Be Encouraged!

Howdy all!  Well, I went to the movies for the first time in many years Saturday night.  My wife and I had to see the OBAMA 2016 movie.  We had to know if we are right in our thinking of him and his plans, or are we off base.  Well, I can tell you that, well first this message from our sponsor,..

So, as I was saying, I have never left a movie madder than I was when I entered; at least until Saturday night.  If you haven’t seen this movie, you must.  It does explain a lot of what has been going on, and why.  And, as a retired Navy Submariner, who spent his entire career fighting a very silent Cold War with Poseidon and Trident nuclear missiles, it really got my blood boiling during the discussion of the reduction of warheads.  The US has presently 8 ballistic missile subs capable of carrying nuclear weapons to protect us from the threat of annihilation.  But the number given as to what Bobo wants will not support that many subs.  It won’t support the protection of our nation at all.  Given the number he wants to go to, Luxembourg could kick our butt!  So I left the movie shaking my head, mad as all get out, and tried to maintain some sensible demeanor.  Then, I looked at the faces and heard the whispering of the others in the audience as they left.  I was not alone.  They all felt the same as me; probably for their own reason, but the feeling was the same.  So I urge you all to go to this movie, and take someone who is riding the fence, undecided, or just not caring.  They will surely walk out with a different opinion. 

So, where you might ask is the encouragement?  How about this.

As I said, I came away mad.  In fact I can’t remember the last time I was this mad.  But what do we do about it?  How should I react, or behave, or respond?  Simple; I need to maintain my focus on the road through November.  Our nation is on a path that is very uncertain.  There are many who have many paths.  And it seems that no one in charge will choose a path that is right.  And you know that isn’t their job!  It’s our job to pick the path.  We the People have the responsibility to choose how our nation will proceed.  That does not end at the November elections; it starts there.  Until November, we will suffer through many challenging events – debates, polls, special television events.  We will be twisted every which way by those trying to get or keep a job.  We need to focus on what our principles and values are, and decide who is aligned closest to those principles and values.  The chosen might not be the ones who are exactly like us.  In fact, the only way to ensure the chosen are exactly like us is for us to run ourselves.  Then, we must submit our vote.  One by one, we will all have a say as to who our local councilmen, aldermen, commissioners, mayors, reps, senators, governors and president will be.  Once the votes are tallied, we then need to formulate the plan to monitor those chosen.  No one gets a pass any more.  No one.  Will we be correct?  Will we be successful?  Will we be able to restore the Constitution to its proper stance in our government?  Will we once again be the exceptional land?  To answer, we just need to read today’s offering from Psalm 31.  But I am trusting you, O Lord, saying, "You are my God!"  God had his hand in our nation’s beginning.  He has been there for us during all of our very hard times.  He is here with us now, while I write, while you read, while we formulate this path of ours.  He was with us in the movie house, helping us understand what has been going on. 

Go to this movie.  Take someone who isn’t quite sure yet.  Buy them some popcorn, and a greater-than-16 ounce-beverage for the show.  (Mine was the 54 ounce monster!)  Learn from it.  Know your opponent.  Understand the thinking.  It’s not just Obama.  There are many more terrible surprises to understand.  Then let’s formulate OUR path through November to restore the Constitution, regain control of the wasteful spending and fix our economy American Style.  We can do this!

Resident Evil: The MSM

4063572750?profile=originalOK, so I am watching a CNN panel discussion about Romney's acceptance speech. Christine O'Donnell was on the panel. The CNN host said that Romney's speech and our side was, in essence, calling the Democrats communist. O'Donnell explained that we are not calling them communist, but simply pointing out the differences in our vision of America verses the Democrats. Once again, an Obama media operative was attempting to spin/distort our words to portray Republicans/Conservatives as being extreme.


Like many blacks, I have high blood pressure issues. Thus, I can not allow these people to get to me.


Still, I could not believe that CNN chose Donna Brazile to be an on-set daily contributor to their Republican National Convention coverage. Give me a break! This black woman is a viscous hate-filled Democrat hack. Nothing coming out of her mouth is going to be fair, balanced or reasonable. But, I counted to ten and felt a little better.


Then, there was the Obama minion on an ABC webcast who said referring to the Romneys, “Happy to have a party when black people drown.” Thank God, this arrogant stupid liberal jerk was immediately fired; in my option, not for his comment, but for getting caught on a live microphone.


Folks, please forgive my passion. I do not like calling people “arrogant stupid liberal jerks”. But, their smugness in their evil erroneous assumptions raises my blood pressure.


Reagan said, “Well, the trouble with our liberal friends is not that they're ignorant; it's just that they know so much that isn't so.”


A wacko black journalist on MSNBC alleged that the Romney Campaign was “using coded language in order to “n----rize” President Obama.” Have you heard ANY media outrage about Toure's insane, divisive, hate and potentially violence inspiring statement? I think not.


This is the same mainstream media that said nothing when Congressional Black Caucus members proclaimed, “the tea party can go to hell” and “the tea party wants to see blacks hanging from a tree”. VP Biden said to a majority black audience, “Republicans want to put y'all back in chains.”


Has the MSM rebuked any of the Democrats' absurd, hate-filled and over-the-top rhetoric? No. Meanwhile, for four years the MSM has distorted the truth, lied and done everything humanly possible to brand an “R” for racist on the forehead of the Tea Party. These people are EVIL!


A few years ago, black Democrat liberal racist Julianne Malveaux offered her modus operandi for the speedy death of black conservative Justice Clarence Thomas. Malveaux suggested having Thomas' wife feed him bacon and eggs everyday for breakfast. The media's response to Malveaux's death-wish for a U.S. Supreme Court Justice was silence. Can you imagine the media outrage and frenzy had a white Republican/Conservative made such a statement?


Well, Ms Malveaux and Obama media minions, I am tweaking my diet, going to the gym and keeping my blood pressure in check.


Gov. Scott Walker's victory and the 2010 Tea Party landslide victory proves that your Evil-Empire dominance in the media can be beaten. Informed activist voters and black conservatives, like me, are your worst nightmare. And, with God's grace, I plan to live a very, very long time.

The choice of Paul Ryan as the Republican Vice-Presidential candidate almost had me convinced to vote for Mitt Romney in November but once again the Republican Party blew a chance to show me they are above the Democrat Party when it comes to morals, honor, integrity, and concern for the Constitution of the United States of America.  Once again the New World Order globalists who run the Globalist Oligarchy Party (GOP) reminded me why I should vote for John Albert Dummett Jr. (www.johndummett.us), a write-in candidate for the Republican Party in 2012.  At their convention this past week the Republican Party establishment showed me they have no regard for the grassroots workers, the “We the People” they should be looking to for support.  Instead of looking to grassroots conservatives they have once again shown they have no regard for liberty whatsoever.  The party establishment again spits in the face of We the People and tells us “we know better than you, we don’t care what you want, sit down and shut up”.

4063572656?profile=originalThe recent RNC Convention in Tampa, Florida was missing one of its most essential conservative ingredients to showcase the essence of the conservative 2010 Republican comeback story.  That comeback was largely due to the grassroots organizing tenacity of Sarah Palin.  Whatever the rationale used by the RNC or Republican presidential candidate Mitt Romney’s campaign strategists to keep Palin’s presence on the sidelines, it missed the point of the narrative.  It was therefore incomplete.

There were remarkable women and others, who spoke at the RNC Convention, but Palin is more than a good speech, she is a foundation builder.

Imagine for a moment, if Sarah Palin and the Tea Party Patriots around this nation had listened to the radicalized left and liberal media pundits.  What if they had done “what they were told” to not make noise, to not organize, to keep their passion for America’s future and potential demise to themselves?  The American conservative comeback of 2010 would have been a “might have been” instead of a solid building block for reemerging American patriotism that the movement has become.

Sarah Palin not only helped developed the new political conservative narrative for America, her heart and her soul is the heart and soul of every American patriot who does not need to watch a political convention to be told and shown what is relevant to them.  Rather, the conservative patriots know full well that the true conservative American Convention is a convention held in their homes and communities each and every single day.

What if America had been subjected to Democrat retention of the House in 2010? What if President Obama had been able to continue to steam roll his misguided agenda into other areas beside Obamacare’s?  A House lead by Speaker Nancy Pelosi could easily have given more trillion dollar bailouts to union leaders, government entitlement handouts and granted illegal aliens first in line job training, education and full citizenship rights.  States would be forbidden to arrest and maintain illegal aliens and all borders would be open and free to any illegal alien that wanted to take advantage of America’s welfare and healthcare systems.
The U.S. Constitution would have been even more abused than Obama’s has already done by failing to enforce laws passed by congress, and usurping federal laws by declaring that nearly one million illegal aliens can avoid a federal constitutionally passed law by breaking it through his executive order.  His rationale, “It’s the right thing to do”   usurped the U.S. Constitution’ separation of powers, and made socialist edicts the new law of the land.

President George Washington’s warned against this type of governmental usurpation of the U.S. Constitution.  He stated in his Farewell Address of  1796:, “But let there be no change by usurpation; for though this in one instance may be the instrument of good, it is the customary weapon by which free governments are destroyed. The precedent must always greatly overbalance in permanent evil any partial or transient benefit which the use can at any time yield.

The Tea Party take over in the House with its congressional candidates prevented a much greater devolution of the nation’s constitution.  Instead it was the steady vigilance of the Tea Party Nation in states across America and Sarah Palin who worked tirelessly to insure those victorious outcomes were secured..

Most critically is the religious and moral foundation on which Palin’s pursuit of American conservative convention lies:  President Washington covered this necessity in his 1796 Farewell Speech.  He stated “Of all the dispositions and habits which lead to political prosperity, religion and morality are indispensable supports. In vain would that man claim the tribute of patriotism who should labor to subvert these great pillars of human happiness -- these firmest props of the duties of men and citizens.

As one can easily surmise, Palin’s embrace of this essential religious and morally principled doctrine successfully guided her in 2010 as well into historic primary wins in states like Texas with Ted Cruz for U.S. Senate.

Instead in the months leading up to the RNC Convention in Tampa, the RNC and Romney camp appeared to focus more on building an assault strategy to showcase at the convention.  They danced away from any attempt to embrace or acknowledge the solid results of a Tea Party conservative revolution and Sarah Palin, a conservative leader who successfully rekindled the Washingtonian beliefs and philosophy“Let it simply be asked, Where is the security for property, for reputation, for life, if the sense of religious obligation desert the oaths which are the instruments of investigation in courts of justice?”
The rekindling of support for those time honored values are more than just a sound bite.  Sarah Palin’s work is solid and there is a new conservative dynamic taking place at dinner tables across America.  The conservative American Convention is televised on social media sites in the tens of millions. The patriots share news on these social networks which are unafraid, un-bought and unbent.

This new social dynamic is the home, where the renaissance of conservative principles, religious ideals and values is the foundation which is as old as the bible and as contemporary as this morning’s kitchen breakfast discussion.  So, in many ways, Sarah Palin’s appearance for one week out of a presidential campaign at a national convention was not as important as keeping her out building and supporting conservative leaders across America.

As her guide, Palin has stood and continues to stand on conservative principles that count in American homes.  As Washington so eloquently phrased it, “And let us with caution indulge the supposition that morality can be maintained without religion. Whatever may be conceded to the influence of refined education on minds of peculiar structure, reason and experience both forbid us to expect that national morality can prevail in exclusion of religious principle.”

America will win against an Obama White House and administration that has abandoned moral and religious principles.  America will win in all the November general elections to follow, by listening to the clarion call of an American conservative leader. Palin has traded attempting to fit into the mainstream political culture, and instead has helped create a culture that is true, that is authentically patriotic.

Sarah Palin’s heart and soul is as true as the words and leadership that America’ heroic founding father and first President offered, “The name of American, which belongs to you in your national capacity, must always exalt the just pride of patriotism.”  This is Sarah Palin and this is her American Convention.

Obama 2016 - The 'ACTION' of 'INACTION' Obama Voting Present
 
As an Illinois Senator Obama voted 'present' effectively side-stepping a "Ayes" or "Nays" vote some one hundred and thirty times in order to stay in the good graces of his constituents and his future political career which was, make no mistake, orchestrated.
 
 
Obama is also M.I.A as a constitutionally qualified president. Obama is not a natural born citizen which has been been interpreted by the Congress as a legislative mandate over 225 years, born in the United States to Citizen parents on the record by literally examining the fact that its never been over turned in our history while its been attempted over 24 times.
One thing most people agree on is that the purpose of the 'natural born citizen' clause is to protect the nation from foreign influence. Americans hold the work of the Founding Fathers in such reverence that they've added to it only 17 times since 1791.
 
 
Sen. Dianne Feinstein, D-Calif., a Judiciary committee member, sees merit in the restriction and said in 2004, "I don't think it is unfair to say the president of the United States should be a native-born citizen," she said at the hearing. "Your allegiance is driven by your birth."
Republican U.S. Senator Orrin Hatch-R from Utah said in October 2004,"The restriction on the foreign-born "has become an anachronism that is decidedly un-American."
Maria Shriver Kennedy at one time supported her husband Republican Arnold Schwarzenegger pushing for a constitutional amendment that would allow the Austrian-born 2004 California governor to run for the White House as soon as 2008.
 
 
As we see UT. R. Sen Orrin Hatch's proposed amendment failed in 2004, Maria (Kennedy) Shriver filed divorce to Schwarzenegger in 2011 for infidelity but as of July 2012 the divorce isn't final, and another 2008 candidate who isn't a natural born citizen duped Americans running and successfully usurped the White House in 2008.
 
 
If you haven't seen the conservative documentary of the decade stunning Hollywood Obama's present from Rocky Mountain Pictures, "Obama 2016", you need to go see it. I took my mother this last Friday even as the hour and twenty-nine minute documentary was expanding from its modest handful of movie screens to 1,900 screens nation wide earning another $5.1 million of its now 18.3 million.
Its an interesting side-note that Michael Moore producer of No. 1-ranked "Fahrenheit 9/ 11," which topped $119 million leading documentaries all time, this last week told Democrats to get used to the words "President Romney".
 
 
The foreboding feeling you feel walking out of Obama 2016 with the audience is worth the price of the ticket. To tell you the truth I personally was relieved to be able to sit quite next to my mom and let someone else do the talking as there have been many a family argument over the work I've been engaged in since 2008 suing McCain and Obama in 2008 on the eligibility issue as a candidate for President and continuing the stand in 2012 as a Democrat Presidential Candidate.
 
 
While I don't say this in justification of failure in the home,there's probably more then a truth or two about my last two marriages ending because of taking a stand for the Constitution in political races that ended unsuccessfully with the finances of my family in a crisis - the reality of underfunded campaigns for any candidate.
 
 
The truth of any political race is there is only one winner, and no matter how many people vote for the second place finisher, all the funds, all the votes, all the hoopla for the campaign doesn't make that campaign any better than the least voted candidate with the most under-voted campaign- it's still a loss and a calculable failure.
This brings me to the crux of this blog that is actually a question for everyone to ask themselves.
 
 
If Mitt Romney is unwilling to fight Obama on the grounds of the Constitutional demands of qualification for the Office of the President, allowing the usurpation, allowing the history to go down without justice to the fraud and forgery Obama has been apart of with the cover-up, spewing out false identification documents according to law enforcement investigations documented in my case Judy v. Obama now set for conference in the United States Supreme Court Sept. 24th, 2012, allowing Obama to build his presidential library and dis-honoring American culture with shocking racism  sending blacks back to a time before color television, then how do you suppose Romney is going to preserve, protect and defend America's Constitution any more then Obama has?
 
 
And if Romney is not going to preserve, protect, and defend the Constitution any better the Obama, what makes your vote for Romney worth the disgrace to God for setting America aside as a peculiar nation of a distinct Republic for which we Americans stand?
While I would not base my vote on any man or women's religious preference, there are some who do. In my opinion one of the finest distinctions in America is the freedom of conscience in America, let them worship who, what, or how they may, for that is the ultimate test of your own religious freedom here in America.
 
 
Saying you wouldn't vote for a "Mormon" is just as easily said about any other religion that is a minority at any given point and is not representative of the United State's Congress Standards outlined in the Constitution, which are chosen by We The People as our Representatives and Senators.
God knows they let us down as the electorate reported the election in 2008 and their popularity has shown this sinking to an all time low, however the legislative mandate has stood the test of time not to allow any but a "Natural Born Citizen", or a "Citizen" before the ratification of the Constitution, to become President.
 
 
With that said and understanding Obama was not born before the Constitution was ratified, a "Natural Born Citizen" is born in the United States to at the very least parents who are "Citizens", or "Natural Born Citizens" themselves.

I believe Dr. Pastor James David Manning makes a credible argument for justice in the following video, as Obama did in legislative session 130 times,by simply voting present when it comes to the President by writing my name in on your ballot "Cody Judy", if the Democrats and Republicans and United States Supreme court refuses to demand justice for the honor of black people, white people, yellow people and any color of people in America.
 
 
You absolutely do not need to disgrace yourself before your God, or higher power, by voting for a lesser of two evils, and I do believe that in this case "inaction" or something that appears futile,ultimately can be seen as 'action' to protect the way that God or your higher power, thinks about you if you think that is relevant and important to you.
 
 
Talking to Iowans Obama this week said something to the affect "that their is always a choice and Americans were gonna have to make one", and Pastor Manning makes it a credible argument here, which has in large part not been articulated by any religious figure in America, that voting for the lesser of two evils is not voting for principle that makes a bit of sense.
 
 
So, I'll say you don't have to "not vote" for anyone, you can always write-in my name Cody Judy understanding no other qualified candidate on the ballot has stood up for and taken a stand against Obama's Eligibility other than me, as actually your present to Obama.
Perhaps Obama would win, but perhaps he will win anyway, and perhaps you will look better to your God in not choosing the lesser of two evils, and simply just choosing someone who took a stand and took it to the U.S. Supreme Court. They may be the highest court we can see in America, but I believe there is one above them in the heavens; that in Gods hands.
 
 
If Obama were to win in America in 2012 perhaps it will be the lesson needed to the majority who put him there, from God, to make of you Patriots of Freedom and Liberty like nothing else would. I know being enslaved myself 8 years as a prisoner of a usurped Constitution by the majority in Utah and the deaf ear of the United States Supreme Court for evidence held by the Presidency of the Mormon or LDS Church, that I became a Patriot of our Constitution like I had never been before.
Then by God your prayers would reach into the heavens and I think that while God might be slow to hear you he would, by the bloodiest revolution America has ever pondered, set your free again, and by that you wouldn't forget it for 1000 years.
 
 
In God's mind, perhaps the greatest lesson to the greatest amount of people, is the best lesson anyway and by that standard I sure wouldn't put it past him, in my own religious sentiment.
So, minus the words that voting for a "Mormon" is a no can do, and perhaps inserting the understanding that voting for a President who has taken a stand against Obama's eligibility consistently since 2008 is a must, here is Dr. James David Manning's articulate report on that matter that rings truth in the matter of apposing a political loss for Obama because he still gets the pension and the presidential library, and the obamanation of history I am apposed to as my founding fathers in America were also.

COMMUNION ON THE MOON!

{ I want to share with every Believer, a very Real Hero, whom just passed away recently, so that all

might know that he was a Real Christian...........who had a tremendous Testimony!

I presume that most of us were unaware of this story. I didn't know this,
but it's awesome! 42 years ago...guess what happened... many have not
heard of this before .

Communion on the Moon: July 20, 1969 (This is an article by Eric
Metaxas) Forty-two years ago two human beings changed history
by walking on the surface of the moon. But what happened before
Buzz Aldrin and Neil Armstrong exited the Lunar Module is perhaps
even more amazing, if only because so few people know about it.

"I'm talking about the fact that Buzz Aldrin took communion on the
surface of the moon. Some months after his return, he wrote about
it in Guideposts magazines <http://www.snopes.com/glurge/communion.asp>
And a few years ago I had the privilege of meeting him myself. I
asked him about it and he confirmed the story to me, and I wrote
about in my book 'Everything You Always Wanted to Know About
God (But Were Afraid to Ask).

The background to the story is that Aldrin was an elder at his
Presbyterian Church in Texas during this period in his life, and
knowing that he would soon be doing something unprecedented
in human history, he felt he should mark the occasion somehow,
and he asked his minister to help him. And so the minister
consecrated a communion wafer and a small vial of communion
wine.

And Buzz Aldrin took them with him out of the Earth's orbit and
on to the surface of the moon. He and Armstrong had only been
on the lunar surface for a few minutes when Aldrin made the
following public statement: "This is the LM pilot. I'd like to take this
opportunity to ask every person listening in, whoever and wherever
they may be, to pause for a moment and contemplate the events of
the past few hours and to give thanks in his or her own way." He
then ended radio communication and there, on the silent surface of
the moon, 250,000 miles from home, he read a verse from the
Gospel of John, and he took communion. Here is his own account
of what happened:

"In the radio blackout, I opened the little plastic packages which
contained the bread and the wine. I poured the wine into the chalice
our church had given me. In the one-sixth gravity of the moon, the
wine slowly curled and gracefully came up the side of the cup. Then
I read the scripture, 'I am the vine, you are the branches. Who so
ever abides in me will bring forth much fruit.. Apart from me you can
do nothing.’

“I had intended to read my communion passage back to earth, but
finally at the last minute [they] had requested that I not do this. NASA
was already embroiled in a legal battle with Madelyn Murray O'Hare,
the celebrated opponent of religion, over the Apollo 8 crew reading
from Genesis while orbiting the moon at Christmas. I agreed
reluctantly. <http://www.snopes.com/glurge/communion.asp>;

“I ate the tiny Host and swallowed the wine. I gave thanks for the
intelligence and spirit that had brought two young pilots to the Sea
of Tranquility. It was interesting for me to think: the very first liquid
ever poured on the moon, and the very first food eaten there, were
the communion elements.”

And of course, it's interesting to think that some of the first words
spoken on the moon were the words of Jesus Christ, who made
the Earth and the moon - and Who, in the immortal words of
Dante, is Himself the "Love that moves the Sun and other stars."

How many of you knew this? Too bad this type news doesn't travel
as fast as the bad does...share it if you've felt God's Love.

Waste My Vote?

Here is something I wrote a while back but may be of interest still.

Waste My Vote?!

There are few ways to waste a vote.  The first, worst way is to not vote at all.  Responsible adults vote every chance they get.  If you don’t vote, you can’t bitch and will never make a difference in this country. 

Another way to waste a vote is to vote for a grossly flawed or substandard candidate. Such a candidate always offends conservative sensibilities.  This fact renders him/her unelectable to any base of patriotic Americans.  Consider some seriously flawed candidates who have actually gotten elected.

Arnold Schwarzenegger; Here’s a RINO who has disappointed everyone except the unions that own the CA government.  His conservative opponent, Tom McClintock is still the most conservative elected official in the state.

John McCain/Lindsey Graham; These liberal knuckleheads lead the Republican efforts of amnesty for forty million plus, illegal aliens who are colonizing America.  They got that chance because the voters of AZ and SC couldn’t bear the prospect of being represented by Democrat senators for a term or two.  Could junior senators have caused as much trouble as either of these two liberals?  Doubtful.

Using my own vote as an example, I helped get Obama elected.  (Author ducks to avoid thrown vegetables, fruit and eggs).  My vote for conservative, Chuck Baldwin of the American Independent/Constitution Party got Obama elected.  Why? Because too many Americans voted for the lesser of two evils.  But my vote has helped America more than the vote of those who voted for that, lesser evil.  How?  President Hussein and the liberals of both parties in congress have given rise to the entire Tea Party movement.  It is their efforts to destroy our liberty, our sovereignty, our economy, our jobs and industry that has spawned a new era in citizen participation.  My hope was that if Obama was elected he would destroy so much liberty and opportunity so quickly that it could not escape notice.  The hopes for my vote have been realized; have yours?

And what if McCain had been elected instead?  Does anyone believe he’d act much differently?  He still advocates amnesty for illegal aliens.  He still votes for bailouts and massive spending.  He still wants full government intrusion into our lives.  He still believes there is a government answer to healthcare, the economy and everything else.  And there is no evidence that he would even nominate constitutionalist judges to the Supreme Court.  He would be pushing us over the same totalitarian cliff we are currently headed toward albeit at a slower, less noticeable pace.

Now, what if patriots had voted with me for the conservative candidate?  Chuck Baldwin promised to grant FULL pardons to Ramos and Compean his first day in office and veto amnesty for the aliens.  He would defend our rights enumerated in THE ENTIRE BILL OF RIGHTS; guns, speech, religion, the works.  Lower spending, lower taxes, lower government intrusion into our lives.  No TARP, no bailouts, no government takeover of industry, certainly no government-as-usual that every president has followed over the past 20 years.

Ask these of yourself.  Do you have faith in your religious beliefs?  Was America founded upon Christian morals and principles?  Is God looking over our nation to help us to survive as such?  Then why in the hell would you vote for McCain who would dissolve our sovereignty?  Who puts faith in the lesser of two evils instead of something higher?  If one believes that we live in a Christian nation, how could one vote for evil to rule it?  Lesser or otherwise.  Do people think that any candidate sent by God to save our nation could only come to us through the Republican Party?  Do people think God a Republican?  The word “Republican” appears nowhere in the Bible.  If Americans had rejected 3rd party candidates, Abraham Lincoln, the first Republican president would never have been elected!  If God actually sent us a political savior as a candidate, most “conservatives” would not even vote for him if he wasn’t Republican!  Is that not insane!?

If you have any belief in Divine Providence at all just study the philosophies and goals of John McCain and Chuck Baldwin and ask yourself  which one would be the more likely to have been sent to save America?  If God sent America a candidate for our salvation, most Americans would never even hear about him because they are too busy deciding which of Satan’s candidates look the best!  I’m not going to suggest that God is sending us candidates.  But I’m pretty sure the devil is.  Any way you look at it, in 2008, most voters chose between two candidates from Hell and we elected one.  When we vote for the lesser of two evils we will always elect evil.

Ask yourself a few more questions.  How bad, liberal or destructive does the Republican candidate have to get before you will refuse to vote for him/her?  What if Hillary had gotten the Republican nomination since she is less liberal than McCain?  Would you have voted for that lesser of two evils?  How will you ever vote for a candidate from Heaven if you are fixated on wasting that vote on those from Hell?

This is the most troubling election we as Christians have ever faced, and from the looks of the polls, the Christians aren't voting Christian values. We all need to be on our knees.
Do you believe we can take God at His word? Call upon His name, then stand back and watch His wonders unfold. This scripture gives us, as Christians, ownership of this land and the ability to call upon God to heal it. I challenge you to do that. We have never been more desperate than now for God to heal our land.
This election is the scariest I can remember in my lifetime. 2 Chronicles 7:14: 'If my people, which are called by my name shall humble themselves, and pray, and seek my face and turn from their wicked ways, then will I hear from heaven, and will forgive their sin, and will heal their land"
During WWII, there was an advisor to Churchill, who organized a group of people who dropped what they were doing every night at a prescribed hour for one minute, to collectively pray for the safety of England , its people and peace. This had an amazing effect, as bombing stopped.
There is now a group of people organizing the same thing here in America .
The United States of America , and our citizens, need prayer more than ever! If you would like to participate, each evening at 9:00 P.M. Eastern Time (8 PM Central, 7 PM Mountain, 6 PM Pacific), stop whatever you're doing, and spend one minute praying for the safety of the United States, our troops, our citizens, for peace in the world, the upcoming election, that the Bible will remain the basis for the laws governing our land, and that Christianity will grow in the U.S.
If you know anyone who would like to participate, please pass this along. Someone said if people really understood the full extent of the power we have available through prayer, we might be speechless. Our prayers are the most powerful asset we have. Thank you.

Much has been said in the media about how Paul Ryan is an "extremist”, how he plans to "destroy" the lives of everyday people, especially the elderly.  A lot has being written about how his fiscal positions make him 4063570466?profile=originalhostile to middle class Americans.  After extensive, intensive, investigative research there is now a Top Ten List to explain Ryan’s "unlike-ability."

1. His economic plan will benefit the private sector economy by reducing big government spending and eliminating unnecessary regulations. If only he would slow job growth, cripple the economy and inflict further damage on the private sector by hiking taxes and continuing trillion dollars a year deficit spending.  Finally there would be a plan with which “progressives” could “compromise”.

2. He has a plan to reform and save Medicare. He will secure the future of Medicare with volunteer vouchers for future retirees, thus preserving the Medicare guarantee for current seniors by preventing the bankruptcy of the Medicare system. If only he would put the entire Medicare system at risk by sticking his head in the sand and pretending that maintaining the insolvent status quo is perfectly fine. Then maybe the White House, the DNC and the mainstream media would celebrate him as a hero of the common man.

3. The Ryan jobs plan will invite investments by lowering of the highest corporate tax rates in the world.  His plan to cut those tax rates will stimulate the creation of middle class jobs, enhance and preserve private wealth and reduce deficits by increasing revenues to the IRS.  If only he would raise taxes on rich.  Then America would be more like Europe, causing insulated “progressive” “elites” in academia and the media to rejoice.  Heck, maybe even Sean Penn would join him on the campaign trail.

4. He's a pro-life candidate who believes that “in every life there is goodness; for every person, there is hope.”  If Ryan would just come to his senses and support government funding the systematic slaughter of millions of innocent, unborn babies the largely post-menopausal National Organization of Women would celebrate his “choice”.

He will reform Social Security and put it on firmer fiscal ground by ending the current bankrupt Ponzi scheme system and providing future generations the option of controlling their own retirement money.  If only he would agree to big government bureaucrats and me-first career politicians remaining in charge of the money, then they could continue to spend it wildly and stuff more IOUs into the Social Security “lock-box”.  After all, the money really belongs to the big government sophisticates.  Americans are lucky they deem to allow taxpayers to keep any of it.  You did not earn it, they did.

6. He will reduce Pell Grants that have been greatly expanded under the current administration.  His proposal calls for reducing Pell Grant spending to pre-stimulus levels.  His plan will help curb tuition inflation and ensure the aid reaches the truly needy.  If he was only willing to continue the government’s sole proprietorship over college loans, then college students would remain beholding to Big Brother and the Nanny State.

7. His budget retains $40 billion in tax deductions for energy producers, thereby ensuring that they remain capable of researching, developing and delivering affordable energy to all Americans.  If only he would continue using taxpayer dollars to investment in impractical, inefficient “alternative” fuels and “green” energy technologies.  Then the government could continue to redistribute billions to the pockets of big “progressive” campaign bundlers and America could continue to burn corn in internal combustion engines instead of feeding its people.

8. He supports the private sector economy. Not surprisingly, the Koch brothers support Ryan with political contributions.  Too bad he refuses to side with “progressives” in pushing for the growth of big government, the destruction of free enterprise and the elimination of national sovereignty.  Then he could reap huge financial rewards from ner do well George Soros and his ill-gotten billions.  Even if Ryan lost his government4063572277?profile=original job, Uncle George would be sure to find a place in one of the hundreds of anti-American foundations he supports for someone dedicated to the “progressive” overthrow of America.  Just ask Van Jones.

9. He supports traditional marriage. If Ryan would just support adoption by gay couples, same-sex marriage, and repealing "don't ask, don't tell."  Then his positions would align with the demands of a tiny fringe minority.  Movie and television scripts would be written singing his praises.  Perhaps even Alec Baldwin would play the starring role.

10. He believes in private property rights and that entrepreneurs built their own businesses.  Ryan ascribes to Ayn Rand's philosophy of individual success.  If only he would get on board with collectivist thought and support “from each according to his ability, to each according to his need”.  Then his election campaign would garner huge support from “progressive” activists and Communists backed labor unions.  Perhaps they would resurrect ACORN to ensure enough dead people, family pets or felons voted to clinch his election.  Then he and Al Franken could have a laugh swapping stories about the naïveté of the voting proletariat.

Paul Ryan’s background, experience and trustworthiness demonstrate that he is a proven leader and a fine citizen who is ideally qualified to become Vice President of the United States.  America knows where he was born, that he will support small businesses and private enterprise, understands the threat posed to America’s unreformed “entitlement” programs, and will not redistribute taxpayer’s money to fringe radical self-separating hyphenated identity victim groups.

America will not like taking some of the steps necessary to recover from a mountain of debt, but someone with Ryan's extensive knowledge of the issues, experience in how Congress works and exceptional, American bred humility knows how to accomplish the task.

donation

 I just gave to the Romney/Ryan Campain, Tea Party, Heritage Organization and NRA and will continue to do so until the election is over. Although my money is needed other places (living expenses ect) I feel that it very necessary to support the canditates and organizations working to preserve our freedoms and way of life for my children and grandchildren.

 I especially hope that my contributions will help to finance the "Little Suzie " infomercials that I have not seen for a couple of weeks. I belive that the "Little Suzie" infomercials were very good. If it is drummed into the peoples heads repeatidly that the goverment is borrowing 40 some percent of everything they spend and that there is over 1 million in unfunded liabilities per taxpayer, then I think that the average voter will eventually realize that things have to change.

Yes I know, I'm kind of stealing and making a play from a line from Bill Clinton's Presidential bid in the 1990's but believe me, I'm no Clinton fan, no not “Bubba” nor Hilary. If you don't believe me, go ask Vince Foster----whoops ! Did I mention Vince Foster ?
No kidding, I mention the economy and the economy as we are all well aware is basically in the toilet. The real unemployment rate here is above 20%, millions of Americans are on Food Stamps, and people have been losing there homes and increasingly their sanity as well. Even myself, although most of my readers are already aware that I am a victim of a Filipina Migration Marriage Scammer, corrupt judges, lawyers and others that conspired to have a City of Batavia, NY cop threaten to murder me, has caused me to not have a paycheck since October of 2008. Indeed the economy being in such a horrible state doesn't make it easier on me nor anyone else looking for a job no matter what the reason.
With acknowledgment from even most politicians that the economy is so bad, one must come to the conclusion that jobs must be available to get our nation back on track. With both Romney and Obama talking about “plans” to get us all working again, the thought of being once employed would give most folks a bright hope for the future----but not me. Let me explain; all this this talk from our politicians and their plans to create jobs may sound good to you, and most folks but the stark reality is; the plans being offered to us often misses the main ingredient to make our economy grow; that is the “ingredient of God.”
Wait a minute now, before any of you start getting all upset and having a hissy fit saying “Oh, there goes that pastor Paul again trying to put God into everything and every problem”, let me share something with you---- This nation of ours is in a bigger mess then what you might think. Just in the news today, there's a report of yet another shooting, a rumor that the shooter was a former US Marine. If you haven't noticed(gee, I can't see how anyone could miss it), the level of anger and hostility has grown exponentially in America in the past few years and people are increasingly getting “pissed-off.” Some of the reasons people are getting quite upset about are justifiably in some cases but extreme in their responses. Being unemployed is just one of a myriad of problems this nation is facing. In fact, if we look at just how many Americans treat their own family members, the economy is nothing in comparison in regards to major issues. This nation(as well as many other nations around the world) of ours is heading to a place of “no return” unless we get our priorities right.
Not only is there tension and hostility growing in many American homes, we also see a great influx of crime, abuse, hatred, injustice in our nation and world that are all growing at an alarming rate. Can the loss of employment and the economy be the sole or primary reason for all the increase in societal upheaval we see today? No, not at all. For all of you that may disagree with me, let me quote a couple warnings that were given to us as to what would occur and has occurred to our nation when we lose and have lost sight as to what should be our primary focus to keep our nation from experiencing job loss, a wrecked economy, and social chaos. See if these 2 quote from just two of our American Founding Fathers resonates with your spirit and perhaps puts “things” back in proper perspective for you as to what and whom we should put our trust;
“ If we and our posterity reject religious instruction and authority, violate the rules of eternal justice, triffle with the injunctions or morality, and reclessley destroy the political constitution which holds us together, no man can tell how sudden a catastrophe may overwhelm us that shall bury all our glory in profound obscurity”~ Daniel Webster.
I believe this last quote from Daniel Webster could not make matters any clearer in regards to what we as US Citizens have done and allowed by putting God next to last, if not absolute last and putting our priorities and reliance's backwards--- that is by making politicians gods and God practically non existent in our lives and our nation. No doubt catastrophes exist and grow here daily, including economic ruin because of our ungodly attitudes, but let me share one more quote to sum up my point....
“Finally, ye...whose high prerogative is to.... invest with office and authority or to withhold them and in whose power it is to save or destroy your country, consider well the important trust...which God(has) put into your hands. To God and posterity you are accountable for them...Let not your children have reason to curse you for giving up those rights and prostrating those institutions which your fathers delivered to you.”~ Rev. The consequence’s of our backward thinking is here upon our nation. Politicians are increasingly focusing on the economy in their promotion of getting elected or reelected but what they are doing by not promoting God of the bible as the answer is only setting bait for Americans to be trapped for more disasters stored up against us at a later date. These politicians have not a focus on a Biblical God nor promoting how rejection of God and instead clinging to and promoting ungodly beliefs such as abortion, feminism, legalization of drugs, acceptance of homosexuality, peadophilia, Islam, Atheism and more...will eventually destroy us all. Equally, as evidenced by our Founding Father's writings that I shared earlier... the answer to our problems is not a “stimulus plan” nor “trickle-down economics” nor “jobs.” No, the answer to getting our economy, our families and even our sanity back in this country is by repenting of our foolishness in believing in the notion that a politician or his policies and doing life “my way”(minus God) can cure our land including “creating jobs” and “economic growth.”
Let's get our nation back by getting Jesus Christ back in our lives and making Him first above all else---for the Christian Bible declares in Matthew 6:33 “ But seek you first the kingdom of God, and His righteousness; and all these things shall be added unto you.” Let's trust God, not politicians who speak with forked tongues. Want a job, want your family and or sanity back ? Make God of the Bible first... His promises are always “yes and amen”, he never reneges on His promises, unlike every politician I have met on “both sides of the isle.”
I hope and pray many Americans have learned their lesson about politicians by now.

Romney, Ryan, Republicans-Ready to Lead

4063571973?profile=originalWith the strong backing of an energized Republican Party and a diverse team of rising stars, candidate Mitt Romney formally accepted the GOP nomination to be President of the United States.

Recalling the excitement and optimism of the presidential race of four years ago, Romney pointed out how those elevated expectations and the bevy of promises that came with those expectations have led to disappointment over opportunities lost:

“Every family in America wanted this to be a time when they could get ahead a little more, put aside a little more for college, do more for their elderly mom who's living alone now or give a little more to their church or charity.

Every small business wanted these to be their best years ever, when they could hire more, do more for those who had stuck with them through the hard times, open a new store or sponsor that Little League team.

Every new college graduate thought they'd have a good job by now, a place of their own, and that they could start paying back some of their loans and build for the future.

This is when our nation was supposed to start paying down the national debt and rolling back those massive deficits.  This was the hope and change America voted for.  It's not just what we wanted. It's not just what we expected.

It's what Americans deserved.”

Romney shared the pain and hardship everyday Americans have felt over the past four years as the result of the current administration’s failed economic policies:

 “You deserved it because during these years, you worked harder than ever before. You deserved it because when it cost more to fill up your car, you cut out movie nights and put in longer hours. Or when you lost that job that paid $22.50 an hour with benefits, you took two jobs at 9 bucks an hour and fewer benefits. You did it because your family depended on you. You did it because you're an American and you don't quit. You did it because it was what you had to do.

But driving home late from that second job, or standing there watching the gas pump hit 50 dollars and still going, when the realtor told you that to sell your house you'd have to take a big loss, in those moments you knew that this just wasn't right.”

He then pointed to the morning light peeking over the horizon by reminding Americans “Now is the moment when we can stand up and say, ‘I'm an American. I make my destiny. And we deserve better! My children deserve better! My family deserves better. My country deserves better!’”

Romney then went on a brief autobiographical journey.  He reminded Americans who know him, and 4063572066?profile=originalrevealed to those who do not, that his life has been a familiar American story.  The son of immigrants, whose parents worked hard to give him opportunities they never had.  By example they taught him the value of hard work and enterprise, and the meaning of love.   He met the love of his life, and with her raised a happy, loving family of their own.  He summed up by saying “And that's how it is in America. We look to our communities, our faiths, our families for our joy, our support, in good times and bad. It is both how we live our lives and why we live our lives. Next, he outlined the story of his business career, where struggles to launch Bain Capital were rewarded by success: “That business we started with 10 people has now grown into a great American success story. Some of the companies we helped start are names you know. An office supply company called Staples – where I'm pleased to see the Obama campaign has been shopping; The Sports Authority, which became a favorite of my sons. We started an early childhood learning center called Bright Horizons that First Lady Michelle Obama rightly praised. At a time when nobody thought we'd ever see a new steel mill built in America, we took a chance and built one in a corn field in Indiana. Today Steel Dynamics is one of the largest steel producers in the United States.”

Romney chose that moment to remind Americans that attacking success is “the centerpiece of the President's entire re-election campaign… Is it any wonder that someone who attacks success has led the worst economic recovery since the Great Depression?  In America, we celebrate success, we don't apologize for it.”

He then reminded voters “That is why every president since the Great Depression who came before the American people asking for a second term could look back at the last four years and say with satisfaction: "you are better off today than you were four years ago."  Except Jimmy Carter.  And except this president.”

Mitt Romney understands that for America to work and for Americans to succeed, they need jobs.  “Lots of jobs,” and how the current administration’s policies “…have not helped create jobs, they have depressed them.”

Romney put American voters on fair notice when he warned them:

 “To the majority of Americans who now believe that the future will not be better than the past, I can guarantee you this: if Barack Obama is re-elected, you will be right.”

Romney then outlined his five point plan to revitalize the American economy:

“First, by 2020, North America will be energy independent by taking full advantage of our oil and coal and gas and nuclear and renewables.

Second, we will give our fellow citizens the skills they need for the jobs of today and the careers of tomorrow. When it comes to the school your child will attend, every parent should have a choice, and every child should have a chance.

Third, we will make trade work for America by forging new trade agreements. And when nations cheat in trade, there will be unmistakable consequences.

Fourth, to assure every entrepreneur and every job creator that their investments in America will not vanish as have those in Greece, we will cut the deficit and put America on track to a balanced budget.

And fifth, we will champion SMALL businesses, America's engine of job growth. That means reducing taxes on business, not raising them. It means simplifying and modernizing the regulations that hurt small business the most. And it means that we must rein in the skyrocketing cost of healthcare by repealing and replacing Obamacare.”

On foreign policy, Romney criticized the current administration for their failure to slow Iran's nuclear threat, for how they have disrespected allies like Israel and Poland, and sought to appease Russia.  He assured Americans that “Under my administration, our friends will see more loyalty, and Mr. Putin will see a little less flexibility and more backbone.”

“The America we all know has been a story of the many becoming one, uniting to preserve liberty, uniting to build the greatest economy in the world, uniting to save the world from unspeakable darkness.

Everywhere I go in America, there are monuments that list those who have given their lives for America. There is no mention of their race, their party affiliation, or what they did for a living. They lived and died under a single flag, fighting for a single purpose. They pledged allegiance to the UNITED States of America.

That America, that united America, can unleash an economy that will put Americans back to work, that will once again lead the world with innovation and productivity, and that will restore every father and mother's confidence that their children's future is brighter even than the past.

That America, that united America, will preserve a military that is so strong, no nation would ever dare to test it.

That America, that united America, will uphold the constellation of rights that were endowed by our Creator, and codified in our Constitution.

That united America will care for the poor and the sick, will honor and respect the elderly, and will give a helping hand to those in need.

That America is the best within each of us. That America we want for our children.

If I am elected President of these United States, I will work with all my energy and soul to restore that America, to lift our eyes to a better future. That future is our destiny. That future is out there. It is waiting for us. Our children deserve it, our nation depends upon it, the peace and freedom of the world require it. And with your help we will deliver it. Let us begin that future together tonight.”

With a strong supporting cast, with an energized Republican Party and a diverse team of rising stars behind him, Mitt Romney demonstrated why on January 20, 2013 he is the man best prepared to sit in the Oval Office.

Mitt Romney, Paul Ryan and Republicans are ready to lead.  It is time for the current administration and their “progressive” allies to either follow or get out of the way.

Public Enemy Number One

I believe the subject of this treatise will be about an individual which a great many people consider to be public enemy number one. For those of you who have read my other treatises, I hate to disappoint you, this particular treatise will not be the scathing witch hunt which uncovers the corruptness of our so-called leadership or of any particular leader for that matter. Instead, I am going to spend the time looking into a man who much of the public seems to intensely dislike, but for whom I have a great deal of respect.

While there are nine U.S. Supreme Court Justices, I am going to focus on one. If you haven’t guessed who I am referring to by now, it is Senior Associate Supreme Court Justice Antonin Gregory Scalia. Antonin Scalia was unanimously confirmed by the U.S. Senate and assumed his office, or his seat, on 26 September 1986 as a Supreme Court Justice. Who is this Supreme Court Justice and what sets him apart from the rest? According to Wikipedia Justice Scalia is, “The longest-serving justice currently on the Court, Scalia is the Senior Associate Justice. Appointed to the Court by President Ronald Reagan in 1986, Scalia has been described as the intellectual anchor of the Court’s conservative wing[i].” I would like to mention a few more items noted in Wikipedia before I continue, which I believe will give us something to work with regarding Justice Scalia. Wikipedia also notes, “In his quarter-century on the Court, Scalia has staked out a conservative ideology in his opinions, advocating textualism in statutory interpretation and originalism in constitutional interpretation. He is a strong defender of the executive branch…and, in his minority opinions, often castigates the Court’s majority in scathing language.” I’ll also touch on Justice Scalia’s beliefs on such matters as flag-burning and abortion as they relate to the Constitution of the United States. I believe these items through his over 25 years on the Court will allow us to find out who Supreme Court Justice Scalia is and why so many people believe he is public enemy number one.

 

A Constitution is not meant to facilitate change. It is meant to impede change, to make it difficult to change.

Because I love the U.S. Constitution and know the founding fathers of this nation were great men, I believe that would be a good place to start. What does Justice Scalia mean when he speaks about originalism in constitutional interpretation? According to an interview with Leslie Stahl of 60 Minutes, the CBS News report states, “Justice Scalia is still a maverick, championing a philosophy known as “originalism,” which means interpreting the Constitution based on what it originally meant to the people who ratified it over 200 years ago[ii].” Personally, I like the idea of interpreting the U.S. Constitution[iii] in a manner that upholds the values, principles and words of our founding fathers who actually risked everything to create such a wonderful document for the people of the United States. In the report Justice Scalia goes on to explain what he means, “It is an enduring Constitution that I want to defend.” Ms Stahl notes, “Scalia has no patience with so-called activist judges, who create rights not in the Constitution – like a right to abortion – by interpreting the Constitution as a “living document” that adapts to changing values.” Justice Scalia states why he is against the idea of a living Constitution, “What’s wrong with it is, it’s wonderful imagery and it puts me on the defensive as defending presumably a dead Constitution.” So it is apparent, Justice Scalia believes the U.S. Constitution should be and is our ‘rock solid foundation’ which we stand upon and which has elevated us, the United States, to our (at least once) grand stature. With regard to the founders, Justice Scalia goes on to say, “Well, it isn’t the mindset. It’s what did the words mean to the people who ratified the Bill of Rights or who ratified the Constitution.” Justice Scalia isn’t against progress or change, “Create it the way most rights are created…Pass a law.” But he is against changing the Constitution, our foundation. Like many people I believe if you wish to change the Constitution, lawmakers need to go through the extremely cumbersome amendment process in order to make the Amendment. However, making a law in itself, is much less cumbersome, it just needs to be constitutional.

Why does Justice Scalia advocate textualism in statutory interpretation and what is it? Oliver Wendell Holmes in The Theory of Legal Interpretation stated, “How is it when you admit evidence of circumstances and read the document in the light of them? Is this trying to discover the particular intent of the individual, to get into his mind and to bend what he said to what he wanted?” Mr. Holmes, who I might add was a brilliant man, further states, “Thereupon we ask, not what this man meant, but what those words would mean in the mouth of a normal speaker of English, using them in the circumstances in which they were used, and it is to the end of answering this last question that we let in evidence as to what the circumstances were[iv].” So I believe Mr. Holmes is stating textualism is not necessarily the intent of the man as much as it is the words themselves, as used by men in general, to understand the meaning of the words within a certain circumstance.

According to the Harvard Journal of Law & Public Policy, “The basic premise of textualism is that judges “must seek and abide by the public meaning of the enacted text, [as] understood in context” and should “choose the letter of the statutory text over its spirit[v].”” Mr. Davis further states with regard to textualism, “Only the statutory text has passed the constitutional requirements of bicameralism and presentment, and that judicial reliance on unenacted intentions or purposes “disrespects the legislative process.”” Also according to Mr. Davis, textualists believe those ‘unenacted intentions and purposes’ are that which “Skirts the constitutional protections designed to safeguard liberty by diffusing legislative power.” So textualism maintains the separation of power within the three branches of government itself and protects the U.S. Constitution as well as the liberty of sovereign individuals and sovereign States.

Just so you know bicameralism is Congress as two chambers, the House of Representatives and the Senate. For the definition of presentment I’ll go to Black’s Law Dictionary, “In criminal practice. The written notice taken by a grand jury of any offense, from their own knowledge or observation, without any bill of indictment laid before them at the suit of the government. A presentment Is an informal statement In writing, by the grand jury, representing to the court that a public offense has been committed which is triable in the county, and that there is reasonable ground for believing that a particular individual named or described therein has committed it[vi].”

So between Oliver Wendell Holmes and Mr. Davis of the Harvard Journal of Law & Public Policy, Justice Scalia’s advocacy of textualism in statutory interpretation is not the intent of what is or was meant, but the actual public meaning of the text itself within the context of what was said [in the statute] and this is done strictly to safeguard our liberty under the U.S. Constitution while holding the government in check. I can’t figure out how that is a bad thing. The framers of the Constitution believed in limited government, to be sure, limited federal government as stated by James Madison in Federalist No. 45, “The powers delegated by the proposed Constitution to the federal government are few and defined[vii].”

 

Now imagine a provision—perhaps inserted right after…the Naturalization clause—which included among the enumerated powers of Congress “To establish Limitations upon Immigration that will be exclusive and that will be enforced only to the extent the President deems appropriate.” The delegates to the Grand Convention would have rushed to the exits.

An example of one of Justice Scalia’s minority opinions can be found in Arizona v. United States. Justice Scalia states, “Must Arizona’s ability to protect its borders yield to the reality that Congress has provided inadequate funding for federal enforcement—or, even worse, to the Executive’s unwise targeting of that funding[viii]?” Justice Scalia goes on to say, “The President said at a news conference that the new program “is the right thing to do” in light of Congress’s failure to pass the Administration’s proposed revision of the Immigration Act. Perhaps it is, though Arizona may not think so. But to say, as the Court does, that Arizona contradicts federal law by enforcing applications of the Immigration Act that the President declines to enforce boggles the mind.” This is wonderful example of Justice Scalia castigating the majority (let’s call it) in scathing language-lite (I would have just called them spineless jellyfish). While the majority opinion was in favor of the President’s so-called plan of doing nothing other than trampling atop the rights of the sovereign State of Arizona, Justice Scalia sets himself apart and appropriately rebuffs the majority as well as the Executive branch. Justice Scalia states, “The Court opinion’s looming specter of inutterable horror…seems to me not so horrible and even less looming…the specter that Arizona and the States that support it predicted: A Federal Government that does not want to enforce the immigration laws as written…Are the sovereign States at the mercy of the Federal Executive’s refusal to enforce the Nation’s immigration laws?” Justice Scalia seems right on point and makes my previous statement with regard to the Supreme Court Justices in “On Sovereignty[ix]” seem a bit harsh. Quite frankly I should have stated the Supreme Court might as well be referred to as ‘Eight Empty Chairs’ instead of nine. Justice Scalia quite eloquently affirmed Arizona’s sovereign status and rebuked the Executive’s misguided stance as well as the Supreme Court’s inconceivable majority opinion. Why should the sovereign State of Arizona be required to allow its borders to be violated? As a sovereign State, Arizona has every right to secure its borders, protect its citizens and enforce Immigration Laws even if the Federal government doesn’t have the backbone or the intestinal fortitude to aggressively enforce those laws. I have always been unable to fathom why the federal government shirks its own responsibilities but has such a voracious appetite for prosecuting decent Americans who simply exercise their freedoms as they see fit, which seem to be at odds with the misguided beliefs of the jack-booted thugs in Washington.

Apparently, the Obama administration which flatly refuses to rigorously enforce existing immigration laws, just like his predecessor, George W. Bush who also refused to enforce those laws should not handcuff a sovereign State from doing so. Each sovereign State, like the nation as a whole, has its own Constitution and its own three branches of government. The federal government in my view is always subordinate to the States as well as the individuals who make up the States, unless one of the various constitutionally guaranteed rights of the individual has been violated by the State. What right does the federal government believe it has to step in as ‘High Lord and Potentate’ and issue its so-called fatwa’s or to even dictate to the sovereign individuals and the sovereign States? The business of the State is just that, the business of the State. The federal government’s power is limited for a reason, the founders believed in the sovereign individual and the sovereign State.  Clearly, the federal government merely acts out of jealousy in its daily attempts to usurp what is not rightfully theirs as stated in the Law of the Land, the U. S. Constitution.

 

Frequently an issue of this sort will come before the Court clad, so to speak, in sheep’s clothing…But this wolf comes as a wolf.

Now that we have seen Justice Scalia beat up on Obama, I think it would be a good time to touch on him [Scalia] as a strong defender of the executive branch. In Morrison v. Olson Justice Scalia gave his dissenting opinion, “We should say here that the President’s constitutionally assigned duties include complete control over investigation and prosecutions of violations of the law, and that the inexorable command of Article II is clear and definite: the executive power must be vested in the President of the United States[x].” Clearly, Article II of the U.S. Constitution states the duties and power of the Executive Branch as separate from either the Legislative or Judicial Branches, as stated in Articles I and III respectively, and vice versa. Justice Scalia’s dissenting opinion continues, “In my view…the Court’s conclusion must be wrong…One of the natural advantages the Constitution gave to the Presidency, just as it gave Members of Congress (and their staffs) the advantage of not being prosecutable for anything said or done in their legislative capacities…It is the very object of this legislation to eliminate that assurance of a sympathetic forum.” As executive privilege is a principle based on the constitutionally mandated separation of powers – the Executive, Legislative and Judicial Branches operate independently from one another. Private decision making with their advisors, in this case the independent council was the Assistant Attorney General Olson, has to be done without fear of ‘how something might look’ to either of the other branches of government. Unless a crime has been committed, no branch of government may frivolously impede the duties of the other branches of government. Especially when the aim is simply to destroy an elected leader’s ability to carry out the duties of his office through a so-called witch hunt or a fishing expedition which effectively renders the elected leader impotent without just cause, or simply to act as a device to destroy one’s political enemy. “The purpose of the separation and equilibration of powers in general, and of the unitary Executive in particular, was not merely to assure effective government but to preserve individual freedom.” This is a good example of Justice Scalia’s strong defense of the executive branch. But in doing so, Justice Scalia is actually defending all three separate branches of government and their duties as delineated in the U.S. Constitution. What strikes me as even more paramount than the defense of the Executive and the separation of powers (which is extremely important), is Justice Scalia’s believe that in doing so it is in the defense of the individual freedoms which are ultimately protected.

Lastly, we should take a look at Justice Scalia’s conservative ideology. If we go back to the 60 Minutes interview with Leslie Stahl, Justice Scalia states, “I’m a law-and-order guy. I confess I’m a social conservative, but it does not affect my views on cases.” An example of Justice Scalia’s impartiality, in spite of his own personal beliefs, is in regard to flag-burners, “If it was up to me, I would have thrown this bearded, sandal wearing flag-burner into jail, but it was not up to me.” While that does sound conservative to me, it also sounds impartial. Justice Scalia clearly states his disdain for flag-burning and flag-burners, yet his opinion with regard to the law is flag-burners are protected under the U.S. Constitution. I’m not so certain I could be so fair-minded. It seems to me, flag-burners have plunged themselves into the depths of the multitudes of depraved individuals around the globe who constantly burn our flag, yet cry a river whenever the United States does something with which they do not agree. Of course, they claim they burn our flag because of our aggression, and while there may be a certain amount of truth to that statement, these people which I speak of live in a barbaric rat hole as a result of their own choosing, not ours. Their argument is disingenuous as well as fallacious.

The right to abortion is another issue with which we are all too familiar, based on the landmark case Roe v. Wade. In Planned Parenthood v. Casey, Justice Scalia gave his dissenting opinion, “By foreclosing all democratic outlet for the deep passions this issue arouses, by banishing the issue from the political forum that gives all participants, even the losers, the satisfaction of a fair hearing and an honest fight, by continuing the imposition of a rigid national rule instead of allowing for regional differences, the Court merely prolongs and intensifies the anguish. – We should get out of this area, where we have no right to be, and where we do neither ourselves nor the country any good by remaining[xi].” Whether someone is for or against abortion, it seems clear to me as it seems to be with Justice Scalia, nowhere within the U.S. Constitution does it state there is a right to abortion. However, I do believe as Justice Scalia’s dissenting opinion states, this is a matter that should be left up to the States. Roe v. Wade is a perfect example of the federal government’s attempts to destroy States rights. Has there been an amendment to the Constitution? The easy answer is no, but if that is the case, then why does the federal government feel they have the right to enact a national law without going through the cumbersome amendment process to the U.S. Constitution? If a State or the people of a State enact a law which either affirms or denies the right to have an abortion through State law, the individual on either side is not held against their will in that State. They have the freedom and the right to leave and seek out their liberty in another State where the people of that State have beliefs which are more in keeping with their own set of beliefs. But to have a national law foisted upon us all with the misguided attempt at appeasement for some, completely disregards the others. Not to mention the fact that such an idea is completely foreign to the U.S. Constitution.

I would conclude by stating Justice Scalia is not only a fantastic jurist, but an outstanding Supreme Court Justice. This man has a clear grasp of the law and an understanding of the U.S. Constitution which is unparalleled. I happen to like the fact that he adheres to the public meaning of text in his interpretation of the statutes and how he sticks to what the founding fathers said and what the words meant to them regarding the U.S. Constitution and the Bill of Rights. Justice Scalia’s belief that the idea of a living constitution is in reality a dead constitution is an honorable defense of the U.S. Constitution. His belief that his duty is to defend an enduring Constitution speaks volumes about this man. Justice Scalia’s defense of the sovereign State in the face of Executive, Congressional and Judicial malfeasance is also quite noteworthy. To protect the sovereign State is to protect the sovereign individual and it would appear as though Justice Scalia is a staunch supporter of both. As I have already stated, he defends the Constitution, but he also does this by affirming there is a clear separation of power between the three branches of government as stated in the Constitution. His conservative leanings don’t seem to sway his opinions or impartiality with regard to any case. And his opinions in general are quite interesting to read. Justice Scalia shows up for work each day fully prepared to uphold, defend and protect the Constitution of the United States. I cannot imagine why so many people hate this man, unless of course, it is because they hate the U.S. Constitution.

Justice Scalia is in many ways like Socrates, he questions and reproves, he educates and he enlightens. While in his interview with Ms Stahl he stated, “I was never cool,” I would have to disagree with him on that point. I personally believe Justice Scalia is in fact very cool, I might even go so far as to say he is a role model for decent and honorable men and not just young lawyers who someday wish to sit on the Supreme Court. Justice Scalia is an example of a man who leads by example. If we had more like him on the Supreme Court, it’s possible our nation wouldn’t hit the nail right on our thumb quite so often.

 

If you think aficionados of a living constitution want to bring you flexibility, think again. You think the death penalty is a good idea? Persuade your fellow citizens to adopt it. You want a right to abortion? Persuade your fellow citizens to enact it. That’s flexibility.
