful action to raise their wages and offer them the security of paid leave. That's how you give hardworking middle-class families a fair shot in the new economy -- not by stripping their rights in the workplace, but by offering them all the tools they need to get ahead." Walker quickly fired back. "On the heels of vetoing Keystone Pipeline legislation, which would have paved the way to create thousands of quality, middle-class jobs, the President should be looking to states, like Wisconsin, as an example for how to grow our economy," Walker replied in a statement. "Despite a stagnant national economy and a lack of leadership in Washington, since we took office, Wisconsin's unemployment rate is down to 5.0 percent, and more than 100,000 jobs and 30,000 businesses have been created." nObama has spent more than six years undermining working Americans all while claiming to be in their corner -- his magic "middle-class economics."  It Takes No Fewer Than 170 Days to Fire Federal Workers  
Government employment usually entails good job security. Consider the EPA, where spending up to six hours per day looking at x-rated websites isn't enough to get employees fired -- even a year after the story broke. No matter which federal department or agency you represent, existing rules ensure that accountability is difficult to enforce, particularly when it comes to veteran workers. Based on a Government Accountability Office report published Monday, "A minimum of 170 days is required to fire a federal employee for poor performance, if a government agency properly follows the required dismissal process," The Washington Free Beacon reveals. Administrators who follow chapter 43 of the United States Code allow misbehaving employees upwards of 110 days to make amends. And if that doesn't work? "After dismissal, the employee is then given the opportunity to appeal, which itself takes an average of 243 days to complete," the Beacon adds. "Alternatively, agencies can use chapter 75, which is 'largely similar to chapter 43.' Chapter 75 is generally faster since it does not require time to allow the employee to improve, but the 'burden of proof for sustaining a dismissal' is higher."  University Violated Speech Rights of Racist Frat Boys  
University of Oklahoma violated the First Amendment rights of two frat boys when it expelled them after they were videotaped leading a racist chant. Over the weekend, the school's student newspaper published a story after it obtained video footage of a group of Sigma Alpha Epsilon frat boys chanting that "there will never be a n----- at SAE." But the university's discipline of the students may have just elevated the students to free speech martyrdom. Legal scholar Eugene Volokh writes, "First, racist speech is constitutionally protected, just as is expression of other contemptible ideas; and universities may not discipline students based on their speech. That has been the unanimous view of courts that have considered campus speech codes and other campus speech restrictions. ... The same, of course, is true for fraternity speech, racist or otherwise." But in the nanny-state that is often called higher education, administration officials simply see students as children, whose rights they can violate at will. A better discipline would have been to call out the perpetrators -- by name -- in the square of public ideas. More...

(Sara Noble) - A border union chief believes without doubt that we are facing terrorist attacks worse than 9/11 because of the president’s liberal programs which allow people to come into the United States without proper vetting...National Citizenship and Immigration Service union president, Kenneth Palinkas, said deportations are “extremely down”. The deportation program is “catch and release”, Palinkas explained. Unless the detainee is convicted of a heinous crime and the person is an aggravated felon, they are detained for about 9 months and..” The administration gets to decide the disposition of the case. They can no longer bring the case before a judge. As adjudicating officers, they [agents] did have the authority to bring them before an immigration judge. They can no longer do that.

 Fed Inspector General Reopens Leak Investigation  
(Jake Bernstein) - The Federal Reserve Board’s inspector general has reopened an investigation into a two-year-old leak of confidential monetary information amid rising Congressional scrutiny into how the Fed has handled the matter, ProPublica has learned...Sources told ProPublica that the IG’s action came March 4 and was based on new information.      (jewishworldreview.com) - The Lord works in mysterious ways. That sentence does not appear in the Koran. Nor, actually, is it found in the Bible. But in recent days it has probably occurred to Ayatollah Ali Khamenei, Iran's Supreme Leader.

     On the one hand, he is reportedly suffering from cancer, an advanced stage. On the other hand, he is tantalizing close to winning battles he has been fighting for more than a quarter-century, since he assumed the mantle of Ayatollah Ruhollah Khomeini, charismatic leader of the 1979 Islamic Revolution and founder of the Islamic Republic of Iran.

     Most significant: His negotiators appear to be on the brink of concluding a deal with President nObama, who will suspend economic sanctions without congressional input (although the most onerous sanctions can be terminated only by Congress) and, in effect, guarantee Iran the right to possess nuclear weapons in the not-too-distant future.

     In exchange, he is not being required to dismantle his illicit nuclear weapons program or stop sponsoring terrorism. He is only being asked to slow-walk the program. What if he agrees and then violates the agreement and the Americans find out? I doubt that worries him.

     "I am not a diplomat. I am a revolutionary," the supreme leader said two years ago. Paradoxically, that may be among the reasons Iranian diplomacy has been so effective. He drew red lines and wouldn't move them. By contrast, his American and European enemies - he does not view them as "negotiating partners" - displayed flexibility in pursuit of "conflict resolution." You might call this asymmetric diplomacy.

     It has been obvious that Mr. nObama - who began writing letters to him in 2009 - was more eager than he to conclude a deal; more fearful of what might follow should the talks collapse. Over time, the American president's definition of success grew modest: It would suffice to end up with a piece of paper that the naive could believe guarantees peace for our time - our time being roughly 10 years, when a "sunset" clause in the pending agreement kicks in and most restrictions on Iran's nuclear program vanish.

     During the course of the negotiations, Ayatollah Khamenei must have been encouraged - if not surprised - to find that nothing he and his deputies did provoked the Americans. For example, last year Iranian Foreign Minister Javad Zarif placed a wreath on the grave of Imad Mughniyeh, the Hezbollah leader believed responsible for the 1983 bombings of the U.S. Embassy and Marine barracks in Beirut that together killed 268 Americans, as well as attacks in the 1990s on the Israeli embassy and a Jewish center in Buenos Aires that killed 114.

     This past weekend, Iran announced a new surface-to-surface cruise missile system, an important addition to its arsenal of long-range rockets. Research continues on intercontinental ballistic missiles that could deliver nuclear warheads to American targets. And earlier this month, Iranian forces destroyed a replica U.S. aircraft carrier in the Strait of Hormuz, through which much of the world's petroleum passes. A general in Iran's Islamic Revolutionary Guard Corps said the exercise was intended to send a "message."

     Mr. nObama's messages have been rather different. He has been instructing Congress not to pass legislation mandating additional sanctions in the event Iranian intransigence continues. Last week, Robert Menendez, the Democratic senator most adamant about stopping the Islamic republic from obtaining nuclear weapons, was accused of corruption by Mr. nObama's Justice Department.

     I suspect the supreme leader is clever enough to appreciate how lucky he has been to have America as his enemy. President George W. Bush took on the task of deposing Iran's nemesis, Saddam Hussein. That achieved, Iraq might have been transformed into a U.S. ally, providing the Americans with a permanent military base right next door and in the heart of the Arab Middle East.

     Mr. nObama chose instead to withdraw U.S. troops - essentially inviting the supreme leader to step in, which he did, supporting Iraq's Shiites and the suppression of Iraq's Sunnis. One consequence: the growth of the Islamic State, a Sunni jihadi movement and rival to the Islamic republic. The United States is helping confront the Islamic State - which means the U.S. is assisting Iranian-backed Shiite militias similar to the ones that a few years ago were killing American troops in Iraq.

     Thanks to the supreme leader's bold policies, Iran is now the dominant power in four Arab capitals: Baghdad, Damascus, Beirut and Sana'a. Hamas, which rules Gaza, maintains close ties to Tehran, which sends weapons when it can. For example, in March 2014 the Israeli navy stopped a commercial ship called the Klos-C, which was filled with Syrian long-range rockets.

     Israel, along with America's Arab allies in the region, e.g., Saudi Arabia, Egypt and the United Arab Emirates, worry that Mr. nObama means to form a de facto alliance with Iran - one that could be maintained only at their expense. That may bring a smile to the lips of the supreme leader.

     Perhaps the smile fades, though, as he ponders this irony: He has given his life to what Saeed Ghasseminejad, an Iranian dissident in exile and a colleague of mine at the Foundation for Defense of Democracies, calls "a holy mission." Like Moses, he has led his followers to the Promised Land - a land not of milk and honey but of power and glory. Also like Moses, he may not be able to accompany them on the final journey. Western intelligence sources quoted by the French newspaper Le Figaro estimate the 75-year-old cleric has no more than "two years left to live."

     Yes, the Lord works in mysterious ways. But a man of faith accepts that, counts his blessings, and submits to the Divine Will.

Raise the debt ceiling? No problem, says Senate Majority Leader Mitch McCon-nell. "I made it very clear after the November election that we're certainly not going to shut down the government or default on the national debt," McCon-nell said Sunday. "We will figure some way to handle that. And, hopefully, it might carry some other important legislation that we can agree on in connection with it." At issue is, yet again, the legal limit on the nation's debt. Last year, lawmakers opted for a "debt ceiling holiday" instead of a specific statutory limit increase, but the holiday ends March 15. The national debt stands at nearly $18.2 trillion, up from $10.6 trillion at Barack nObama's inauguration, but it's still not enough. Instead of putting up a fight after gaining control of both chambers of Congress, McCon-nell said the GOP would rather just play nice.  SCOTUS Upholds Religious Liberty in nObamaCare Case  
Before the Hobby Lobby case, the court system told the University of Notre Dame it had to comply with nObamaCare's contraception mandate -- even if doing so violated the Catholic university's collective conscience. But in a ruling by the Supreme Court Monday, the case was sent back to the lower court with instructions that the court must decide the case based on the Hobby Lobby ruling. Mark Rienzi, senior counsel of the Becket Fund for Religious Liberty, said, "This is a major blow to the federal government's contraception mandate. For the past year, the Notre Dame decision has been the centerpiece of the government's effort to force religious ministries to violate their beliefs or pay fines to the IRS. As with the Supreme Court's decisions in Little Sisters of the Poor and Hobby Lobby, this is a strong signal that the Supreme Court will ultimately reject the government's narrow view of religious liberty."  Under NV Law, Gun Carrying Homes Can't Give Foster Care  
Brian and Valerie Wilson are at the forefront of the effort to change foster care policies in Nevada. The couple -- who started carrying handguns after an attempted home invasion -- wanted to become foster care parents, but they were denied because Nevada rejects applications from couples if they have gun permits.  Does the Ethanol Mandate Include Singing Its Praises?  
A number of potential Republican presidential candidates descended on the Iowa Ag Summit this past weekend to shore up their bona fides with the state's agricultural industry.  Little Support for nObama's 'Strategy' Against ISIL  
Problems continue to abound for Barack nObama in dealing with the Islamic State and other jihadists in the Middle East. He claims he wants congressional support, and he boasts there is a united front to combat the Islamic State, but, given the current situation in the Middle East and nObama's record of failed foreign policy, few are lining up to follow his lead. Early last month, nObama submitted to Congress his request for an Authorization for the Use of Military Force (AUMF) to fight the Islamic State. As we noted then, his request prohibits any enduring offensive combat operations and sets a timetable for three years, which in his warped view will show the world our resolve in countering the Islamic State. In reality, the 2001 AUMF against al-Qaida and the 2002 AUMF for military operations in Iraq allow nObama to pursue the Islamic State. An exhaustive list of genocidal threats by major Iranian politicians between 2009 and 2012 has been compiled by the Jerusalem Center for Public Affairs. The latest threat was made on March 1 of this year.

The Islamic State and other terrorists do not represent an idealized version of normative Islam, and a number of Muslims may not even support them. But their scriptural and historical roots frankly have plenty of precedent, and far from minimal support.

Shi'i Islam is a very different belief system from Sunni Islam. Iran today resembles a medieval European state.

     When Israeli Prime Minister Binyamin Netanyahu spoke from the podium of the U.S. Congress to warn of the dangers of a nuclear-armed Iran, the clock was already ticking towards March 31. That is the deadline for a final agreement between the P5+1 (the five permanent UN Security Council members plus Germany) and the Iranian regime on limits to Iran's nuclear program, in return for the lifting of sanctions currently imposed on Iran.

     By now, everyone has read page upon page of commentary on what the likely consequences of such a deal may be, with a preponderance of analysts agreeing that President Barack nObama's drive to secure a resolution is likely to put Iran on a clear course to nuclear weapons capability after about ten years. Given Iran's tendency to enrich uranium in secret, they may achieve nuclear breakout capability well before ten years from now.

 Netanyahu's mission was to warn Congress about the possible ramifications of these negotiations not only for Israel, but for the entire free world. nObama's vehement opposition to Netanyahu's speech was a desperate sign of how far his political advantage now takes precedence over any concern for the danger that Iranian nuclear weapons will pose to Israel, the Middle East, Europe and even America.

     Over the years, Iran's threats to destroy Israel, to "wipe it" from the pages of history or to flatten Tel Aviv and Haifa, have been direct and unambiguous. This last threat was made on March 1 of this year. Joshua Teitelbaum and Michael Segall, at the Jerusalem Center for Public Affairs, have compiled an exhaustive list of genocidal threats by major Iranian politicians between 2009 and 2012. It is highly unlikely that Barack nObama, Hanoi John Kerry, or anyone else in the U.S. Administration or the State Department have ever read it, or, if they have read it, that they care.

     What is worrying more than anything is that the U.S. president and his allies seem not to understand, even a little, the country now working to build nuclear weapons: its culture, its religion, and its apocalyptic obsessions.

     nObama seems to think the Iranian leadership is made up of pragmatic politicians who favor an almost areligious approach to world affairs. This calculation seems based on a wished-for interpretation, which is almost secularist, of a religiously-defined and faith-inspired culture.

     Let us start with a recent statement by President nObama, made during a press conference with German Chancellor Angela Merkel on February 9, 2015. nObama argued that a nuclear deal with Iran was possible because "according to their Supreme Leader, it would be contrary to their faith to obtain a nuclear weapon." Sadly, this comment reveals that he is as ignorant of Islamic scripture as he is of Islamic history.
 
     nObama has gone out of his way to say that Islamic terrorism has nothing to do with Islam. He insisted, at a White House summit later in February, that "We are not at war with Islam. We are at war with people who have perverted Islam." But he failed to explain how reams of accurate quotes from centuries of theory and practice of the Qur'an, the hadith (traditions) and works of Islamic jurisprudence, could constitute "perversion."

     If we speak about the faith of the Iranian people, we are ignoring a few small minorities. Shi'i Islam is a very different belief system from Sunni Islam. Regrettably, it seems that neither nObama nor his advisors knows a thing about the theology, history, rituals and mechanisms of Shi'ism, its clerical system, its seminaries, its sects, or its modern manifestations. Many of these matters are very relevant to the question of whether Iran would use nuclear weapons once it had them.

     Even if it is unreasonable to expect that the American president embark on a study of the intricate metaphysics of Ishraqi philosophy, Babi apocalypticism, or Usuli ejtehad, at least he has at his disposal universities full of scholars, who could bring him up to speed on the most basic elements in modern post-revolutionary Iranian beliefs. The problem is that he seems not to want to listen to people who might tell him what he does not know, in case he might disagree with it. This wilful blindness calls into question the wisdom of enabling Iran to be a nuclear-armed country -- ever. Unfortunately, a nuclear-armed Iran is something nObama and his supporters apparently intend to make a reality.
 
     Professor Bernard Lewis, in 2009, said on the question of Iran's nuclear weapon, "For most of the Iranian leadership MAD would work as a deterrent, but for Ahmadinejad and his group with their apocalyptic mindset, mutually assured destruction is not a deterrent, it's an inducement."

     True, Mahmoud Ahmadinejad is no longer the Iranian president, and the current president, Hassan Rouhani is often deemed by the west a pragmatist and a reformer, but the apocalyptic mindset is not something unique to Ahmadinejad and his followers. It has deep roots in Shi'ite belief. That -- plus raw superstition, a large measure of religious fanaticism, and a cult of martyrdom -- makes Iran the most dangerous country on the planet today.

     Put another way, if someone boasts of uncontrollable urges to slaughter everyone he considers his enemy, is it really advisable to buy him an assault rifle and a few of boxes of bullets? Imagine what he could do with a batch of nuclear-tipped intercontinental ballistic missiles (ICBMs).

     According to Jane's Defence Weekly, Iran's longest-range rockets, while "theoretically capable of ICBM ranges," cannot be classified as ICBMs. But the United States Institute of Peace believes Iran already has the largest and most diverse ICBM arsenal in the region, built from foreign imports, notably from North Korea. In the meantime, the regime has long-range missiles capable of delivering nuclear payloads to Israeli cities. On 8 March 2015, at a ceremony in Tehran, Iran unveiled its new Soumar long-range cruise missile. Their Qadr and Qiam missiles can already reach Israel.

     The expectation of the coming of a messianic figure called the Mahdi, peripheral in Sunni Islam, has always been a key feature of Shi'ism. In this belief, the war that will bring on the "End of Days" or the Apocalypse, will bring to earth the Mahdi, the "Hidden Imam," a descendent of Mohammad. Then there will be universal peace.

     The promise of mankind's liberation through a semi-divine saviour has been at the heart of the Shi'ite faith -- the faith that nObama thinks will not contemplate the use of nuclear arms. The Shi'a identify the Mahdi as the last of their twelve holy Imams, a young boy who disappeared from human sight in the year 260 (872 C.E.), lives in a state of occultation as the Hidden Imam in the celestial cities of Hurqalya and Jabulsa, and will return to earth with a sword to fight a last battle against the forces of unbelief. The form of Shi'ism that is dominant in Iran is the majority Twelver sect, which means that the living presence of the last Imam, and the promise of his return to establish a world of peace and justice, runs through the veins of all believers.

     Since the Islamic Revolution of 1979, and especially during the presidency of Mahmoud Ahmadinejad (2005 to 2013), apocalyptic notions and supernatural influence on political decisions have challenged those who seek a rational and pragmatic approach to state affairs. Perhaps the leading scholar of this trend is Dr. Mehdi Khalaji, a senior fellow at the Washington Institute for Near East Policy. Khalaji trained in Islamic theology and philosophy for fourteen years in the seminaries in Qom, then in Tehran and Paris. He is now an American citizen who understands the Iranian regime as an insider. His study, "Apocalyptic Politics: On the Rationality of Iranian Policy," should be compulsory reading for anyone who thinks Iran can be approached and negotiated with as a rational partner. Although he was writing about the Ahmadinejad period, his monograph shows substantial evidence that irrationality was not and is not restricted to one man's delusions. According to Ali Rahnema, "... the president's Ahmadinejad's behaviour and utterance and those of his proponents were neither exceptional nor isolated cases in historical terms."    

     "The Islamic government of Iran," Khalaji writes, "has turned to an apocalyptic vision that brings hope to the oppressed and portrays itself as an antidote to immoral and irreligious behaviour." (p. vii) Perhaps this is merely religious superstition that has no impact on political behaviour. But Khalaji stresses several times that Ahmadinejad was reputed to belong to a secret society that believes in the imminent return of the Hidden Imam. He informs us that "It is very difficult to know precisely what this secret society believes, but some rumours suggest it is eager to control the country's nuclear program." Later, Khalaji points out that the president "juxtaposes the preparation for the return of the Hidden Imam with the collapse of the state of Israel", and chillingly adds that "Ahmadinejad has stated that the Iranian nuclear program is running under the control of the Hidden Imam". Even if the former president is a crank, millions upon millions of Iranian Shi'is have an intense belief in the power of the Mahdi over human affairs.

     Between 1997 and 2005, the president of Iran was Mohammad Khatami, since considered as a key figure in the reform movement that sought to replace clerical rule with a more secular system. Although a cleric himself, Khatami opposed Khomeini's theory of rule by religious guardians (velayat-e faqih). Yet even in the years of his second term, 2001-2005, an enhanced yearning for the return of the Twelfth Imam was advocated through selective mosque networks and Islamic associations. That this happened under a genuine reformist, who wanted to bring about a true democracy in Iran, is of considerable importance in any analysis of what may happen under Iran's current president, Hassan Rouhani.

     Rouhani has been widely interpreted as a reformer, but the increase in hangings, strictures on veiling, and mistreatment of the Baha'i community under his presidency suggest he is a very different man from Khatami or to those belonging to the suppressed "Green Movement". Khamenei's support for Rouhani is itself indicative of his adherence to traditional norms. There is no sign of a let-up in superstition or the apocalyptic vision under his presidency.

     An important sign of the continuing appeal of extreme religious thought and behavior may be found in the growth of a major cult based around what is now a huge mosque complex on the outskirts of Qom, where the more rationalist seminary is located.

     Modern Iranian messianism is no longer the passive style of centuries past, but activist, and can lead to military action.

     Religiosity and superstition played an equally important part in the Iranian military response to Iraq during the 1980-1988 war between the two countries, during which some 750,000 Iranians died and tens of thousands more were badly wounded.

     Throughout the war, religious themes predominated, from calls to jihad, to imitating the events of Karbala, when the Imam Husayn was martyred ("Every day is Ashura, every land is Karbala"). All dead soldiers were lauded as martyrs; even children were sent into battle carrying plastic silver "keys to paradise." The idea was that by fighting the Iraqi army in a war between truth and falsehood, Iranians would hasten the return of the Hidden Imam.

     With this sort of thinking -- the willingness to sacrifice, whatever the cost -- it is critical to remember the words of former "reformist" president Akbar Hashemi Rafsanjani in 2000:

"If one day, a very important day, of course, the Islamic World will also be equipped with the weapons available to Israel now, the imperialist strategy will reach an impasse, because the employment of even one atomic bomb inside Israel will wipe it off the face of the earth, but such a bomb would only do damage to the Islamic World. It is not unreasonable to consider this possibility."

     Militant messianism is as dangerous as ever today. Expectation of the Hidden Imam and the activist struggle to bring about his advent are not only matters of pious belief. According to Mehdi Khalaji, the former Iranian cleric, apocalyptic ideas have a strong following within the Islamic Revolutionary Guard Corps (IRGC) and the Basij militia. He points out that Ahmadinejad's followers, who believe in the coming apocalypse, "are linked to an influential group of the IRGC that has responsibility over Iran's nuclear program." There is no reason to suppose that this group within the IRGC has abandoned its apocalyptic beliefs, or the link between them and control of nuclear arms.

     Iran today resembles a medieval European state more than a modern secularized democracy. The Muharram processions, when men march through city streets naked to the waist while whipping themselves with chains and razor blades, bring to mind the ritual marches of medieval Flagellants. Like the Flagellants, the Shi'a of Iran expect the imminent end of the world.

     In a country sunk in economic misery, subject to a harsh system of government and justice, where young people are desperate to flee abroad to seek normal lives, where nothing works, where corruption is rife at all levels, not least among the "spiritual," it is not surprising that so many seek escape through superstition, pilgrimage, writing letters to a man who died centuries ago, and connecting their Saviour's return to military might and the conquest of the world.

     The Iranian regime is changeable, with frequent shifts in direction and personnel. President nObama treats the current Iranian president, Hassan Rouhani, as a pragmatist with whom he can do a deal. But Rouhani (who remains a hardliner) is not the most powerful man in the country. Greater power resides in the hands of the Supreme Leader, Ayatollah Ali Khamenei. Even that may be about to change, long before Rouhani comes to the end of his term. On the March 5, the Jerusalem Post reported that Khamenei may be close to death. There have been rumours about his cancer for several years, but now it seems he does not have long to live. We do not know what sort of man will replace him, but it is unlikely to be an entirely rational figure, and it could turn out to be a cleric who espouses at least some of the superstitious beliefs outlined above. Nor should we forget that current polls place Mahmoud Ahmadinejad close behind Hassan Rouhani for the 2017 presidential elections. If Iran has nuclear weapons during a third Ahmadinejad term, the risks for humanity will be immense.

     Can the world afford to give the green light for building nuclear weapons to a country that is so unstable and so close to justifying the use of such weapons by believing in the nearness of The Last Day?

These students, in an asylum of higher indoctrination claimed it was offensive to illegal aliens.

“The American flag has been flown in instances of colonialism and imperialism. There were people who were like, ‘the flag triggers me’ – that was their exact wording, too.”

The Executive Leadership of that student government body vetoed the ban but that wasn’t the last word on the topic.

According to the Chancellor of U.C. Irvine…Howard Gillma…“Regardless of your opinion on the display of the American flag, we must be united in protecting the people who make this university a premier institution of higher learning.”

And what of those who are paid by taxpayer dollars to indoctrinate tomorrow’s leaders today? What did the professors, steeped in liberal/socialism for generations have to say regarding this matter???

Feeling a bit groggy today? Did you commute to work in the dark again? Not surprising since the government mandated that you wake up an hour earlier this morning (and every day until Nov. 1). The rationale for the creation and expansion of Daylight Savings Time was to save energy. The original idea was said to be Ben Franklin’s, but it became part of the mainstream American experience under President Woodrow Wilson during World War I. Wilson famously tried to keep the regime in place after the war, but Congress overruled him, even overriding his veto. The practice returned during World War II and was maintained by some local governments after the war. The time-shifters fought and won a long battle, eventually pushing through legislation in 1966 that required states to adopt uniform standards and gave the federal government authority over starting and stopping Daylight Savings Time. Today, every state except Arizona and Hawaii obeys. But does it work? Nope. WaPo passes along a study from time-zone-crazy Indiana that revealed that the shift wastes energy. Why? Because whatever electricity people are saving by having more sunlight in the evening is outstripped by the energy used for heating in the chillier, earlier mornings and cooling in the evening.

Hilly Clinton has addressed her private email scandal so far only with a lone tweet, although she reportedly plans to publicly address the issue today. But Barack nObama has already taken plenty of flak on the subject. Over the weekend, CBS News asked nObama when he learned of Clinton's private account.  Social Security Continuing to Implement Amnesty Actions  
It was the logical next step. If illegal immigrants are getting Social Security numbers, then they are going to collect benefits. Stephen Goss, chief actuary for the Social Security Administration, wrote a letter to Sen. Ron Johnson (R-WI) claiming that by 2017 some 16,000 illegal immigrants amnestied by Barack nObama's executive action would start receiving Social Security benefits. Furthermore, Goss admitted the agency is ignoring the injunction blocking the implementation of nObama's executive decrees. In the letter, Goss wrote, "Based on the best advice and counsel we have gotten, we're working on the assumption that these [mass amnesty actions] will persist. Most indications we seem to get are that it's likely that this will get back on track, with some delay." This is the administration that has 6.5 million active Social Security numbers for people 112 years old or older. The Wrong “America Works”

     (city-journal.org) - Most Hollywood fictions can be relied upon to rewrite conservative truth into left-wing fantasy. In real life, the staunch Cold Warrior president John F. Kennedy is assassinated by a Communist for the sake of Communism. At the movies, Oliver Stone turns Kennedy into a peacenik killed by a vast right-wing conspiracy. In real life, a married Democratic president faces credible charges of philandering and mistreatment of women. Onscreen, Michael Douglas magically transforms him into an unmarried man of integrity excoriated by the puritanical right for falling deeply in love with an accomplished woman his own age. In real life, leftists in the news media attempt to discredit a Republican president by creating a nonsensical scandal out of the Valerie Plame kerfuffle. At the multiplex, the scandal becomes deadly real and Vice President Dick Cheney (who had nothing to do with any of it) is somehow behind it all.

     We’ve all become so accustomed to this leftward rejiggering of history that watching Netflix’s TV series House of Cards can be a weird and confusing experience. On the one hand, by dramatizing the rise of a corrupt, soulless Democratic pol willing to break any law, betray any principle, and literally throw his opponents under trains to acquire power—and by showing a Republican opposition too bumbling and cowardly to oppose his ruthless machinations—the series hews so close to the facts that it can hardly be called fiction at all. But when it comes to portraying the actual nuts and bolts of day-to-day policy making, the show sometimes seems to take place in an unidentifiable political Wonderland.

     In the first season, House majority whip Frank Underwood—the soulless Democrat in question, played by the wonderful Kevin Spacey—seeks serious entitlement reform in spite of opposition from Republicans. He also stands up to the teachers’ unions in hopes of improving education. One can be forgiven for wondering on which planet this is taking place.

     Then, in the present third season, Underwood, now risen to the White House, seeks to reform Social Security and other entitlement programs that are “sucking this country dry,” in order to fund a program that will get people off the welfare rolls and put them to work. When I heard those ideas come out of the mouth of a Democrat, I thought for a moment I had accidentally switched to the SyFy network.

     But to add to the confusion, the name of Underwood’s $500 billion job proposal is America Works. Only it’s not at all like the real America Works, which actually works, but much more like nObamanomics, which hardly works at all.

     Underwood’s America Works—as Jon Hartley notes in Forbes—looks a lot like nObama’s $787 billion America Recovery and Reinvestment Act, which was supposed to create 7 million new jobs and bring the unemployment rate down below 7 percent by 2010. None of that happened. In fact, the drop in the unemployment rate didn’t really get started until Republicans finally found the guts to put an end to unemployment benefits in 2013. This they managed to do despite the fact that Democrats like nObama and Nancy Pulosi kept claiming that unemployment insurance was actually creating jobs itself. By that logic we would have reached full employment once everyone was out of work!
 
     The real-life America Works, however, was formed in 1984 as a response to the abject failure of government attempts to end poverty. In an Autumn 2012 City Journal piece, America Works founder Peter Cove described how his experience as “a foot soldier in America’s War on Poverty,” led him to create the initiative:
We know for certain that income transfers, the preferred tactic of generations of liberals, have utterly failed to end poverty . . . . I learned that if we helped welfare clients get jobs, even entry-level jobs, they would then attend to their other needs. By contrast, if the government gave them money and other benefits, they were likely to remain dependent.
The reasons should have been obvious all along. Work maximizes a person’s capacity to achieve economic self-reliance. Work socializes people and instills a sense of personal responsibility in them. Work connects behavior and consequences. And it permits people, especially men, to obtain the admiration and respect of their spouses and children by supporting them.

     America Works set itself up as a job agency for state and local welfare agencies. It took payment only when it placed clients in jobs, and the clients held those jobs for at least four months. It claims to have taken more than 300,000 people off the welfare rolls and to have inspired the 1996 Welfare Reform Act. And still, Cove reports, the initiative is viewed with suspicion by those people whose ideology—and power—requires dependency and the big government that encourages it.

     I suppose it’s realistic enough that the soulless Democrat Underwood would ignore a private America Works that works in order to propose a government America Works that doesn’t work. But it would have been nice if he hadn’t further muddied the show’s muddy politics by putting a good name to bad policy.
