“Jonah rightly calls today’s David Brooks column a must-read. Brooks discusses Reckless Endangerment, the new book by Gretchen Morgenson and Joshua Rosner exposing Fannie Mae’s role in the runup to the financial crisis. Brooks also rightly credits Michele Bachmann for her important role in publicizing a topic many other national politicians have been silent on.

I’ve only had a chance to give Reckless Endangerment a quick look, but my impression is that it tells the right story, if a bit too much from Fannie Mae’s point of view. In Morgenson and Rosner’s telling, Fannie Mae effectively buys off ACORN and other low-income housing groups. There’s some truth to that, but it underestimates the extent to which ACORN and allied groups forced Fannie Mae into the subprime business in the first place, and sometimes pushed themselves onto Fannie Mae against resistance.

I tell that story in the ACORN chapter of Radical-in-Chief, based on heretofore unseen documents from the ACORN archive at the Wisconsin Historical Society.

I also show that Barack Obama was knee-deep in ACORN activities just as their banking campaign reached its height. In fact, much of ACORN’s national housing campaign in the mid-nineties was coordinated from the Chicago office Obama was funneling money to at the time.

So if the combination of the publication of Reckless Endangerment and Michele Bachmann’s campaign brings a new awareness of Fannie Mae’s role in precipitating the financial crisis, by rights it also ought to raise awareness of ACORN’s role, and Obama’s abetment of ACORN activism as well. Of course, for that very reason, the entire story is likely to be ignored. Maybe only someone like Bachmann has the power to break it through.”

“Faced with bracing evidence and the testimony of four ATF agents contradicting the Justice Department’s initial blanket denials that assault weapons were knowingly allowed to escape into the clutches of Mexican drug cartels, Democrats tried a new approach at a hearing Wednesday.

Rather than focus on questioning the GOP’s investigative tactics, Democrats on the House Oversight Committee sought to subtly channel the burgeoning scandal into a push for new gun control laws.

For instance, Rep. Gerry Connolly, Virginia Democrat, connected the apparently reckless investigative strategy to the National Rifle Association’s (NRA) lobbying pushes.

“The NRA has opposed regulations which would require tracking of multiple gun sales,” Connolly noted in a statement passed out to reporters. “The gun lobby and its advocates in Congress are even trying to pass legislation to eviscerate the ATF’s authority to stop criminals.”

Rep. Carolyn Maloney, New York Democrat, also drew a link between the Operation Fast and Furious scandal and whether ATF agents are plagued by “toothless” laws.

“US Attorneys have complained” that prosecutions for illegally purchasing weapons to resell to criminal networks are viewed by judges as “mere paper violations. Have you heard this criticism before?” Maloney asked the four ATF agents testifying.

“I have and I agree with it,” said Peter Forceilli, who thought a minimum sentence of one year in jail would ensure cooperation from “straw buyers” caught by federal authorities.

Darrell Issa, chairman of the Oversight Committee, sought to intervene.

“I want to caution the witnesses,” Issa said. “The scope of your testimony here is limited, and is not about proposed legislation and the like.”

Elijah Cummings, Maryland Democrat and Issa’s combative foil on the oversight panel, protested vociferously. “It’s only fair” for the ATF agents to speak their mind about whether gun laws should be strengthened, he said.

The shift in tactics by the Democrats came as they also appeared to concede the weight of the evidence Issa was presenting clearly undercut blanket denials initially issued by the Justice Department.

Cummings, for instance, called the four ATF agents “great Americans” for “standing up for what you believe in,” and warned the ATF not to retaliate against the agents.

However, when a top deputy to Attorney General Eric Holder was testifying, Cummings ostentatiously apologized for Issa’s conduct in demanding answers from assistant attorney general Ronald Weich. “Let me apologize,” he said. Issa objected that “you may apologize on behalf of something you say.”

Cummings, in defending Weich, shows Democrats are still invested in defending the Obama administration even as documents and testimony are increasingly undermining the administration’s claims.

But the gun control comments Wednesday indicate they may be preparing to chart a new course: embracing the controversy and using it for their own political purposes.

That would, at the very least, leave less time to save Holder from Issa’s zealous investigation.”

“(CNSNews.com) - Instead of trying to stop the flow of weapons from the U.S. to Mexican drug cartels, the Obama administration’s “Operation Fast and Furious” deliberately allowed it to happen. Moreover, “This shift in strategy was known and authorized at the highest levels of the Justice Department,” says a report by congressional staffers.

“Through both the U.S. Attorney’s Office in Arizona and ‘Main Justice’ headquarters in Washington, D.C., the Department closely monitored and supervised the activities of the ATF,” the report says.

On Wednesday, Rep. Darrell Issa, chairman of the House Oversight and Government Reform Committee, convened a hearing to determine who ultimately authorized the Operation Fast and Furious, who knew about it – “and why it took the murder of a 40-year old border patrol agent and a congressional inquiry before administration officials cancelled it.”

Operation Fast and Furious, conducted by the Bureau of Alcohol, Tobacco, Firearms and Explosives, was launched in 2009 in an effort to track the flow of guns from U.S. straw purchasers to Mexican cartels.

ATF agents who complained about the recklessness of allowing cartel associates to buy guns in Arizona were reprimanded, the congressional report said.

David Voth, a supervisor at the ATF field division in Phoenix, told complaining agents to back off: “Whether you care or not people of rank and authority at HQ are paying close attention to this case and they also believe we (Phoenix field division) are doing what they envisioned the Southwest Border Groups doing,” Voth wrote in an e-mail dated March 12, 2010. “It may sound cheesy, but we are ‘The Tip of the ATF spear’ when it comes to Southwest Border Firearms Trafficking.

“If you don’t think this is fun you’re in the wrong line of work – period,” the Voth e-mail continued: “This is the pinnacle of U.S. law enforcement techniques. After this, the tool box is empty. Maybe the Maricopa County Jail is hiring detention officers and you can get paid $30,000 (instead of $100,000) to serve lunch to inmates all day.”

Voth’s e-mail was included in a 51-page report by Republican staffers on the House Oversight and Government Reform Committee and the Senate Judiciary Committee.

Two of the guns purchased by cartel associates were found at the scene of a U.S. Border Patrol agent’s murder in December.

Attorney General Eric Holder said in March he ordered the Justice Department inspector general to investigate the ATF’s gun-tracking operation – “to see exactly what happened, and whether or not what happened was appropriate.”

TX State Sen. Interrupts Immigrant’s Testimony: ‘Why Aren’t You Speaking in English?’

If you are giving testimony in front of Texas State Senator Chris Harris, he’d prefer you speak English.

During a Senate hearing on Monday, Antolin Aguirre of the Austin Immigrant Rights Coalition was testifying against Senate Bill 9, a law that would crack down on illegal immigrants in Texas. But instead of giving testimony in English, he decided to give it in Spanish and speak through an interpreter.

Harris wasn’t having any of that. KTRH-RADIO explains:

Two minutes into Antolin Aguirre’s testimony, Sen. Chris Harris, a Republican
from Arlington, interrupted asking Aguirre’s interrupter, “Did I understand him
correctly that he has been here since 1988?” Harris asked. “Why aren’t you
speaking in English then?”

 

Through his interpreter, Aguirre said Spanish is his “first language and
since it is his first time giving testimony he would rather do it in
Spanish.”

 

“It is insulting to us,” Sen. Harris fired back. “It is very insulting. And
if he knows English, he needs to be speaking in English.”

The bill, which would allow police officers to check a suspect’s immigration

Who Shot The Dollar?

President Barack Obama delivered the deathblow to the dollar.

Who killed the U.S. dollar? This question will be debated by future historians. Already, more people are asking that question than tuned in to find out who shot J.R. on Dallas. The lineup of suspects is long, but it ends with Barack Obama, the triggerman who killed the buck.

The first wound came from Franklin Delano Roosevelt, who expanded the Federal government’s influence far beyond what the writers of the Constitution ever imagined. He devalued the price of gold and made it impossible for ordinary Americans to convert currency to bullion. But FDR was also crucial during America’s World War II victory, a pivotal event that set the stage for America to become the world’s largest creditor and greatest superpower.

LBJ Chooses Guns And Butter

Another suspect is Democrat Lyndon B. Johnson. When I was in college studying economics, our professor made us read history. This seemed counterintuitive until we read about the guns-and-butter policies of the Johnson Administration.

And while Presidents George W. Bush and Barack Obama make Johnson look like a penny-pincher, Johnson was the first to take a shot at the dollar.

Johnson pressed forward his vision with major spending programs for education, medical care, crime and transportation. He wanted to transform America the way FDR had. And he had a war to fight in Vietnam.

Gold demand rose, creating a drawdown on America’s gold reserves. The root of it all was a growing trade deficit that the United States owed to the rest of the world.

The Administration of John F. Kennedy knew America’s gold standard was in trouble. In January 1961, Kennedy’s Undersecretary of the Treasury, Robert Roosa, suggested the U.S. and Europe pool their gold to prevent a private marketplace for gold in which the price would exceed the mandated price of $35 per ounce. French President Charles de Gaulle reneged on the deal and began to redeem dollars for gold instead of U.S. Treasuries. The drain on U.S. gold became severe.

The 1960s marked a gigantic increase in Federal spending. Johnson’s two-front war was being fought at a prohibitive cost. In 1968, for the first time since 1893, the United States ran a deficit in its balance of trade. Federal debt began to soar. By the end of the 1960s, the U.S. faced the stark choice of eliminating trade deficits or devaluing the dollar.

Gold On Nixon’s Enemies List

On Aug. 15, 1971, President Richard Nixon cut the final link between gold and the dollar. Other nations could no longer redeem rapidly depreciating greenbacks for bullion.

In February 1973, the world’s currencies “floated.” By the end of 1974, the price of gold had soared from $35 to $195 an ounce. The U.S. could suddenly pump dollars without constraint. It was a period during which red flags were being raised for paper investors, few of whom paid any notice.

The majority of investors would pay a steep price for their ignorance. Over the next decade, they suffered through the worst bear market in stocks since the Great Depression and the worst bond market of the 20th century.

A Democrat Gives The Dollar A Reprieve

It is ironic that another Democrat would breathe life into the buck, but that is what President Bill Clinton did.

During the Clinton Administration — with the help of innovative accounting — the dollar stormed back. The disgrace Clinton brought to the Oval Office over the Monica Lewinsky affair seems almost forgivable since his Administration presided over a growing economy and what underpinned it, a strong dollar. More than a decade ago, the world had confidence in the U.S. dollar.

As you can see, the greenback has been experiencing an unprecedented decline since 2001. No doubt much of the weakness in the dollar was caused by another guns-and-butter President: George W. Bush.

Just 2½ years into office, Obama is pushing the value of the dollar even lower. It’s so low that the value of the U.S. dollar now threatens to undermine our future and our children’s future.

The notion of bad deeds, specifically curses, coming back to haunt their originator is long established in the English language and was expressed in print as early as 1390, when Geoffrey Chaucer used it in The Parson's Tale: And ofte tyme swich cursynge wrongfully retorneth agayn to hym that curseth, as a bryd that retorneth agayn to his owene nest. 

The Center for Media and Democracy's Real Economy Project is now assessing the total cost to taxpayers of the Wall Street bailout. Multiple federal agencies have disbursed $4.6 trillion dollars in support of the financial sector since the meltdown in 2007-2008. Of that, $2 trillion is still outstanding. Our assessment demonstrates that the Federal Reserve has provided by far the bulk of the funding for the bailout in the form of loans amounting to $3.8 trillion. Little information has been disclosed about what collateral taxpayers have received in return for these loans. CMD also concludes that the bailout is far from over, as the government has active programs authorized to cost up to $2.9 trillion, and still has $2 trillion in outstanding investments and loans.

You are looking at the tip of the iceberg—two ideas in play, one, independence—life, liberty, and the pursuit of happiness, calling for self-governance; the other, dependence—for the good of all.  The above stated assessment tells you that for the good of all the world’s leadership, through the systematic theft of the individual’s property, is striping the individual of his life, liberty, and the pursuit of happiness. What to do about it is the problem.  Hundreds of millions of people are caught between a rock and a hard place.

The answer to the problem is clear enough, but it doesn’t fit the world’s current reality. Sociologist Robert K. Merton’s self-fulfilling prophecy:  “in the beginning, a false definition of the situation evoking a new behavior which makes the original false conception come 'true'. This specious validity of the self-fulfilling prophecy perpetuates a reign of error. For the prophet will cite the actual course of events as proof that he was right from the very beginning.”  

The universe is both quantitative and qualitative.  Everyone understands the difference.  Quantity applies to space and time. Quantitatively, the planet Earth compares to one grain of sand on all the beaches in the world. Qualitatively, one can be completely dependent on others. Why are millions of Indians living on the street?  Why was the World Trade Center destroyed and thousands of innocents killed? Why do millions of Middle-East Muslims see Jews as a threat and want to kill them all?

The quality of life is terrible for the majority of the world’s population.  Millions of the miserable in Americans are on the Yellow Brick Road with Dorothy, the Tin Man, without a heart, the Cowardly Lion, and the Man of Straw, without a brain, all on their way to see the Wonderful Wizard of Oz.  The dream ends back where we were, at square one.

This fairy tale would be true were it not for the Mayan calendar. The world turns; it transits around the sun; the sun around the galaxy.  We are about to reach the tipping point of a galactic change.  Thousands of responses to my blogs at www.mymiraclemessage.com  say a groundswell of new thought is building that is going to break and sweep the world.  

I’m thinking about Woodrow Wilson’s progressive inspired depression. It didn’t last but a year. President Harding took care of Wilson’s progressive attempt to make socialist slaves of us. And then there was Jimmy Carter’s progressive inspired stagflation, which didn’t last either, not after Ronald Reagan took office and changed directions. The change coming with the end of Barack Obama’s economic disaster, according to the Mayan calendar, on December 21, 2012—be ready for astounding news—is going be an evolvement that happens once in many thousands of years.  But, ah, this change I’m speaking of, “the progressive order of the divine dealings of God with humanity, ‘the increasing purpose’ which runs through and links together the ages, from the beginning of the life of man to the end in eternity,” says Rev. By now you are probably aware that President Obama’s recently released “Certificate of Live Birth”, which you provided to me above has been found to be fraudulent by an international expert on scanners and document-imaging software and he has recently filed a 22-page criminal complaint with the FBI to that effect.

For your information, I have included some information regarding subject criminal complaint below:

On or about May 31, 2011, Mr. Doug Vogt, an international expert on scanners and document-imaging software filed a 22-page criminal complaint with the FBI charging that the long-form birth certificate released by the White House, on or about April 27, 2011, is criminally fraudulent.

Background on Mr. Doug Vogt:

Since 1993, Vogt has owned Archive Index Systems Inc., in Bellevue, Wash., a company that sells a wide variety of document scanners worldwide and develops document-imaging software.

Before that, Vogt owned Nova Typesetting for 11 years.

Mr. Vogt stated the following in the Criminal Complaint:

“What the Obama administration released is a PDF image that they are trying to pass off as a Certificate of Live Birth Long Form printed on green security paper by the Hawaiian Health Department,” Doug Vogt writes, “but this form is a created forgery.” 

Mr. Vogt’s criminal complaint asserted: 

“I have irrefutably proven that the Certificate of Live Birth that President Obama presented to the world on April 27, 2011, is a fraudulently created document put together using the Adobe Photoshop or Illustrator programs, and the creation of this forgery of a public document constitutes a class B felony in Hawaii and multiple violations under U.S. Code section Title 18, Part 1, Chapter 47, Sec.1028, and therefore an impeachable offense.”

“It is a logical conclusion,” he says, “that since President Barack Obama felt it necessary to have a Certificate of Live Birth forged for himself then we must conclude that there is in fact no birth certificate in Hawaii and therefore he was not born inside the United States, as the Constitution requires, and he knew it and others also knew it but wanted him in office for whatever reason.”

When the Obama birth certificate “forgery” comes to the public’s attention, Vogt continues, “It will surpass all previous scandals including the Watergate scandal of the Nixon administration.”

“Retired Maj. Gen. Paul Vallely, the chief of Stand Up America, a national security expert and Fox News contributor, says the “Certificate of Live Birth” released in April by the White House as “proof positive” of President Obama’s Hawaiian birth is a forgery, but the FBI is covering the fraud and no one in Congress is willing to tackle the situation because of fears of a “black backlash” if the failings of the nation’s first black president are revealed.

In an interview today with Greg Corombos for WND, Vallely, who previously has expressed concerns about whether the Obama administration is in violation of the U.S. Constitution, said, “His actual birth certificate has never been found in Hawaii nor released from Hawaii hospital there, Kapiolani hospital there, if it in fact did exist.”

“We’ve had three CIA agents, retired, and some of their analytical associates look at it, and all came to the same conclusion, that even the long-form was a forged document,” Vallely said.

“No members of Congress will take this on. The word I get out of Washington is that they don’t want to challenge this because it would be in fact a felony offense and in some cases may be even treasonous and [they are] afraid of a black backlash from some of the urban areas,” Vallely said.

“But that’s a very poor excuse for not taking necessary steps to make sure this president in fact is a legitimate president under Article 2 and he is a born U.S. citizen.”

The departments of government designed to uncover wrongdoing, in this case, are on the wrong side, he said.

“I think they’re (the FBI) covering for this administration. I think the corruption within this administration is so proliferated through the agencies of government now, we’re just in a bad situation here. I think the lack of confidence in our government is growing and many feel that not only all the members of Congress but even our courts are corrupted at this time,” he said.

The questions over Obama’s eligibility to occupy the Oval Office under the requirements in the Constitution that call for a “natural born citizen” have been raised since before he was elected.

Numerous lawsuits have been filed and challenges organized but none have uncovered Obama’s documentation. For most of the past few years, his supporters relied on an online image of a Hawaiian short-form “Certification of Live Birth” as proof of his Hawaiian birth, claiming it was the only documentation available from the state.

However, just as the New York Times best-seller, “Where’s the Birth Certificate: The Case that Barack Obama is not Eligible to be President,” by Jerome Corsi, Ph.D., was about to be released, Obama dispatched a private attorney to Hawaii to fetch the supposed long-form “Certificate of Live Birth” and explained that the record now would include  the full documentation available from Hawaii.

The original hard-copy birth document, whatever it actually is, has never been seen by the public.

Corsi told WND, “The list is growing of those openly acknowledging the Obama long-form birth certificate released by the White House on April 27 is a forgery.

“That former CIA agents are beginning to weigh in on the White House forgery is important. Too many experts remain afraid to speak out about what is an obvious forgery, fearful that openly speaking out against Obama will hurt their income. That Gen. Vallely has now spoken out shows the cracks are widening around the White House façade that the Obama birth certificate is a legitimate document.”

He said, “Vallely is right in saying that millions of Americans are still trying to find out who Barack Obama is.

“The cover-up in Hawaii is still continuing. Every professional forensic document examiner knows the best evidence of the Obama long-form birth certificate is not the electronic Adobe file released on the White House website, but the original document the Hawaii DOH is still hiding in its vault, unwilling to let the public see it with their own eyes. Why won’t the White House allow a team of independent professional forensic document examiners inspect and authenticate the original birth certificate document? It makes no sense — unless of course there is no long-form birth certificate in the Hawaii DOH vault.”

When Obama released the purported long-form certificate, officials in the Hawaii Department of Health and governor’s office refused to simply confirm to WND that the image being presented by Obama was an accurate representation of the records maintained by the state.

Vallely said the document should “thoroughly be analyzed by resident FBI officials and analysts to determine if in fact and validate whether it’s forged or real.”

“One of the apparent flaws in that document was they listed Kenya as the place of birth of Obama’s father, but Kenya was not an established country at that time,” he noted.

“There’s still a lot of controversy about it, and some of us would just like to have this thing clearly authenticated.”

He also cited one of the many issues raised by document experts who have challenged the “birth certificate’s” authenticity – the layering in the Adobe computer file.

And Vallely said he knows some would not be satisfied with anything the Obama administration would release, which is a problem, in itself, for the White House.

“That’s true, because they don’t believe he is eligible. You have a fairly growing contingent out there.”

Vallely also made similar statements in an online radio program in which he supported Lakin, the Army doctor who refused orders because neither the military nor the White House would document Obama’s eligibility. There, Vallely said, “Obama’s birth certificate – I’ve had retired CIA agents and other investigators go over the birth certificate that was produced and by far, 10 out of 10 have said it’s a forgery. So we still have that corruptness going on in the White House. There’s a great number of organizations and people still trying to find out who Barack Obama is, where he was born, what his legitimacy is as president of the United States. We know for sure that the Constitution has been violated in Article 2, particularly when you look at the natural-born status.”

Only one day earlier, officials in the state of Hawaii claimed that the original of the Obama ‘birth certificate’ document – the document posted online by the White House – remains “confidential” and cannot be produced in response to a subpoena in a lawsuit over Obama’s legitimacy.

The image released by Obama has been challenged by a number of document imaging analysts as a fraud, and it doesn’t align with descriptions of it by Obama supporters.

For instance, two weeks before Obama finally released his “long-form birth certificate,” Hawaii’s former Health Department chief Chiyome Fukino – the one official who claimed to have examined the original birth document under lock and key in Hawaii – was interviewed by NBC News’ national investigative correspondent Michael Isikoff, who reported that Fukino told him she had seen the original birth certificate and that it was “half typed and half handwritten.”

However, the document released by the White House was entirely typed. Only the signatures and two dates at the very bottom were “handwritten.” What Fukino described apparently is a different document from what Obama released to the public.”

“This is the third and last of three articles explaining the criminal complaint that scanner expert Doug Vogt filed last week with the FBI.

NEW YORK – The White House’s release of an electronic copy of Obama’s long-form birth certificate instead of a certified paper copy raises questions in a 22-page criminal complaint with the FBI filed by an international expert in scanners and document-imaging software.

Doug Vogt’s complaint charges that individuals within the Hawaii Department of Health, Obama political operatives and an unidentified graphic artist worked in a multi-state conspiracy to create a fraudulent long-form birth certificate for Barack Obama.

Vogt’s complaint asserts: “I have irrefutably proven that the Certificate of Live Birth that President Obama presented to the world on April 27, 2011 is a fraudulently created document put together using the Adobe Photoshop or Illustrator programs.”

He claims the long-form birth certificate the White House released April 27 as an electronic document in PDF format was forged from a composite of legitimate birth certificates obtained from the Hawaii DOH archives and manipulated to replace the original information with a fraudulent Obama birth record.

The birth certificate the White House released consists of an electronic file that when opened as a PDF file in Adobe Illustrator reveals nine different layers that corresponded to different sections of the form, including the signatures.

“I also opened up the White House PDF file in WordPad so I could see the codes and headers in the file. There I discovered the evidence for the nine layers embedded in the code,” Vogt writes. “The big surprise I discovered was that the file was finished or created on April 27, 2011, and the copy I had downloaded from the White House web site was modified on April 28, 2011, at 9:58 a.m., the day after the news conference.”

Vogt sees a discrepancy between the electronic PDF file released on the White House website and the White House-released correspondence with the Hawaii Department of Health, including a letter from DOH Director Loretta J. Fuddy, that clearly states she released in Hawaii to White House outside counsel Perkins Coie two certified copies of Obama’s original Certificate of Live Birth.

“The whole White House story that the President had his Seattle-based lawyer fly to Hawaii and pick up a signed and stamped paper Certificate of Live Birth and fly directly to Washington, D.C., is obviously not the document the public has been shown,” Vogt concludes.

“In other words the whole story is not true,” he said. “The Press Secretary proudly stated that he personally put up the PDF on the White House web site and that’s probably all they got, was the PDF by e-mail.”

Vogt also questions why the Obama birth certificate was shown by the White House as a positive document, black printing on a white background (covered by green hash-marked official Hawaii DOH document paper), while the Nordyke twins’ birth certificates from the same era were obviously archived as microfilm, with photostatic copies clearly showing the white printing on black background characteristic of positive copies made from records preserved on microfilm.

To make the point, Vogt displayed a TIFF image of the Obama birth certificate issued by the White House and the photo static copy issued to the Nordyke twins by the Hawaii DOH in 1966:

The White House has not explained how the copy of the Obama birth certificate released to the press in the White House press room was produced without the green hash-mark background that supposedly represented the document as officially issued by the Hawaii DOH.

The Hawaii DOH has refused to show the original document in its vault to the public, to compare with the White House-released versions. The agency also has not explained the apparent discrepancy of retaining Obama’s 1961 long-form birth certificate as a paper document, while the Nordyke twins’ birth certificates issued within days of Obama’s are maintained as microfilm records, not paper documents.

Multiple Layers:

Vogt notes that the multiple layers in the PDF file released by the White House have been widely demonstrated by various experts in numerous videos posted on Internet sites.

He provides a rebuttal to Jean-Claude Tremblay, a Canadian graphic artist who argued on the Fox News Channel on April 29 that the layers were a natural result of the Hawaii DOH scanning the original document while leaving OCR (Optical Character Recognition) software operative within the scanner.

Tremblay told Fox News that scanner OCR software tries to translate characters or words in a photograph into text, producing multiple layers in the resulting PDF file.

Tremblay further maintained that in the scanning process, layers were created when the OCR software was unable to separate text fully from background, resulting in the creation of a separate layer within the document.

Vogt charges that Tremblay “knows nothing about OCR engines and how they work and their file structure.”

Vogt notes the Obama PDF birth certificate file was supposed to have come directly from the Hawaii DOH office.

He maintains that the Hawaii DOH would have absolutely no reason to use OCR features when making the scan, and if the Hawaii DOH were asked to give the White House a PDF image, “it would be from their existing TIFF image stored in their document imaging program on the server.”

“My qualifications on OCR programs are considerable,” Vogt asserts.

He provides the following technical explanation:

“Our own document imaging program, TheRepository, has an OCR option from Expervision that is called TypeReader. We integrated TypeReader into our program but to do this we had to sign a non-disclosure statement with them and then we got their Took Kit and API. When an OCR program saves a file as a searchable PDF, the file contains three main files within it. The first file is an image file, usually a compressed Group4 TIFF. The second file is a ASCII text file and the last file is a matrix file that contains the X and Y coordinates of all the words in the document. The Starting point for the image file and the matrix file is usually the upper left hand corner of the image measured in pixels. The text file and matrix files would never be seen as separate layers and there is certainly no nine layers. The three files would be in a PDF ‘wrapper’ and that’s all. All OCR programs work on the same principle.”

Put simply, Vogt explains, OCR technology is typically used to read into a word processing program text from a typed or printed document that is translated into electronic format by a scanner.

If the Hawaii DOH produced the PDF file for the White House, a flat TIFF image would have been sufficient, as the Hawaii DOH had no reason to think the White House or U.S. citizens would manipulate the document in a word processer, either before or after the document had been released.

Instead, Vogt asserts, the White House released, perhaps by mistake, a nine-layer Adobe Illustrator file that had been used to forge the document.

As of this writing, the Obama birth certificate placed on the White House website can still be viewed and downloaded.”

“WASHINGTON — The White House is telling Congress that President Obama has the legal authority to continue American participation in the NATO-led air war in Libya, even though lawmakers have not authorized it.

In a broader package of materials the Obama administration is sending to Congress on Wednesday defending its Libya policy, the White House, for the first time, offers lawmakers and the public an argument for why Mr. Obama has not been violating the War Powers Resolution since May 20.

On that day, the Vietnam-era law’s 60-day deadline for terminating unauthorized hostilities appeared to pass. But the White House argued that the activities of United States military forces in Libya do not amount to full-blown “hostilities” at the level necessary to involve the section of the War Powers Resolution that imposes the deadline.

“We are acting lawfully,” said Harold Koh, the State Department legal adviser, who expanded on the administration’s reasoning in a joint interview with White House Counsel Robert Bauer.

The two senior administration lawyers contended that American forces have not been in “hostilities” at least since April 7, when NATO took over leadership in maintaining a no-flight zone in Libya, and the United States took up what is mainly a supporting role — providing surveillance and refueling for allied warplanes — although unmanned dronesoperated by the United States periodically fire missiles as well.

They argued that United States forces are at little risk in the operation because there are no American troops on the ground and Libyan forces are unable to exchange meaningful fire with American forces. They said that there was little risk of the military mission escalating, because it is constrained by the United Nations Security Counsel resolution that authorized use of air power to defend civilians.

“We are not saying the president can take the country into war on his own,” Mr. Koh said. “We are not saying the War Powers Resolution is unconstitutional or should be scrapped, or that we can refuse to consult Congress. We are saying the limited nature of this particular mission is not the kind of ‘hostilities’ envisioned by the War Powers Resolution.”

The administration unveiled its argument at a time when members of Congress have shown increasing skepticism about the Libya operation. On June 3, the House of Representatives passed a resolution declaring that the mission had not been authorized.

On Wednesday, the Speaker of the House, John Boehner, Republican of Ohio, sent Mr. Obama a letter pointing out that even under a flexible interpretation of War Powers Resolution that would allow hostilities to last 90 days without Congressional authorization, Mr. Obama was out of time. Mr. Boehner demanded a legal explanation by Friday.

“Given the mission you have ordered to the U.S. Armed Forces with respect to Libya and the text of the War Powers Resolution, the House is left to conclude that you have made one of two determinations: either you have concluded the War Powers Resolution does not apply to the mission in Libya, or you have determined the War Powers Resolution is contrary to the Constitution,” Mr. Boehner wrote. “The House, and the American people whom we represent, deserve to know the determination you have made.”

It remains to be seen whether majorities in Congress will accept the administration’s argument, defusing the confrontation, or whether the White House’s response will instead fuel greater criticism. Either way, because the War Powers Resolution does not include a definition of “hostilities” and the Supreme Court has never ruled on the issue, the legal debate is likely to be resolved politically, said Rick Pildes, a New York University law professor.

“There is no clear legal answer,” he said. “The president is taking a position, so the question is whether Congress accepts that position, or doesn’t accept that position and wants to insist that the operation can’t continue without affirmative authorization from Congress.”

Ten members of Congress — led by Rep. Dennis Kucinich, Democrat of Ohio, and Rep. Walter Jones, Republican of North Carolina — filed a lawsuit on Weednesday asking a judge to order Mr. Obama to stop the air war. The suit asserts that the operation is illegal because Congress did not authorize it. That lawsuit faces steep challenges, however, because courts in the past have dismissed similar cases on technical grounds.

The administration had earlier argued that Mr. Obama could initiate the intervention in Libya on his own authority as commander-in-chief because it was not a “war” in the constitutional sense. It also released a memorandum by the Justice Department’s Office of Legal Counsel agreeing that he could do so unilaterally because he anticipated that its nature, scope, and duration would be limited.

Since then, the conflict in Libya has dragged on longer than expected, and the goal of the NATO allies has all but openly shifted from merely defending civilians to forcing the Libyan dictator, Col. Muammar Qaddafi, from power. But Mr. Koh and Mr. Bauer said that while regime change in Libya may be a diplomatic goal, the military mission is separate, and remains limited to protecting civilians.

The administration legal team considered other approaches, including a proposal to stop the use of armed drones after May 20 in order to bolster the case that United States forces were no longer engaged in hostilities. But the White House ultimately decided not to make any changes in the military mission.

While many presidents have challenged the constitutionality of other aspects of the War Powers Resolution — which Congress enacted over President Nixon’s veto — no administration has said that the section imposing the 60-day clock was unconstitutional. In 1980,the Office of Legal Counsel concluded that it was within Congress’s constitutional power to enact such a limit on unauthorized hostilities.

Mr. Bauer and Mr. Koh said the 1980 memorandum remains in force, but that their legal argument does not invoke any constitutional challenge to the act.

It was not clear whether the Office of Legal Counsel has endorsed the White House’s interpretation of what “hostilities” means. Mr. Bauer declined to say whether the office had signed off on the theory, saying he would not discuss inter-agency deliberations.

Mr. Koh argued that the administration’s interpretation of the word was not unprecedented, noting that there have been previous disputes about whether the 60-day-clock portion of the War Powers Resolution applied to deployments where — unlike the Libya operation — there were troops on the ground and Americans suffered casualties.

Still, such previous cases typically involved peacekeeping missions in which the United States had been invited to take part, and there were only infrequent outbreaks of violence, like those in Lebanon, Somalia and Bosnia. Libya, by contrast, is an offensive mission involving sustained bombardment of a government’s forces.

The closest precedent was the NATO-led air war over Kosovo in 1999. In that case, the Clinton administration’s legal team characterized the campaign, which involved many piloted American warplanes, as “hostilities” even though there was little exchange of fire from Serb forces after their air defenses were destroyed and there were no United States casualties.

In Kosovo, however, Congress appropriated specific funds for the mission before 60 days had passed. The Clinton administration decided that by providing the money, Congress had satisfied the requirements of the War Powers Resolution.”
