Washington, D.C. (January 11, 2018) Congressman Steve Pearce released the following statement after the U.S. House of Representatives voted on S. 139, the Foreign Intelligence Surveillance Act (FISA) Amendments Reauthorization Act:

National security agencies play an integral role in thwarting domestic and foreign threats to our homeland. It is essential to provide these government agencies with the tools they need to keep us safe, however, this cannot come at the expense of the Constitution. We need common-sense protections that uphold the rights and liberties of American’s, while safeguarding our freedoms from overbearing, unlawful government practices. I supported efforts to make simple changes to FISA that would not have limited the government’s ability to collect information necessary to protect our nation from foreign threats. Passing the FISA reauthorization today without the addition of necessary safeguards and warrant requirements does not find the balance our nations needs and deserves.”

In 1978, Congress enacted FISA to provide a statutory framework that governs how government agencies may gather foreign intelligence, obtain authorization to conduct electronic surveillance or physical searches, utilized trace devices, and other activities. Following the attack on September 11, 2001, Congress put the USA PATRIOT Act in place to enhance investigation tools that government agencies can use to achieve their mission of thwarting foreign threats. This act and subsequent acts amend FISA to broaden the government’s ability to obtain information about potential threats.

Rep. Pearce cosponsored an amendment called the USA Rights Act, which alters the FISA reauthorization bill to limit the scope of information that the government can collect on U.S. citizens without a warrant. This amendment ensures any information collected is in specific regards to a surveillance target. It continues to allow the Federal Bureau of Investigation (FBI) to use information collected under Section 702 as it relates to foreign threats, while prohibiting warrantless backdoor searches on American’s communications.

In 2014, the Wall Street Journal published an article entitled "Wind Power is Intermittent, But Subsides Are Eternal."  Rep. Kenny Marchant (R-TX) deserves credit for trying to prove them wrong.

Marchant and Rep. Mike Pompeo (KS) are seeking to end a two decade long subsidy to the unprofitable wind energy sector by introducing H.R. 1901, the PTC Elimination Act.  H.R. 1901 would phase out and repeal the renewable energy production tax credit (PTC), the central federal handout to unprofitable wind energy corporations.  

The PTC gives wind producers a 2.3-cent tax credit for each kilowatt-hour of electricity produced.  The industry has become reliant on federal and state support despite the fact that wind energy is unreliable and costs more to produce.  The industry, which claims to make $1 billion a year, does not need a federal handout and should sink or swim on its own, without taxpayer support.  The PTC was originally designed to kickstart the industry to be self-sufficientbut has become another form of corporate welfare.  A cottage industry of lobbyists have sprung up.  Their sole mission is to extend the needed government support mechanism. 

Congressman Marchant said “If we want to build a healthier American economy, Congress must get rid of the dead weight in the tax code that is limiting our nation’s potential. That’s why I have introduced legislation to eliminate the production tax credit. Since its creation in 1992, the PTC has ballooned from a temporary boost for energy innovation into a massive special interest handout for the now multibillion-dollar wind industry. Today the wind industry regularly produces more energy than the market demands while hardworking taxpayers shell out billions of dollars each year in PTC support. In fact, because the credit pays claimants for 10 years of energy produced, Americans are currently on the hook for a minimum of $6.4 billion over the next decade.

“The fully mature wind industry should not be spoon-fed by taxpayers any longer. Even the industry’s top lobbying organization admits wind is a mainstream part of the market and has publicly supported a future phase-out of the PTC. The PTC Elimination Act would begin this phase-out immediately by significantly scaling back PTC handouts to those who are eligible. Similar proposals have been estimated to save nearly $10 billion. But the PTC Elimination Act doesn’t stop there. It would also completely dismantle the credit’s statutory framework and use the savings to lower the U.S. corporate tax rate. Even the president agrees that the U.S. corporate tax rate – which is the highest in the industrialized world – must come down to keep American businesses competitive. The PTC Elimination Act may only be one piece of the effort to fix our broken tax code, but it puts the American people first and levels the playing field both at home and in the global marketplace. That’s the approach to tax simplification we must use to revitalize the American economy.”

The American people pay at least $12 billion annually to prop up wind energy.   The time has come to pull the cord and end the cycle of subsidies and cronyism.

Rep. Pitts Exposing Corporate Cronies

A RedState article highlights a remarkable event that will happen next week -- a member of Congress will hold a hearing exposing corporate cronyism.  

The issue is called 340B, a discount drug pricing program that was originally created to assist veterans get drugs they need at a cost they can afford.  The relatively small program was around for nearly two decades before it was turned into a corporate profit center for hospitals and chain drugs stores by its rapid expansion in ObamaCare.

ObamaCare rapidly expanded the program to the point where corporations soon recognized they could take in large amounts of discounted drugs and then turn around and bill insurance companies and the government for their full cost.  Policyholders and taxpayers are being shafted while hospitals and drug stores make hundreds of millions of dollars.  Congress is finally taking a look at the scam:

Next week, the House Committee on Energy and Commerce Subcommittee on Health, Chaired by Rep. Joe Pitts (R-PA) will take its first look at the program.  It will examine the genesis the program, an attempt to assist the poor to its current form -- a get rich quick arbitrage scheme that is helping investors and financial institutions rather than those in need.

A cottage industry of corporations and lobbyists has been spawned by the ObamaCare expansion of the program.  The 340B Coalition has become the lobbying are of nationwide drugstore chains line Walgreens and CVS that have profited greatly from being able to take in drugs at a price-control rate and then billing Medicare and private insurance companies for the full cost of the drugs.

The 340B drug program was passed as part of the 1992 Veterans Health Care Act. The program was a subsidy program designed for “safety-net” hospitals serving underprivileged communities, compelling drug companies to sell drugs at steep discounts as a condition of their being allowed to participate in Medicare and Medicaid.

 After the program's expansion in ObamaCare, investors recognized the potential locked in profits.  Duke University Hospital pocketed nearly $70 million through the program.  The Charlotte Observer reported the hospital "purchased $65.8 million in drugs through the discount program, which saved $48.3 million. It sold the drugs to patients for $135.5 million, for a profit of $69.7 million. The profit would have been $21.4 million if Duke had not participated.  At Duke, about 67 percent of patients who received those discount drugs were covered by commercial insurance companies, which often pay hospitals many times over cost for medications. Only 5 percent of the Duke patients were uninsured.

They weren't alone. The Healthcare Corporation of America sold $1 million in converted bonds with an 8 percent coupon in April to finance marketing of its 340B software program that helps facilities maximize their profits through the subsidy program.

With the program clearly hijacked by cronies who care less about the poor, Rep. Joe Pitts (R-PA) has decided to take a look.  If Republicans are serious about ending crony socialism, reforming or abandoning the 340B Program would be a good place to start.

It was pointed out that you are ignorant of the oath you took.

However, far more important is his extremely provocative and ignorant comment at the very end. He claims that he took an oath to protect “the country against enemies foreign and domestic,” and then he claims that “these are the domestic enemies.”

I’ll give you a pass on your ignorance of the oath you took….

But…

If you TRULY believe that your oath was….. to protect “the country against enemies foreign and domestic,”

Then I have some questions you should answer.

 

Where were you when illegal aliens were allowed to freely invade our country against the Laws of our Country

They are at least foreign enemies and likely also domestic enemies after they invaded and raped  our domestic aid programs and then protested and demanded more. Where were you?

 

Where were you when obama FAILED to provide help to our American patriots in Benghazi?

 

Where were you when it became accepted fact that the Domestic Terrorists at the IRS undermined and severely abused our Constitution?

 

Where were you on Fast and Furious?

 

Where were you on NSA?

 

I could go on but I you should have the point by now.

The 2nd Amendment: Who Decides Its Meaning?

 

                        The Constitution of the United States of America, Amendment II:  “A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

It isn’t a matter of whether the government bureaucrats and politicians understand the phrase “shall not be infringed” or not, but rather a matter of they don’t acknowledge the basic tenet of the Constitution or any of the Amendments in the Bill of Rights.

Mullin Disappoints Once Again

 

                        I attended a town hall meeting in Claremore on Tuesday, January 29, 2013 featuring Markwayne Mullin, the newly elected congressman from Oklahoma’s 2nd District.  Some of his statements sounded strange coming from a “conservative” but one response to a question bothered me more than the rest.

 A man asked Mullin about the executive orders being used by Barack Obama to by-pass Congress, and what can be done to nullify them.  Mullin’s response was that the way to stop an EO was for the House to pass legislation nullifying the order, then send it to the Senate where Dingy Harry Reid would refuse to allow it to be heard.  And even if it could be passed by the Senate it would have to go to Obama for his signature.

Mullin in Boehner’s Pocket Already?

 

Newly elected Rep. Markwayne Mullin (R-Ok 2) was on KFAQ radio’s Pat Campbell Show on Tuesday Jan. 8 to “explain” his vote for John Boehner as Speaker of the House of Representatives (http://www.1170kfaq.com/podcasts/patcampbell/186021332.html). His explanation of why he voted for Boehner seems to be “business as usual” in Congress.  I thought we sent him there to oppose the business as usual mindset.  One explanation he gives is that he was told at the freshman orientation that he could only vote for someone who was nominated, and naturally Boehner was the only one nominated.  His other position is that not voting for Boehner is the same as voting for Pelosi.  That is the same lame crap we heard from the Republican establishment in the 2012 general election (not voting for Romney is voting for Obama).  It didn’t take him long to cabbage onto the establishment lingo did it?

It seems Oklahoma’s fine senior senator once again has no qualms about telling We the People how stupid we are and how wonderful he is.  With the “fiscal cliff” vote, in which he voted for the measure after taking an entire three minutes to peruse the 154 pages contained within, Senator Bullcrap took a great deal of criticism from local talk radio.  Tulsa radio station KFAQ’s Pat Campbell Show listeners were highly critical.   As a frequent listener I find Campbell to be very fiscally conservative and more moderate on social issues.  Senator Bullcrap didn’t appreciate the criticism so he called the Pat Campbell Show to “explain himself”, and how important it was to vote for this travesty (http://www.1170kfaq.com/podcasts/patcampbell/185414432.html).  He proceeded to explain how We the People benefitted because had the measure not passed taxes would have gone up a whole lot more than they did on a lot more people that they did and that he “protected” 98% of said We the People by making the 2001 and 2003 tax rates permanent for most Americans (chant the party line, blah, blah, blah).  If you take a good look at whose taxes aren’t going up and whose are going up you see a very different story than is being bandied about by both sides.  Warren Buffett and Donald Trump came out just fine, thank you!!! As did Hollywood and the typical Democrat money groups!!! Oh, and spending is still going up.

I have been listening to the cacophony of cowardly Republicans jumping all over Congressman Todd Akin of Missouri concerning his comments about rape and abortion a few days ago.  I understand that what he said was ill-advised but he tried to answer a very tough question instead of dodging it as most politicians would do.  He did manage to make a mess of it but has attempted to make amends in a very humble and honorable fashion.  Akin has apologized profusely, explained what he actually meant, explained where he got the information he was basing his statement on, and has also acknowledged that he spoke on facts that he now knows were feasible but questionable.  The man made a mistake in the way he stated his point and the entire Republican Party is throwing him to the wolves for it.
