The Letter and Spirit of the Law

4063490047?profile=originalThe Dow Jones market lost $30 billion in the crash of 1929. Thirty billion dollars in 1929 would be the equivalent of $377 trillion today. The Dow Jones peaked on September 3, 1929 at 381 and bottomed out at 42. 

During the Great Depression a gallon of East Texas gas in Dallas cost 11 cents.  We bought a bushel of tomatoes at the Dallas City Market for 50 cents and canned them.  For many, the soup kitchen was their only source of food.

The cause of the Great Depression is widely debated but typically the cause included a weak banking system, overproduction and bursting of the credit bubble. We didn’t learn a thing from the Great Depression.

The letter of the law has to do with the form of the law, the spirit with morals and ethics.  Without the spirit of the law, you get the law of the jungle. I can tell you from personal experience how important it is to know the letter and spirit of the law.

Under the law of the jungle, the bigger you are, the more you consume: such as a herd of animals and a whale, in the human case, the majority vote or the king, president, dictator, capitalist, movie star, star athlete. None of the above connects with the spirit of the law.  The spirit of the law connects with intrinsic principles, such as equal in rights.

For the sake of forming a union of states, America’s forefathers compromised. They allowed for slavery, compromised their principle in the right to property.  Black slaves were the property of white people, the same as mules and cows.  More lately, the courts have compromised principle in the right to property though the taxing and spending authority, allowing for tax slavery.  Compromising intrinsic principles is always seen a being for the good of all—by kings, presidents, dictators, and the rich. Case in point: Although President Obama criticizes Governor Romney for catering to investors at the expense of jobs, he goes to the rich doing the same thing for campaign money.  Obviously, Obama feels that his expedience is for the good of all and Romney’s is for the rich.  Obama is trained in constitutional law, yet he does not seem to know the difference in the law of the jungle and the spirit of the law.  

I’d like to point out the great difference in legal training in constitutional law and actually studying the Constitution and using reason and logic to determine which is lawful; that is, backed by intrinsic principles.  To say that it is for the good of all to take from the rich and give to the poor violates intrinsic principles.  How is one to know why one is rich and another poor?  It doesn’t matter, say the makers and keepers of the law, because they have a certificate that says they know more than the people they control—or that they won an election.  In either case, it’s the law of the jungle.  You need to know this because it is you who loses your freedom.  

You are either self-governed or governed by external authority.  The original makers and keepers of American law gave you a Bill of Rights that cannot be taken from you except by due process of law, including your property.

If you knew the law, you would know chapter 29 of Magna Charta.  Nothing compares in importance with America’s Constitution.  “No free man shall be taken or imprisoned or deprived of his freehold or of his liberties or free customs, or outlawed, or exiled, or in any manner destroyed, nor shall we go upon him, nor shall we send upon him, except by a legal judgment of his peers or by the law of the land.”  

The law of the land in America is the U. S. Constitution.  Under the Fifth Amendment  (in the Bill of Rights) every individual is guaranteed  due process of law, as stated in chapter 29 of Magna Charta. Logically, a tax on income, under America’s law of the land, could not be constitutional if it taxed the individual out of a basic existence. In 1975, I was a single taxpayer employed in an entry level job. Government was taking withholding tax from my wages.  I was unable to pay my rent. I was locked out.  How can that be that under America’s Constitution?  This individual deprived of his basic rights is conveniently kept out of sight, out of mind.  In my case, it didn’t work.  I was in control because I took the time to learn the law and my constitutional rights.  It did something mysterious that people don’t grasp.  Whereas, if anything could go wrong it did, after I took the bull by the horns, when everything should have gone wrong everything started going right.

Since when has it worked to turn your control over to government?  After all, government is people in control of your life.  Too much control is corrupting. In spite of this fact, more than half of the American people depend on government in one way or another.

Nature provides man with reason and logic to survive. This is fundamental to man’s law.  But like other life, in that we possess the power drive, it causes us to form groups, and to look externally for our survival.  Might makes right only so long.  One ultimately becomes powerless. Compromising intrinsic principles is ultimately the reason nations come and go. 

Starting with a life in ruins, by learning the law, directly, and using it, all of my dreams came true. The United States lost its tax case against me, not in court, but from the court record. I took it to the press. An investigation was made.  The IRS admitted that for eleven years it had been wrong. I had been before the U.S. Tax Court, three U.S. District Courts, the U.S. Court of Appeals, and the U.S. Supreme Court. How could that be?  The powers that be allow the IRS to make limitless mistakes.  Is it for the good of all, or for the good of those with the power?

Lewis Countian Thomas Massie Wins GOP Nomination in Ky. 4th District

FRANKFORT, Ky. (AP) -- With the political and financial clout of the tea party behind him, Republican Thomas Massie easily won the GOP nomination Tuesday to run for an open congressional seat in Kentucky's 4th District.

The relative newcomer of politics, a protege of U.S. Sen. Rand Paul, beat two well-established Republicans, state Rep. Alecia Webb-Edgington and Boone County Judge-Executive Gary Moore.

With 99 percent of precincts reporting, Massie had 19,638 votes or 45 percent, to 12,501 votes for Webb-Edgington or 29 percent. Moore had 6,503 votes or 15 percent.

The race showed that the tea party movement remains strong in Kentucky. Paul endorsed Massie and was actively involved in the race, even appearing in a TV ad. And a Texas-based tea party group put more than $500,000 into the race.

"Some people want to make this race about the tea party," Massie said after securing the victory. "Good campaigns and good government are about building coalitions. This is a coalition of the tea party, the liberty movement and grassroots Ronald Reagan Republicans. And we have one thing in common: We want less government, not more."

Republican strategist Mike Karem of Louisville said Massie's decisive victory sends a strong signal to Kentucky's GOP establishment.

“The tea party is, in fact, a force to be reckoned with," Karem said.

The Republican nominee in the 4th District will be the overwhelming favorite to win the November general election. The congressional seat, which is centered in the suburbs just south of Cincinnati, has been held by the GOP since 1967, except for a six-year stint between 1999 and 2005 when Democrat Ken Lucas served.

When Franklin Roosevelt, a Democrat, introduced the Social Security (FICA)
Program. He promised:

1.) That participation in the Program would be completely voluntary,

No longer Voluntary


2.) That the participants would only have to pay 1% of the first $1,400 of
their annual Incomes into the Program,

Now 7.65% on the first $90,000


3.) That the money the participants elected to put into the Program would be
deductible from their income for tax purposes each year,

No longer tax deductible


4.) That the money the participants put into the independent 'Trust Fund'
rather than into the general operating fund, and therefore, would only be
used to fund the Social Security Retirement Program, and no other Government
program.
Under Johnson, another Democrat, the money was moved to The General Fund and
Spent


5.) That the annuity payments to the retirees would never be taxed as
income.

Under Clinton & Gore, Democrats, Up to 85% of your Social Security can be
Taxed

Since many of us have paid into FICA for years and are now receiving a
Social Security check every month -- and then finding that we are getting
taxed on 85% of the money we paid to the Federal government to 'put away'

Fund' and put it into the general fund so that Congress could spend it?

A: It was Lyndon Johnson and the Democratically controlled House and Senate.

Immigrants moved into this country, and at age 65, began to receive Social
Security payments! The Democratic Party gave these payments to them, even
though they never paid a dime into it!

Then, after violating the original contract (FICA), the Democrats turn
around and tell you that the Republicans want to take your Social Security
away!

And the worst part about it is uninformed citizens believe it!
If enough people receive this, maybe a seed of awareness will be planted and
maybe changes will evolve. Maybe not, some Democrats are awfully sure of
what isn't so.

Why are America's leaders of industry, who are the producers of jobs, who are the basic creators of wealth, judged greedy capitalists and athletic heroes earning greater incomes not judged greedy?  The American people are not getting the truth from the news media or politicians of the liberal persuasion.    If the establishment beats the liberal drums long enough, for the majority, the truth is totally blocked.  I was not born to follow the lead. The Danger of Article 82 and Obama's Latest Treaty

Back in 1982, President Ronald Reagan decided not to sign a treaty known as "Law of the Sea" (LOST), a United Nations convention that would raid America's treasury for billions of dollars, then redistribute that wealth to the rest of the world by an international bureaucracy headquartered in Kingston, Jamaica. But today, the Obama Administration has revived that treaty, and tomorrow Senator John Kerry (D-MA) will hold hearings designed to illustrate its supposed benefits and generate support for its ratification. Without a doubt, Reagan's decision should stand, and LOST should remain relegated to the trash bin of history.
The rationale for LOST is that it supposedly brings order to the world's oceans, defines the rights and responsibilities of nations as they navigate and conduct business across the seas, protects the marine environment, and allows for the development of natural resources of the deep seabed. On the surface, these all sound like worthwhile goals. The thing is, the United States doesn't need to join another United Nations treaty to make it happen.
For more than 200 years before LOST was adopted in 1982 and for 30 years since then, the U.S. Navy has successfully protected America's maritime interests regardless of the fact that the United States has not signed on to the treaty. The United States'Â navigational rights and freedoms have been secure, and they are best guaranteed by a strong Navy.
LOST is not without consequences, either. One of the more nefarious and insidious of its provisions is Article 82, which requires the United States to forfeit royalties generated from oil and gas development on the continental shelf beyond 200 nautical miles - an area known as the "extended continental shelf." That money, which one estimate says could be worth many billions, if not trillions of dollars, would go to the International Seabed Authority, a new international bureaucracy created by the treaty and based in Jamaica. Heritage's Steven Groves explains that from there, America's money could be shipped to the Middle East, Africa, China, and even state sponsors of terror:

Be Encouraged! 5/22/12

Howdy all!  Well, we had a fun weekend at the compound.  Took an impromptu trip to see some water falls.  Very cool indeed.  When you see what beauty comes from violent erosion like a water fall, you can then understand the phrase “God works in mysterious ways.”

Article IV, Section 4.  In my opinion, (minor as it may be), the best line in the entire Constitution.  “The United States shall guarantee to every State in this Union a Republican Form of Government,..”  We are guaranteed a republic, not a democracy.  Sure, we have all heard the word democracy used to explain our nation, but it isn’t a democracy.  It can’t be.  Art IV Set 4 has the only guarantee in the entire Constitution.  Madison’s discussion here can help explain the founders thinking on this.  Simply put, a majority on one side or another does not mean their interests are the right one.  Maybe this should be part of a required seminar for all legislators and the executive branch on a regular rotation, like once a month!

So, what should we do?  Ephesians 6:18 has a hint.  Pray for all on every occasion.  And “Stay alert and be persistent in your prayers for all believers everywhere.”  Stay alert and be persistent.  Keep our federally elected employees in your prayers, all of them; they need it.  But don’t let that be your only effort to correct their misguided ways.  Be persistent in your dealings with them; call, write, visit.  Tell them where they are wrong or right.  Don’t let them think they are in control.  If they do, then offer a copy of the Constitution’s Article I Section 1; “All legislative Powers herein granted shall be vested in a Congress’..”  And that does say we the people shall grant powers to the congress.  NOT THE OTHER WAY AROUND!

I love the Constitution.  It has so many cool ways to smack down the Government, don’t you think?
