August 26, 2019, may go down as a day in infamy when the courts allowed a frivolous lawsuit to squeeze through the bench on its way to attack the Second Amendment of the United States Constitution. This has been a long-standing battle for the right to “keep and bear arms” as written and so vehemently defended by our Founding Fathers. The Honorable Judge Thad Balkman of the Cleveland County District Court just sent a volley of serious attacks against our freedoms that will forever change history.

Background

The Cleveland County District Court was destined to hear the case on Oklahoma’s opioid crisis, between the Oklahoma Attorney General Mike Hunter (R) and the Conglomerate Johnson’s & Johnson’s subsidiary Jenssen. This has been a long-running trial now for over two years. Evidence was heard on both sides, documents, and witnesses from parents and partners of deceased opioid users.

After some intense deliberation, the Honorable Judge Thad Balkman handed down a verdict citing that the Defendants’ “actions caused harm” (1) “because those actions annoyed, injured or endangered the comfort, repose, health or safety of Oklahomans” (1). He ruled that the “drugmaker Johnson & Johnson helped ignite the state’s opioid crisis” (2). The judge then ordered $572 million to be paid by the Defendants, stating from the bench, “The opioid crisis has ravaged the state of Oklahoma and must be abated immediately” (1).

From the Trial

Before the trial was even set, the Oklahoma Attorney General asked the manufacturer to pay huge sums of money to settle the case outside of court. This is customary for many cases, as 97% of all civil cases settle before trial. The Oklahoma Attorney General asked for a sum of $17.5 billion in his lawsuit, far greater than a reasonable settlement. In mediation, this tactic is called the extortion offer.

I, for one, was watching most of the trial unfold, and am alarmed at how this verdict was reached. Witnesses were crying and sobbing as they remembered their loved ones slipping away or recounting how their loved one “didn’t want to die.” Playing on every channel during the trial were commercials touting these same losses and heartbreaks. This is sad and extremely painful to watch, but even more so for those that live through this catastrophe.  

But is it Johnson & Johnson’s fault?

One individual recounted how their adult child started using pain killers (opioids) and continued even after they recovered. Another described how their loved one couldn’t get the opioids from the prescribing physician, so they resorted to stealing prescriptions and buying prescription medications illegally.

Every day, the trial showcased people who have suffered from the opioid epidemic, while also railing against the carelessness of Johnson & Johnson to allow people to become addicted to opioids.

One such commercial told a story of how their son started taking opioids after an injury and then continued to take the opioids afterward to get “high.” They go on further to say their son “didn’t want to die.”

Reality Check

How did the Honorable Judge Thad Balkman conclude that Johnson & Johnson was at fault for people unlawfully obtaining prescription medications and subsequently overdosing on them? Where was the prescribing physician? Was the physician still prescribing the opioid to the patients?

Where is the connection that led the Honorable Judge Thad Balkman to realize that Johnson & Johnson or its subsidiary Jenssen were in some manner giving out or prescribing a class 2 pharmaceutical?

When did a person “knowingly” allow their son to continue taking a high potent prescription medication to get “high” become the standard to penalize the manufacturer? This comes down to personal responsibility. If you eat MacDonald’s every day while not exercising, is it MacDonald’s fault for your potential health problems?

I have grave concerns that a Republican Attorney General and a Republican District Judge were moved by emotions rather than facts. Even if the manufacturer did not admit to the total addictiveness of the pharmaceutical, the facts do not link the manufacturer to the distribution, nor does they link the manufacturer to the prescription.

Opioids must be prescribed by an attending physician who is licensed and trained for years on the addictive nature of opioids. The medications can only be obtained by a prescription taken to a pharmacy to be dispensed. There have been more restrictive laws and double-checks in place for years to prevent unethical physicians from prescribing opioids. Removal of licensure, lawsuits and prison sentences have been handed down for medical physicians improperly prescribing high-level narcotics. Have we forgotten the Michael Jackson case?

Neither the unlawful purchase of someone else’s medication, the theft of another person’s prescription, nor the theft of personal property to sell or barter to obtain a class 2 pharmaceutical narcotic constitute a manufacturer’s liability to warn about addictiveness. It also doesn’t point to the manufacturer helping “ignite the state’s opioid crisis” (2).

The standard as stated by the Honorable Judge Thad Balkman, “actions annoyed, injured or endangered the comfort, repose, health or safety of Oklahoman’s” (1) is quite a slippery slope.

You can claim: the cashier was rude and this “annoyed” me — sue the produce manufacturer, the tire blowing out from a passing car “endangered my comfort” — sue the automotive manufacturer, or the steel manufacturer uses to produce the automotive, the smoke blown outside the door harmed my “health and safety” — smoke was from a jet flying above — sue the jet fuel manufacturer, and the alarm clock disturbed my “repose” — sue the plastics manufacturer who supplied the alarm clock housing.

The standard is too vague and broad, creating an umbrella law to attack anyone for anything, regardless of their connection to the “action.”

Our Court System

Our courts are made up of laws passed by the legislature for the betterment of society. They are made to uphold our Constitutions, both state and federal. The most noted of all laws are not cited; they are bench laws or precedent. Precedent is when a judge makes a ruling on a case.

These are our most dangerous and harmful laws we have in the country and why we are in such grave danger now. When a judge sets a precedent, every case coming afterward seeks to hold by that ruling. Once lawyers find a favorable precedent, they can appeal to the former judge’s findings and how they ruled. Now, that judge can choose to ignore the previous litigation, which will end up in an appeal for not following precedent; affirm the precedent and award in line with the former judge, which most commonly happens; or overrule the former judge’s ruling, creating the opportunity for further appeals to the superior court.

This is not easy as most litigants, present case excluded, do not have the tens for thousands of dollars to fight a case to the superior courts or all the way to the United States Supreme Court. People accept the ruling by precedent and are forced into servitude or bankruptcy.

A History of Fruitless Attacks on the American Constitution

Everyone remembers the MacDonald’s case where the person was burned with a scorching cup of coffee. What people do not understand is the case was not about hot coffee but under-insulated cups and improper lids when handing out 120-degree beverages. All we remember is a person was burned by coffee, and they were awarded a huge sum of money. This case has been cited as precedent in many later cases to justify penalizing companies for actions that may or may not truly be the Defendant’s fault.

This same burger giant was targeted again years later for “making people fat.” This spawned videos and antics where healthy people who worked out daily, ran marathons, and ate a moderate green diet went on an eating binge to consume thousands of calories more than usual. This led to ignorant findings that were touted to prove that the fast-food chain was knowingly harming the citizens.

We have all heard of the attacks on the auto manufactures for a half-century. When the vehicle is made improperly or defectively, the manufacturer absolutely bears responsibility. When the manufacturer knows of a defect and chooses to ignore the danger, the manufacturer is certainly liable. But it has been ruled many times that the automobile manufacturer does not bear guilt for driver error and weather conditions that exceed the manufacturer’s intended purpose. This case now opens the door for lawsuits against automobile manufacturers when someone drives 200 miles on the doughnut spare, and it blows out.

Everyone remembers the lawsuit to sue the ammunition manufactures for causing death because someone was shot and killed by a bullet built for “one purpose, to kill.” Well folks, all bullets are made to kill, not just some.

Now, certain groups are looking to sue the gun manufactures for someone deciding to commit a deadly act with a firearm. It wasn’t until later we found out the weapon was, in fact, illegally obtained by a person and then was used in an illegal act. I do believe this case was dropped due to lack of, you guessed it, precedent.

How this Affects Our Freedom and Second Amendment

There has been an attempt to hold gun manufacturers liable for mass murders and open the door for Red Flag gun laws for decades. Until now, they have not had a precedent for the extermination of our Second Amendment rights. This precedent has far surpassed the previously discussed attempts from the left to seize and prosecute law-abiding American manufacturers for acts outside of their control.

This dangerous precedent places an independent fifth-party manufacturer as liable for the actions, whether legal or illegal, of people whom the manufacturer has zero control over. Further, the manufacturer has no oversight, supervisory control, prescribing directive, or ability to consult before a prescription for the manufacture’s product is dispensed. Not only this, but there are a second-party intermediary (physician) and a third-party intermediary (pharmacist) who prescribe and procure the product for the user under the direction of established fourth-party healthcare regulatory bodies which lie outside the direction, control, supervision or oversight of the manufacturer.

With this awful tragedy of justice, anyone injured or killed from a firearm, whether that be an accident, suicide, or murder, now has precedent for claiming the manufacturer, not the actor nor seller nor distributor, was at fault for the injury or death, whether or not the firearm was obtained lawfully or illegally nor was the obtainer of the gun legally allowed under law to be in possession of a deadly weapon. This puts in place the direct link to attack the Second Amendment of the Constitution of the United States of America and our God-given right to keep and bear arms by extortion or trial.

Once someone is killed or injured, the prosecutor or litigating plaintiff will try to settle for millions or even billions of dollars from the manufacturer. This will be touted; “you see what happened to Johnson & Johnson.” This extortion is used in mediation cases every day as a bargaining chip.

 It’s a “do as I say or else” threat that has teeth when there is precedent. Once the Honorable Judge Thad Balkman’s gavel cracked, people started lining up to extort funds from all types of manufacturers. It is said there are 30 other states’ attorneys general waiting for the ruling on the Oklahoma opioid case. They now have precedent for extortion of millions of dollars or retry Oklahoma’s Attorney General Mike Hunter’s extortion of $17.5 billion. 

If extortion does not work, the legal team goes to work to set in place the precedent that “because those actions annoyed, injured or endangered the comfort, repose, health or safety” (1). This is a slippery slope that has devastating implications. You can now, theoretically, sue or extort money from an electric company because they manufactured the electricity that burned your hand off while you were stealing copper from a city transformer during a rainstorm.

We will see a surge in attacks to extort money from anyone and everyone in mediation and settlement conferences dealing with manufacturers from this date forward. Once they can attach a claim to the manufacturer for the production of a product, then they will have legal right to further restrict the purchase, use, access and carry of all weapons as a dangerous and harmful manufacturer is at fault for manufacturing (drugs, guns, ammo, cars, gasoline, etc.).

There have already been attacks on our gun manufacturers, especially Armalite, the manufacturer of the AR-style rifle. These attacks have waned even to get started because there was no precedent of a removed party manufacturer liability for the use or misuse of a product by an actor who obtained a firearm, whether legally or illegally, and acted with this firearm outside the manufacturer’s guidelines, but that has changed to society product. Once someone is injured or killed in a shooting, it will be open season. If you can claim the manufacturer was a fault for building the product, you can theoretically claim the school was at fault for being the place of the attack, the police were at fault for not stopping it, the parents were at fault for sending their children to school and the bus driver was liable because he transported the student with a weapon. These are all removed party unrelated uninvolved actors.

Conclusion

The first attack on our society, if this ruling is not quickly eviscerated, is the gun and ammunition manufacturers. They will extort billions for suicides to mass shootings touting this precedent. These cases are “bad law” and should not be upheld by the superior courts. This precedent has such a range of implications that we will see frivolous lawsuits and extorted mediation settlements for decades ranging into the billions on removed party product manufacturers whom will have no choice but to shut down due to liability or charge astronomical prices.

Our rights as citizens of the United States, especially here in Oklahoma, just took a back seat as we can no longer pursue happiness as entrepreneurs. We will forever be looking over our shoulder to see if the candle we made and sold to a distributor, who sold the candle to Walmart, bought by a person in another state, was left burning in a window with drapes when everyone left for ice cream and the wind blew the drapes over the flame and the stray cat under the porch died. This is the dangerous precedent that was set today in infamy.

Montgomery, ‘THE HAMMER’ Surveillance System Whistleblower, Became The Deep State’s Enemy Number One After Exposing The Truth

Remember, do not kill a mockingbird. When a whistleblower is singing for America’s protection, we embrace and celebrate him.

Inventor and software designer Dennis Montgomery, a CIA/DOD/DHS/NSA/FBI  contractor-turned-whistleblower, alerted FBI Director James Comey’s office in 2015 that President Obama’s CIA Director John Brennan and Obama’s Director of National Intelligence James Clapper had turned the super-surveillance system that Montgomery designed for foreign surveillance, known as THE HAMMER into a domestic surveillance system.

Montgomery became alarmed when Obama and his intelligence chiefs Brennan and Clapper turned the super-surveillance system against the American people.

Montgomery asserts that Obama, Brennan, and Clapper used THE HAMMER in a diabolically intrusive manner in order to spy on the American people and collect massive amounts of surveillance data for “leverage” and “blackmail.”

THE HAMMER was only to be used for foreign surveillance, not to be weaponized for domestic surveillance against the American people, according to Montgomery and to U.S. military sources.  

According to those U.S. military sources, Montgomery’s surveillance technology not only saved American lives as America’s “War on Terror” broadened, but also featured built-in safeguards to prevent the system from ever being used for domestic surveillance.

“Multiple echelons” of government, including the FISA court, had to sign off on each and every foreign surveillance operation conducted with the use of THE HAMMER, those sources say.

Montgomery claims that Brennan and Clapper used the super-surveillance system Montgomery designed to spy on Article III federal judges, including the onetime head of the FISA court Judge Reggie Walton, Supreme Court Justice Antonin Scalia, and Chief Justice of U.S. Supreme Court John Roberts.

Montgomery’s revelations about his super-surveillance system THE HAMMER call into question Chief Justice Robert’s strange and inexplicable 2012 decision that stood in direct opposition to his own stated legal argument. At the eleventh hour, Roberts flipped and supported the individual mandate for President Obama’s highly unpopular Affordable Care Act.

Montgomery, who is constrained by non-disclosure agreements, has spoken about the system but has not publicly identified the system by name. The secretly-recorded “Whistleblower Tapes” identify the name of the system as “THE HAMMER,” as we first reported in our March 17, 2017 exclusive exposé. The March 2017 WikiLeaks CIA Vault 7 document dump confirms the name of the system as THE HAMMER (HAMR).

Military sources, we can now report exclusively, confirm the existence of the super-surveillance system known as THE HAMMER. Those sources caution that the super-surveillance system was only to be used for foreign surveillance.

Comey Knew

In August 2015, Montgomery turned over to FBI General Counsel James Baker, who represented the office of FBI Director Comey, physical evidence, in the form of 47 computer hard drives containing 600 million pages of documents.

Montgomery maintains that the data on the hard drives prove the existence of THE HAMMER and prove that Brennan and Clapper engaged in illegal domestic surveillance, despite the existence of safeguards that were already in place.

On August 19, 2015, Montgomery turned over the hard drives under two immunity agreements struck with the U.S. Department of Justice. The 600 million pages of documents stored on those hard drives, when stacked one upon another, would measure a stunning thirty miles high, says Montgomery.

The FBI provided Montgomery with a detailed receipt for the 47 hard drives, including handwritten descriptions of each and every hard drive.

FBI Director Jim Comey took Montgomery’s evidence and buried it.

Montgomery’s claim that Obama, Brennan, and Clapper illegally spied on millions of Americans is by itself explosive.

Montgomery’s identification, by name, of one particular U.S. citizen that Montgomery insists was under constant surveillance “for years” by Obama, Brennan, and Clapper via THE HAMMER has led Obama’s inner circle to take desperate measures.

The name of that U.S. citizen targeted by THE HAMMER is Donald J. Trump.

Whistleblower Tapes: Trump Wiretapped "A Zillion Times" By 'The Hammer,' Brennan’s and Clapper's Secret Computer System - The American Report

The Whistleblower Tapes released by U.S. District Judge G. Murray Snow reveal that Donald Trump was wiretapped a “zillion times.”

The CIA feared Trump, maintains Montgomery.

Donald Trump and his late father Fred Trump are both known for their lifelong aversion to communism.

President Obama’s CIA Director, admitted communist John Brennan, feared Trump.

As we previously reported, Brennan and Comey both affirmed their belief in communism.

Comey, we simultaneously reported, told New York Magazine “I’d moved from Communist to whatever I am now."

Frank Marshall Davis, President Barack Obama’s mentor during Obama’s formative years in Hawaii, was a card-carrying Communist Party USA member (CPUSA member #47544) and suspected KGB agent who was listed on the FBI’s Security Index, Davis’s lengthy FBI file reveals. According to Paul Kengor, “Davis hailed Joe Stalin’s state for its alleged freedom and democracy.”

Stalin could only have dreamed of a Soviet surveillance system with capabilities approaching those of THE HAMMER. Russian historian Alexander Solzhenitsyn says that Stalin murdered 60 million of his own countrymen during his reign of terror.

With THE HAMMER, Brennan, Clapper, and Obama were implementing a political system — communism — that is antithetical to America’s system of justice and to the U.S. Constitution.  

Under the U.S. Constitution, the purpose of American government is to secure the rights of each American to life, liberty, and private property.

Brennan, Clapper, and Obama illegally used THE HAMMER as a technological instrument of tyranny in order to take away Americans’ inalienable rights as outlined under the U.S. Constitution.

These conspirators transformed a high technology tool designed to protect the American people from foreign threats into a tool of tyranny.

During a 2017 radio interview with his attorney Larry Klayman, Montgomery explained:

I provided to the FBI seventeen businesses of Donald Trump, including the Trump Tower, the Trump leasing programs, all of these different programs, and including Trump himself and the various family members that had been wiretapped under these programs. There has been a wiretap on Trump for years...

...I was a CIA contractor both under John Brennan and under James Clapper and these individuals were running domestic surveillance programs in the United States collecting information on Americans...they collected everything they could find. Bank accounts, phone numbers, chats, emails, and they collected a massive amount of it under the Obama administration.

According to sources, Comey was the general counsel and senior vice president of Lockheed Martin when Montgomery was paid $8,000 to use a supercomputer at a Lockheed facility in the Los Angeles area to collate the tranche of data harvested by The Hammer into individual files for each of the individuals being targeted

“The proof of Donald Trump being wiretapped is in the documents that were handed over to the FBI” Attorney Klayman told reporter Fanning.

Brennan and Clapper covertly operated THE HAMMER out of a U.S. government facility in the Washington, D.C. suburb of Fort Washington, Maryland, according to the secretly-recorded audio tapes released by a U.S. District Judge G. Murray Snow in 2015.

From September 13, 2001 until June 2006, Clapper was the director of the National Geospatial-Intelligence Agency (NGA), known until 2003 as the National Imagery and Mapping Agency (NIMA).  Clapper’s previous post as NGA director is an important detail because NGA is known to operate out of Fort Washington.

Obama and his henchmen were using THE HAMMER to create a tyrannical police state in America worthy of the East German Stasi or Hitler’s Gestapo.

According to Montgomery, the FBI, under Director Robert Mueller’s leadership, provided the computers for THE HAMMER super-surveillance system.

Special Counsel Robert Mueller’s Russia collusion investigation entirely cleared President Donald Trump of collusion with the Russians.

Regardless of the evidence and the $35 million dollar two-year investigation, many, including John Brennan and James Clapper and, according to Democrats’ spin, Robert Mueller himself, continue to smear and characterize President Trump as guilty of collusion and treason.

Montgomery’s Journey From Computer Genius To Enemy Of The Deep State

Dennis Montgomery was celebrated and hailed from many quarters as a “computer genius.”

Montgomery was later reduced from whistleblower to enemy number one of the Deep State, with purpose and forethought. Those holding and abusing positions of power within the intelligence community who had previously hired Dennis Montgomery as a national security contractor for classified projects could not afford to have him expose their duplicitous and treasonous actions.

“IT IS NOT THE FACTS THAT MATTER, IT IS THE PERCEPTION”

Montgomery claims that the FBI buried its investigation into his federal whistleblower claims about illegal domestic surveillance and that U.S. intelligence agencies, several years earlier, attempted to destroy his reputation.

According to Montgomery, the same intelligence agencies, after they had finished smearing his reputation, quietly rehired him.

In 2011, James Risen and Eric Lichtblau authored a New York Times article in which they painted Montgomery as a fraud, citing CIA sources.

In 2016, Montgomery sued Risen and the publisher of Risen’s book Pay any Price: Greed, Power, and Endless War for defamation over a chapter that portrayed Montgomery’s work for the U.S. government as a hoax.

Lichtblau has been exposed. Lichtblau, who was working as CNN editor, and two other reporters resigned from CNN in June 2017 after CNN retracted their discredited story linking the Trump transition team to a Russian investment fund. Only two months earlier, CNN had recruited Lichtblau to its investigative unit.

Montgomery stated in an interview with Larry Klayman:

Eight years ago, Americans were so eager to elect a black president; they voted for a darling of left-wing extremists, Barack Obama. The corrupt, and likewise, leftist, main-stream media joined Democrats in hoisting Marxist Barack Obama upon their shoulders, carrying him to the White House.

This Marxist ideologue immediately declared war on traditional Americans, their culture, religion, laws, and the Constitution. His eight years of torturous tyrannical rule were agonizing for all freedom-loving Americans. Constitutionalists suffered through it all hoping and praying that at the end of the nightmare a miracle candidate would emerge.  We were desperate for someone from beyond the binding chains of political chicanery that could stop the hemorrhaging of liberty and resurrect a long-sleeping giant.

Hillary Clinton, a not-so-bright, female political hack and clone of Barack Obama, was chosen by the left-wing lunatics to succeed the worst President in U.S. history.  She pledged to preserve his legacy of Marxist tyranny, and continue his war on America; particularly white Christians. This totally corrupt and despicable woman claimed and exhibited only one qualification for President; marrying Bill Clinton.

Since the Ronald Reagan era, Republican politicians’ empty promises fell on disinterested conservative ears. They promised anything to get elected, and then fell into bed with the Washington establishment; never heard from again until the next election. Conservatives remained in a stupor for decades, realizing not one presidential candidate in either party did anything to propel them toward extraordinary action or allegiance.

This forgotten segment of society, benumbed by decades of main-stream media’ and politicians’ lies and promises, retreated into a quiet, introspective acceptance of the status quo.

Then, a clarion call came from a man who spoke in clear, straightforward, and uncompromising terms. Political correctness was a foreign concept to this man, as was multiculturalism, niceties, and made-up rules of politicians and the media. Supporters loved that he gave no quarter to the anti-American forces in America’s leftist political barrenness. When attacked, he retaliated mercilessly and relentlessly. 

Donald Trump was a successful entrepreneur and business mogul with no political or government policy experience.  Predictably, polish was something on his shoes, not in his oratory. He wasn’t tied to a political machine, and given a zero chance of success by political hacks, media morons, pointy-headed pundits, and the established political parties.

This Republican spoke plainly to disenfranchised Democrats, Republicans, independents, and first-time participants in the political process. He dove headlong into a political campaign using an unorthodox course of action never before witnessed in our nation.

Naturally, sparks ensued and the left exploded in a rage; as did the established Republicans. However, the quiet, forgotten Americans answered the call to patriots and erupted into a freedom-frenzy. They rose up, stood in massive lines, and suffered continuous derision and abuse to hear Donald Trump say the words they all craved; but feared they would never hear again. Similarly, countless numbers of those living on the Democrat plantations, and hard-working union members took heed and joined in this movement for the ages. 

Ignoring mounting, withering attacks, this unconventional, innovator voiced conservative ideas and values, and countermanded the extreme Marxist, anti-American views of Barack Obama, Hillary Clinton, and the New Socialist Democrat Party. He spoke of America-first in all dealings with foreign nations, and pounded repeatedly the simple, realistic idea that without secure borders, we will never have security or a country.

Second Amendment supporter, Donald Trump spoke to the hated gun owners, the Christians, the marginalized, and the despised set-asides from Obama’s leftist America. One-by-one he invalidated every policy, ideology, and tyrannical dictate from the destructive Democrats, and the go-along to-get along, mainstream Republicans.

It was a revolution set squarely against the destructive, Obama Marxist revolution.

Businessman Trump also knew that allowing a racehorse economy to again run freely, we must unhitch Obama’s heavy government wagon of regulations and taxes from businesses and corporations. Private sector jobs flourish only when market freedom exists. 

From the coal mines and the hills of West Virginia, Kentucky, and Pennsylvania, they came. From small towns and rural countryside of Americana, from the Great Plains, rustbelt states, and the Gulf Coast, long-suffering voters sprang to life when long-dormant Johnny Freedom (the American spirit) https://www.youtube.com/watch?v=DbyF0Rxw1U0  awakened to end the long siege by Barack Obama and his tyrannical bureaucrats.

Johnny Freedom rose to lead these new patriots toward the inspiring words and welcomed ideas of a man sounding the “cry of freedom from tyranny.” These modern patriots rattled the establishment, perplexed the media, and sent a blood-curdling, paralyzing sense of loss to academia, and the powder-puff liberals. Donald Trump won the election!

The prancing, stomping, and parading mobs rampaging through the streets of the nation and the halls of academia embody the ill educated, misinformed, immature, and lawless rabble that clings like barnacles to the sinking ship of Marxism.  

As seen by the wailing, hysterical lunatics on the left, they would not survive without conservatives to protect them from themselves and ordinary life. Perhaps it’s time for the law of natural selection to decide their fate.

Meanwhile, will Obama, Clinton, and the liberal establishment grieve themselves into a pile of worthless, progressive dreams as their legacy vanishes as quickly as an Obama promise?

        The cycle of abuse is a social cycle theory developed in 1979 by Lenore E. Walker to explain patterns of behavior in an abusive relationship. 1: Tension building-During this period, the abuser feels ignored, threatened, annoyed or wronged. To prevent violence, the victim may try to reduce the tension by becoming compliant and nurturing. We see President Obama and the left do this on a daily basis, lest we forget the 'Apology Tour'

2: Acting-out-During this stage the abuser attempts to dominate his partner, with the use of violence. The release of energy reduces the tension, and the abuser may feel or express that the victim "had it coming" to them. Anyone that has read any public boards after the Garland, TX attacks, read the similar comments 'Well, she shouldn't of provoked them'.

3: Reconciliation/honeymoon- The victim feels pain, fear, humiliation, disrespect, confusion, and may wrongly feel responsible. The abuser will often times ignore the event, or offer false apologies.

4: Calm-During this phase, the relationship is relatively calm and peaceable. This stage the enemy regroups and the false sense of rightness prevents separation or intervention. Next few weeks, it will be calm in America, she has earned her day of calm, after appeasing the Muslims.

           The point of terrorism is to inspire terror to control people. The point of the Garland, Texas Art contest was to tell the terrorists they are not feared and will not control us. They will kill you whether you draw cartoons or not because they believe you should be killed for not being a Muslim. This isn't about cartoons, it's about world domination of Islam.
           Just like an abusive husband will continue to abuse if the wife lets him, Islam will continue to lash out every time they feel offended.  It's time to quit walking around on eggshells like a battered wife, and stand up to the terror that is assaulting America.

As you know our nation is losing twenty-two (22) veterans everyday to suicide. We are losing untold hundreds due to incompetence of the Veterans Affairs healthcare system. Much has been said about this nationally. Congress seemed to act quickly with the Veteran’s choice card issued under the Veterans Access, Choice and Accountability Act. However, it is anything but a choice. Veterans are now finding out they cannot choose a doctor; they have little choice as to when their appointment is to be. Veterans are not being paid for mileage as is required by law. Many of the appointments are many miles beyond the absurd distances they are required to drive already to get care. An increasing number of vets are not getting any care under this new system because there are no doctors “signed up” or “in the system”. Vets are still waiting because the VA still has to first diagnose a “need” then try for month to fill the appointment. Moreover, to add insult to what is great injury, veterans are having to pay for the appointments as the VA is delaying payment to the provider, and the vet is made responsible for the VA’s nonpayment. Veterans are finding out there are far too many hoops to jump through for this new program to be in anyway effective. But then that was the point wasn't it? The Veterans Access, Choice and Accountability Act was a political ploy to make the American people think our leadership cares for America’s veterans. It is clear you do not. The VA is spending millions of healthcare dollars on advertising and website development to convince the American people they care about vets. It is clear you do not. This letter is not to tell you how I want you to vote or act as my elected representative. It is a demand. I am demanding you, this day, draft legislation to give American veterans a healthcare account that they may buy their own health care insurance with. The VA hospital system is out of date, out of touch and out of control. It would take hundreds of years to fix the VA and many thousands of American veterans will die waiting for you to fulfill the commitment we as a nation agreed to. It cost the United States approximately $750-$900 to cover a veteran under the current VA hospital system. Those numbers are most likely much higher. Create legislation that will put this money into an account, much like the VA education funds, and let vets buy their own healthcare. Place no restrictions on it save that they can only spend the funds on health insurance, i.e. HMOs or PPOs. Also allow insurance companies to cover and entire family if they can as a way to be competitive. Many families do not pay as much to cover all of their members as the VA spends to cover just one vet. Let them have the whole $750-$900. The current chain of VA hospitals can bid for these funds like any other healthcare provider. After all if VA healthcare is so much better than civilian health care as they say, then vets will overwhelmingly choose the VA hospital system. Give them real choice; give them real healthcare, now!

More than just the birthday of our nation, the 4th of July commemorates something we as a country have all but forgotten. The 4th of July represents a celebration for it was, is, and always will be the only true philosophical revolution in all history. Distinctly American, ours was a revolution that changed the very concept of government.

On July 4, 1776, the Declaration of Independence was signed by our founding fathers as they denounced our separation and “absolved from all Allegiance to the British crown”. In doing so, the United States of America was created and with it a new concept emerged as a government under the people declared their freedom and independence.

This concept of government was uniquely American as it served as,”only a convenience created and managed by the people,with no powers of its own except those voluntarily granted to it by the people” stated Ronald Reagan.

The government we see today is no longer of mere convenience as Americans, more evident than ever before, relinquish their consent in acceptance of absolute despotism.

The long train of abuses and usurpations by the government have increased under the Obama adminstration to a point in which there “evinces a Design” to reduce us under “absolute despotism”.

The establishment of absolute tyranny appears to be surging into inevitability as the President sets a defiant tone in asserting that he will act “with or without congress“. In his 2014 State of the Union address, Barack Obama promised a “year of action” as he stated his intent to unilaterally act “wherever and whenever” he can without legislation.

Thus the President confirms his transformation into taking actions that are akin to a king.

John Locke wrote of this transformation under his Second Treatise of Government stating, “Whereas usurpation is the exercise of power to which someone else has a right, tyranny is the exercise of power to which nobody can have a right”.

Furthermore, “It is what happens when a governor, however entitled he is to govern, is guided not by the law but by his own wants, and his commands and actions are directed not to preserving his subjects’ properties but to satisfying his own ambition, revenge, covetousness, or any other irregular passion”.

Currently our President has shown nothing but sheer contempt for those who remain against his ideology. He is guided not by laws but by his own wants and commands directed at satisfying his own ambition to fundamentally transform the United States of America.

With Locke’s notion of tyranny in mind, one must only look towards the Declaration of Independence, specifically with an eye towards the founders description of the king, in comparing the similarities of Obama’s increasingly imperial presidency.

The Declaration states that the king, “has dissolved Representative Houses repeatedly, for opposing with manly Firmness his invasions on the Rights of people…He has erected a Multitude of new offices, and sent hither swarms of officers to harass our people…He has refused his Assent to Laws, the most wholesome and necessary for the public good”.

The President has dissolved the “Representative Houses” in acting “with or without congress”, most notably in his multiple unilateral actions of delaying and implementing Obamacare. He has used the Government, particularly the IRS, to harass Tea Party groups, which continues to this day. He has refused acceptance of our laws, most recently in refusing to protect our borders as illegal immigrants swarm into the country without fear of deportation.

Just by reading a newspaper or watching news on television, it is easily my observation that there is no longer our right to have ‘Freedom of the Press’. The ‘Operation American Spring’ (OAS) in D.C. sure proved that. There were people there for weeks and not one news network picked up the story. Joe Esposito, a fellow writer and poet, had his ‘Facebook Timeline’ taken down. His profile was disabled due to ‘Violations of Standards’. What did Joe violate? He posted political poems which he mentioned names of people currently serving under the present government. Was that a violation? Under the First Amendment we are allowed to vocalize and write anything we choose. Have we lost that right?

Situations that I encounter make me think. I wonder how long it will take before more rights as Americans will be taken from us. The government is trying to take control of our lives. They have disarmed many Veterans just because of having PTSD. They want to take away guns from non-violent Americans but that is another story for another day.

I am a Tea Party patriot that wants corporations to stop controlling the United States, to stop meddling in our constitutional rights, and to pay their fair share of taxes. If you truly want America and your constitutional rights back, you will demand that any money contributed to any conservative organization by David and Charles Koch and any of their foundations will be given back.

When corporations pay their fair share of taxes, stop evading taxes, and act responsibly- jobs are created, the deficit of the nation declines, safety regulations are enforced, banks have more money to loan (that is not being loaned to fund government waste and operations, and the economic cycle created benefits not only the wealthy, but every citizen. 

When corporations use political movements like the Tea Party to hide behind, the world laughs at that organization. The Tea Party is being laughed at because they are taking dirty corporate money that is being funneled through political front organizations. 

It is time to get big oil out of our government once and for all- and to EVICT the Koch brothers out of the Tea Party movement and separate ourselves from their records and their tainted money. 

Only then will the Tea Party and conservative organizations  be taken seriously. 

Our Tea Party deserves better than being used as a front organization in an attempt to discard our laws, our constitution, and place a few wealthy individuals in charge of the Tea Party movement.
